The request is to rezone the property from R-2 Two-Family Residential district to C-2 Neighborhood Commercial Shopping Center district. The Zoning Advisory Commission recommended approval of the request to rezone the property at their October 7, 2015 meeting. til The area of the property owned by the person opposed to the request equals 22.2% of the private p property within 200 feet of the subject lots. Therefore, it will require a super-majority of the City Council to approve the rezoning request. Consider this my"official"objection based on the reasons stated during the public hearing: 1. The roundabout at Grandview and Delhi will impact traffic flow;how much we just do not know. Considering 4 new roundabouts in the area, I am concerned about the overall impact on the movement of cars through midtown,Specifically the roundabout to be constructed in early 2016 at the intersection of Grandview Avenue and Delhi Street will directly impact vehicular and pedestrian traffic on Grandview Avenue between University Avenue and Washington Middle School. 2. Concern for safety is of paramount importance. Daily,from 50 to 200 children attending Washington Middle School will walk from the school to the corner of University Avenue and Grandview Avenue through the new roundabout to the bus stop or to walk home.Additionally,the"4 Way"stop sign is to be replaced by a new traffic signal at University Avenue and Grandview Avenue.Traffic speeds will increase as,motorists"gun"their engines to"beat the yellow light."At a minimum,any request for re-zoning must be tabled until all road construction is complete and the City of Dubuque can confidently assure the parents of these students that their children's safety has not been compromised. 3. Parking creep has already become a major problem for neighbors on Nowata,Auburn,Grace, Bennett, Delhi, College,Atlantic, Douglas, Parkway,Custer,West Third and West Fifth streets. Considering the$50 million expansion of Finley Hospital and the existing 1,310 employees at Finley(950), Dubuque Internal Medicine(300), Hartig/MedOne(50),and Klauer(10)alone, I believe we have saturated a neighborhood which adjoins the University of Dubuque and their miscellaneous parking issues which have been the subject of much discussion.Applying additional parking pressure to the neighborhood is uncalled for and avoidable. 4. The residents adjoining and around the subject property are entitled to"quiet enjoyment"of their residential property. Re-zoning these properties to C-2 treads on the rights of homeowners and residents. I believe the objectors represent more than 20%of the adjacent land within 200 feet of the proposed rezoning which would require a super majority for passage. Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed layout for the subject parcels. He noted he will provide the required number of off-street parking spaces, has had discussions with the City Engineering Department regarding access, and plans on doing an attractive building with appropriate lighting and landscaping. Staff reviewed the staff report, noting surrounding zoning and land use, existing traffic levels on adjacent streets, and the list of permitted and conditional uses for the C-2 District. There were several public comments regarding the potential for increasing the volume of traffic in the area, encouraging additional parking in surrounding neighborhoods by employees of the surrounding businesses and institutions. Concerns were also raised about the planned roundabout and the East-West Corridor Moratorium and their impact on traffic flow in the area. The Zoning Advisory Commission discussed the request, reviewing the permitted uses in the C-2 District, and how trip generation is estimated for different types of land uses. Commissioners noted that additional vehicle trips generated by the proposed development would be a small percentage of the existing volume of traffic. Commissioners also discussed that the planned roundabout would address the traffic congestion concerns. Commissioners also discussed that the surrounding property is not generally residential, but a mixture of non-residential uses. The Commission received and filed written input at the meeting. Rezoning Staff Report — 1660, 1670 & 1690 University Ave. Page 2 Adjacent Properties: The subject property, if rezoned to C-2 Neighborhood Shopping Center District, would like have additional impact on surrounding properties by an increase in vehicle trips as well as additional ambient light from new overhead lighting. CIP Investments: None proposed. Staff Analysis: The applicant is requesting to rezone three parcels along University Avenue (1660, 1670 & 1690) from R-2 Two-Family Residential to C-2 Neighborhood Shopping Center District. The property is located at the southwest corner of University Avenue and North Grandview Avenue. The property is comprised of approximately 20,500 square feet of property with frontage on University Avenue and North Grandview Avenues as well as a recently completed green alley to the south. The property has been used for residential purposes since its development prior to the 1930s. Attached to this staff report is the copy of the C-2 Neighborhood Shopping Center District regulations that list the allowed uses for the district. The applicant has indicated his intention is to demolish the existing residential dwellings and build a commercial building housing a Laundromat. The C-2 Neighborhood Shopping Center District includes 21 principle permitted uses as well as 9 conditional uses. If rezoned, the subject property can be used for any of the allowed uses, provided adequate off-street parking can be provided. A copy of the district regulations are attached to this staff report. If the requested rezoning is approved, a site plan prepared by a licensed civil engineer must be reviewed and approved prior to any construction. An approved site plan demonstrates that a new commercial building will comply with City regulations for street access, storm water management, utility connections, parking and landscaping. My wife Joyce and I own 1705 Delhi St asJDK Real Estate LLC. Unfortunately, due to a commitment in Iowa City this evening we will not be able to attend the meeting. I am very concerned with explosive growth in the neighborhood and the effect it has had on parking. Unity Point's growth will be a substantial addition to an already serious situation. The planned round-about and the reconfiguration of the Grandview-University intersection and the Loras- Grandview intersection may also impact the number of on-street parking spots available. It would seem to make sense to investigate this more thoroughly before adding to the problem. Would it not be prudent to table this measure and allow for a more in-depth look at the area as a whole? Initially,we also had concerns about the security and safety of our church property and those who use the building, and the potential for increased traffic flow in the alley behind our church. Representatives of HTLC have reviewed Mr. Tiefenthaler's proposed building plans for a laundromat or dental office, and do not believe they will degrade the security of the area due to the plans for exterior lighting and 24 hour security cameras around the property if it is developed into a laundromat. He also expressed his plans to not have customer access to the business from the alley. We believe that the City of Dubuque's efforts at improving the Grandview-University Ave. intersection, and the five points intersection will be successful in making those intersections more safe and orderly, and better able to handle any future increase in traffic. We further believe that University Avenue is already constructed in a manner to handle a high volume of traffic, and re-zoning this parcel won't significantly increase the traffic flow. Furthermore,the area is really no longer suited for residential properties. Over time this area has been developed to include a larger drug store and medical offices. And, with the Fire Station also on University Avenue, parking remains ata premium within that corner of the vicinity. The uncertainty of the nature of the businesses to be housed in this commercial complex is highly uncomfortable. You had stated that you were interested in acquiring the property to be used for a parking lot for your staff. The property owner adjoining the subject area to the west has recently submitted a letter requesting to vacate the same. A copy of that vacate letter is included for your reference. Per the city's policy, the adjacent land owner would have the first right to purchase/vacate the area. At this time, the City would like to determine its ultimate right of way needs at the intersection before disposing of any portion of this property. The City plans to hire a consulting firm to prepare a conceptual plan showing options for intersection improvements which will determine future right of way needs.
