Gentlemen: You have referred
to me a communication from the
League of Iowa Municipalities con-
cerning a contribution toward a
Municipal Fire Defense Institute,
sponsored by the American Mun~-
cipal Association.
I have reviewed the plan and
believe it to be a well orr~anized
program which will affect the fire
protection activity in our city. This
field, ranging from fire staff, equip-
ment, protective devices to fire
ratings and insurance. represents
one of the highest cost to citizens
in our community both through
direct tax levy and insurance
premiums. Even the smallest suc-
cess resulting from study, informa-
tion or concerted action on the part
of the Municipal Fire Defense In-
stitute will reflect a benefit far
greater than the contribution the
City has been asked to make.
I recommend that the Council
authorize payment to Municipal
Fire Defense Institute of $1.00 for
each Fire Department employee or
a total of $74.00.

Gentlemen: You have referred to
your staff a petition of Mr. M.
Witterholt and others protesting
the existing conditions of the prop-
erty at 2156 Elm Street.
Mr. Bandy and Mr. Miller have
made an inspection of the property
at 2156 Elm Street and have writ-
ten areport which I am enclosing.
Based on the inspection report, I
do not recommend that the Coun-
cil declare the property a nuisance
and thereby order it to be fixed
up or torn down.
I can only suggest that the Build-
ing and Health Departments con-
tinue their surveillance of the sit-
uation and urge upon the owner,
correction by voluntary action.

Dear Sir: An inspection of the
building located at 2156 Elm Street
has been made by the Building and
Health Departments and we wish
to report the, following:
This is a two story building used
as a dwelling and the age of same
has not been determined.
The original building was stucco,
since that time additional sheathing
has been added to the exterior and
covered with roll asphalt brick sid-
ing. This siding has come loose in
places and parts in small sections
have been removed. The entrance
is directly off the sidewalk
The interior is composed of three
rooms and attached closed porch
to the rear on the first floor.
The condition of these rooms is
presentable, the walls and ceiling
show a little more than ordinary
wear but are intact.
The second floor is composed of
two bed rooms and bath room.
This floor has evidently been reno-
vated in the past and the structural
supports were disturbed and leaves
the floor and ceiling very uneven.
The wiring is of the old knob and
tube type as in all the older homes.
There are extension cords about
the rooms and there is only a mini-
mum of outlets. The fuses are fif-
teen ampere and are proper and
there is no evidence of continued
blowing of fuses.
The building is equiped with a
sink on the first floor and a stool
and bath on the second.
As a result of this inspection we
state the following:
The building in its present state
adds nothing to the adjoining area
as far as exterior looks are con-
cerned.
The interior while uneven and
cut up is not up to standard con-
ditions but the occupants are not
in danger because of possible build-
ing failure.
To re-habilitate this building,
level the floors, re-wire and dress
up the exterior would cost more
than the value of the building.
We found no evidence of any
animals or fowl other than four
small dogs and one cat.

City's attention to certain condi-
tions in the Elm Street area be-
tween 20th & 22nd Streets and the
additional petition requesting re-
zoning to Local Business District
"A" the area between 20th and
22nd St. except for the area now
occupied by service station and
tavern has been considered by the
Planning & Zoning Commission.
This area is predominately resi-
dential, the homes are well main-
tained and the residents desire ad-
ditional protection by more restrict-
ed zoning.
The planning and zoning com-
mission recommends granting the
petition and the area between the
center line of Washington Street
and the Great Western Railroad
Tracks from the center line of
Twenty Second Street to a line
one hundred and twenty five feet
northerly of and parallel to the
center line of .Twentieth Street
and Rhomberg Avenue be rezoned
to Local Business District "A."

