City Attorney Gus Psihoyos, City Engineer, SUBJECT: Iowa Department of Transportation Title VI Assurances and Title VI Nondiscrimination Agreement DATE: November 2, 2015 INTRODUCTION This memorandum is to request City Council approval of an updated Title VI Assurances and Title VI Nondiscrimination Agreement between the Iowa Department of Transportation (Iowa DOT) and the City of Dubuque related to the city's receipt of federal aid funding. As a condition of receiving federal financial assistance from the Federal Highway Administration, the Iowa Department of Transportation is required to establish and implement a Title VI program that ensures nondiscrimination in its programs, services and activities. Recipients and sub-recipients receiving federal funds must adhere to the regulations set out by 23 CFR and 49 CFR, which are the regulations for Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, Title IX of the Education Amendments of 1972, the Age Discrimination Act of 1975, and a variety of program-specific statutes with nondiscrimination requirements. BACKGROUND On October 1, 2012 City Council approved the Iowa DOT Title VI Assurances and Title VI Nondiscrimination Agreement between the Iowa Department of Transportation and the City of Dubuque related to projects that were eligible for federal aid funding and appointed City Engineer Gus Psihoyos as the Title VI Coordinator. As Title VI Coordination, Gus Psihoyos, signed the documents which subsequently were sent to the I DOT. DISCUSSION In response to an August 13, 2015 request from Iowa DOT Compliance Officer, Ms. Rainey, and as required by Federal Regulations, a compliance review was to be performed. The Title VI Sub-recipient Site Review Tool was completed and submitted for [DOT review. On October 12, 2015, Nikita Rainey, met with city staff to review the documents submitted in 2012, the Review Tool submitted on September 14, 2015, and the actions of the City since that time. Items that needed attention and resubmittal include the Title VI Assurances and Title VI Nondiscrimination Agreement executed by the Mayor and resubmitted to the IDOT. The Site Review Tool covered project overview and funding, demographic information, public notification of rights and accessibility, limited English proficiency, transportation, public participation and outreach, and investigation and complaint process. Items that were noted which staff is currently working on and implementing are: 1. Completing and keep on file Annual Title VI Accomplishment & Goals 2. Inclusion of Title VI Assurances appendixes in all city contracts, deeds, permits, and leases; and ensuring that consultants, on behalf of the city, include Title VI languages and appendixes. 3. Explore collection of demographic information for City boards/commissions, to ensure Dubuque citizen representation on board/commission; and on public information sign-in sheets 4. Explore formalizing a course of Title VI training for Leadership Team staff on the various Title VI areas. 5. Seek out additional minority participation processes around service areas and decision making. 6. Expand Limited English Proficiency city-wide. 7. Complete and have on file, on-going curb ramp and access route transition plans. The IDOT will be reviewing the Title VI compliance every three years. If the designee, the mayor, or the Title VI Assurances and Title VI Non-Discrimination Agreement, changes, then those documents must be re-submitted to the IDOT for their file. RECOMMENDATION I recommend that the enclosed Title VI Assurances and Title VI Non-Discrimination Agreement be submitted to the City Council for review, approval, signature and forwarding to IDOT. Items #1 and #7 above, anticipated to be completed before the end of the year, will be sent to you for your review and submittal to the City Council. ACTION TO BE TAKEN I respectfully request that the City Council approve and hereby authorize the mayor to sign the Iowa DOT Title VI Assurances and Title VI Non-Discrimination Agreement with those documents being forwarded to the IDOT.
