Claim by Chris BlakemanTHE CITY OF C DUB E MEMORANDUM Masterpiece on the Mississippi BARRY LINDA~t~ CITY ATTORNEY To: DATE: RE: Claimant Mayor`Roy D. Buol and Members of the City Council January 21, 2008 Claim Against the City of Dubuque by Chris Blakeman Date of Claim Chris Blakeman 01 /10/08 Date of Loss 12/ 17/07 Nature of Claim Vehicle Damage This is a claim in which the claimant alleges that a City of Dubuque snow plow truck struck the driver's side mirror of claimant's parked vehicle. According to the report of John Klostermann, Street & Sewer Maintenance Supervisor, Mr. Klostermann received a phone call from Chris Blakeman on December 17, 2007, in which Mr. Blakeman stated that he witnessed a Public Works truck strike the mirror of his parked vehicle. Mr. Klostermann met with Mr. Blakeman and investigated the incident shortly after it was reported. Mr. Klostermann states that he has no way to track the specific location of a Public Works truck at a specific time. However, Mr. Klostermann did verify that there was a Public Works truck in the general location at the time of the above-described incident. Based on the information provided by Mr. Blakeman, Mr. Klostermann states that it is possible that a Public Works truck may have damaged the mirror of Mr. Blakeman's vehicle without the Public Works truck driver knowing it. It is therefore the recommendation of Mr. Klostermann to approve this claim for the amount of the submitted invoice of $168.28. The City Attorney's Office concurs with this recommendation. Mr. Blakeman claims that his vehicle was damaged when a Public Works truck hit his mirror while he was parked on Central Avenue. On December 17th I received a call from Mr. Blakeman and he said that he witnessed a Public Works truck strike the mirror of his parked truck. I met with Mr. Blakeman and investigated the incident shortly after it was reported to me. Although I have no way to track the location and time of our trucks, I did verily that I had a truck in that general location around the time of the incident. Based on the information provided by Mr. Blakeman I believe it is possible that a Public Works Department truck may have damaged the mirror of Mr. Blakeman's vehicle without the driver knowing it. It is therefore my recommendation to pay the claim ($168.28) as filed. Sincerely, J hn Klostermann S eet/ Sewer Maintenance Supervisor
