AGREEMENT
This agreement entered into be-
tween the City of Dubuque, Iowa,
a municipal corporation, through
its Playground and Recreation
Commission, as first party, and
Dubuque Baseball, Incorporated,
an Iowa corporation, with its prin-
cipal place of business at Dubuque,
Iowa, as second party, WPfNESS-
ETH:
1. For and in consideration of
the agreements of second party,
hereinafter set forth, and the pay-
ment of the sum of One Dollar
($1.00) by second party to first
party, first party hereby grants
permission to second party to use
the Dubuque Municipal Athletic
Field located on Fourth Street Ex- '
tension in the City of Dubuque, I
Iowa, for the purpose of conduct- 'i
ing baseball exhibition contests
during the hours and on the dates i
set forth in the schedule attached
hereto, marked Exhibit "A" and I
by this reference made a part
hereof. '~,
2. In consideration of the fore-
going agreement by first party,
second party agrees as follows:
a. To pay the amount of One
Dollar ($1.00) to the first party
at the time of execution of this
agreement.
b. Second party to assume re-
sponsibility for and to pay for
the maintaining of the Municipal
Athletic Field during the period
from April 29, 1960 to Septem-
ber 15, 1980 inclusive, including
the playing Field, bleacher seats,
fences, backstop, the batting
cage, score board, parking lot
and concession stand, and the
club house and other buildings
on the premises; and second
party to assume and pay for
the replacement of all lamps for
the lighting system, to provide
all rest room supplies, to main-
tain and care for the water
heaters and to care for and
maintain all other property with-
in the confines of said park
and to pay for any repairs to
preserve said premises and to
restore the same to the condi-
tion said premises were in at
the time second party takes over
said premises.
c. The term of said lease shall
run from April 29, 1980 to Sep-
tember 15, 1960 inclusive.
d. Second party agrees to pro-
cure and deposit with the City
of Dubuque a policy of liability
insurance for coverages as fol-
lows:
1. Bodily injury liability -
$25,000 for each person and
$50,000 each accident; and
2. Property damage liability in
the amount of $5,000 each
accident, and the City of
Dubuque named as an addi-
tional insured.
e. Second party agrees to pay
For all electricity consumed dur-
ing the period of this lease.
f. Second party agrees to com-
ply with all applicable Statutes,
Ordinances and Regulations of
the United States, the State of
Iowa, and the City of Dubuque,
and agrees to allow no violation
of the laws of Iowa or Ordi-
nances of the City of Dubuque
upon the premises by partici-
pants or audience and to this
end agrees to employ such po-
lice for the preservation of the
peace and order as the circum-
stances may indicate.
g. Second party agrees to
make no change or alteration to
the grounds or structures or ap-
purtenances thereto without per-
mission in writing from the Play '..
ground and Recreation Commis-
sion.
h. Second party agrees to co-
operate with the Department of
Recreation in allowing the Boys'
Baseball Program the use of the
playing field, without prepara-
tion, during the hours of 1:00-
3:00 P.M. Monday through Fri-
day of each week for games as
scheduled by the Department of
Recreation.
i. Second party agrees to co-
operate with any and all other
leagues and teams desiring the
use of the athletic field and to
negotiate for the use of same un-
der conditions agreeable to both
of said parties.
j. Second party agrees that any
improvements or additions of a
fixed or permanent nature by it
made shall be and become the
property of the City of Dubuque,
Iowa upon the termination of
this lease.
k. Second party agrees and
understands that this lease shall
be automatically terminated
when second party ceases to play
baseball games regularly sched-
uled by an organized baseball
league.
I. Second party agrees that the
first party shall prepare the ath-
letic field for the opening of
the baseball season only and
that upon termination of this
lease second pazty agrees to re-
turn the premises in the same
condition in which it was turned
over to second party.
m. Second party shall be per-
mitted to use the equipment nec-
essary to prepare the playing
field which equipment shall be
returned by second party to first
party in good condition upon
the termination of this lease.

