Council met at 7:30 P. M.
Present-Mayor Schreiber, Coun-
cilmen Kean, Schaller, Schueller,
Takos. City Manager Gilbert D.
Chavenelle.
Mayor Schreiber read the call
and stated that this is the regular
monthly meeting of the City Coun•
cil for the purpose of acting upon
such business as may properly
come before the meeting.

Gentlemen:
I am enclosing a letter from
F, H, Kretschmer dated March
21st and a recommendation from
the City Engineer dated March
27th in regard to the cancellation
of a bond covering a blasting per-
mit issued to the Steger Construc-
tion Company.
Since the work has been com-
pleted by the contractor, it is re-
quested that the Council release
the blasting permit bond.

Gentlemen:
For some time your Traffic
Division has observed traffic move-
ment during rush hours along
University and Asbury, and it is
believed that the movement of
traffic would be enhanced by con-
tinuing the no parking zone on the
north side of Asbury from St. Am-
brose to Bunker Hill.
It is therefore recommended
that the city ordinances be so
changed and that the City Solicitor
be, requested to draft the necessary
amendment,

Gentlemen:
It has been brought to the at-
tention of your staff that there
is some traffic difficulty caused
by cars stacking up along Univer•
sity Avenue in preparation for
making a right hand turn on As•
bury Street during rush traffic
hours.
The situation has been surveyed
and the following recommenda-
tions are made;
1. The three way stop sign in-
tersection should be maintained
because of pedestrian traffic. The
installation of the stop signs has
greatly improved the situation,
2. The radius of the northeast
corner should not be increased be-
cause it is sufficiently rounded. It
is believed that any greater radius
will not aid traffic movement.
3. Traffic lanes will be. painted
on University for north. bound traf-
fic as it approaches Asbury. The
right turn lane will be ten foot
wide and the left turn lane will
be 8 feet wide. Although as the
street is now, it is believed that
the lanes are sufficiently wide
enough to handle traffic moving
at a moderate speed.
4. The necessary traffic lanes
on University are dependent on re-
stricting the north side of the
street to no parking from Loras
to Asbury.
We most strongly urge that no
parking be installed in the recom•
mended area and suggest that the
City Solicitor be requested to draft
an amendment to the ordinance

which will provide no parking on
the north side of University from

Gentlemen:
You have referred to your staff
a petition by Mrs, H. J. Burdt and
others requesting that Washington
Street be changed from a two way
to a one way street from 20th to
30th Street with permissable park-
ing on both sides from 20th Street
north.
It has been noted that parking
has been limited on the west side
of the street from 20th to 22nd,
24th and 25th Streets. This limi-
tation is necessary because of the
narrowness of the street. Further,
the residents in these. no parking
areas are serviced and have an
excess to their property by an al•
ley immediately to the west of
Washington Street.
Further, besides the narrowness
of the street requiring the no park-
ing areas, it is noted that Wash•
ington Street is a residential type
passing through a neighborhood.
It is not intended to be a way
for moving a large volume of traf-
fic. Other streets in the area such
as Jackson Street have been desig-
nated as heavy traffic ways.
It is believed that if Washington
Street is made a one way street,
it will become a traffic way in-
stead of a neighborhood street,
and further, the need of such a
traffic way is not necessary at this
time.
Therefore, it is recommended
that the petition be denied.

Gentlemen:
On February 13, 1981, Clarence
Blakeman filed a claim for injuries
as a result of a fall on a public
sidewalk at 1124.1130 Iowa Street
in the City of Dubuque, Iowa
which occurred on February 10,
1961.
I have made an investigation of
this matter and have conferred
with Mr. Blakeman who has made
an offer of settlement in the
amount of $108,00 and it is the
recommendation of the City At-
torney that said offer of settlement
be accepted and that the City
Auditor be directed to draw a war-
rant payable to Clarence, Blakeman
and Caroline Blakeman, his wife,
in the amount of $108.00 and to
deliver the same upon receipt of
a duly executed release.
Original claim is attached here-
Auditor instructed to issue a war-
rant payable to Clarence Blakeman
and Caroline Blakeman, in the
amount of $108. in full settlement
of the claim. Seconded by Council-

