and stated that this is a regular
monthly meeting of the City Coun-
cil held far the purpose of acting
upon such business as may proper-
ly came before the meeting.

Aerie No. 568, Fraternal Order of
Eagles, expressing their thanks for
granting permission to hold the
Eagles Junior Drum & Bugle Corps
parade on May 13, presented and
read. Councilman Schaller moved

The petition of the Board of
Dock Commissioners requesting
the installation of lights in the
area along the riverfront from
Lincoln Avenue west to Hawthorne
Street and on Hawthorne Street
southeast to the public boat Paunch-
ing ramp was referred to the City
Manager and Electrical Inspector
for investigation and report.
Upon investigation, it is recom-
mended that lights be installed at
the following locations:
1. New light on the pole located
at the beach and the river-
front opposite the Naval Cen-
ter.
2. New light on pole midway be-
tween the beach and the bend
of the river,

On May 23, 1960 ,Mrs. Blanche
L. Donavan, 642 University Ave-
nue, Dubuque, Iowa, filed her
claim in the amount of $300.00
for injuries suffered as a result
of a fall on a public sidewalk
abutting the post office building,
which fall occurred on March 28,
1960.
I have made an investigation of
this matter and have conferred
with Mrs. Donovan, who' has made
an offer of settlement in the a-
mount of $150.00.
I recommend said offer of set-
tlement by Mrs. Blanche L. Dono-
van in the amount of $150.00 be
accepted and that the City Auditor
be directed to draw a warrant in
the amount of $150.00 payable to•
Blanche L. Donovan and Richard
Donovan, her husband, and to de-
liver the same upon receipt of a
duly executed release from Blanche
L. Donovan and Richard Donovan.

tion 5 and by repealing Section 5A
thereof and by enacting a new
Section 5 in lieu thereof and by

NOW THEREFORE BE IT OR-
DAINED BY THE CITY COUNCIL
OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That Section 5 of Or-
dinance No. 61-57 be and the same
is hereby repealed and the follow-
ing enacted in lieu thereof:
"Section 5. That the various
municipally owned Parking Lots
in the Clty of Dubuque shall be
designated numerically as follows:
"Lot No. 1. The lot situated be-
hveen Ninth and Tenth Streets
and Iowa Street and Central Ave•
nue;
Lot No. 2. The lot situated at
the southeast corner of Ninth and
Blnff Streets;
Lot No. 3. The lot situated at
the southwest corner oP Ninth and
Bluff Streets;
' Lot No. 9. The lot situated at
the northwest corner of Ninth and
Bluff Streets;
'Lot No. 5. The lot situated
generally on Lots 7 and 8 of City
Lot 683;
"Lot No. 6. The lot situated at
the northwest corner of Fifth and
Bluff Streets;
Lot No. 7. The lot situated at
the southwest corner of Fourth
and Iowa Streets;
"Lot No. 8. The lot situated on
the middle 1/5 of Out Lat 448 in

Section 2. That Section 5A of
Ordinance No. 61-57 be and the
same is hereby repealed and the
following enacted in lieu thereof:
"Section 5A. Parking meters on
municapally owned parking lots,
when installed and properly op-
erated, shall show legal parking
upon and after the deposit of
United States coins, in accord-
ance with the following schedule:
"1. On Parking Lots Nos. 3 and
4 and on the easterly two thirds
of Parking Lot No. 1 and on the
easterly half of Parking Lot No.
6, ouch meters shall show legal

parking for one hour upon the
deposit of each Yive cent coin, two
hours upon the deposit of each ten
cent coin and five hours upon the
deposit of one twenty-five cent
coin, but not more than a total
of ten hours at any one time;
" 2. On Parking Lots Nos. b and
7, and nn the westerly half of
Parking Lot No. 6, such meters
shall show legal parking for two
hours upon the deposit of each
five cent coin, four hours upon
the deposit of each ten cent coin,
and ten hours upon the deposit of
one twenty-five cent coin, but
not more than a total of ten hours
at any one time;
" 3. On Parking Lot No. 8, such
meters shall show legal parking
for twelve minutes upon the de-
posit of each one cent coin, one
hour upon the deposit of each Pive
cent coin, and two hours upon
the deposit of one ten cent coin,
but not more than a total of two
hours at any one time;
"4. On the westerly third of
Parking Lot No. 1 and on Park-
ing Lot No. 2, such meters shall
show legal parking for one hour
upon the deposit of each five cent
coin up to a total of three hours
time and no other coins shall be
used to actuate and operate these
meters.
"5. On Parking Lot No. 9, such
meters shall show legal parking
for 18 minutes upon the deposit
of each one cent coin, 90 minutes
upon the deposit of each five cent
coin, three hours upon the de-
posit of each ten cent coin, and
7~ hours upon the deposit of each
twenty-five cent coin, but not
more than a total of nine hours
at any one time."

electors of this City and he served
with integrity and distinction in

loved family and the community
in which he lived; and
WHEREAS Frank Van Duelman
on the 24th day of April, 1961,
passed away from this earthly
jurisdiction to assume his eternal

its acceptance, and

said ordinance has filed with the
City Council a certified statement
showing all the amounts paid out
by her in connection with the con-
struction of said sewer, including
engineering and inspection fees
amounting to $5,946.78.