Gentlemen:
Our attention has been directed
to the street lighting conditions at
the Hawthorne Street end of Ker-
per Boulevard. The curb on Haw-
thorne and Kerper Boulevard
shows damage evidently because
cars have missed the entrance.
It is therefore recommended
that the following lights be in-
stalled:
1. That a standard 4000 lumen
street light be installed by In-
terstate Power at Hawthorne &
Kerper Boulevard.
2. That a light be installed at Peos-
ta and Hawthorne Street which
would also furnish light for the
flood control pumps directly
across from the swimming pool

3. That a light be placed oa the
park side across from the river-
front drive.

An examination of the lighting
conditions on the Brunswick alley
portion between Groveland and
Lowther Streets was made by the
Electrical Inspector relative to the
petition of Mrs. A. Eilers.
There seems to be a definite
need for lighting in this section
and the following installations are
recommended:
1. A new light at Goethe and
Brunswick alley.
2. A new light on Pole 207-83E
which would be midway between
Goethe and Groveland in the
Brunswick alley.
3. A light at Groveland and Bruns-
wick alley.
4.A light on Brunswick on a pole
located on the northwest corner.

Gentlemen:
The City has two "Slow Dip"
signs located on White Street,
south of East 7th Street which are
of no use at the present time be-
cause the 7th Street dip has been
repaired.
These signs can be used to ad-
vantage as warning signs for the
double dip at West 5th and Glen
Oak Streets. One sign could be
placed on the pole at 1265 West
5th and the other on a pole in
front of 1340 West 5th Street.
It is therefore recommended
that the "Slow Dip" signs on White
Street be removed and placed on
West 5th Street at the aforemen-
tioned locations.

Gentlemen:
The petition of Rodney H. Cross
and James R. Steger of West 32nd
Street relative to water running
onto their property from the sub-
division on the hill behind them,
was referred to the City Manager
for consultation with the devel-
oper.
In checking with the developer
we found that a turn around in
the development above the Cross
and Steger properties had not been
completed, which we think let a
considerable amount of water run
down onto the properties in ques-
tion.
The developer has now com-
pleted the turn around which
should give the desired relief.

Gentlemen:
The Water Department has in-
stalled the 8" water main re-
quested by the Ralston Purina
Company on the Industrial Island
off 12th street, which was ap-
proved by the City Council. The
line has been tested and is ready
for Purina to install their service
line and sprinkling line.
Some policy should be estab-
lished immediately as to who is
to pay for the installation of the
8" main in E. 9th street extension
from Pine street to 12th street
extension.
The Water Department is not in
a position to bear the entire cost
of this extension but could pos-
sibly assume the cost of installa-
tion of fire hydrants and the dif-
ferential in cost of pipe larger
than six inch.

Pursuant to the joint meeting of
May 25th, a visit was had with a
committee of the Playground and
Recreation Commission to again

determine their thoughts pertain-
ing to the relocation of the Raf-
ferty softball fields.
It is the belief of the Commis-
sion members that, irrespective of
the course of action to be followed
by the Sears Roebuck Company, it
is to the advantage of our com-
munity to relocate the softball
fields presently located at Rafferty
play field and to follow the pro-
cedure of obtaining and develop-
ing an area of sufficient size that
not only softball but other recrea-
tional activities as well can be
promoted. The approximately sev-
en acres at Rafferty will accom-
modate three softball fields, with
no opportunity for providing ad-
ditional recreational facilities.
The members of the Playground
and Recreation Commission fur-
ther adhere to the belief that the
total of $284,359.00 as paid by the
Sears Roebuck Company for the
Rafferty property should be set
up in a trust and agency fund to
be used by the Commission for the
development of a recreational pro-
gram for the benefit of our com-
munity, with thought granted at
this time to the following:
1. The purchase of an adequate
site.
2. The developing of an least
four lighted softball fields.
3. The developing of a baseball
field for general use by our
amateur teams.
4. The installation of six lighted
tennis courts.
5. The building of four lighted
handball courts.
6. The development of eight
lighted horseshoe courts.
In conjunction with the above
project, thought can be granted
to the erection of an indoor ice
rink, along with a new baseball
park, with the understanding these
projects must be approved by the
voters of Dubuque, but can be in-
cluded on the site purchased with
the funds as received from the
Sears Roebuck Company.
The members of the Playground
and Recreation Commission ex-
press thanks and appreciation to
the Council for their interest and
cooperation in the furthering of
the recreation movement and ask
your continued help in aiding iu