Resolution establishing a sani-
}ary sewer connection charge for
Saunders Street.
Whereas, the sanitary sewer in
Saunders Street has been construct-
ed in accordance with plans and
specifications as provided for in
Green Acres Subdivision from the
existing sanitary sewer to said sub-
division, and
Whereas, the City Engineer has
inspected the same and they have
been accepted as constructed in
accordance with plans and speci-
fications, and
Whereas, the. owner has filed
with the City Council a certified
statement showing the construction
of said sewer, including engineer-
ing and inspection fees amounting
to: Sanitary Sewer $3,158.04.
Now, Therefore, Be It Resolved
by the City Council of the City of
Dubuque, Iowa:
Section No. 1. That hereafter any
person or persons desiring to con-
nect with said sewer shall first
apply to the City Manager for per-
mission Co do so and such permis-
sion shall be granted upon condi-
tion that the applicant shall pay
to the City Treasurer for the ac-
count of Reilly Realty Inc., a con-
nection charge of $3.49 per foot
for the sanitary sewer per frontage
of land to be served by said con-
nection. However, nothing in this
resolution shall be construed to
exact any charge for any extension
of said sewer made by the City of
Dubuque or its permittees.
Section No. 2. That the establish-
ment of said connection charge to
said sanitary sewer shall not be
construed to relieve Reilly Realty,
Inc. or his contractor, or his bonds-
men from their obligation, or the
obligation of anyone of them from
tY.e provisions as set forth in the
subdivision ordinance concerning
Green Acres Subdivision.

the hereinafter described real es-
tate, at which hearing all inter-
ested parties were afforded an
opportunity to be heard for or

Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been com-
pleted and the City Manager has
certified the completion thereof to
the City Council and the City
Council has ascertained the cost
thereof and has determined that
$2,367.93 of the cost thereof shall
be assessed against the property
subject to assessment therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City Council to is-
sue bonds for the purpose of pro-
viding for the payment of the as-
sessed cost of said improvement

pursuant to such notice and all

This Bond is one of a series of

Wilbricht Lane Sanitary Sewer as
described in said Resolution, in said
City, which cost is payable by the
abutting and adjacent property
along said improvements and is
made by law a lien on all of said
property. It is payable only out of
the Special Assessment Fund No.
1232 created by the collection of
said special tax, and said fund can
be used for no other purpose.
It is hereby certified and recited
that all the acts, conditions and
things required to be done, pre-
cedent to and in issuing this series
of bonds, have been done, hap-
pened, and performed, in regular
and due form, as required by law
and said Resolution, and for the as-
sessment, collection and payment
hereon of said special tax, the full
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.

olution have on file with the City
Clerk objections to the amount of
the proposed assessments, they
shall be deemed to have waived all
objections thereto.
Said improvements shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared there-
fore by the City Engineer which
have been approved by the City
Council and are now on file with
the City Clerk. That the cost and
expense of making said improve-
ment will be assessed upon and
against all privately owned prop-

State of Iowa are burdened with
the need to extend, construct and
maintain streets in order to carry
increased vehicular traffic, and
WHEREAS, the Fifty-Ninth Gen-
eral Assembly has recognized the
street problem of municipalities by
passing legislation which increases
the allotment of Road Use Tax
Fund to cities of this State, and
WHEREAS, the officers of the
City of Dubuque, Iowa, because of
increased street funds available in
1962, will greatly extend and im-
prove the street system to the bene-
fit of all citizens, and
WHEREAS, the Iowa Chamber of
Commerce Executive Association
did organize the Urban Street and
Highway Research Association and
thereby did assist the General As-
sembly in its consideration of Road
Use Tax Fund legislation, and
WHEREAS, the Dubuque Cham-
ber of Commerce both by its as-
sociation with other Iowa Cham-
ber groups, and through its local
members, did extend great effort
and leadership in representing the
plight of Dubuque to the Legis-
lature:
NOW, THEREFORE, BE IT RE-
SOLVED, that the City Council of

