SUBJECT: REAP Grant Agreement — Eagle Point Park Environmental Restoration

Planning Services Manager Laura Carstens recommends City Council approval of the
Fiscal Year 2016 REAP Grant Agreement with the Iowa Department of Natural
Resources for the Eagle Point Park Environmental Restoration Project in the amount of
$200,000. The REAP grant will cover all project costs and no City match is required.
Eagle Point Park overlooks the Mississippi River, providing a spectacular view of Iowa,
Illinois, and Wisconsin. With 164 acres, Eagle Point Park also is considered a regional
park because of its size, abundant recreational facilities, and many visitors from
Dubuque County and the tri-state region.
Over time, Eagle Point Park's multipurpose green space and natural wooded hillsides
have experienced severe erosion and sediment loss. Invasive plant species have
added to the storm water management issues on the park's rolling and sometimes
rugged terrain. Environmental restoration is needed to mitigate and reverse these
impacts. All of this environmental work must be done within the context of the park's
rich cultural history.
The Eagle Point Park Environmental Restoration Project will incorporate the park's
historic features and landscape restoration plans with sustainable best management
practices to mitigate stormwater runoff, prevent soil erosion, and remove invasive
species throughout the cultured grounds and natural areas of Eagle Point Park.
The first phase of this project will be for the City to retain experts in landscape
architecture, environmental engineering and ecological restoration who have expertise
in the design of ecologically sustainable best management practices in context with the
park's many historic and cultural assets. The second phase will be development and
implementation of the Management Plan for Environmental Restoration at Eagle Point
Park. The project will be completed over a two-year time frame, beginning in January,
2016.
In addition to the REAP grant, the City of Dubuque has assembled a historic
preservation team to nominate the park to the National Register of Historic Places and
to conduct a Phase 1 Archeological Survey. The National Register of Historic Places
nomination will provide important information on the historic contexts, cultural themes,
and architectural significance of the park's buildings and landscape. The Archeology
Survey will allow the City to identify any archeologically sensitive areas. With this
information, the City can avoid any sensitive areas when undertaking environmental
restoration.

INTRODUCTION
This memorandum requests City Council approval of the FY 2016 REAP Grant
Agreement with the Iowa Department of Natural Resources (IDNR) for the Eagle Point
Park Environmental Restoration project in the amount of $200,000. Enclosed are the
grant agreement, map, and resolution.
REAP (Resource Enhancement and Protection) is a State grant program for parks and
open space administered by IDNR. 15% of REAP is set aside for grants to cities for
projects that help establish natural areas, encourage outdoor recreation, and enhance
and protect Iowa's natural and cultural resources.

RESOLUTION AUTHORIZING REAP GRANT AGREEMENT WITH IOWA DEPARTMENT OF
NATURAL RESOURCES FOR EAGLE POINT PARK ENVIRONMENTAL RESTORATION
PROJECT
Whereas, the Iowa Department of Natural Resources has allocated grant funds from REAP
(Resource Enhancement and Protection) for projects that help establish natural areas, encourage
outdoor recreation, and enhance and protect Iowa's natural and cultural resources; and
Whereas, the City of Dubuque has adopted the 2012 Comprehensive Plan that includes goals
for environmental quality, park improvements, and stormwater management.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The Mayor hereby is authorized to sign the FY 2016 REAP Grant Agreement with
the Iowa Department of Natural Resources for the Eagle Point Park Environmental Restoration
Project in the amount of $200,000.
Section 2. That the City Council hereby provides its written assurance that the completed
project will be adequately maintained for its intended use in accordance with state requirements.

1. PURPOSE. The purpose of this REAP Development Grant Agreement is to enable the Iowa Department of
Natural Resources (DNR), acting for the State of Iowa, to assist the CITY OF DUBUQUE (Grantee) in
the development of land for the enhancement and protection of open space areas.
2. PARTIES/AUTHORITY. The parties to this Grant Agreement are the DNR, an agency of the State of Iowa,
and the CITY OF DUBUQUE. The parties make this Grant Agreement pursuant to 1989 Iowa Code
Supplement Section 455A.19(1)(a), which authorizes the Natural Resource Commission to spend certain
state funds appropriated for projects to enhance and protect open spaces.
3. GENERAL DESCRIPTION OF PROJECT LANDS. This Grant Agreement is for your project described as:
PREPARATION AND IMPLEMENTATION OF A SUSTAINABLE MANAGEMENT PLAN
FOR ENVIRONMENTAL RESTORATION OF EAGLE POINT PARK, INCLUDING
MITIGATING STORM RUNOFF, SOIL EROSION, & INVASIVE PLANTS WHILE
,RETAINING THE HISTORIC FEATURES & LANDSCAPE, DUBUQUE, IOWA.
4. GRANT AWARD AND REIMBURSEMENTS. The DNR will provide 100 percent of development costs up to
a maximum amount of $200000.00.
A. A ninety (90) percent advance reimbursement of the grant award may be requested by submitting a
letter of request to:

B. Final payment will be made when the project is completed and the grantee submits a letter of request
along with the following grant requirements:
• a legal description of the property for the required Notice of Use Restriction;
• pictures of the completed project;
• copies of billings and canceled checks for 100 percent of the grant award;
• contracted development work requires; a copy of the signed contract, pay estimates, and
contractor's reimbursement Refund of Sales Tax;
• final report, to include a description of the completed project and efforts made to procure goods
and services from Targeted Small Businesses (TSBs).

5. RESPONSIBILITIES. The grantee is solely responsible for the project completion as outlined in the project
proposal. The grantee will make a concerted effort to procure goods and services from Targeted Small
Businesses (TSBs) during the performance of this Grant Agreement. The DNR may provide assistance at
the request of the grantee, or at the Director's recommendation.
6. AMENDMENTS. This Grant Agreement may be amended only by written ADDENDA signed and dated by
the DNR Director or the DNR REAP coordinator. Requests for amendments shall be directed to the DNR
REAP coordinator.
7. EFFECTIVE DATE/TERMINATION. This Grant Agreement shall become effective when it has been signed
and dated by the DNR Director and the grantee. All work specified in the project proposal will be
completed by DECEMBER 31, 2017.
8. AVAILABILITY OF FUNDS: If funds anticipated for the continued fulfillment of this agreement are at any
time not forthcoming or insufficient, either through the failure of the State of Iowa to appropriate funds, or
discontinuance or material alteration of the program under which funds were provided, then the
Department shall have the right to terminate the agreement without penalty.
9. By signing this Grant Agreement, the grantee agrees to the terms and conditions set forth in this agreement
and all attachments listed below:
