Kennedy Road DATE: August 10, 2015 INTRODUCTION The purpose of this memorandum is to seek acceptance of sanitary sewer, sidewalk, and storm sewer easements from Halle Properties LLC for existing utilities across Lot 2 of Lot 2 of Lot 2 of the W'/z of the NW % of Section 27; and Lot 2 of Lot 1 of Lot 2 of the NE '/ of the NE '/ of Section 28, all in Township 89 North, Range 2 East of the 5th P.M., in the City of Dubuque. DISCUSSION The property owners are planning to construct a retail tire business (Discount Tires) at their site on John F. Kennedy Road (JFK). This property was formerly the Long John Silver's restaurant site. The owners, Halle Properties LLC, and the City of Dubuque wish to set forth terms for the construction, maintenance, and replacement of the proposed site improvements, including parking lot pavement and retaining walls, over the existing storm sewer, sidewalk, and sanitary sewer on the property. The terms in the Grant of Easement would prevent the property owner from building additional structures over the easement without the City's consent. Should the City have to remove any pavement, retaining walls or other private improvements during the repair or replacement of the public utilities, the terms of the easement require the property owner to be responsible for all retaining wall replacement costs. The documents also grant a needed public sidewalk easement for pedestrian travel along JFK Rd. The City of Dubuque will continue to own and maintain the sanitary and storm sewer utilities. The property owner will continue to own and maintain the public sidewalk along the lot's JFK Rd. frontage. RECOMMENDATION I recommend accepting the Grant of Sanitary Sewer and Sidewalk Easement and Grant of Storm Sewer Easement through, over and across Lot 2 of Lot 2 of Lot 2 of the W %2 of the NW '/4 of Section 27; and Lot 2 of Lot 1 of Lot 2 of the NE '/4 of the NE '/ of Section 28, all in Township 89 North, Range 2 East of the 5th P.M., in the City of Dubuque, as described in Exhibit A on the attached Grants of Easement.
