PETITION FOR DECLARATORY JUDGMENT
COMES NOW Plaintiff Terry Dolan, by and through his attorneys, and in support
of his Petition for Declaratory Judgment, states as follows:
1. By this action, Plaintiff Terry Dolan seeks a declaration pursuant to
I.R.Civ.P. 1.1101 that he is a civil service employee as defined under Iowa's Civil Service
statutes entitled to the protections afforded under said statutes, that the City of Dubuque,
Iowa, failed to abide by Iowa's Civil Service statutes when seeking to fill an open operator
position at the Water Pollution Control Plant, and ordering the City to appoint Plaintiff
into the operator position at the City's Water Pollution Control Plant.
2. Plaintiff is and, at all material times hereto, was a resident of Dubuque,
Dubuque County, Iowa.

4. Plaintiff worked as an operator in the Water Pollution Control Plant for
twenty (20) years when in April 1998 he was laid off due to City budget cuts. Plaintiff
received an honorable discharge by the Water Pollution Control Plant in April 1998, was
placed on a preferred list of candidates for an open position at the plant, and was told that
he and the other employees laid off would be the first people to come back to work at the
plant when the hiring freeze was lifted.
5. At the time of the lay-off Plaintiff was transferred to the City's Operation
and Maintenance Department, where he has remained ever since and currently works on
a City recycle truck.
6. On December 6, 2006, a vacancy notice was posted in the Water Pollution
Control Plant for a Water Pollution Control Plant Operator. This was only the second time
since the 1998 lay-offs that a position opened up at the plant. The first time an employee
with more seniority at the plant than Plaintiff received the open position. A true and
correct copy of the position Vacancy Notice is attached hereto as Exhibit "A".
7. Under Civil Service, the operator position at the Water Pollution Control
Plant is a higher grade than Plaintiff's position in the Operation and Maintenance
Department and as such would be a promotion.
8. On December 7, 2006, Plaintiff requested that his name be put on the
candidate list for the open Water Pollution Control Plant Operator position.

9. Previously, an original entrance examination was given on June 7, 2005 and
on July 7, 2005, a certified list of candidates was posted by the Dubuque Civil Service
Commission. Plaintiff's name was included on this list. The list is "good for two (2)
years from" July 7, 2005. A true and correct copy of the certified list is attached hereto
as Exhibit "B."
10. On April 13, 2007, Plaintiff interviewed for the operator position with
Jonathon Brown, the Water Pollution Control Plant Manager, Bill Junk and Wayne
Poulsen. At Plaintiff's interview, Mr. Brown told Plaintiff he had the job and all three
shook Plaintiff s hand welcoming Plaintiff back to the plant.
11. On May 10, 2007, Jonathon Brown wrote a memo to Randy Peck, the City's
Personnel Manager, recommending and requesting that Plaintiff be offered the operator
position at the Water Pollution Control Plant. A true and correct copy of Jonathon
Brown's memo is attached hereto as Exhibit "C".
12. At some point, for unknown reasons, Jonathan Brown withdrew his
recommendation and request for Plaintiff's appointment to the operator position.
13. Plaintiff has not been allowed to start the operator position, and the position
remains open.
14. The certified list of candidates referred to in Paragraph 9 above expired on
July 7, 2007.

SUBJECT: Open Operator Position
DISCUSSION:
It is the recommendation of Bill Junkg Assistant WPCP Manager and Wayne Polsean
WPCP Maintenance Supervisor that Terry Dolan, currently employed in the Operation
and Maintenance Department, be offered the position of Operator at the WPCP. This
position is open following a termination of an operator at the WPCP. I have discussed
with Terry the need to be able to obtain the required operator license and he has
assured me that he will do whatever is required to obtain and maintain the proper
certification. Terry is familiar with the operations of the WPCP and has been a good
worker for the plant in the past.
ACTION REQUESTED:
Based on my interview with Terry and his recommendation by key staff of the WPCP I
am requesting that Terry Dolan be offered the open operator position at the WPCP and
following your review, if acceptable, that this recommendation be forwarded to the City
Manager for his review.

