Buol and Members of the City Council February 22, 2008 Claim Against the City of Dubuque by Jill Jellison Date of Claim 11 /27/07 Date of Loss 11 /01 /07 Nature of Claim Vehicle Damage This is a claim in which the claimant alleges damage to her vehicle after it was sprayed by a container of grease which was being compacted by a City of Dubuque refuse truck. According to the report of Paul Schultz, Solid Waste Management Supervisor, the Sanitation Driver at the scene reported that the liquid exploded from an improperly disposed container of what appeared to be vegetable oil, causing the damage to claimant's vehicle. It is therefore the recommendation of Paul Schultz to approve this claim for the amount of the submitted invoices of $232.78. The City Attorney's Office concurs with this recommendation. Schultz, Solid Waste Management Supervisor SUBJECT: Claim of Jill Jellison DATE: February 21, 2008 The claim and estimate is recommended to be approved as filed for $232.78. Jill Jellison submitted a claim on January 22, 2008 and estimate from February 1, 2008. She alleged that on November 1, 2007 at approximately 10 A.M, City refuse truck #3401 discharged an oily, greasy substance which sprayed the whole driver's side of her car. The car was parked at 1320 Forest Lane. The Sanitation Driver, operating the truck spoke to a person in the household and then reported the accident immediately to Lead Sanitation Driver Dave Sitzmann. Our driver reported that the liquid exploded from an improperly disposed container of what appeared to be vegetable oil and caused the damage. This happens (rarely) when the packer blade sweeping the hopper compresses a plastic bottle or jug containing a liquid. This is also one reason why liquids are not allowed to be set out as refuse. Dave Sitzmann investigated the accident, took photos and left our information sheet on how to file a claim with a woman in the residence. The estimated cost of repair to Ms. Jellison's car was less than $1,000.00. It initially appeared to Dave that the car would only need a wash. Given the delay in the claim submission, a further problem may have developed from the liquid substance having leaked down on the in-door power regulator.