citizens, express appreciation to

for annexation of said territory to
the City of Dubuque, Iowa, and
Whereas said territory is being
substantially built up; and
Whereas, the inhabitants of said
territory will be enabled to secure
the benefits of City government in
the way of police and fire protec-
tion if said territory is incorporat-
ed within the city limits of the
City of Dubuque, Iowa; and
Whereas, the inhabitants of said
territory will be enabled to se-
cure water, sewer, and other mu-
nicipal services if said territory is
incorporated within the city limits
of the City of Dubuque, Iowa; and
Whereas, Section 362.30 of the
1958 Code of Iowa, authorizes the
extension of city limits in situa-
tions of this character by the ad-
option of a resolution therefor;
and
Whereas, the future growth,
development and preservation of
the public health of the City of
Dubuque, Iowa, makes it impera-
tive that said territory be made a
part of the City of Dubuque, Iowa;

Wheeras, it is necessary to pro-
vide for the orderly and systematic

d. To install watermains in accord-

e. To install sanitary sewers in ac-

f. To install sanitary sewer and
water house laterals for each lot
from the main to behind the
property line;
g. To construct the foregoing im-
provements in accordance with
plans and specifications approved
by the City Manager and under
the inspection of the City
Engineer;
h. To maintain the street improve-
ments for a period of four (4)
years from the date of their ac-
ceptance and to maintain the
sanitary sewer and water mains
for a period of four (4) years
from the date of its acceptance;
i. To provide the foregoing con-
struction and maintenance at the
expense of the Owner;
j. To construct said improvements,
except sidewalks, prior to No-
vember 1, 1962;
k. To construct said sidewalks prior
to November 1, 1963 aad further
provide that Clarence J. Arlen
and Dolores Arlen as owners of
subdivision provide the perform-
ance of the foregoing conditions
by providing security in such
sum and with such sureties as
may be acceptable to the City
Manager;
Section 3. That in the event the
said Clarence J. Arlen and Dolores
Arlen shall fail to execute the ac-
ceptance and provide the security
provided for in Section 2 hereof
within forty-five (45) days from

provisions hereof shall be null and

shall not be effective.

on Lemon Street. Mr. Norton has
investigated the location.
The petitioners request a light
between 3106 and 3110 Lemon
Street. Since the light at this loca-
tion would be shaded by trees, it is
recommended that a new light be
placed at the northwest corner of
the intersection of Stoltz and
Lemon Streets.
Also, it is recommended that a
light, presently located on Stoltz
at the rear property line from
Lemon Street be moved to pole
number 207-906 located at the in-
tersection of an alley and Stoltz.

RESOLUTION NO. 188-61
Resolution Approving a Plat of
"Broadway Heights"
Whereas there has been filed
with the City Clerk correct plats
of:
The Subdivision of Lot 1 of Lot
8 of Sub. of Lot 3 of Mineral
Lot 319, and of the Subdivision
of Lot 1 of Lot 1 of Sub. of Lot
29 of John King's 2nd Addition,
and of the Subdivision of Lot A
of Lot 1 of Lot 8 of Sub. of Lot
3 of Mineral Lot 319, all in the
City of Dubuque, Iowa.
To be hereafter platted as:
Block 1 and Block 2 in "Broad-
way Heights" in the City of Du-
buque, Iowa,
By the Hartmann Construction
Company, an Iowa Corporation, as
owners thereof and said plat has
been examined by the City Plan
Commission and had its approval
endorsed thereon; and upon said
plat appears a street to be known
as "Ventura Drive" and a street to
be known as "Pleasant View
Drive" and easements for public
utilities which the owners upon
said plat have dedicated to the
public forever; and

