The application, staff report and related materials are attached for your review. Discussion Peter Schweigeraht, representing the applicant, spoke in favor of the request, reviewing the area to be rezoned, the proposed senior housing development they wish to build on- site and noted that the senior portion of the population was growing in the community. He reviewed the surrounding land uses and noted that his company will be working with Nativity Parish on the provision of off-street parking which may include demolition of the newer Nativity School building. Staff reviewed the staff report, noting that the property had previously served as part of the playground for Nativity School, and reviewed the list of allowed uses in the proposed OR Office Residential District. Staff also reviewed surrounding zoning and land use and average daily trips provided by 2013 Iowa Department of Transportation counts. Several persons spoke in support of the request, stating the proposed senior housing project would be compatible with surrounding uses. The Zoning Advisory Commission discussed the request, and felt it was compatible with surrounding property. Recommendation By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. Physical Characteristics: The subject property is relatively flat and is located at the northwest corner of University Avenue and Alta Vista Street. The subject parcel is approximately 1.3 acres in size. Concurrence with Comprehensive Plan: The 2030 Future Land Use Map designated the property for institutional use. Impact of Request on: Utilities: Existing utilities are adequate to serve the site. Public Services: Existing public services are adequate to serve the property. i Rezoning Staff Report— Northwest Corner of University Avenue /Alta Vista Street Page 2 Environment: Staff does not anticipate any adverse impact to the environment provided adequate storm water management and erosion control is practiced during all phases of development. Adjacent Properties: The subject property is located in a mixed use area located at the intersection of two existing public streets. Planning staff anticipates that development of the property under the Office Residential District zoning would increase to some degree the ambient light level and vehicle trips generated from the existing site. CIP Investments: None proposed. i Staff Analysis: The applicant is proposing to rezone the property at the northwest corner of University Avenue and Alta Vista Street from R-2 Two-Family Residential to OR Office Residential District. The OR Office Residential District standards are attached to this staff report. The OR District is intended to serve as a transition zone between commercial, single and two-family residential areas. Typically, Office Residential districts are not intended to be applied to undeveloped or newly developing areas of the city. However, while the property in question is currently not developed with buildings on it, it is in a completely developed portion of the city and is not a newly developing area. The proposed project would be considered an in-fill development. The development of in-fill sites must be done in a manner compatible with the existing development pattern so as to not negatively impact the use and enjoyment of surrounding property. The OR District is to be located in areas abutting arterial and/or collector streets. University Avenue is designated as a minor arterial and Alta Vista Street is a local street on the Urban Federal Functional Classification Map for Dubuque. The applicant's intention is to develop the existing property as a senior housing residence encompassing 51 dwellings with the required off-street parking and green space. The OR district allows 16 permitted uses as well as 13 conditional uses. Generally, the allowed uses are office or residential in nature. If rezoned, the subject property can be used for any of the allowed uses provided adequate off-street parking and lot area can be provided. A copy of the OR Office Residential District regulations is attached to this staff report. Based on aerial photography since the 1930s, the property has never had a structure on it, and until recently, was part of the play yard associated with Nativity School. Attached to this staff report is a couple of aerial photos depicting the subject parcel and surrounding property. The most recent development in the area was the construction of the Radio Dubuque Inc. studio/offices immediately to the west of the subject property. The rezoning request was reviewed in the spring of 2009 with construction following in 2010. If the requested rezoning is approved, a site plan prepared by a licensed civil engineer must be reviewed and approved prior to any construction. The site plan review process ensures that new construction will comply with city regulations for street access, storm water management, utility connections, setbacks, parking and landscaping. Planning staff recommends the Commission review the criteria established in Article 9.5 of the Unified Development Code regarding property reclassification applications. The submitted rendering depicts a three-story building that was recently proposed by the applicant for another community. The rendering depicts the style of building the applicant proposes for the Nativity Parish site. The applicant has discussed the possibility of building a four-story structure. The OR District allows a building height of 40 feet. The typical height of a story is 10 feet. A four-story building may not be able to comply with the 40-foot height regulation, depending on the roof design. The Zoning Board of Adjustment would need to review and approve a waiver to the height regulation if the final design exceeds the 40-foot height regulation.
