stated that service thereof had
been duly made and that this meet-
ing is an adjourned meeting of the

Dear Mr. Frommelt:
Your letter of June 13th was ad-
dressed to Associated Consultants
since it was under that name that
we made the traffic and parking
study of Dubuque's downtown area
in 1955. Since that time we have
combined our practice with that of
Mr. Aschman, a city planner of
broad experience, and now operate
under the name carried by this
letterhead. We are now practicing
in the fields of city planning, traf-
fic engineering, parking, highway
design and related fields.

In your letter, amplified by our
subsequent telephone conversation,
you asked me to suggest a proced-
ure for re-examining today's needs
in downtown Dubuque. I would
suggest that we serve you Wrough
a two-phase project with a possi-
bility that the second phase may
not have to be undertaken at this
time.
The first phase might be defined
as "a general review and appraisal
of the needs of downtown Du-
buque." The purposes of this re-
view would be as follows:
a. To appraise, from a planning
viewpoint, the form of the
downtown area, the nature of
business and commercial activ-
ity comprising the area, and
the feasibility of physical mod-
ernization to strengthen the
area and to contribute to its
further economic development.
b. To conduct research in the field
of parking and traffic circula-
tion, to determine what changes
have taken place since 1955.
c. To recommend any essential
changes in the system of traf-
fic circulation and control in
or near the downtown area.
d. To determine how existing
parking facilities are used, and
to recommend steps, if possi-
ble, for obtaining better use
from these facilities.
e. To leazn whether the demand
for parking today and in the
years immediately ahead, ex-
ceeds the capacity of the sys-
tem of existing parking facil-
ities enough to warrant a ma-
jor expansion of the parking
system.
If we find during this appraisal
that there evidently is a need for
a significant expansion of the
parking capacity, we then would
recommend for your consideration,
that the study be broadened im-
mediately to include the second
phase. This phase would include
the research necessary to measure
parking demands, locate new park-
ing facilities, determine their costs,
and recommend a financing pro-
gram. It would be anticipated that
this work would be done in suf-
ficient detail to provide the fac-
tual basis for a revenue bond is-
sue.
To make the review suggested
as the first phase, we would send
a staff engineer to Dubuque to
carry on the necessary research
and investigations. H he were to
find no evidence of need for a
great expansion of the parking sys-
tem, he would prepare a report
detailing the results of his study
and return to Dubuque to discuss
the situation with city officials
and interested businessmen. H no
more than Phase One is required,
I estimate that our fee would run
between $2,700.00 and $3,100.00.
If the study during this first
phase disclosed rather clearly the
need for a significant investment
in additional parking facilities,
we would recommend that we pro-
ceed immediately into Phase Two
prior to the completion of Phase
One, in order that staff and field
personnel could be efficiently util-
ized. In this case our report would
cover both phases. I would esti-
mate now that our fee for Phase
Two would be in the range of
$3,000.00 to $3,500.00, though a
more precise estimate could be
made by our staff engineer at the
time he recommends the additional
work.
Does this approach to your prob-
lem appear to be the proper one
for Dubuque? Do you have an al-
ternate approach that you would
like to suggest? We would wel-
come an opportunity of serving
Dubuque again and we would like
to design a service which best
meets your needs.

Mr. Al Baumhover of 2620 Penn-
sylvania Avenue addressed Ithe
Council by objecting to the condi-
tion of the premises owned by the
Cash Screw Works. He claimed
that the area was never cleaned
up despite the fact that the owners
have been urged to do so for some-
time.
Mayor Takos moved that the re-
port of the Building Commissioner
be returned to him and the City
Solicitor for further investigation
and report and also that the Coun-
cil view the grounds. Seconded by
Councilman Schueller. Carried by
the following vote:

Gentlemen:
On February 26, 1960, M. C. Se-
wall filed a claim against the City
of Dubuque for damage to the
right rear tail light to his vehicle
as same was being towed during
snow removal operations and said
claim is in the amount of $14.54.
I have made an investigation of
this matter and it is my opinion
that said claim should be paid.
I therefore recommend to the
City Council that the City Auditor
be instructed to issue a warrant in
the amount of $14.54 made pay-
able to M. C. Sewall and Mary Se-
wall, his wife, and to deliver the
same upon receipt of a duly exe-
cuted release.

by the City Council of the City of

1. That the City Council deems it
advisable and necessary for the
public welfare to make said im-
provement.
2. Said improvement shall be con-
structed and done in accord-
ance with said plans and speci-
fications of the total cost of
making said improvement shall
be assessed against privately
owned property, but shall be
paid out of the proceeds of
General Obligation Bonds to be
issued for the purpose.
3. On the 5th day of July 1900 at
7:30 P.M, the City Council will
meet in the City Council Cham-
bers in the City Hall, in the
City of Dubuque, Iowa, and
hear property owners and in-
terested parties for and against
the improvement, its costs, or
the forms of contracts.
4. The City Clerk is hereby au-
thorized and directed to cause
public notice of the date, time
and place of hearing to be giv-
en by publication once each
week for two consecutive
weeks, the first of which pub-
lication shall be not less than
two weeks nor more than four
weeks prior to date of said
hearing.

