ZONING ADVISORY COMMISSION
REGULAR SESSION
January 2, 2008

PRESENT: Chairperson Eugene Bird Jr.; Commissioners Steven Hardie, Martha Christ,
Charles Mlller and Jeff Stiles; Staff Members Kyle Kritz and Guy Hemenway.
ABSENT: Commissioners Dick Schiltz and Ron Smith.
CALL TO ORDER: The meeting was called to order at 6:30 p.m.
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying that
the meeting was being held in compliance with the Iowa Open Meetings Law.
MINUTES: The minutes of the December 5, 2007 meeting were approved unanimously as
submitted.
ACTION ITEMIFINAL PLATICREEK WOOD DRIVE: Application of North Cascade
Developers LLC/Marty McNamer for approval of the Final Plat of Timber-Hyrst Estates #2
located along Creek Wood Drive.
Marty McNamer, 1739 Creek Wood Drive, offered to answer questions for the
Commission.
Staff Member Kritz reviewed the staff report. He said that the Commission previously had
seen the Preliminary Plat for Timber-Hyrst Estates. He said that the Commission had
requested to review the final plat and to require dedicated park area. He discussed the
subdivision layout, lot size and street access. He said that Lot C has no frontage and is
accessed through an easement. He discussed an aerial photo of the site noting the
wooded floodplain area. He said that, although no parkland had been delineated on the
plat, the Commission has the opportunity to approve the plat and require that parkland be
dedicated in the future. He discussed the extension of Creek Wood Drive, right-of--way
width, and phasing of the development.
Commissioner Stiles asked about a secondary access to North Cascade Road. Staff
Member Kritz said there are several options regarding secondary access.

Commissioner Hardie asked if the City has standards for parkland area predicated on the
size or density of development. Staff Member Kritz said that currently there are no City
standards regarding required park area.
Motion by Hardie, seconded by Christ, to approve the Final Plat of Timber-Hyrst Estates
#2, subject to waiving the City's minimum cul-de-sac length standard and the lot frontage
for Lot C, with the requirement that parkland be dedicated in a future phase of the
development. Motion carried by the following vote: Aye -Hardie, Christ, Stiles, Miller and
Bird; Nay -None.
ACTION ITEMIFINAL PLATISTAR BREWERY DRIVE: Application of the City of Dubuque
for approval of the Final Plat Riverwalk Eighth Addition located along Star Brewery Drive.
Staff Member Kritz reviewed the proposed street rights-of-way, lot configurations, and
substandard parcel. He said that Lot C is substandard as it does not have the required lot
frontage or area, but that it will be replatted and consolidated at a future date. He said that
the Final Plat of Riverwalk Eighth Addition is in all other respects in substantial compliance
with the Subdivision Regulations.
The Commission discussed the request and felt it was appropriate.
Motion by Stiles, seconded by Christ, to approve the Final Plat Riverwalk Eighth Addition
subject to waiving lot frontage and area requirements for Lot C. Motion carried by the
following vote: Aye -Hardie, Christ, Miller, Stiles and Bird; Nay -None.
PUBLIC HEARINGIREZONINGINORTHEAST CORNER OF THE NORTHWEST
ARTERIAL AND ARBOREUM DRIVE: Application of Mike Felderman to rezone property
located at the Northeast Corner of the Northwest Arterial and Arboreum Drivefrom AG
Agricultural District to R-1 Single-Family Residential District.
Mike Felderman, 2380 Samantha Drive, reviewed his request with the Commission.
Staff Member Hemenway reviewed the staff report. He noted surrounding zoning and land
use, the size and topography of the parcel and the adjacent street system. He noted that
access would be taken from Arboretum Drive and that any access from the Northwest
Arterial would have to be approved by the City Council.
Commissioner Stiles asked about the number of access points. Staff Member Hemenway
said that the property is to be subdivided into three lots, all which will have access onto the
paved portion of Arboretum Drive.
The Commission discussed the rezoning request and felt it was appropriate.

Motion by Christ, seconded by Stiles, to approve the rezoning request as submitted.
Motion carried by the following vote: Aye -Hardie, Christ, Miller, Stiles and Bird; Nay -
None.
PUBLIC HEARINGIREZONINGISOUTH OF OLD HIGHWAY ROAD AND WEST OF
RAILROAD LINE: Application of Toby Kress, Kress Industrial Facility (tabled from
December 5, 2007) to rezone property located South of Old Highway Road and west of
railroad line from County R-1 Residential District to City LI Light Industrial District, in
conjunction with annexation.
Staff Member Kritz stated that Mr. Kress has asked to table his request until the February
6, 2008 Zoning Advisory Commission meeting.
Motion by Stiles, seconded by Christ, to table the request to the February 6, 2008 meeting.
Motion carried by the following vote: Aye -Hardie, Christ, Miller, Stiles and Bird; Nay -
None.
ITEMS FROM STAFF:
Staff Member Kritz informed Commissioners that the Bluffland Advisory Committee has
requested a joint meeting with the Zoning Advisory Commission. Commissioners
discussed the request and felt it was a good idea and asked staff to arrange a time and
place for the meeting.
ADJOURNMENT: The meeting adjourned at 7:00 p.m.