On May 23, 1960 you directed
that I give you an opinion con-
cerning the use of so much of the
funds derived from the operation
of parking meters for the purpose
of up-dating the traffic and park-
ing report of Evanston Associates.
Section 390.5.2 provides that the
funds received from the operation
of parking meters shall be used
for the payment of cost of main-
tenance and repair of meters, the
collection of meter taxes, and the
enforcement of traffic laws in the
parking meter district.
The up-dating of said survey
and report would be for the pur-
pose of more adequately enforcing
the traffic laws in the parking
meter district and therefore would
be permissible, and would not be
in violation of Ordinance No. 32-
56, which Ordinance covers the
bond indebtedness of the City for
the acquisition of off street park-
ing facilities.

WHEREAS, proposed plans, spec-
ifications, form of contract, plat
and schedule have been duly pre-
pared and approved by the City
Council of the City of Dubuque and
are now on file in the office of the
City Clerk showing among other
things the following:
1. Assessment Limits.
2. The streets to be improved.
3. The width of such improve-
ment.
4. Each lot proposed to be as-
sessed together with a valua-
tion fixed by the council.
5. An estimate of the cost of the
proposed improvement, stat-
ing the same for each differ-
ent type of construction and
kind of material to be used.
6. In each case the amount
thereof which is estimated to
be assessed against each lot,
for the City of Dubuque, 1960
Street Lighting Project No. 1
in Mississippi Heights Subdivi-
sion No. 2 on River Ridge and
Mississippi View Drive.
BE IT THEREFORE RESOLVED
that the City Council on its own
motion or upon petition of proper-
ty owners, deems it advisable and
necessary for the public welfare
to make the herein mentioned im-
provement, and unless property
owners at the time of the final
consideration of this proposed
resolution have on file with the
City Clerk objections to the
amount of the proposed assess-
ments, they shall be deemed to
have waived all objections thereto.
' Said improvement shall be con-
structed and done in accordance
with the plans and specifications
which have been prepared therefor
by the City Engineer which have
been approved by the City Council
and are now on file with the City
Clerk. That the cost and expense
of making said improvement will
be assessed upon and against all
privately dwned property lying
within assessable distance provided
by law and in an amount not to
exceed the amount provided by
law, property will be assessed
whether the same abuts thereon or
is adjacent thereto according to
area and in proportion to the
special benefits conferred thereby,
and any deficiency shall be paid
out of the street fund. Bonds shall
be issued and sold in anticipation
of deferred payments of assess-
ments when a contract has been
performed and accepted and the
proceeds thereof used to pay the
contractor. The railway portion of
any street ar assessment district
shall be assessed to and paid by the
railway company.

Gentlemen:
J. F. Stampfer Company has
made a request to the City with
reference to establishing a no
parking area in front of their new-
ly completed side entrance.
On West 8th Street between
Main and the first alley east of
Main, five meters are presently
in operation. These metered spaces
have proven to be a source of
congestion when it comes to back-
ing into one of the spaces. Usu-
ally it backs traffic into the
intersection which results in con-
fusion and danger to pedestrians.
Another consideration concerns
available access to the building
in case of disaster.
It is therefore recommended
that the first three meters west
of the alley between Main and
Iowa Streets on the north side
of West 8th Street be removed
and this space be made a "no
parking zone".