Zoning Ordinance o[ the City of
Dubuque by Repealing Section 1 of
Article 4 of the Zoning Ordinance
of the City of Dubuque and En-
acting a Substitute therefore to
Authorize Additional Uses in the
Multiple Residence District.
BE IT ORDAINED by the CITY
COUNCIL of the CITY OF DU-
BUQUE, IOWA:
SECTTON 1. That Section 1 oP
Article 4 of Ordinance No. 3.34,
designated "Zoning Ordinance of
the City of Dubuque" be and the
same is hereby repealed, and a
new Section 1 of Article 9 of Or-
dinance No. 3-34 enacted in lieu
thereof, as follows to wit:

used, and no building shall be
erected or altered to be used in

provided for in this ordinance, ex-

Unit to be installed and placed
in operation at the existing pump-
ing station on the City of Dubuque
Flood Control Levee between 12th
Street and 16th Street. The bids

The bid of $54,630.00 as sub-
mitted by the Layne-Western Com-
pany of Ames, Iowa, contained a
statement on their proposal as fol-
lows: Not Including Sales Tax or
Use Tax. This statement constitutes
a qualification to their proposal
which is not in accordance with
the City of Dubuque General
Specifications or "Notice to Con-
tractors" for this project.
I therefore recommend that the
contract for the Storm Water
Pumping Unit be awarded to the
Conlon Construction Company of
Dubuque, Iowa, who submitted the
second low bid of $55,810.00.
The bids received this morning
constitute the major portion of
installing and placing in operation
the second Storm Water Pump.
There are additional costs of re-
building the sub-station, switches,
wiring, engineering and inspection
that will be necessary to complete
the installation. These additional
costs plus the bids received this
morning will bring the total cost
of this project to about $63,000.00
or 15% less than the original
estimate.

Mr. Frank Flores, a representa•
tive of Layne Western Company,
one of the bidders on the pumping
unit addressed the Council by stat-
ing that the net cost as submitted
by his company would be the price
as given to us,
City Attorney Russo was of the
opinion that the Layne Western
bid was not responsive to the
notice. Mr. Orlin Conlon of the
Conlon Construction Co, addressed
the Council by stating that the
low bid is not according to
specifications.

WHEREAS, sealed proposals
have been submitted by contrac-
tors for the Storm Water Pump-
ing Unit to be installed at the
existing Pumping Station on the
Flood Control Levee between 12th
Street and 16th Street, pursuant
to Resolution No. 75-61 and no-
tice to bidders published in a
newspaper published in said City
on March 16, 1961 and March 23,
1961; and
WHEREAS, said sealed propos•
als were opened and read on April
17, 1961, and it has been deter-
mined that the bid of Conlon Con-
struction Company of Dubuque,
Iowa in the amount of $55,810.00
for the furnishing of all labor and
materials and performing the work
as provided for in the plans and
specifications; now therefore,
BE IT RESOLVED by the City
Council of the City of Dubuque
that the contract far the above
mentioned improvement be award-
ed to Conlon Construction Com-
pony of Dubuque, Iowa and the
Manager be and he is hereby di-
rected to execute a contract on
behalf of the City of Dubuque for

IYIr. Vincent Smith addressed
the Council by saying that the is-
sue was voted down and therefore
let it stay down. Mr. Sol Mathew-
son stated that Dubuquers do not
like the fast time but he would
like to see it put to a vote. Mr.
D. C. Kringle, representative of
the Railway Trainmen, stated that
the wishes of the people should be
respected which was shown when
it was voted down.
Mr. Ed Majerus was in favor of
the fast time. Frank Saunders, as•
sistant secretary at the Chamber
of Commerce, was of the opinion
that the picture has changed since
the referendum and the economic
good derived from fast time would
be to the benefit of every citi-
zen. The Chamber has only pre-
sented the facts and it is up to
the Council to make the decision.
Mr. Saul Greenstein stated that
the City is interested in attracting
new industry therefore capital in-
terests should be considered. At
the present time we are out of
s±ep with the rest of the country
and it is fast becoming a matter
of economic survival. bTr. Art
Mosle, chairman of the Retail
Merchants Bureau, was of the
opinion that more people would
be pleased if the Council decided