operation of a wastewater treatment facility and a variety of skilled and semi-skilled tasks in the repair
and maintenance of various types of equipment and facilities; ability to handle a variety of tasks
without close supervision; ability to work outside in inclement weather, physical ability to handle
medium to heavy work with some heavy lifting; ability to understand and follow written and oral
instructions; ability to establish and maintain effective working relationships with employees and the
general public; skill in the building or mechanical trades; skill in the use and care of tools and
equipment necessary to perform a variety of tasks; demonstrated ability to follow a management style
that is input-oriented and values problem solving and the development of partnerships; demonstrated
ability to work effectively as a member of a team; desire to be part of an organization that values
service, people, integrity, responsibility, innovation and teamwork.
ACCEPTABLE EXPERIENCE AND TRAINING: Some experience in the operation of a wastewater
treatment facility and in the repair and maintenance of equipment, grounds and buildings,
including experience as a building or mechanical trades apprentice; possession of a high school
diploma or its equivalent; or any equivalent combination of experience and training that provides the
essential knowledge, skills and abilities.
ADDITIONAL REQUIREMENTS: Possession of or ability to obtain and maintain a valid Iowa driver's
license within 30-days after appointment. Possession of or ability to obtain and maintain a State of
Iowa Department of Natural Resources Grade II Wastewater Treatment License within Twenty-four
months after appointment.

this position on September 6, 2007 at 6:30 p.m. in the Five Flags Civic Center in Dubuque, Iowa. The
Civic Center is located at the corner of Fourth and Locust Streets in Dubuque. Please bring a photo

Office by 5:00 p.m. on August 24, 2007. Applications may be obtained at the City Personnel Office,

The Clty of Dubuque, Iowa Invites applications for
the positron of Water Pollution Control Plant Opera-
tor. The successful candidate will be responsible for
the physical, biological and chemical treatment of
wastewater, operating and maintaining various mech-
anisms and pump equipment and operating the
solids dewaterrng equipment and sludge Incineration
reactor. The successful candidate will possess some
experience in the operation of a wastewater treat-
ment facility and in the repair and maintenance of
equipment, grounds and buildings, Including experi-
ence as a building or mechanical trades apprentice;

15. On August 9, 2007, a vacancy notice for the position was posted again and
again Plaintiff requested that his name be put on the candidate list for the position. A true
and correct copy of the vacancy notice is attached hereto as Exhibit "D".
17. On August 12, 2007, however, the City published a want ad in the Telegraph
Herald giving notice to the general public that an entrance examination for this position
would be held on September 6, 2007. A true and correct copy of the want ad is attached
hereto as Exhibit "E".
18. An original entrance examination was given on September 6, 2007 and on
October 1 1, 2007, a certified list of candidates was posted by the Dubuque Civil Service
Commission. Plaintiff s name was not included on this list. A true and correct copy of
the certified list is attached hereto as Exhibit "F."
19. Iowa Code § 400.7 "Preference by service," specifically states:
An employee regularly serving in or holding a position when
the position becomes subject to this chapter ...shall retain
the position and have full civil service rights in the position
under any of the following conditions:
1. The employee meets the minimum qualifications
established for the position and has completed the required
probationary period for the position.
20. Iowa Code § 400.9(1) and (3) specifically states:
1. The Commission shall, at such times as shall be found
necessary, under such rules as shall be prescribed and

published in advance by the commission, and posted in the
city hall, hold competitive promotional examinations for the
purpose of determining the qualifications of applicants for
promotion to a higher grade under civil service, which
examinations shall be practical in character, and shall relate
to such matters as will fairly test the ability of the applicant
to discharge the duties of the position to which the applicant
seeks promotion.
3. Vacancies in civil service promotional grades shall be
filled by lateral transfer, voluntary demotion, or promotion of
employees of the city to the extent that the city employees
qualify for the positions. When laterally transferred,
voluntarily demoted, or promoted, an employee shall hold full
civil service rights in the position. If an employee of the city
does not pass the promotional examination and otherwise
qualify for a vacated position, or if an employee of the city
does not apply for a vacated position, an entrance
examination may be used to fill the vacancy.
21. Plaintiff is a civil service employee as defined under Iowa's Civil Service
statutes entitled to the protections afforded under said statutes, and is qualified for the
Water Pollution Control Plant operator position.
22. The City violated Iowa's civil service statutes by holding an entrance
examination both in 2006 and in 2007 for the open Water Pollution Control Plant operator
position, by failing to include Plaintiff on the October 11, 2007 certified list of candidates
for the Water Pollution Control Plant Operator, and by not appointing Plaintiff to the open
operator position.

23. The City should be ordered to transfer and appoint Plaintiff to the Water
Pollution Control Plant operator position immediately.
WHEREFORE, Plaintiff Terry Dolan respectfully requests that the Court, pursuant
to I.R.Civ.P. 1.1101, enter a declaratory judgment that Plaintiff is a civil service employee,
as defined under Iowa's Civil Service statutes, entitled to the protections afforded under
said statutes, that the City of Dubuque, Iowa, failed to abide by Iowa's Civil Service
statutes when seeking to fill an open operator position at the Water Pollution Control
Plant, order the City to transfer and appoint Plaintiff into the operator position at the City's
Water Pollution Control Plant, and for such other and further relief as the Court may deem
just and proper under the circumstances.

