We received a copy of correspondence from City Attorney, Barry Lindahl to City Mayor,
Roy Buol. This was related to concern with communications from neighbors and
citizens to council members regarding use of the Medical Associates Green Space.
Immediately following the initial vote, Laura Carstens explained to Medical Associates
and our neighbors that public input to the council has ended, and discussions, if any,
during the next two readings would be limited to the Council table. To aid in our
preparation, it would be helpful if you could send us any specific information you may
receive from council members in response to Mr. Lindahl's memorandum prior to the
third reading.

I am writing to express my disappointment in the recent City Council vote in regard to
the zoning change between Medical Associates and the residents of Cora Dr.
The members of the Zoning Commission, who have studied the proposal in depth, twice
declined the request. They felt Medical Associates had other alternative sites on their
property that could be used for the expansion. In addition, they felt there was no
justification to change the agreement between the city residents and Medical Associates.
As citizens, we can no longer trust that decisions made and agreed upon will be upheld
by our city officials in the future.
I respectfully request that you reconsider your vote on this issue.

Come on a deal is a deal! Stand behind it. Make MA use land on the other side. The greenspace should
stay as is. The potential extra traffic thru and established neighborhood is not necessary and could put
lives of small children at risk as well as adults the pazents and grandpazents. MA do the right thing you

Subject: Rezoning of the green space located at Medical Associates
At the end of Mr. Hartig's presentation he made several inaccurate statements that the
residents were not able to respond to. An example of this is he had shown a photo of my
home at 3814 Cora and stated my drain pipes were routed towards his property. This statement
is not accurate as those drain pipes aze routed to and empty to Cora Drive. He had also shown
a photo of a flower garden and again stated it was on his property. Again, this statement is not
correct as this flower gazden is on my property. I had the home built and I pulled the surveyor
stakes out myself. I know these aze simple items and not very material to the big picture but it
does lead to another question. If these simple easily verifiable items were misstated by Mr.
Hartig then what other items aze misstated? If he can not take two seconds and notice the drain
goes towards Cora Drive and does not run up hill to drain onto Medical Associates then how
can we believe his other statements? If he is not willing to take the time to look at the lot lines
before making statements "as fact" to the council then how can we believe his cost estimates
and Medical Associated incapability to chose another site on the vast Medical Associates
campus? As one member of council noted, they did not realize they had that much space
available.
Also, several of the statements made by the city council itself seemed to try to compaze
apples to oranges. One member likened it to a vacant lot where they played but someone built
a house on and life went on. The vacant lot was more than likely zoned for a house all along
and you knew this when they purchased your home. City council then did not give the okay to
put in a gas station. You knew what you were going to get. Same as another remazk with
regard to kids playing near by the unverifiable truck traffic. The rather unprofessional remazk
was to tell the kids not to play in the street. He lives on University and he gets way more
traffic than we will see and the traffic in front of the house on Cora Drive is more dangerous
anyway. The backyard for the three young children ages 3 and up should be a safe place to
play without truck traffic which is why those residents purchased that home. The memory for
the council seems to be very short as at the beginning of the same session you were praising a
new children's program. You chose to live on University and you know what you would
have for traffic when you purchased the property. It would be great if the city would
make University and Asbury a four lane road to easy the traffic congestion heading too and
from the west end. I do not see why this is not possible since when I was kid I lived 50 ft from
Dodge Street and you tell kids not to play in the street and you get use to it, like living next t to
the train tracks. If the city council was doing this to your neighborhood you would be up
in arms. Residents purchased homes knowing the traffic in this area is not an issue that
is why the moved here and now the city council has chosen to change this.
Medical Associates had improper contact with a member of the zoning committee as
noted in Mary's presentation (which seems to be forgotten) or both requests to this committee
would have been unanimously rejected. The residents have unamously rejected this proposal.
Yet our elected officials entrusted with the weU being of the residents have chosen to
ignore the zoning committee and~q~ What is the purpose of the zoning
committee? It appears our tgp~ s~`",~`~~placed in our elected officials.

