Gentlemen:
You have referred to your staff,
the petition of Mrs. Anna Foulks
requesting that a "na parking
zone" be not established in front
of her property at 486 West Fourth
Street.
Some years ago, no parking was
established on both sides of the
Street at the west end in order
to permit vehicles room to make
the turn at the deadend. During
the course of time, due to weather
and replacement of curbing, the
yellow paint on the curbs has
disappeazed.
Since the turn around space is
necessary, I am instructing that
the Traffic Department paint a
thirty-two foot yellow zone on the
north curb extending easterly from
the elevator property, and a ten
foot zone extending in the same
manner on the south curb.
The ten foot strip on the south
side of the street will cause a mini-
mum interference with pazking in
front of 486 West Fourth Street.

letter from the Dubuque Safety
Council dated September 8th,
which expressed concern over the
confusion resulting from left turn-
ing movements at the intersection

Street. The letter also suggested
that stop signs be posted at all the
approaches to the intersection of
University Avenue and Asbury
Street.
The Traffic Department has been
instructed to go ahead and paint
channelization markings at the
intersection of Grandview Avenue
and Dodge Street. I would like to
point out that this intersection will
be entirely reconstructed by the
State when Highway No. 20 is re-
built. I hope this occurs within
the coming year.
As for the intersection of As-
bury and University, an ordinance
has been recently passed making
this intersection a three way stop
intersection, and since that time,
the Traffic Department has been
preparing stop signs which indicate
that it is a three way stop. The
stop signs are now in place.

Gentlemen:
For the past two ears, the ord-
inance covering stop intersections,
has required that northbound
Grandview Avenue traffic stop at
Clarke Drive. At the time the ord-
inance was enacted, this mazked
the end of Grandview Avenue as
a boulevard. Since then, construc-
tion of new North Grandview pav-
ing calls for added control for
traffic southbound on Grandview
into Clarke Drive.
A temporary stop sign has al-
ready been erected at this point in
order to~ stop the southbound
Grandview Avenue traffic, and the
ordinance should be modified ac-
cordingly. Therefore, it is recom-
mended that the intersection,

North Grandview Avenue and
Clarke Drive, be added to Section
F of Schedule III of Ordinance
33-49.

CONTRACT
This agreement entered into be-
tween the City of Dubuque, Iowa
as first party and Joseph C. Hefel,
3510 Central Avenue, Dubuque,
Iowa as second party, WITNESS-
ETH:
Whereas first party operates a
municipal sewer system; and
Whereas the second party is the
owner of Lots 63, 64, and 65, all
in Linehan Park Addition in Du-
buque Township, Dubuque County,
Iowa, which is located outside
of the corporate lindts of the City
of Dubuque and which shall here-
after be referred to as "the premis-
ies served"; and
Whereas, second party desires
to have an eight inch (8") sanitary
sewer extended from the present
terminus of the municipal sewer
system in the area to the premises
served and to pay a sewer service
charge to the City; and
Whereas first party is agreeable
to provide said service under the
following terms and conditions:
NOW, THEREFORE, it is agreed
between the parties hereto as fol-
lows:
1. Second party agrees to obtain
the necessary consents of all Gov-
ernmental bodies and all necessary
easements for the laying of said
sewer;
2. Upon such consents and ease-
ments having been obtained, sec-
ond party agrees to construct said
eight inch (8") sanitary sewer along
the line shown on the plat sub-
mitted with second party's applica-
tion to the City of Dubuque for
such service and in accordance
with plans approved by the City
Manager and under the supervision
of the City Manager; second party
agrees to pay the entire cost of
such construction, including all
necessary engineering and inspec-
tion charges, permit fees, street
excavation and restoration chazges
and all other expenses necessary or
incidental to such construction;
3. Upon the completion of such
construction said eight inch (8")
sanitary sewer shall become the
property of first pazty;
4. Upon completion of such con-
struction first pazty agrees to pro-
vide sanitary sewer service to the
premises served through said eight
inch (8") sanitary sewer under the
regulations established by Ordin-
ances No. 35-57 and No. 39-57, or
any subsequent amendments there-
to and at the price of 150% of the
charge set in Ordinance 35,57, or
any amendments thereto, for per-
sons, firms or corporations out-
side the City of Dubuque;
5. Second party covenants and
agrees to use his best efforts to
have the premises served by said
sewer annexed to the City of Du-
buque and in the event second
pazty shall directly or indirectly
resist such annexation, first party
may, at its option, terminate this
agreement. Ea the event termina-
tion is effected by first party un-
der the rights established in this
pazagraph, first party shall have
the further rights, at its option
to take up and remove the said
eight inch (8") sanitary sewer and
retain the same as its own prop-
erty. Any waiver by first party
for any breach of this pazagraph
shall not constitute a waiver of
any subsequent breach hereof;
6. In the event the premises
served are annexed to the City of
Dubuque this Agreement shall be
terminated and second party shall
thereafter be served under the
same conditions and at the same
rates and charges as other users
located within the City of Du-
buque, but the said eight inch
(8") sanitary sewer shall remain
the property of the first party.
7. In the event property abutting
said eight inch (8") sanitary sewer
is granted permission by first party
to connect thereto, first party
agrees to exact and collect a con-
nection charge for the benefit of
second party. Said connection
charge shall be determined by

An Ordinance Granting Rich-
ard C. Henschel the right to
construct a Sanitary Sewer in
an Alley from Sullivan Street
to Lorimer Street and Prov[d-
ing the Terms and Conditions
thereof.
BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Richard C. Hen-
schel be and he is hereby granted
the right to construct an eight
inch (8") sanitary sewer In the
first alley north of Southern Ave-
nue from the existing sanitary
sewer in Sullivan Street to Lot
No. 40 of South Avenue Addition
in accordance with the plans as
approved by the City Engineer
upon the following terms and con-
ditions:
(a) That grantee agrees to con-
struct said sewer within one yea[
from the date of the adoption of
this Ordinance and PaY the entire
cost thereof including the cost oP
restoring the surface of the etr¢et.
(b) That said sewer eha71 be con-
structed in accordance with plane
approved by the State Department
of Health and the City Manager
and under the eupervlsion and
direction of the CRy Manager and
City Engineer.
(c) That grantee will enter into
a contract for the construction of
said sewer with a qualified con-
tractor which contract among other
things will contain a clause requir-
ing the contractor to obtain all
necessary permits required by the
City of Dubuque or any other gov-
ernmental agency, a clause obligat-
ing the contractor and hie bonds-
men to keep said sewer in good re-
pair fora period of not leas than
two years from the date oY the ac-
ceptance of the work, and a clause
requiring the contractor to furnish
a surety bond with the City of Du
buque named as one of the obli-
gees, guaranteeing the faithful
performance of said contract.
(d) That upon completion oY said
sewer and the acceptance of the
same by the City Council said sew-
er shall become a public sewer un-
der the exclusive charge and con-
trol of the City of Dubuque and its
free use as such shall not be inter-
fered with by grantee or his auc-
cesaors or assigns.
Section 2. That the authority
granted herein shall terminate on
November 1, 1960 unless the terms
and conditions of this Ordinance
are accepted in writing by the
grantee prior to that date.
Section 3. After said sewer has
been completed and the total coat
the
the construction of Said sewer, in-
cluding engineering fees and the
cost oP restonng the surface of the
street. Thereafter, any person or
persons desiring to connect with
said sewer except the grantee,
herein, shall brat apply to the City
Manager for permission to so do
and such permission shall be grant-
ed upon condition that the appii-
cant pay to the City Treasurer, for
the account o[ the grantee herein,
a connection charge in an amount
which will be fixed by Resolution
oY the City Council at the time
of the acceptance oP the said
sewer. However, such connection
charge shall not be exacted Yor
any extension of said sewer made
by the City of Dubuque or its
permtteee.
Section 4. This Ordinance shall
be in full force and effect from
and after its final passage, adop-
tion and publication as provided
by law.

jections were raised as to making
Devon Drive a through street. Most
of the group were of the opinion
that it would throw too much traf-
fic on the street especially now
that the new super market is being
built in the area. The request was
made that the entrances to Devon
Drive be resurveyed. The sugges-
tion was made that the Council try
to find ways to create or establish
streets that would run parallel to
Devon Drive, toward Highway No.
20, in the hope of relieving Devon
Drive of some of the traffic. The
group was advised by the Council
that the City planner would be in
town very shortly at which time
the suggestion would be given to
him.

The lowest bid submitted was
entered by Hennessey Brothers,
Inc., of Cedar Rapids, Iowa. Their
combined bid for the project in-
clusive of Bid Sections No. 1 and
2 was $764,130.00 at 3.70% under
the engineer's estimate; and their
combined bid for Bid Sections No.
1 and No. 2 Alternate was $799,-
217.75 at 4.72% under the esti-
mate. Atabulation of all bids sub-
mitted is attached.
I therefore recommend that the
contract for the City of Dubuque
1960 Storm Sewer Project No. 1,
Bid Section No, 1-Kaufmann Ave-

Resolution initiating proceedings
for the issuance of $970,000 Sewer
Bonds of the City of Dubuque,
Iowa.
WHEREAS the City of Dubuque,
in the County of Dubuque, and
State o£ Iowa, heretofore pursuant
to and in strict compliance with
all laws applicable, lawfully or-
dered and provided for building
and constructing certain sewers
in and for said City, the cost
whereof, to the amount of $970,000,
is to be paid by said City as a
whole by the issuance of bonds;
and
WHEREAS it is necessary and
advisable that provisions be made
for the issuance of such bonds
and notice and hearing on the ini-
tiation of proceedings fm• such is-
suance has heretofore been given
in manner and form required by
Section 23.12 of the Code of Iowa,
and no petition nor protest has
been filed, and no petition has
been filed asking that an election
be called on the question of is-
suing said bonds.
NOW THEREFORE, Be It Re-

Gentlemen:
You referred to your staff a let-
ter from Mr. Whelan of 951 White
Street requesting that the City not
use salt during the coming winter
season. Street Commissioner Allen
has contacted several municipal-
ities with regard to the use of salt
on streets. The report is as fol-
lows:
~'~ Sioux City-reports the normal
use of about 1700 tons and a
last winter use of 3000 tons of
salt plus 60 tons of calcium
chloride.
Des Moines-reports a policy to
use on all major streets and a
mixture of salt and sand on resi-
dential streets. 65 carloads of
salt was used during the last
season.
Waterloo-reports the use of 511
tons of salt in their past year
snow removal program.
Davenport-reports the use of ap-
proximately 785 tons of salt per
year.
Madison, Wisconsin-reports that
a clear salt application is used
on 145 miles of primary streets.
It is the opinion of the staff that
the use of salt in Dubuque's snow
removal program produces bene-
fits which far exceed the damage
that may result. We believe that
the saving of life, personal injury
and the reduction of property dam-
age, which can be directly traced
to our salt program, far outweighs
the small loss incurred because of
its corrosive effects.
Further, we believe that there
is no economic or effective substi-
tute for salt in the removal of
ice and snow from our streets.
It is with these ideas in mind
that we intend to continue using
salt during the coming winter sea-
son.

AN ORDINANCE authorizing the
issuance of $970,000 Sewer Bonds
and providing for the levy of
taxes to pay the same.
WHEREAS the City oY Dubuque,
in the County of Dubuque, and
State of Iowa, heretofore, pursuant
to and in strict compliance with
all ]awe applicabie, lawfupy order-
ed and provided for building and
constructing sewers in and for said
City, the cost whereof, to the
amount of Nine Hundred Seventy
Thousand Dollars ($970,000) is to
be paid by said City as a whole by
the issuance oI bonds; and
WHEREAS it is necessary and
advisable that provisions be made
Yor the issuance of such bonds at
this time and notice and hearing
on the initiation of proceedings
for such issuance has heretofore
been given in manner and form
required by Chapter 23 and 408A
of the Code of Iowa, and no peti-
tion nor protest has been tiled,
and no petition has been filed ask-
ing that the question of issuing
said bonds be submitted to the
voters of said City;
NOW, THEREFORE, Be I[ Or-
dained by the City Council of
the City of Dubuque, Iowa, as
follows:
SECTION 1. That pursuant to
and as authorized by Section 356. Z2
oY the Code of Iowa, there shall
he and there is hereby ordered
issued the negotiable Sewer Bonds
of said City of Dubuque in the
principal amount of $970,000, said
bonds to be nine hundred seventy
in number, numbered consecutively
from 1 to 970, both numbers in-
cluded, and to be dated November
1, 1960. That the bonds of said issue
numbered 1 to 225, inclusive, shall
bear interest from the date thereof
ontil paid at the rate of Two and
three-quarters per cent (2s/4%) per
annum, the bonds oY said issue
numbered 226 to 620, inclusive,
shall bear interest from the date
thereof until paid at the rate of
Three per cent (3%) per annum,
and the bonds of said issue num-
bered 621 to 970, inclusive, shall
bear interest from the date thereof
until paid at the rate of Three and
one-eighth per cent (36fi%) per
annum, all of such interest being
payable May 1, 1961, and semi-
annually thereafter on the first
days of November and May in each
year. Said bonds shall be signed
by the Mayor and attested by the
City Clerk and the seal of said
City affixed, and be registered as
to issuance by the City Treasurer
and a certificate of such registra-
tion endoreed thereon. Interest on
said bonds shall be evidenced by
coupons thereto attached and ma-
tunng on [he severe] days when
such interest matures, which cou-
pons shall be executed with the
facsimile signatures of said offi-
cials, and said Mayor and said
City Clerk by the execution of said
bonds, shall adopt as and for their
proper signatures their respective
facsimile signatures appearing on
said coupons. Both principal and
interest of said bonds shall be
payable in lawful money of the
United States of America at the
office of the City Treasurer in and
of the Clty of Dubuque, Iowa. Said
bonds shall be of the denomination
of $1,000 each, and shall become
due and payable in their numeri-
cal order $46,000 on November I
of each of the years 1961 to 1966,
inclusive, and $50,000 on November

Mr. Vincent Jestice of 1451 Mc-
Poland Avenue addressed the
Council by stating that the extra
lots next to his home are practic-
ally worthless because of water
flooding them from neighboring
streets. The curb in front of the
lots seems to be too low and the
water goes over the top of the
catch basin during a heavy storm.