Whereas said plat has been
found by the City Council to con-
form to the Statutes and Ordi-
nances rellating thereto, except
that the street has not been re-
duced to grade or paving, sewer,
water service or sidewalks in-
stalled therein;
NOW THEREFORE, BE IT RE-
SOLVED by the City Council of
the City of Dubuque, Iowa:
Section 1. That the dedication
of Ventura Drive from Broadway
Extension, northerly a distance of
447 feet, aad Pleasant View Drive
from Ventura Drive, easterly a dis-
tance of 64 feet, together with the
easements for public utilities, as
the same appear upon said plat
are hereby accepted;
Section 2. That the plat of the
subdivision of the first above de-
scribed real estate, which will be
hereafter known as Block 1 and
Block 2 in "Broadway Heights" in
the City of Dubuque, Iowa, be and
the same is hereby approved and
the Mayor and City Clerk are here-
by authorized and directed to en-
dorse the approval of the City of
Dubuque, upon said plat, providing
the owners of said property, here-
inbefore named, execute its writ-
ten acceptance hereto attached,
agreeing:
(A) To reduce Ventura Drive and
Pleasant View Drive to grade
as shown by the profiles sub-
mitted with the plat.
(B) To surface Ventura Drive from
Broadway Extension, norther-
ly adistance of 447 feet and
Pleasant View Drive from
Ventura Drive easterly a dis-
tance of 64 feet as the same
appeazs upon said plat, for a
width of 30 feet from curb
face to curb face with Port-
land Cement concrete surfac-
ing, with integral curb and
gutter, all in accordance with
City of Dubuque Standard
Standard Specifications for
Portland Cement Streets.
(C) To install concrete sidewalks
on both sides of Ventura Drive
and Pleasant View Drive, ex-
cept the easterly part of Ven-
tura Drive from Broadway Ex-
tension northerly a distance of
191.47 feet, in accordance with
City of Dubuque Standard
Specifications for Permanent
sidewalks;
(D) To install watermain in ac-
cordance with plans submitted
with the plat;
(E) To install storm and sanitary
sewers in accordance with
plans submitted with the plat:
(F) To install sanitary sewer house
laterals for Lot 1, Lot 2, Lot 6
and Lot 7 in Block 1 of said
subdivision and Lot 1 in Block
2 of said subdivision from the
main to the property line:
(G) To install water house laterals
for Lot 1, Lot 2, Lot 6 and Lot
7 in Block 1 of said subdivi-
sion and Lot 1 in Block 2 of
said subdivision from the main
to behind the property line;
(H) To construct the foregoing
improvements in accordance
with plans and specifications
approved by the City Manager
and under the inspection of
the City Engineer;
(I) To maintain the street improve-
ments for a period of four (4)
years from the date of their
acceptance and to maintain
the sanitary sewer and water
mains for a period of four (4)
years from the date of its
acceptance;
(J) To provide the foregoing con-
struction and maintenance at
the expense of the owners;
(K) To construct all of said im-
provements, except the side-
walks, prior to July 1, 1963
and to construct the sidewalks
prior to November 1, 1983;
And further provided that the
Hartmann Construction Company,
as owner of said Subdivision, se-
cures the performance of the fore-
going conditions by providing se-
curity in such sum and with such
sureties as may be acceptable to
the City Manager.
Section 3. That in the event the
said Hartmann Construction Com-
pany shall fail to execute the ac-
ceptance and provide the security
provided for in Section 2 hereof
within forty-five (45) days from the
date of this Resolution the provi-
sions hereof shall be null and void
and the acceptance of dedication
and approval of the plat shall not
be effective.

Mr. Ray Cooper, 357 Southern
Avenue, addressed the Council rel-
ative to storm water that comes
down from Tressa Street to the
rear of his property. This condi-
tion has been in existence for
some time. Mr. Cooper was in-
formed that some corrective meas-
ures have been taken by raising
the crown of Tressa street in or-
der to divert the flow of water
toward the catch basin in the side
of the street, rather than having
it all flow into the catch basin at
the foot of Tressa Street. If this
does not produce the desired ef-
fect the only other way to correct
the situation is to procure ease-
ments from property owners at
the foot Tressa Street and pipe
the water to a ravine away from
the Cooper property.
Councilman Schueller moved
that the problem be referred to the
City Manager and Engineering De-
partment. Seconded by Council-
man Schaller, Carried by the fol-
lowing vote:
