Vice chairperson Tom Swift called the meeting to order at 4:30 p.m. following staff assurance of
compliance with Iowa Open Meeting Law.

Review and Certification of Minutes of 20 March 2007 Housing Code Appeals Board

Consent Agenda
The consent agenda items are considered to be routine and non-controversial and all consent
items will be normally voted upon in a single motion without any separate discussion on a
particular item.
The following extensions were approved:
Uriah Miller, 1428 Iowa Street -extension to 8/15/07.
New Dawn, Inc./Peter Lippstock, 2162/2164 Washington -extension to 7/15/07.
RJK Investments, LLC, 568/570 W. Locust -extension to 7/30/07.
Mercy Housing/Lawlor Garvey, 1337 Main Street -extension to 8/18/07.
Judge Properties, 3203 Jackson Street #2 -extension to 8/11/07.
Bill Kinsella motioned to approve the consent agenda. Jim Matheos seconded. Motion passed
3-0.
ALL DEFICIENCIES AND MOTIONS ARE IN ACCORDANCE WITH THE DUBUQUE
RESIDENTIAL HOUSING CODE UNLESS OTHERWISE STATED. EXTENSIONS OF TIME
ARE GRANTED IN ACCORDANCE WITH SECTION 26-9.(f)(1) AND VARIANCES ARE
GRANTED IN ACCORDANCE WITH SECTION 26-9.(f)(2).
New Business
It was requested that Case #1 be tabled until the end of the meeting as Inspector Tim Moler was
currently at the property for a visual inspection.
CASE #2
Bon Vivant, LC, owner of 505 Almond Street requested a variance on a habitable room that is
6'8" wide and 14'6" long. This room meets the minimum square foot requirement of at least 70
square feet.
This is a S8 Initial inspection.
BILL KINSELLA MOTIONED TO APPROVE THE VARIANCE DUE TO PRACTICAL
DIFFICULTIES OR UNNECESSARY HARDSHIPS IN CARRYING OUT THE STRICT LETTER
OF THE ORDER. JIM MATHEOS SECONDED. MOTION PASSED 3-0.
CASE #3
Carol Loney, owner of 1553 Fairfax, requested a variance on light and ventilation. The rear
bedroom has available 6.41 square feet of natural light. The requirement is 8.44 square feet,
making the bedroom 2.03 square feet deficient. The living room is deficient 11.88 square feet of
natural light and 2.42 square feet of natural ventilation.
Tom Smith clarified that only the living room variance was being requested. A continuance had
been granted by David Harris for the bedroom.
This is a S8 Initial inspection.

CASE #4
Rosanne Samuels-Barry, owner of 122 Stoltz Street, requested a variance on ceiling height
standard of 7 feet and required sloped ceiling width of 4'. The actual ceiling height is 6'6" and
sloped ceiling width is 3'.
This is a Rehab inspection.
BILL KINSELLA MOTIONED TO APPROVE THE VARIANCE DUE TO PRACTICAL
DIFFICULTIES OR UNNECESSARY HARDSHIPS IN CARRYING OUT THE STRICT LETTER
OF THE ORDER. JIM MATHEOS SECONDED. MOTION PASSED 3-0.
CASE #5
Brenda Huseman, owner of 720 Rhomberg Avenue requested an extension of time until
January 1, 2008, to finish the exterior building repairs and garage. HUD rules prohibit over 90
day extensions for Section 8 tenants.
Brenda and Larry Huseman reported that most of the exterior buildings are completed and that
they should be finished within the 90 days limit imposed by HUD.
This is a S8 Initial inspection.
JIM MATHEOS MOTIONED TO GRANT AN EXTENSION TO OCTOBER 1, 2007. BILL
KINSELLA SECONDED. MOTION PASSED 3-0.
CASE #1
Judge Properties, agent for 1003-1005 Bluff Street, requested an extension of time until
September 15, 2007, to complete exterior repairs: soffit, fascia, stucco, peeling paint, rotted
wood, repair stairs and add guardrail.
Inspector Tim Moler reported that there has been no progress since Judge Properties had
initially requested their extension several months ago. It was also reported that this is no longer
a S8 unit and it would be referred back to General Housing.
This is a S8 Initial inspection.
JIM MATHEOS MOTIONED TO GRANT AN EXTENSION TO AUGUST 31, 2007. BILL
KINSELLA SECONDED. MOTION PASSED 3-0.
INFORMATION SHARING
As this was Jim Matheos' first meeting, he asked for clarification on the metal fire escape
discussion from the March 20, 2007, meeting. It was explained that the protocol used would be
if the metal was in deteriorated condition.
ADJOURNMENT
Bill Kinsella motioned to adjourn. Jim Matheos seconded. Motion passed 3-0. The meeting
was adjourned at 5:05 p.m.