At the request of Mrs. Weber
of 1100 Rhomberg Avenue, an in-
vestigation was made relative to
parking on Farley Street between
Rhomberg and Garfield Avenues.
Farley Street is only 22 feet
wide and when parking exists on
both sides of the street, the pass-
ing of other vehicles is made
quite hazardous.
The abutting property owner to
the Weber property, namely Mrs.
Piiz, on the same side of the
street, is aware of the proposed
parking restriction of removing

of Farley Street.
It is recommended that Sched-
ule VI of Ordinance No. 33-49 be
amended by adding thereto a new
section as follows:

lizing what a parking problem
McCormick Street has been, the
Traffic Department has recom-
mended that the portion in the
petition between Finley and Ben-
nett Streets be excluded because
of a small business that may seri-
ously be affected by a "no parking
zone".
It is recommended that Schedule
VI of Ordinance 33-49 be amended
by adding a new section thereto
as follows:
"89. The westerly side of Mc-
Cormick Street from Finley Street
to University Avenue."

Gentlemen:
Pursuant to your instruction,
the Engineering Department has
investigated the possible develop-
ment of North View Drive and
the proposed subdivision of Lot
1-1-1-1-1 of Willy Place with the
intent of determining the loca-
tion, right of way, and cost to
the City of Dubuque for access I
to Lot No. 1 of the N.E. '/4 of
said Section 15 (also known as
Lot No. 1 of Mineral Lot 383)
and the abutting property.
A statement was obtained from
the owners of Lot 9-block 5 of
Scenic View Heights, Lot 1-1-1-1-1
of Willy Place, and Lot 2 of 1
of St. Mary's Place to inform the
City of their intentions for grant-
ing the necessary right of way
for street purposes. Copies of the
owners' statements and conditions
of granting the right of ways are
attached. A brief summary of
these statements are as follows:
1. Lot 1-1-1-1-1 of Willy Place
-The owner will cooperate in
the location of Streets A, B, &
C (as shown on the attached
play) to concur with the in-
tended subdivision of said lot
and contingent to the develop-
ment of abutting property with
the provisions as listed in his
statement.
2. Lot 9-Block 5 of Scenic View
Heights-The owner submitted
his statement with an alternate
proposal. The initial statement
declared that he will dedicate
the necessary right of way for
North View Drive with the un-
derstanding that the improve-
ments for street purposes,
excluding sewer and water
would be assessable to the re-
maining property. The alternate
proposal listed that he would
grant the necessary right of
way for the full width of the
street (60 feet) by donating
thirty foot of the right of way
and assuming the cost of the
street improvements by assess-
ment for one half of the cost
of improvement abutting his
property, and the City purchase
the remaining thirty foot right
of way for $1.00 per square foot.
3. Lot No. 2 of 1 of St. Mary's
Place-The owner will donate
the thirty foot strip of land for
North View Drive with provis-
ions that none of the cost for
the improvement be assessed to
the owner, inclusive of curb
and gutter, surfacing, sidewalks,
sewer or water.
The cost to the City of Dubuque
would be approximately as fol-
lows:
North View Drive-from Kane
Street to a point approximately
840 feet north.
By accepting the proposal of
the owner of Lot 2 of 1 of St.
Mary's Place, and the initial pro-
posal of the owner of Lot No. 9
Block 5 of Scenic View Heights,
the cast to the City for this
section of North View Drive
would be approximately $7,-
250.00 which is the estimated
assessed cost for Lot No. 2 of
1 of St. Mary's Place. This
amount does not include pre-
liminary grading of the street.
By accepting the alternate pro-
posal of the owner of Lot No.
9 block 5 of Scenic View Heights,
the cost to the City would be
$12,180.00.
Lot 1-1-1-1-1 of Willy Place
The street construction included
in this lot would be covered
by the owner as per the devel-
opment of the subdivision with
the exception of the "Street B"
as shown on the attached plat;
and as stated by the owner,
he will dedicate the necessary
right of way for said street.
There should be no cost to the
City for street purposes in the
said lot.
In conclusion, with the state-
ments from the owners of Lot 9-
Block 5 of Scenic View Heights:
Lot 1-1-1-1-1 of Willy Place: and
Lot 2 of 1 of St. Mary's Place
accessability can be obtained to
serve Lot No. 1 of the N.E. ~/4 of
the S.E. r/4 of said Section 15
(also known as Lot No. 1 of Min-
i eral Lot 383) and abutting pcop-
erty. These statements of purpose
far obtaining the right of way
for North View Drive and Lot