Dear Mayor and City Council Members,
I am glad to see that one of our members of council was able to take a step back and notice
all of the space Medical Associates has to work with and realize that building right up next to
residential homes in the disinated green space is not the only option Medical Associates has. I invite
all members to pull out the map of the west end campus and think is this really the only place an
addition can go? (In the green space next to a residential neighborhood)
Is a deal really a deal? In the fall of 2007 in our first meeting with the city council they felt a
deal was a deal, green space was important, city zoning committee was correct, and they denied
Medical Associates request. I believe they then stated they may have better luck with the next city
council, and here we are. This council does not feel a deal is a deal and is willing to let Medical
Associates devalue the residential neighborhood. We will be taxed at the same rate but no one
really believes as the charts presented suggested that the market value of our homes will increase
with a 2 story building 50 feet way that has unrestricted deliveries at anytime of the day or night.
You have now added traffic adjacent to the backyards of small children, people who have purchased
this property knowing the land behind them was zoned as green space and the city would protect
them form anyone building a facility that would bring unrestricted truck traffic to their back door. (I
guess they were wrong) I ask that you individually think what if this were you, what if this was your
family? Is this the right thing to do?
If the current proposal goes through who is going to hold Medical Associates to the new deal?
To fully screen the building as they proposed it would require evergreen plantings 15 feet plus in
height and to fully screen as stated they would need to be close together. Since city council is
now sending the message that a deal is not a deal what is going to hold them to the new
deal?
Please answer these questions
1. Pull out a map of the Medical Associates campus. Do you believe the only available space to
build is in the green space up close to a residential neighborhood?
2. Do you value the opinion of the city zoning committee?
3. If a deal is not a deal then what message are you sending to all of the other developers and
city residents?
4. What if this was your house, your neighborhood?
5. If approved who is going to hold Medical Associates to the new deal, since we already know
deals were made to be broken.
6. Is this the right thing to do?

I have been awaze and listening to the issues presented by Mr. Hartig and Medical
Associates in regard to the rezoning of the green space located at Medical Associates
West. I must say that I believe this is has taken much time and discussion when it should
have been settled long ago. Indeed it was my impression that it was. Isn't there a limit
on the number of times a business is told "NO"' before it becomes "No"? Or what is the
point in having a zoning or council meeting. It appeazs that big business and the twisting
of the truth can sway the members.
Going "green" is a great idea, a wonderful promise, and a true move toward the future.
However going back on a promise to the people for the benefit of big business in such a
manner of lies is disgusting. For Medical Associates, "We believe" slogans should now
include: We believe.... That our word is not our word; that the progress of business can
be swayed and in fact is not for the people but for the pocketbook. As far as Hartig's
motto:" We're here for life"...no matter whom we step on. What a deal for the city!
This gives the impression that there certainly isn't a concern or value for the opinions of
the people.
There is other land that Medical Associates owns. It is not necessary to tell lies to get
council members to change their votes. I know that I am only one person and that
probably means little to anyone, but I have a choice on which companies that I do
business. Mr. Hartig has not presented himself as a positive and honest model worthy of
my business.

Once again I am compelled to write a letter to the City Council to request reconsideration of
their approval of the amendment to the Medical Associates Planned Unit Development.
The facts surrounding this issue remain as follows:
(1) During 1996, the City Council approved the existing Planned Unit Development
(PUD) with the intent of protecting the established residential properties along Cora
Drive, Marjorie Circle and Donovan Drive.
(2) Medical Associates agreed to the Planned Unit Development. The original plan
provided land for growth. (This is evidenced by their decision to add on to their
existing building for MRI equipment two years ago.)
(3) The Zoning Advisory opposed Medical Associates amendment to the Planned Unit
Development.
The City Council's disregard for the Zoning Advisory Committee's recommendation is
worrisome. This decision by the City Council has already undermined the ability of the
Zoning Advisory Commission. Last Wednesday, during a discussion of the Toby Kress
proposed development, several of the zoning commissioners questioned the "effectiveness"
of placing any restrictions on this proposed development, due to the decision on the
Medical Associates amendment. One commissioner referred to the Medical Associates
PUD as "broken promises."
While the Medical Associates decision impacts me personally, I am concerned about the
impact this decision will have on future developments for the City. Citizens must be able to
trust their local government officials to protect their existing homes once an ordinance is
adopted. As Mr. Jones has stated several times "a deal is a deal." Unfortunately, for us,
this "deal" resulted in broken promises.
If, however, you decline to reconsider this decision, certain restrictions must be placed on
any future development in this area. Throughout this debate, Medical Associates has been
vague in their description, use and size of this building and the visual screening to be
provided. The building must be limited to one story (walkout). During their presentations
Medical Associates presented the following items which must be approved as restrictions:
(1) Visual screening must be limited to evergreens in order to provide screening year
round.
(2) Visual screening must be high enough (minimum of 20 feet, at planting) to block
the sight of the building from the residents on Cora Drive.
(3) All green space and visual screening must be properly maintained and/or replaced
by Medical Associates as needed.
(4) The type of building permitted on this property must be restricted to medical office
use.
(5) Hours of operations must be restricted to normal business hours (Monday -Friday
8:00 am - S:OOpm).
(6) Existing drainage the directed towards Cora Drive must be rerouted during
construction.
(7) Drainage for new construction must be directed away from Cora Drive.
(8) The loading dock must be on the west end of the building.
(9) The proposed driveway must end at the west end of the building.
(10) No parking shall be allowed in the rear (north end) of the building.
(11) The building shall be limited to one story (walkout).
Medical Associates stated twice during the February 4, 2008 Council meeting of their intent
to provide 50 feet of green space, landscaping, plus another 60 feet between the landscaping
and the building. This should be considered a restriction as well.