DISCUSSION:
It is the recommendation of Bill Junkg Assistant WPCP Manager and Wayne Polsean
WPCP Maintenance Supervisor that Terry Dolan, currently employed in the Operation
and Maintenance Department, be offered the position of Operator at the WPCP. This
position is open following a termination of an operator at the WPCP. I have discussed
with Terry the need to be able to obtain the required operator license and he has
assured me that he will do whatever is required to obtain and maintain the proper
certification. Terry is familiar with the operations of the WPCP and has been a good
worker for the plant in the past.
ACTION REQUESTED:
Based on my interview with Terry and his recommendation by key staff of the WPCP I
am requesting that Terry Dolan be offered the open operator position at the WPCP and
following your review, if acceptable, that this recommendation be forwarded to the City
I~^a Hager for his review.

DEPARTMENT: Water Pollution Control HOURLY SALARY RANGE: $18.50 to $20.83
GENERAL STATEMENT OF DUTIES; Performs responsible technical work in the operation
and maintenance of the City of Dubuque s Water Pollution Control facility; performs skilled and semi-
skilled tasks in the maintenance and repair of buildings, grounds and equipment; performs related
work as required.
DISTINGUISHING FEATURES OF THE CLASS: Work involves responsibility for the physical,
bio{ogical and chemica! treatment of wastewater, operating and maintaining various mechanisms and
pump equipment and operating the solids de-watering equipment and sludge incineration reactor.
Work in this class also involves responsibility for performing a variety of skilled and semi-skilled tasks
in the repair and maintenance of buildings, grounds and equipment. Work is supervised through
inspection, results achieved, and by observing the effectiveness of facility operations through the
analysis of shift and laboratory reports. Employees are assigned to a specific work shift. Shift
assignments are subject to change.
EXAMPLES OF WORK (ILLUSTRATIVE ONLY):
ESSENTIAL: Operates computers and associated hardware, pumps, control panels, chemical feed
equipment, solids de-watering equipment, fluidized bed sludge incinerator and miscellaneous
associated equipment; performs and evaluates laboratory tests related to sludge de-watering
equipment and adjusts equipment accordingly; maintains all wastewater treatment equipment and
components on a regularly scheduled basis; makes periodic inspections of the treatment facilities;
maintains a log of facility operations; performs equipment, building and grounds maintenance and__
custodial duties; uses a variety of hand and power tools.
KNOWLEDGE, SKILLS AND ABILITIES: Knowledge of the use of computers, algebra and physical,
chemical and microbiological principles; knowledge of the occupational hazards associated with high
voltage equipment and how to take necessary precautions; knowledge of the methods, practices,
tools and materials used in a variety of building, equipment and grounds maintenance; ability to

make independent evaluations and adjustments of systems operating conditions within a general set
of guidelines; ability to inspect and troubleshoot mechanical equipment and operations; ability to
monitor and adjust treatment processes; ability to read meters, gauges and computer generated
graphics and to maintain records of shift operations; ability to safely perform technical tasks in the
operation of a wastewater treatment facility and a variety of skilled and semi-skilled tasks in the repair
and maintenance of various types of equipment and facilities; ability to handle a variety of tasks
without close supervision; ability to work .outside in inclement weather; physical ability to handle
medium to heavy work with some heavy lifting; ability to understand and follow written and oral
instructions; ability to establish and maintain effective working relationships with employees and the
general public; skill in the building or mechanical trades; skill in the use and care of tools and
equipment necessary to perform a variety of tasks; demonstrated ability to follow a management style
that is input-oriented and values problem solving and the development of partnerships; demonstrated
ability to work effectively as a member of a team; desire to be part of an organization that values
service, people, integrity, responsibility, innovation and teamwork.
ACCEPTABLE EXPERIENCE AND TRAINING: Some experience in the operation of a wastewater
treatment facility and in the repair and maintenance of equipment, grounds and buildings,
including experience as a building or mechanical trades apprentice; possession of a high school
diploma or its equivalent; or any equivalent combination of experience and training that provides the
essential knowledge, skills and abilities.
ADDITIONAL REQUIREMENTS: Possession of or ability to obtain and maintain a valid Iowa driver's
license within 30-days after appointment. Possession of or ability to obtain and maintain a State of
Iowa Department of Natural Resources Grade It Wastewater Treatment License within twenty-four
months after appointment.
