PRESENT: Chairperson Mike Ruden; Board Members Randy Klauer, Bill Gasper,and
Jim Urell; Staff Members Wally Wernimont and Guy Hemenway.
ABSENT: Board Members Bill Gibbs.
AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying the
meeting was being held in compliance with the Iowa Open Meetings Law.
CALL TO ORDER: The meeting was called to at 4:00 p.m.
DOCKET 7-08: Application of Charles Walter, Jr. & Barbara Zoellner for a conditional
use permit for property located at 216 Clarke Drive to allow a Bed & Breakfast
establishment with 7 guest rooms in an R-3 Moderate Density Multi-Family Residential
District, in conjunction with rezoning and receiving Individual Historic Designation
status.
Charles Walter, Jr., Ocala, Florida, outlined his request to convert the property at 216
Clarke Drive to a Bed and Breakfast establishment.
Norma Denlinger, 215 Clarke Drive, asked if the bed and breakfast will have a resident
manager. Mr. Walter indicated there will be a resident manager on site.
Staff Member Wemimont outlined the staff report discussing the existing zoning,
rezoning, resident manager requirements and historical designation status process. He
also discussed on-street and off-street parking requirements for a bed and breakfast
establishment. He discussed the criteria for a conditional use permit which included
floor area requirements, signage and parking.
Chairperson Ruden asked if staff was notified of parking issues in the neighborhood.
Staff Member Wernimont said one neighbor with concerns about parking had contacted
him. He discussed the available parking in the neighborhood.
Motion by Urell, seconded by Gasper, to approve the conditional use permit with the
condition that the property be rezoned from R-2 to R-3 and the property receive historic

designation status. Motion carried by the following vote: Aye -Klauer, Gasper, Urell
and Ruden; Nay -None.
DOCKET 8-08: Application of 1-Wireless/City of Dubuque for a conditional use permit
for property located at Madison Park (10-24-182-006) to allow a wireless communications
facility using a flag pole and equipment compound in an R-2 Two-Family Residential
zoning district.
Andy Anderson, 5000 Tremont Avenue, Davenport, representing I-Wireless, explained
his request to the Board. He explained the cell phone coverage area. He explained
that Madison Park is in a historic area. He said they are proposing to conceal the
antenna in a flag pole. Mr. Anderson presented a display board with a rendering of the
flag pole and the compound. He described the location of the equipment area and said
he had the Historic Preservation Commission provide a courtesy design review. He
said landscaping will be installed around the pole to shield the lighting at ground level.
He also discussed installing a wrought iron fence around the compound with additional
landscaping. He explained that he is working with the City on the landscaping design.
Mr. Anderson discussed the lighting, installation and maintenance of the pole. He
explained the City is required to maintain the flag. He said the flag pole will be 4'/z' at
the base narrow to 3'/Z feet with a gold ball on top.
The Board and applicant discussed the dimensions of the flag.
Gloria Schiesl, 1752 N. Main Street voiced concerns with equipment shed relative to the
bluff. He also said Shive Hattery prepared a rendering using dimensions provided by (-
Wireless. He said he cannot guarantee that the rendering is accurate regarding the
scale of the pole. Chairperson Ruden said he wants to table this agenda item to the
March 27, 2008 meeting. He said he would like the applicant to provide an engineered
drawing with the dimensions of the flag pole and a photo from a flat plane. He also
requested that staff measure the concrete monument and the tree next to the proposed
installation.
Motion by Urell, seconded by Gasper, to table this agenda item for more information to
the March 27, 2008 meeting. Motion carried by the following vote: Aye - Urell, Gasper,
Klauer and Ruden; Nay -None.
DOCKET 9-08: Application of Philip Schmidt/Scott Frank for a conditional use permit
for property located at 1381 Oak Park Place to expand the Oak Park Place residential
facility adding 18 assisted living units and 7off-street parking spaces, in a PR Planned
Residential zoning district.
Phlip Schmidt, ARC design consultant, Verona, Wisconsin, outlined the request. He
explained that they are adding 18 assisted living units and 7off-street parking spaces.

Staff Member Hemenway outlined the staff report. He explained the property is zoned
PR Planned Residential with an underlying R-4 Multi-Family Residential zoning. The
Board and the applicant discussed off-street parking requirements.
Motion by Urell, seconded by Klauer, to approve the conditional use permit as
submitted. Motion carried by the following vote: Aye - Urell, Gasper, Klauer and
Ruden; Nay -None.
MINUTES ~ NOTICES OF DECISION: The minutes of the January 24, 2008 meeting and
Notices of Decision for Dockets 63-07, 1-08, 2-08, 3-08, 4-08, 5-08 and 6-08 were
approved, as submitted, unanimously.
ADJOURNMENT: The meeting adjourned at 5:05 p.m.