favorably on fast time. Mr. R. F.
Sefzik expressed his opinion by
saying that the people should be
allowed to vote on the question
of Daylight Saving Time.
Councilman Schaller moved that
the City Clerk be instructed to
move the City clacks ahead one
hour on June 3, 1961, at 2 A. M.
and turn the city clocks back to
regular standard time on Septem•
ber 3, 1961, at 2 A. M, and invite
the rest of the City to do likewise.

SECTION 1. That Hillcrest Build-
ers, Inc., be and they are hereby
granted the right to constnuct an
3" sanitary sewer with lateral ex
tensions and a 0" water main with
lateral extensions in the fullowing
named streets in the City of Du-
buque, Iowa: Sharon Drive and
Key Corners from the .west prop-
erty line of Lot 15, Block 4, in Key
Knolls Subdivision, to Pennsyl-
vania Avenue in the City of Du-
uuque, Iowa, upon tho fonowing
terms and conditions:
(a) That the grantee agrees to
construct said sewer and water
mains within one year from the
date of adoption of this ordinance
and pay the entire cost thereof,
including the cost rf publication,
inspection and restoration of the
surface of the street.
(b) That said sewer and water
mains shall be constructed fn ac-
cordance with plans approved by

the State Department of Health
and the City Manager and under
the supervision and direction of
the City Manager and City En-
gineer.
(c) That the grantee shall enter
into a contract for the construc-
tion of said sewer and water mains
with a well-qualified contractor,
which contract, among other things,
will contain a clause : equiring the
contractor to obtam all necessary
permits required by the City of
Dubuque or any other govern-
mental agency, a clause obligating
the contractor and leis bondsmen
to keep said setvrr and water
mains in good repair for a period
of not less than four years from
the date of acceptance of the work
and a clause requiring the con-
tractor to furnish a surety bond
with the City of Dubuque gamed
as one of the obligees guaranteeing
the faithful performance of acid
contract.
(d) That upon completion of said
sewer and water mains attd the
acceptance of the Same by the City
Council, said sewer and water
mains shall become public eewer
and water mains under the exclu-
sive charge and control of the City
of Dubuque and its free tree as
such shall not be interfered with
by the grantee or its auoceasora
or assigns.
(e) That Hillcrest Builders, inc.,
as owner of said Key Knolls Sub-
division, secure the performance
of the foregoing terms and con-
ditions by providing security not
leas than ten per cent of the cost
of said sanitary sewer and water
main with such sureties as may
be acceptable to the City Manager,
and said security shall be for a
period of not less :.hen four years
from the date of acceptance cf
said improvements by the City
Council.
SECTION 2. That the altth~rity
granted herein shall terminate on
June 1, 1961, unless the terms and
conditions of rhis ordinance are
accepted in writing by the grantee
prior to that late.
SECTION 3. This Jrdinance shall
be in full force and effect from
and after its final passage, adop-
tion and publication as provided
by law.

BE 1T THEREFORE RESOLVED
that the City Council on its own
motion or upon petition of prop-
erty owners, deems it advisable
and necessary for the public wel•
fare to make the herein mentioned
improvement, and unless property
owners at the time of the final
consideration of this proposed res•
olution have on file with the City
Clerk objections to the amount of
the cost of improvement, they shall
be seemed to have waived all ob-
jections thereto.
Said improvement shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared there-
for by the City Engineer which
have been approved by the City
Council and are now on file with
the City Clerk. That the cost and
expense of making said improve-
ment will be paid from the Street
Construction Fund.
