Claim by Lois PearceTHE CITY OF DUB E Masterpiece on the Mississippi MEMORANDUM BARRY LINDAHL I~ CITY ATTORNEY To: Mayor Roy D. Buol and Members of the City Council DATE: RE: Claimant Lois Pearce January 7, 2008 Claim Against the City of Dubuque by Lois Pearce Date of Claim 12/26/07 Date of Loss 12/04/07 Nature of Claim Vehicle Damage This is a claim in which the claimant alleges that her vehicle mirror was damaged when she hit the mirror of a parked car on Hill Street due to actions she took to avoid a snow plow driving over the centerline. According to the report of John Klostermann, Street & Sewer Maintenance Supervisor, there is no way to track the location of the City's snow plow trucks at any given time. Ms. Pearce identifies in her claim, the snow plow which crossed the centerline as a City snowplow with a "V" blade. Mr. Klostermann states that no other information was provided in the claim, such as the size of the truck or truck number. Based on the information provided by Ms. Pearce, it is Mr. Klostermann's recommendation to deny this claim, as the City does not have any trucks equipped with "V" plows as stated is Ms. Pearce's claim. The City Attorney's Office concurs with this recommendation. BAL:tIs cc: Michael C.
