Mr. Ray Cooper, 357 Southern
Avenue, addressed the Council rel-
ative to storm water that comes
down from Tressa Street to the
rear of his property. This condi-
tion has been in existence for
some time. Mr. Cooper was in-
formed that some corrective meas-
ures have been taken by raising
the crown of Tressa street in or-
der to divert the flow of water
toward the catch basin in the side
of the street, rather than having
it all flow into the catch basin at
the foot of Tressa Street. If this
does not produce the desired ef-
fect the only other way to correct
the situation is to procure ease-
ments from property owners at
the foot Tressa Street and pipe
the water to a ravine away from
the Cooper property.
Councilman Schueller moved
that the problem be referred to the
City Manager and Engineering De-
partment. Seconded by Council-
man Schaller. Carried by the fol-
lowing vote:

Gentlemen:
At the request of the Board of
Directors of the Chamber of Com-
merce, its Tax Study Committee

is making an analysis of the 1962
Budget requests of the three tax-
ing bodies in the City.
Upon completion of our study
of the City of Dubuque 1962 pro-
posed budget submitted by the
City Manager, we submit for your
consideration the following obser-
vations which were approved by
our Board of Directors at their
regular meeting July 20, 1961.
1. The Liquor Fund Revenue es-
timated for 1962 shows a sub-
stantial decrease from the ac-
tual 1960 Revenue.
2. The Sanitation Sewer Rental
Fund estimated for 1962 shows
a decrease from the actual 1960
Revenue while the Water De-
partment Revenues are esti-
mated to increase. This is diffi-
cult to understand since they
are interlocked.
3. The Airport Revenues estimat-
ed for 1962 are substantially
less than the actual for 1960.
4. The Parking Meter Revenues
estimated for 1962 are substan-
tially less than the actual reve-
nue for 1960.
5. Although surplus monies in the
debt retirement funds have
been invested in bonds, the in-
terest on these bonds does not
appear as estimated income for
1962.
6. Although in the Kaufmann
Avenue Sewer Bond proceeds
there will be an estimated bal-
ance of $77,024.53 remaining
after the payment of all bills,
this sum does not appear in
the estimated unencumbered
balances to be available for re-
ducing the payments in the
Debt Service Fund or to be ex-
pended for any other purpose.
7. Although in the Sewage Dis-
posal Revenue Bond proceeds
there will be an estimated bal-
ance of $6,571.59 remaining af-
ter the payment of all bills,
this sum does not appear in
the estimated unencumbered
balances to be available for re-
ducing the payments in the
Debt Service Fund or to be
expended for any other pur-
pose.
8. The Program for Community
Improvement of April 1961,
shows the City's share of the
first year for the Urban Re-
newal Program to be $9,700.00
whereas the Budget estimates
an expenditure of $50,000.00.
These are not intended to be all
inclusive but are merely a few
examples of items in the budget
which have led to the conclusion
that the anticipated unencumbered
balances and non -tax revenues
have been materially underesti-
mated while the costs of proposed
expenditures have been over -esti-
mated. This appears to be done
with the objective stated on page
two of the "1962 Budget Recom-
mendation Summary," to recoup
the cash reserves depleted in 1960
and 1961.
The budget as presented admit-
tedly contemplates increasing the
uncommitted balance on hand at
the end of the fiscal year. The
committee agrees in principal to
the restoration of a reasonable
working balance. The committee
does not agree to the restoration
of a working balance in one year
of all losses to that balance which
have occurred over a period of two
years during which actual spend-
ing exceeded actual income.
By under - estimating income and
over - estimating expenditures, this
budget contemplates an actual in-
crease in balance at the close of
the year that could amount to as
much as $150,000.00.
This anticipated increase can
and should be re- evaluated by
more realistic figures which will
allow a more modest millage in-
crease or none at all.

Gentlemen:
In a recent statement to the
press, the Mayor commented on
our letter to the City Council con-
cerning the 1962 budget. We were