Section 2. That the acceptance
of said sewer by the City of Du-
buque. and the establishment of
said sewer as a public sewer shall

garet Steichen or her contractor, or
his bandsmen from their obliga-
tion, or the obligation of any one
of them, to keep said sewer in
good repair for a period of not
less than two years from the date
of this resolution as provided in
Ordinance No. 2-61,
Section 3. That hereafter any
person or persons desiring to con•
nect with said sewer, shall first
apply to the City Manager for per-
mission to do so and such permis-
sion shall be granted upon condi-
tion that the applicant shall pay to
the City Treasurer for the account
of Mrs. Margaret Steichen, a con-
nection charge of $4.05 per front
foot of land to be served by said
connection. However, nothing in
this resolution shall be construed
to exact any charge for any ex-
tension of said sewer made by the
City of Dubuque or its permittees.

Now Therefore, Be It Resolved
by the City Council of the City of
Dubuque, Iowa:
Section No. i. That hereafter
any person or persons desiring to
connect with said sewer and water
main shall first apply to the City
Manager for permission. to do so
and such permission shall be graat•
ed upon condition that the appli-
cant shall pay to the City Treasur-
er for the account of Mr. Glen
Carris, a connection charge of
$3.20 per foot for the sanitary
sewer and $2.49 per foot far water
main per frontage of land to be
served by said connection. How-
ever, nothing in this resolution
shall be construed to exact any
charge for any extension of said
sewer made by the City of Du-
buque or its permittees.
Section No. 2. That the estab-
lishment of said connection charge
to said sanitary sewer and water
main shall not be construed to re•
lieve Glen Carris, Carris Construc-
tion Company or his contractor, or
his bondsmen from their obliga-
tion, or the obligation of anyone
of them from the provisions as
set forth in the subdivision ordi•
nonce concerning Ciaver Hills Ad-
dition.
Section No. 3. That the City
Clerk be and he is hereby author-
ized and directed to record a cer-
tified copy of this resolution in
the office of the County Recorder

to have waived all objections there-
to.
Said improvement shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared therefor
by the City Engineer which have
been approved by the City Coun-
cil and are now on file with the
City Clerk. That the cost and ex-
pense of making said improvement
will be assessed upon and against
all privately owned property lying
within assessable distance provided
by law and in an amount not to ex-
ceed the amount provided by law,
property will be assessed whether
the same. abuts thereon or is ad-
jacent thereto according to area
and in proportion to the special
benefits conferred thereby, and
any deficiency shall be. paid out of
the sewer funds. Bonds shall be
issued and sold in anticipation of
deferred payments of assessments
when a contract has been per-
formed and accepted and the pro-
ceeds thereof used to pay the con-
tractor. The railway portion of any
street or assessment district shall
be assessed to and paid by the
railway company.

this claim and have conferred with
Mr. Cletus Allen, Street Commis-
sioner and it is the recommenda-
tion of the City Attorney that the
claim in the amount of $83.55 be
paid to Dr. A. C. Pfohl and that
the City Auditor be instructed to
draw a warrant payable to Dr. A. C.
Pfohl in the amount of $83.55 and
to deliver the same upon receipt of
a duly executed release.

On March 27, 1961, Mrs. Sarah
M. Keckevoet of 553 West 3rd St.,
Dubuque, Iowa, filed her claim far
personal injuries allegedly result-
ing from a fall on March 10, 1961
on a public sidewalk abutting 504
Bluff St. in the City of Dubuque,
Iowa, which the claimant alleges
was in defective condition.
I have made an investigation of
this matter and I have consulted
with Mrs. Sarah M, Keckevoet who
has made an offer of settlement in
the amount of $600.00. Mrs. Kecke-
voet has incurred medical expenses
in the sum of $409,25 as a result
of her fall.
The abutting property owners
have agreed to contribute the sum
of $40925 toward said settlement
and therefore I recommend the. ac•
ceptance of the offer of settle-
ment made by Mrs, Sarah M.
Keckevoet.
It is requested that the City Aud-
itor be instructed to draw a war-
rant payable to Mrs. Sarah M.
Keckevoet in the amount of $190.75
and to transmit the same to the.
City Attorney for delivery to Mrs.
Sarah M. Keckevoet upon receipt of
a duly executed release,

In the Fall of 1957, Conlon Con•
struction Co. entered into a con•
tract with the City of Dubuque,
Iowa to construct a pumping sta-
tion at the intersection of Dodge
and Terminal Streets and at the
same time Schueller & Co., Inc. en-
tered into a contract with the City
of Dubuque, Iowa, to perform cer-
tain sewer construction work to be
performed in the city of Dodge and
Terminal Streets in the City of
Dubuque.
On or about February 28, 1958 a
portion of the eighty inch rock
storm sewer collapsed at the con-
struction site at Dodge and Term•
final Streets and. pursuant to agree-
ment between all parties concerned

a separate contract was made for
the repair of same, the actual cost
of which was $10,408.00.
It was the position of the City
of Dubuque, Iowa that the collapse
of said sewer on February 28, 1958
was due to the negligence of each
of the aforementioned contractors
and as a result of which agreement
was entered into by all parties con-
cerned that the amount of $10,408:
00 would be withheld from each
contractor until final determina•
tion of the liability for the collapse
of said sewer.
That pursuant to indemnifying
agreement obtained from both con-
tractors the City bas received an
offer of settlement in the amount
of $9,408.00 in full settlement of
any and all claims by City of Du-
buque, Iowa, resulting from the
collapse of said sewer.
I have made an investigation of
this matter, conferred with the
City Manager, and the City Engi•
Weer, and it is my recommendation
that the offer of settlement in the
amount of $9,408.00 be accepted by
the City and that upon receipt of
same the amount of $10,408.00
withheld from Conlon Construction
Co. and the amount of $10,408.00
withheld from Schueller & Co.,
Inc. on each respective contract be
remitted to the respective contrac-
tors.
