Buol and Members of the City Council DATE: January 29, 2008 RE: Claim Against the City of Dubuque by Heath Koester Claimant Date of Claim Date of Loss Nature of Claim Heath Koester 01/09/08 12/06/07 Vehicle Damage This is a claim in which the claimant alleges that a City refuse truck struck his vehicle as claimant's vehicle was parked in the alley between Ida and Auburn Streets. According to the report of Paul Schultz, Solid Waste Management Supervisor, Mr. Koester's truck was parked in the alley between Ida and Auburn Streets, blocking normal passage through the alley. While attempting to pass the Koester truck, the City truck went up on a curb but slipped off scratching Mr. Koester's truck. It is therefore the recommendation of Paul Schultz to approve this claim for the amount of the submitted invoice of $472.23. The City Attorney's Office concurs with this recommendation. Schultz, Solid Waste Management Supervisor ,, SUBJECT: Claim of Heath Koester DATE: January 28, 2008 The claim and estimate is recommended to be approved as filed for $472.23. Heath Koester submitted a claim alleging that on December 6„ 2007 at approximately 7 A.M., City refuse truck #3409 scratched the side of his truck which was parked in asnow-covered, tight alley between Ida Street and Aubum Street. Mr. Koester's truck was blocking normal passage through the alley. In attempting to pass the Koester truck, the city truck went up on a curb but slipped off scratching Mr. Koester's truck. The Sanitation Driver, operating the truck and at least partially responsible for the damage, reported the accident immediately to Lead Sanitation Driver Dave Sitzmann. Dave Sitzmann investigated the accident, took photos and left information on the claimant's vehicle on how to file a claim. The estimated cost of repair to Mr. Koester's truck was less than $1,000.00.
