Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the location of the existing lot line
and desire to build a porch addition on the back of his house at 528 W. 16th Street.
Staff reviewed the staff report, noting the existing lot layout, ownership, and existing
structure encroachments. Staff indicated that the submitted Final Plat addresses the
encroachments, but requires that the lot frontage for Lot 3 be waived, and lot area for
both Lots 1 and 3 be waived.
There were no public comments.
The Zoning Advisory Commission discussed the request and felt it was appropriate.
Recommendation
By a vote of 6 to 0, with one abstention, the Zoning Advisory Commission recommends
that the City Council approve the request subject to waiving the lot frontage requirement
for Lot 3 and lot area for Lots 1 and 3.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Final Plat of Schlosser Place
INTRODUCTION
The submitted Final Plat of Schlosser Place re-plats four existing parcels into three new
lots. The submitted final plat is being reviewed by the Zoning Advisory Commission and
City Council as it's considered to be a minor final plat as it constitutes three or more
lots.
DISCUSSION
The submitted Final Plat of Schlosser Place re-plats four existing lots to address
encroachments by existing structures on property owned by two members of the same
family and to facilitate the construction of a rear porch on the house at 528 W. 16th
Street.
Lot 1 is expanded to the south to place an existing building, retaining wall and steps on
the same parcel as the single-family house facing West 16th Street. Lot 2 is the
consolidation of Lot 4 and Lot 8 of Morgan's Subdivision.
Lot 3 is an existing lot that does not have frontage on a public street. The replatting of
Lot 3 reduces its size and still does not provide frontage on a public street, but does
address an existing shed structure encroachment.
The submitted Final Plat requires the waiver of lot frontage for Lot 3 and the lot area for
Lot 1 and Lot 3. The waiver of lot frontage and lot area does not materially change the
developability of these two lots, but rather, specifically addresses encroachments by
existing structures. Attached to this memorandum is an aerial map that depicts
ownership of the property included within the Final Plat of Schlosser Place.
Planning staff has no objection to the submitted Final Plat. While it does not completely
resolve the long standing legally non-conformity of no lot frontage for Lot 3, it does
eliminate existing encroachments and will facilitate future sale of the properties to a new
property owner.

Planning staff recommends that the Final Plat of Schlosser Place be approved subject
to waiving the lot frontage requirement for Lot 3, and lot area requirement for Lots 1 and
3 of Schlosser Place.

RESOLUTION APPROVING THE FINAL PLAT OF SCHLOSSER PLACE IN THE CITY OF
DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Schlosser Place in the city of
Dubuque, Iowa ; and
Whereas, said Final Plat provides 0 feet of frontage for Lot 3 on a public or approved private street,
where 50 feet of street frontage is required, and provides 3,985 square feet and 3,023 square feet of lot
area for Lots 1 & 2 respectively, where 5,000 square feet is required by Section 11-14 of Title 16 of the
City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and had its
approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it conforms to the
statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is waived to allow 0 feet of frontage on a public street or an approved private street
for Lot 3 and 3,985 square feet and 3,023 square feet of lot area for Lots 1 & 2 respectively.
Section 2. That the Final Plat is hereby approved and the Mayor and City Clerk are hereby
authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said Final Plat.

RESOLUTION APPROVING THE FINAL PLAT OF SCHLOSSER PLACE IN THE CITY OF
DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Schlosser Place in the city of
Dubuque, Iowa ; and
Whereas, said Final Plat provides 0 feet of frontage for Lot 3 on a public or approved private street,
where 50 feet of street frontage is required, and provides 3,985 square feet and 3,023 square feet of lot
area for Lots 1 & 2 respectively, where 5,000 square feet is required by Section 11-14 of Title 16 of the
City of Dubuque Code of Ordinances, Unified Development Code; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and had its
approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it conforms to the
statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances, Unified
Development Code, is waived to allow 0 feet of frontage on a public street or an approved private street .
for Lot 3 and 3,985 square feet and 3,023 square feet of lot area for Lots 1 & 2 respectively.
Section 2. That the Final Plat is hereby approved and the Mayor and City Clerk are hereby