startled to see the Mayor dismiss
our observations with the com-
ment that we did not understand
the law of municipal financing. We
believe that perhaps we were not
sufficiently lucid in our presenta-
tion and, therefore, are submitting
this letter to amplify our previous
communication.
The Sanitation Sewer Rental
Fund does affect tax askings be-
cause a portion of it is available
to pay maintenance and operation
of interceptor mains and lift sta-
tions and to pay cost of trunk line
sewers. The proposed budget raises
the funds for these purposes
through taxation in the Sanitation
Fund. The appropriation of sewer
rental funds to pay part of this
cost would reduce the tax.
The balance from the Kaufmann
Avenue Sewer Bonds does affect
tax askings because it is available
to reduce the 1962 levy in the Debt
Service Fund for the payment of
interest and principal due on this
bond issue in 1962.
Since the budget law requires
that the estimated miscellaneous
non -tax revenues be subtracted
from the budget requirements to
arrive at the amount needed to
be raised by taxes, it is clear that
any under - estimation of any such
non -tax revenues that are avail-
able to the functional funds will
reflect a need for additional taxa-
tion.
State liquor profits, airport and
parking meter revenues were con-
ceded by the Mayor to be esti-
mated less than 1960 without any
reason for the decrease. These do

affect the tax askings since they
were under- estimated and included
in the miscellaneous revenues to-
tal.
We questioned the $50,000 esti-
mated expenditures for Urban Re-
newal as compared to the 1961 es-
timate of $9,700 for the first year
owing to the fact that already ap-
propriated in the 1962 budget un-
der Planning and Zoning are $6,300
for consultant and $7,000 for a
city planner and under the Build-
ing Commission's budget is $5,340
for a building inspector. These
total $18,640 and are all listed as
necessities in the Urban Renewal
Program. Since these are appropri-
ated, we were inclined to believe
the $50,000 was an over - estimation
for 1962 as these together would
total $68,640 for Urban Renewal
in 1962.
The budget is on its face techni-
cally illegal because the Manager
states in his recommendations to
the Council that it is designed with
the purpose of producing more rev-
enue than the city actually intends
to spend with the result of at-
taining his objective of increasing
the working cash balances. As pre-
viously stated, we do not object
to a reasonable working cash bal-
ance, but feel that the deficit re-
sulting from the past two years'
depletions should not be wholly
restored in one year.
Further, complying with the ex-
pressed wish of the Mayor, we
also wish to submit the following
specific suggestions for reducing
the 1962 tax askings all of which
are within the scope of Iowa law.
Transfer $10,000 from Road Use Tax Money to Bridge and
and Viaduct Construction since the 14th Street Overpass is
part of an arterial street. $ 10,000.00
Transfer at least $10,000 from Road Use Tax Money to
Snow Removal to pay a portion of this street maintenance
item on arterial streets. $ 10,000.00
Appropriate the uncommitted proceeds of the Kaufmann
Avenue Sewer Bond issue to payment of principal and in-
terest on this bond issue in 1962 and reduce the levy in the
Debt Service Fund accordingly. (See Iowa Code Sec. 76.4)$ 77,024.53
Transfer at least $10,000 from Sewer Rentals to Sanitation
Fund to pay fair share of operation, maintenance, repair
and new construction of interceptor mains and lift stations
not paid for by special assessment. $ 10,000.00
Reduce estimated expenditures in Urban Renewal by at
at least $20,000.00. $ 20,000.00
Increase estimated revenue from Liquor Fund to at least
the actual 1960 payments. $ 10,000.00
Total Reduction in Taxes $137,024.53

Mr. Frank Saunders requested
that the letters sent to the Council
by the Chamber of Commerce Tax
Study Committee be read in their
entirety. His request was granted.
Walter A. Pregler of 2966 Shiras
addressed the Council by compar-
ing salary of the newly appointed
Building Inspector to that of po-
licemen and firemen. Mr. Chas.
Spielman of 1785 Bennett Street
expressed himself by being against
additional taxes in any form. Mr.
Eldon Pfohl of 2591 Central Ave.
stated that he felt that the Cham-
ber of Commerce has done the
public a great service. He raised
the question, What is urban re-
newal; and stated that he definitely
was against it because it is not
being explained to the citizens.
He further stated that there are
seven areas in this town that
should be worked on but thought
by placing money in the budget
for urban renewal was the begin-
ning of incurring a great future
debt for the City. Mrs. Rob't Mc-
Cabe of 576 Springgreen Court
was definitely against the proposed
hiring of meter maids as provided
for in the budget and also that
Bunker Hill Golf Course should
be self supporting. Mr. Chas. Sitter•
ly of 555 Clinton Street expressed
alarm at the high taxes we are
required to pay, not only on a local
level, but made reference to the
over all tax picture in general. Mr.
R. F. Sefzik of 430 Clark Street
read a list of objections to various
phases of the budget. Mr. E. B.
Lyons of 80 Fremont Avenue ad-
dresed the Council by making in-
quiry as to Urban Renewal.
Mayor Schreiber stated that he
would like to see something insert-
ed into the budget covering a tree
planting program and Councilman
Schaller stressed the idea of giving
some consideration to a proposed
museum.
Councilman Schueller moved
that the tax askings in the budget
be reduced as follows: Street Fund
$47,000 (Street Repair and Grad-
ing Item No. 128); Street Fund -
Cancel Bridge and Viaduct Con-
struction appropriation $10,000; Re-
duce Capital Improvement in the
General Fund -Urban Renewal $20,-
000, making a total reduction of
$77,000. then add $3,000. to the
Street Fund, tree trimming, and
$2,500. to Recreation Museum ac-
count, making a net overall re-
duction in the 1962 budget of $74,-
000. Seconded by Councilman
Schaller. Carried by the following
vote:

Be it Ordained by the City
Council of the City of Dubuque:
That the unexpended cash bal-
ances on hand at the close of the
preceding fiscal year not estimat-
ed or appropriated in the original
budget approved by Resolution No.
167 -60 and Ordinance No. 1 -61 are
hereby allocated and appropriated
for payment of necessary expendi-
tures of City Government, in the
following amounts and for the pur-
poses as hereinafter set forth, and
to that end the appropriations and
allocations of funds are hereby

Street has been completed and the
City Manager has examined the
work and filed his certificate stat-
ing that the same has been com-
pleted according to the terms of the
contract, plans and specifications
and recommends its acceptance,

BE IT RESOLVED, by the City
Council of the City of Dubuque,
that the recommendation of the
City Manager be approved and that
said improvement be and the same
is hereby accepted.
BE IT FURTHER RESOLVED,
that the City Treasurer be and he

Whereas George Saffran as the

caused the same to be replotted as
"Barbara Subdivision," consisting
of eight lots, and has filed said
plat with the City Clerk, and
Whereas, said plat has been ex-

Zoning Commission and approved
by it; and
Whereas, said plat has been
found by the City Council to con-
form to the Statutes and Ordi-
nances relating thereto; and no new

Avenue from the existing sanitary
sewer in Shiras Avenue opposite
the easterly property line of Lot
1 of Lot 3 of Mineral Lot 310,
thence northwesterly in Shiras Ave-
nue to the Corporation Limits pur-
suant to Resolution No. 174 -61 and
notice to bidders published in a
newspaper published in said City
on July 10, 1961 and July 17, 1961;
and
WHEREAS, said sealed proposals
were opened and read on August 7,
1961, and July 17, 1961; and
WHEREAS, said sealed proposals
were opened and read on August 7,
1961, and it has been determined
that the bid of Fondell & Sons, Inc.
of Dubuque, Iowa in the amount of
$6,416.60 was the lowest bid for
the furnishing of all labor and ma-
terials and performing the work as
provided for in the plans and speci-
fications; now therefore,
BE IT RESOLVED by the City
Council of the City of Dubuque that
the contract for the above men-
tioned improvement be awarded to
Fondell & Sons, Inc. of Dubuque,
Iowa and the Manager be and he
is hereby directed to execute a con-
tract on behalf of the City of Du-
buque for the complete perform-
ance of said work.
BE IT FURTHER RESOLVED,
that upon the signing of said con-
tract and the approval of the con-
tractors bond the City Treasurer is
authorized and instructed to return
the bid deposits of the unsuccess-
ful bidders.

breach of conditions.
The purchaser has objected to
the reverter clause as has the lend-
ing agency financing the improve-
ment of the purchaser.

for your enactment which elimi-
nates the reverter clause.

WHEREAS, Resolution No. 163 -61
being a resolution authorizing con-
veyance of Lot Two (2) of Block
Eight (8) of River Front Subdivi-
sion No. 3 in the City of Dubuque,
Iowa, was passed, adopted and ap-
proved by the City Council of Du-
buque, Iowa, on the 3rd day of
July, 1961; and

WHEREAS, said resolution con-
tained condition therein with a
reverter clause in the event of
breach of conditions, which are not
acceptable to the purchaser of said
property and to the lending agency
financing said improvement.
NOW THEREFORE BE IT RE-
SOLVED by the City Council of
the City of Dubuque, Iowa:
Section 1. That Resolution No.
163 -61 passed, adopted and ap-
proved on the 3rd day of July, 1961,
be and the same is hereby de-
clared null and void and of no
further force and effect, and that
the attached Resolution be adopted
in lieu thereof.
Section 2. That the City Clerk be
and he is hereby authorized and di-
rected to record a certified copy

WHEREAS, Robert Ibinger of In-
dependence, Missouri doing busi-
ness as JANLIN PLASTICS COM-
PANY has offered to purchase Lot
2 of Block 8 of River Front Sub-
division No. 3 in the City of Du-
buque, Iowa, for the sum of Three
Thousand Five Hundred ($3,500.00)
Dollars per acre as a factory site;
and
WHEREAS, the Dock Board of
City of Dubuque, Iowa, has recom-
mended acceptance of said offer;
and
WHEREAS, pursuant to public
notice published in the Telegraph -
Herald on June 12, 1961, and on
June 19, 1961, a public hearing was
held in the City Council Chambers
on July 3, 1961 at 7:30 o'clock P.M.
at which time and place all elec-
tors of the City of Dubuque, Iowa,
and all other interested parties
were afforded an opportunity to
appear and be heard on the pro-
posal to dispose of said real es-
tate; and
WHEREAS, the City Council has
determined that the proposal to dis-
pose of said real estate is in the
best public interest.
NOW THEREFORE BE IT RE-
SOLVED by the City Council of
the City of Dubuque, Iowa:
Section 1. That all objections to
the proposal to dispose of said real
estate be and the same are hereby
overruled.
Section 2. That Lot 2 of Block 8
of River Front Subdivision No. 3 in
the City of Dubuque, Iowa, subject
to easements reserved to the City of
Dubuque for a storm sewer, be and
the same is hereby sold and con-
veyed to Robert Ibinger, doing bus-
iness as Janlin Plastics Company
of Independence, Missouri, for an
agreed purchase price of $3,206.00.
Section 3. Said conveyance is up-
on the expressed condition, how-
ever,
1) that the grantee construct a
factory building thereon in accord-
ance to the plans approved by the
Dubuque Board of Dock Commis-
sioners,
2) that said premises be used for
manufacturing purposes employing
a work force of 12 to 16 persons or
more,
3) that said premises shall not
be used for warehouse purposes,
except and unless it be incidental
to the manufacturing operations
conducted on said premises.
Section 4. That the Mayor and
City Clerk be and they are hereby
authorized and directed to execute
the deed of the City of Dubuque,
Iowa, conveying said property to
said grantee subject to said condi-
tions and deliver the same upon
the receipt of the sum of $3,206.00.
Section 5. That the City Clerk

directed to record a certified copy
of this Resolution in the office of

Section 3. That in the event that
the said Andrew J. Richard shall
fail to execute the acceptance and

On March 3, 1961, Eva M.
O'Rourke, 1651 White St., Dubuque,
Iowa, filed her claim for injuries
suffered as a result of a fall at
the east cross walk of the inter-
section of 18th & Central, on the
10th day of February, 1961, which
fall resulted from defective man-
hole cover and area surrounding
same.
I have made an investigation of
this matter and have conferred
with the claimant who has agreed
to accept the amount of $40.50,
same being the total amount of
her medical expenses, in full set-
tlement of her claim.
It is the recommendation of the
City Attorney that said offer be
accepted, and it is respectfully
recommended that the City Audi-
tor be instructed to draw a war-
rant payable to Eva M. O'Rourke
and Vincent O'Rourke, her hus-
band, in the amount of $40.50 and
to deliver the same upon the re-
ceipt of a duly executed release
by Eva M. O'Rourke and Vincent
O'Rourke, her husband.

1110 Iowa Street addressed the
Council inquiring why the cut in
gas rate is being made and also
if the citizens would be given any
further opportunity to have a hear-
ing on the Ordinance, before it is
finally adopted. Mr. Wilfred
Naught asked the question "Why
not give us a real cut in the gas
rate ?" He was of the opinion that
we should have lower rates than
Manchester and Dyersville and
any rate adopted here should be
in relation to towns west of here.
Both gentlemen were given assur-
ances that the Ordinance would be
subject to further hearings.

Whitsel, 177 Main Street, was
charged with having liquor for
beverage purposes of alcoholic
content greater than 4% by weight,
in violation of Section 26 of Ordi-
nance 9 -35.
On August 8, 1961, Mrs. Bessie
Whitsel entered a plea of guilty
in Police Court of the City of Du-
buque and was fined $100.00 for
violation of this ordinance.
I therefore recommend that the
Class "B" Beer Permit No. 8 is-
sued in the name of Mrs. Bessie
Whitsel be revoked.

at which location, beer was made
available to minors. I therefore
recommend that the Class "B"
Beer Permit No. 58 issued in the
name of Donald J. Meyer be re-
voked.