Dear City Council:
I wanted to let you know that I disagree with the rezoning of Medical Associates I believe
a contract is a contract and we as a city need to protect the rights of the homeowners.
Buying a house is an extremely important event in our lives, careful thought is gone into
buying a home, selecting the location etc. For a corporate company to come to them years
later to say "sorry we want to go back on our promise" and build a building with a drive
way in your back yard is unacceptable.
Medical Associates has several acres of land that they can build on, why build on top of
the hpriieowners?

Honorable Mayor and City Council Members,
I am writing to voice my opposition to the zoning change on the Medical Associates Property. There are
several reasons why I oppose said rezoning including.
• Neglecting to take the recommendation of our City Zoning Commission who twice denied the
application. Is this not the purpose of having such committees in our city and community?
• 'The vast amount of land that Medical Associates has to place the facility elsewhere. While they say
this is the only piece of land that the new building will work on and they need the other land for
future development, they have sold other parcels of land to related and other entities for housing and
other purposes including the Bio-Life facility as an example. What prohibits them from continuing to
sell additional parcels instead of developing the land for their own expansion as they claim they need
it for?
• Medical Associates compares this to other commercial districts on the West End. This is not a fair
comparison due to the density of housing and number of residents impacted in this neighborhood
and area compared to other districts they refer to.
• Green space, although I must admit I am not a green fanatic, our City has placed much emphasis on
this, however is willing to overlook this and compromise for Medical Associates because they are
willing to plant green and some larger trees mainly to assist in blocking the view of the building not
for green purposes.
• Additional traffic and safety issues.
But mainly is your unwillingness to listen to your constituency and the citizens of Dubuque who live and
reside in the area. When we as citizens enter into an agreement we consider it binding and live by the terms
of the agreement. You are changing these terms after the fact with only one party agreeing to the change. I
believe you are setting a dangerous precedent with your decision to approve rezoning against the
recommendation of the City Zoning Commission and all of the residents that are impacted by this decision.
Being in business and dealing with business owners on a daily basis I understand the importance of Medical
Associates and that they are a good corporate citizen however this should not trump the people who
purchased property and built or bought homes in the neighborhood understanding what the zoning was in
this neighborhood.

First of all, THANK YOU MR. VOETBERG! It takes a big person to change their vote and stand up for what is
right! It is good to know that Mr. Voetberg, Ms. Braig, and Mr. Remick are council persons who care about
neighborhoods in Dubuque.
Everyone tells us "money talks" and that's just not right. They say "you can't fight aty hall", but city hall is on our
side! LISTEN to your zoning commissioners!! It was their job to consider this proposal and when they gave their
recommendation, you disregard it...what is that telling them!!
Mr. Jones, look back at what you said!! "A DEAL IS A DEAL" That's what you said!! YES, Medical Associates
made the proposal of GREENSPACE in order to get their PUD!!! We know that, the zoning commission knows
that, and city hall knows that! Now they want to renege on the deal!! Please change your vote!
Mr. Lynch, stand up for the neighbors in your ward!! Medical Associates isn't going to leave! Tell them to
build on the other areas of their property! Zoning Commissioners told them to, City Hall has pointed out other
areas where they can build, the neighbors talked with them about other options!! PLEASE change your vote!!
Mr. Buol and Ms. Connors, stand up for the people of Dubuque! GREENSPACE means so much to Dubuque

Deaz Honorable Mayor and Members of the Dubuque City Council,
As the owners and residents of 3828 Cora Drive, we aze writing to you to express our
concern regazding the proposal to amend the existing Associates Pazk Planned Unit
Development District to designate a portion of the existing greenway buffer for business use.
The Zoning Commission, the City Council, and Medical Associates made a commitment to
the residents and future residents of Cora Drive in 1994, 1996, and 1999. The Zoning
Commission honored this commitment in September and again in November by voting
against this amendment. The green space was established for a reason over fourteen yeazs
ago-to serve as a buffer between residential and business zones. Property owners have
made investment decisions since its establishment based on the existence of this buffer,
believing that this commitment would continue to be honored. Per the Zoning Commission,
"the original reasons for establishing the greenway buffer have not changed." As a result, it
does not follow that this same greenway buffer should be eliminated or reduced in any way.
We do recognize that Medical Associates is an important part of our community and the good
that they do. We also understand that Medical Associates does have a need for expansion.
However, this expansion does not need to take place in this particular location. Medical
Associates owns (or could easily acquire) other land in the vicinity of the west campus that
could be used for the proposed building. Part of the azgument for not using this land is to
preserve pazking for future expansions that could happen as faz into the future as 20 or 30
yeazs or more. Other land is also available to them that is not currently reserved for
pazking. Medical Associates has failed to prove that using this greenway buffer is the only
way to meet their expansion needs. Medical Associates can still meet their needs and
maintain the greenway buffer .currently in place.
On the website for the Dubuque City Council, there is a list of goals, priorities, and visions
for the City of Dubuque. One of top priorities listed in the 2007-2009 category is "green city
initiatives." Voting for Medical Associates' proposal in our opinion does not support a
"green city" movement. Since there aze options for Medical Associates' expansion needs
that do not include eliminating green space, these options need to exercised. If a priority for
the Dubuque City Council is becoming a greener city, there should not be an unnecessary
removal of already existing green space. The City Council should be looking to preserve
existing green spaces, not eliminating them or even reducing them in size.
Although we strongly oppose the approval of this amendment to the existing PUD, if the City
Council should approve it in the third reading, we ask that the City Council ensure that the
conditions mentioned in the February 18 City Council meeting aze in place to make sure that
Medical Associates carries through on their promises to the Zoning Commission, the City
Council, and to the azea residents. The current written proposal does not require Medical
Associates to do the following: plant trees to block the view of the building, place the
building 60 feet beyond the trees, or restrict the uses of the building. We ask that Medical
Associates be required to plant and maintain trees at the height necessary to block the view of
the building from the neighbors. We would ask that Medical Associates be required to place
the building at the described 60 feet beyond the trees (a total of 110 feet from the neighbors
on Cora Drive). We also ask that Medical Associates' use of the building be restricted. The
area is currently zoned as C-3 which allows for 66 different types of business uses. These
uses range from bars to private clubs to supermarkets. Although a covenant currently restricts
the use of the property, this covenant can be changed at anytime without prior approval from
the Zoning Commission, City Council, or Planning Services. We ask that the property be
restricted to the medical office/clinic use described by Medical Associates. We feel that these
restrictions are essential in order to make for a more peaceful cohabitation of the commercial
and residential districts-giving residents some peace of mind. We also believe that these
requests will allow Medical Associates to use the building as they themselves have described.

Once again I am writing you to ask that you deny the proposed amendment of the green buffer
concerning Medical Associates and Cora Drive residents.
After reviewing the minutes of the past several meetings I once again feel you should deny this request
and look at the other options Medical Associates has.
With this said, green space is green space and a deal is a deal! Also, please keep in mind this is
residential not commercial. Let's keep it residential. I have always had the deepest respect for my city
government officials and I will continue to do so as long as I know they are protecting my rights as a
property owner. Please deny this request keeping in mind that the complaints by the neighbors to
Medical Associates have never been addressed even though Bob Hartig said they were. Could the City
Council possibly see a copy of these complaints from the residents? No, because Medical Associates and
Bob Hartig have done nothing to remedy this. What could happen next if this amendment is approved?