of Wahlert High School relative
to the City's inquiry about the
availability of a strip of ground
for street purposes off the easterly
boundry of the School property.
You have furnished a plat of the
area and the strip is described
thereon as Lot 2 of 1 of "St.
Mary's Place", City of Dubuque,
Iowa.
We are authorized to advise you
that Wahlert High School, as a
gesture of good will toward its
neighbors and the City and in the
interest of the common good, will
make a gift of the above described
strip of land to the City for street
purposes upon the following con-
ditions:
1. Wahlert High School and its
property will not be subject to
any assessment for the proposed
street improvement, including
curb and gutter, surfacing, side-
walks, sewer, water or other
improvements.
2. The School will be afforded one
cut in west curbing of the pro-
posed street, at a place to be
mutually agreed upon, to afford
access to the street in lieu of
the existing access to Kane
street that will be lost.
3. Grade of proposed street and
storm sewer, if any, will be so
designed so that water will not
drain on to School property.
4. The School reserves the right
to remove the stone that it has
applied on this area for use on
other school property. Thirty
days prior notice should be giv-
en by the City of its intention
to commence grading of the
street.
5. If the City desires to acquire
the property upon the foregoing
terms, please advise within
ninety (90) days from date
hereof.
H, in the future, the School
would desire to make additional
curb cuts into the proposed street
or to utilize any of the sewer
or water lines, it would be agree-
able to paying an equitable portion
to the cost of the improvement so
utilized, based upon a useful life
to be agreed upon at the time
of the conveyance.

Subdivision has been reserved
for street purposes to serve Lot
No. 1-1-1-1-1 of Willy Place.
2. Street "A" as shown on the at-
tached plat will be extended in
a northerly direction to serve
the intended subdivision. The

the State of Iowa are not equitably
represented in the General Assem-
bly in proportion to their popula-
tion, and
WHEREAS, the General Assem-
bly of the State of Iowa has not
completely reapportioned itself
since the year 1904, and
WHEREAS, the question of call-
ing a Constitutional Convention
will be submitted to the voters
at the general election to be held
in November of the year 1960, and
WHEREAS, the City Council of
the City of Dubuque, Iowa, is of
the opinion that the most effec-
tive way to secure legislative re-
apportionment is by Constitution-
al Convention.

Now that we have reached a
decision in our search for a City
Manager, I find it necessary to
submit my resignation from this
council. Personal reasons are the
cause for this action.
Since I played a full part in
the selection of Mr. Gilbert Chave-
nelle for the office, this resigna-
tion will not be effective until
Mr. Chavenelle is sworn in and
assumes the duties of the office.
In concluding this letter of res-
ignation, Icall upon the members
of this council and the citizens
of Dubuque to look to the future
with the faith that is necessary
to keep this a truly great city.

this matter and it is the recom-
mendation of the City Attorney

On June 6, 1980, James Kraus-
man of 2068 Chaney Road, Du-
buque, Iowa, at the intersection
of Nevada and University, struck
a manhole cover laying in the
street and caused damage to his
car in the amount of $77.35.
I have made an investigation of
this matter and it is my opinion
that said claim should be paid.
It is the recommendation of the
City Attorney that the claim of
Mr. James Krausman in the
amount of $77.35 be paid and that
the City Auditor be instructed to
issue a warrant payable to James
Krausman and Beverly Krausman,
his wife, in the amount of $77.35
and to deliver the same upon the
receipt of a duly executed re-
lease.