Resolution providing for the is-
suance of Boulevard Light Improve-
ment bonds for the purpose of pro-
viding for the payment of the as-
sessed cost of improving Central
Avenue from 12th street to 16th
street.
Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$24,349.83 Dollars of the cost there-
of shall be assessed against the
property subject to assessment
therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City Council to issue
bonds for the purpose of provid-
ing for the payment of the assessed
cost of said improvement and a
public hearing has been held, pur-
suant to such notice and all objec-
tions made thereto have been con-
sidered and determined;
NOW THEREFORE BE IT RE-
SOLVED by the City Council of the
City of Dubuque:
1. That to provide for the pay-
ment of the assessed cost of the
City of Dubuque 1959 Boulevard
Lighting Project No. H, Section
1-Central Avenue from the North
Property Line of 12th Street to the
South Property Line of 16th Street
there shall be issued Boulevard
Light Improvement bonds in the
amount of $24,349.83 in anticipa-
tion of the deferred payment of
assessments levied for such im-
provement.
2. Such bonds shall be called
Boulevard Light Improvement
bonds; and shall bear the date of
August 5, 1960; and shall be num-
bered consecutively; and they shall
be numbered, divided into series,
and be in such denominations and
for such maturity dates as are
shown in the following table:

This bond is issued by the City of

lution No. 159-60 the provisions of
which are incorporated by refer-
ence into this Bond.
This Bond is one of a series of
49 bonds, 48 for $500.00 numbered
from 3041 to 3088 both inclusive,
and one for $439.83 numbered 3089,
all of like tenor and date, and is-
sued for the purpose of the im-
provement of City of Dubuque 1959
Boulevard Lighting Project No. D,
Section 1 as described in said Reso-
lution, in said City, which cost is
payable by the abutting and adja-
cent property along said improve-
ments and is made by law a lien
on all of said property. It is pay-
able only out of the Special As-
sessment Fund No. 1225 created
by the collection of said special
tax, and said fund can be used for
no other purpose.
It is hereby certified and recited
that all the acts, conditions and
things required to be done, pre-
cedent to and in issuing this series
of bonds, have been done, hap-
pened, and performed, in regular
and due form, as required by law
and said Resolution, and for the
assessment, collection and pay-
ment hereon of said special tax,
the full faith and diligence of said
City of Dubuque are hereby ir-
revocably pledged.

Gentlemen:
On the 28th of June 1960, Mr.
and Mrs. Otto Donath filed a pur-
ported affidavit in setting out in
effect that by reason of alleged
property rights in certain property
located in Lenox Addition, which
has been the subject for struggle
for some twelve years on their
part to retain same and that they
have been refused help by•the
Dubuque City Council and other
agencies and persons, and that
they will not be responsible for
anything that may happen and that
further, if anything physically or
mentally happens to either one
o£ them or their children, they
will hold the Dubuque City Coua-
cil and others responsible. This
purported affivadit has been re-
ferred to the City Solicitor for
investigation and report.
I have made an investigation of
this matter and find that the
City Council has no jurisdiction in
this matter as it concerns a prop-
erty dispute between separate per-
sons, and is not the subject for
relief by the Dubuque City Coun-
cil.
From an examination of said
instrument filed by Mr. and Mrs.
Donath it appears to be in the
nature of a threat and therefore,

in my opinion, violates Rule 23 of
Resolution No. 250-51 known as the
Rules of Order for the City Coun-
cil of the City of Dubuque as it
constitutes a reflection injurious
to the harmony of the Council by
indulging in personalities and it is
therefore out of order.
It is the recommendation of the
City Attorney that the instrument
filed by Mr. and Mrs. Otto Donath
on June 28, 1960 and bearing date
of June 25, 1960 be ruled out of
order.
Your attention is directed to the
fact that Mr. Otto R. Donath is
an employee of the City of Du-
buque, employed in the Sanitation
Department.

Gentlemen:
There seems to be a continual
jam of traffic on Shiras when mo-
torists coming from Eagle Point
Park attempt to enter Rhomberg
Avenue. Vision of the motorists
seems to be obscured as the re-
sult of trees directly in front of
Fecker's Grocery Store and also
the trees in front of the Eichman
apartments.
Under normal conditions, we
would not recommend the removal
of healthy trees. However, in the
interest of public safety, this is a
case where the removal of trees
on Rhomberg Avenue near the
intersection of Shiras and Rhom-
berg should be seriously consider-
ed.
It is therefore recommended that
the first two trees southwest of
Shiras on the west side of Rhom-
berg, and also the first three trees
northwest of Shiras on the west
side of Rhomberg should be re-
moved.

A problem of traffic congestion
exists on Althauser Avenue due
to the narrowness of the street
in the vicinity of Jefferson Junior
High School.
This situation could become
acute in the event of a fire in
the area especially during school
hours. It is believed that this
situation should be remedied be-
fore any serious mishaps occur.
It is therefore recommended
that parking be prohibited on the
west side of Althauser from Merz
to Eagle Street.
It is further recommended that
Schedule VI of Ordinance 33-49
be amended by adding Section 90
thereto as follows:

Gentlemen:
There has been a great increase
in traffic moving through the in-
tersection of Twenty-Second and
Central Avenue. Northbound mo-
torists faciag the light on Central
Avenue with the intention of turn-
ing off from Central to Kaufmann
Avenue is the cause of creating
considerable delay for the motor-
ists waiting behind the turners,
backing the traffic up to 21st
Street.
In connection with the new pav-
ing program on Central Avenue,
the State of Iowa, in cooperation
with the City, has set aside 35
feet of parking areas near each
intersection within the project. At
the southeast corner of Central
the existing yellow zone of seven-
teen feet will be extended to
thirty-five feet. The Traffic De-
partment feels that this 35 feet
yellow zone should be extended
to a fifty-foot zone in the hope
it will relieve the traffic conges-
tion at this corner.
It is therefore recommended
that a no parking zone be created
on the east side of Central from
the southerly property line of
East 22nd Street for a distance
of fifty feet.

Since West 8th Avenue was
made cone-way street (eastbound),
and the various bus stops were
re-arranged on the same street,
there has been a bottle-neck cre-
ated at the southwest corner of
the intersection for motorists
traveling east towards Main
Street.
The Traffic Department and of-
ficials of the Interstate Power Co.
have been working to eliminate
as much congestion as possible
at 8th and Main, both as to bus
travel, motorists, and pedestrians.

The hazard at 8th Street does not
seem to be as great for the local
motorist as it does for the out
of town motorist.
Attached is a diagram showing
the elimination of a bus stop and
the creation of a new one, and
also showing the elimination of
two one-half hour meters in Front
of Matt's Cafe. The removal of
the meters was discussed with the
proprietor of Matt's Cafe, who
stated it was of no concern to
him.
It is therefore recommended
that:
1. The two one-half hour meters
on the south side of West 8th
Avenue west of Iowa be re-
moved.
2. The space now occupied by
these two meters be made a
"No Parking" Zone for use as
a bus stop.

limits of the established street,
and any other facilities or ob-
structions which interfere. with
the construction of the project.
e. To remove or cause to be re-
moved any other encroachment
or obstruction within t h e
rights-of-way of the. streets or
highways covered by the pro-
ject and to prevent any future
encroachment or obstructions
therein.
3. Since this project may be partly
financed with Federal Aid funds,
the grant of which requires that
the Iowa Highway Commission,
comply with Federal laws and
regulations with respect thereto,
the Council agrees to take such
action as may be necessary to
comply with such Federal laws
and regulations.
4. The Council further agrees that
within the limits of the proposed
surfacing and for a distance not
less than depth of trench outside
thereof where the City or utility
companies may be digging
ditches prior to the proposed sur-
facing, the city will require that
all backfilling and compaction of
ditches shall be made in accord-
ance with the Standard Specifica-
tions of the Iowa State Highway
Commission, Current Series, the
work to be subject to the ap-
proval of the Iowa State Highway
Commission.
5. The Council consents that during
construction of the project, traf•
fic may be detoured over the
following described streets:
Provided that the Iowa State
Highway Commission will erect
signs as necessary to direct traf-
fic on said streets, and will re-
move them when the detour is
discontinued. It is understood
that the Iowa State Highway
Commission will not surface,
maintain or provide access to
properties abutting on or in the
near vicinity of the street being
constructed on this project.
6. Within 90 days after passing this
resolution, the Council will pass
and make effective ordinances
prohibiting parking of any na~
ture.

7. Within 90 days after passing this
resolution, the Council will by
ordinance establish access con-
trol under the provisions of
Chapter 306A, Code of 1958 pro-
hibiting ingress or egress to,
from or across said facility to or
from abutting lands, except at
such designated points at which
access may be permitted by the
Iowa State Highway Commission,
upon such terms and conditions
as may be specified from time to
time. Access rights will not be
destroyed except by purchase or
appropriate condemnation pro-
ceedings thereof. However, such
access rights shall be subject to
such regulations in the interest
of public welfare and safety as
the City and Iowa State Highway
Commission may agree upon, pro-
vided that no additional access
ways or change of use shall be
permitted by the City without
the consent and approval of the
Iowa State Highway Commission.
The Council will also authorize
the Iowa State Highway Commis-
sion to acquire right-of-way and
access rights by purchase or con-
demnation, as shown on the plans
for Project Number U-UG305
(12), and more specifically des-
cribed as follows:

The County authorizes the High-
way Commission to construct and
preserve, within the limits of the
right-of-way, such physical bar-
riers as the Highway Commission
deems necessary to prohibit or
eliminate unlawful means of ac-
cess to, or use of, the highway
facility by pedestrian or vehicu-
laz traffic, or for any other pur-
pose.
8. The Council agrees with the Iowa
State Highway Commission that
the Storm Sewer listed as fol-
lows and as shown on the pro-
ject plans are a necessary part of
the improvement, that said Com-
mission shall include in its con-
struction contract the construc-
tion of the Storm Sewer, and up-
on completion of the work, pur-
suant to the provision of Chap-
ter 313, Code of Iowa 1958, the
Council will reimburse the Com-
mission. For the actual cost of
the storm sewer as shown by the
project records of the Iowa State
Highway Commission.

Changes in storm sewer found
necessary during construction may
increase or decrease the cost. The
City shall reimburse the Highway
Commission for the actual cost ex-
cept that reimbursement shall be
limited to a 20% increase over the
contract price of the storm sewer.
It is understood that the sewer
referred to is a storm sewer and
not a sanitary sewer and the Iowa
State Highway Commission shall
have no future responsibility for
maintenance or operation of the
same, and the City assumes and un
dertakes such responsibility includ~
ing the responsibility of providing
by proper ordinance for the making
of any necessary connection to sail
storm sewer and the prevention o1
its use as a sanitary sewer.
9. Within 90 days after passing this
resolution, the Council will pass
an ordinance establishing speed
limits as specified below and
making such speed limits effec-
tive upon completion of project:
55 M.P.H. from Sta. 2404100 to
Sta. 2415+00.
45 M.P.H. from Sta. 2415+00 to
Sta. 2436100.
35 M.P.H. from Sta. 2436+00 to
Sta. 2446+50.
10. Upon completion of the project,
the Council agrees that-
(a) Upon receipt from the High-
way Commission of a list of
driveways and entrances pro-
vided for access under the
above improvement specified
as Project Number U-UG-305
(12), said list will be recorded
under a supplemental ordi-
nance.
(b) Signing affecting directional
traffic movements will be er-
ected, or changed only after
approval is secured from the
Highway Commission.
(c) Any changes in the physical
features of the project or
changes in speed limits agreed
to under paragraph 9 will be
authorized only after approval
is secured from the Highway
Commission.
(d) Traffic signals at the follow-
ing locations when replaced
shall conform to the uniform
standards of the Iowa State
Highway Commission a n d
more specifically the type of
equipment, location and opera-
tion shall be described below:
(11) Council will notify by mail all
abutting property owners of:
a. the parking and access control
restrictions that are being es-
tablished on this section of pri-
mary road extension.
b. the regulation regarding the
moving and/or adjustment of
private sewer, water, gas and
electric service.

Gentlemen:
Reference is made to the 1961
Airport Budget in the amount of
$57,800.00 as approved by the Air-
port Commission and presented to
the Council.
It is felt by the Airport Com-
mission these funds are necessary
in order for the Commission to
meet their responsibility in provid-
ing Dubuque with a modern up to
date Airport.
We understand the Council has
requested a $19,000.00 item under
Airport Development be deleted
which would cover a 1'/z" asphalt
lift for the Airport Access road,
parking lots and apron. We also
understand a $500.00 deletion was
requested by the Council under ma-
terials and supplies along with a
$1,489.00 deletion on salaries.
It is felt by the Airport Commis-
sion that the 1961 Airport Budget
be approved as submitted by the
Airport Commission. The Commis-
sion would like to call attention
that the 1961 Airport Budget is
under 1960 Budget with the same
tax asking in 1961 as in 1960.
