Gentlemen:
The attached petition from Earl
Brahm and others requesting the
installation of street lights in
Green Acres Subdivision was re-
ferred to the City Manager and
Electrical Inspector for investiga-
tion and report.
Upon investigation it was de-
termined that street lights should
be installed at the following loca-
tions and as shown on the attach-
ed plat.
1. Intersection of Maplewood Court
and Oak Crest Drive.
2. Intersection of Maplewod Court
and Timber Line.
3. On Timber Line between 2918
and 2926.

the Planning & Zoning Commission.
The plans for this development
are indefinite and adjacent to this
small area in a very large single
family development now ynder
way. The Commission believes this
would not enhance the area as pre-
sently planned and therefore re-
commends denial of the petition.

Gentlemen:
The petition of Ralph Berendes,
3015 Shiras Avenue requesting ap-
proval of plat of Lots 171 and 172
Julien Addition in which the width
of McKinley Street would be re-
duced from sixty-six feet to forty
feet has been considered by the
Planning & Zoning Commission.
An examination of this street
may some day serve would indicate
that the street width should not
be reduced. Our present subdivi-
sion ordinance provides a width of
fifty feet for a minor street and
McKinley Street should serve a
large area.
Therefore the Planning & Zon-
ing Commission recommends de-
nial of the petition.

This petition requests zoning the

tral Avenue above Twentieth
Street to Business Zone. The front
half of these lots are presently
zoned as Business Area.
The Planning & Zoning Com-
mission recommends that Lots 1,
2 and 3 L. H. Langworthys and the
north one half of Lot 1 of the Sub-

that part of Lot 676 not included

Gentlemen:
The petition of Elvin Schwartz
Assoc. Inc. and Rainbo Oil Co. pre-
sented by Clewell, Cooney and
Fuerste requesting vacation of
Vine Street has been considered
by the Planning & Zoning Com-
mission.
Vine Street is located on the
Hillside and several public util-
ities are located therein, namely
sewer, water and gas mains, over-
head wires and a set of steps from
Dodge Street to Burns Street.
The Commission upon investiga-
tion finds that people in this area
do use the steps for a short cut
but due to the condition of said
steps the amount required to re-
place or place same in a suitable
and safe condition would in their
opinion be prohibitive. Therefore
e- the Commission recommends grant-
e- ing of the petition and retaining
the easement rights.

Art Broadman, all residents of
Burns street addressed the Council
urging them to reconstruct the
steps on Vine street because they
are used quite often. Mrs. Hy
Gassman of Oak street stated that
the steps is the only way to get
down to Ddge in the event of a
snowstorm. Attorney Fuerste re-
presenting the Rainbo Oil Co.
stated that as it stands the steps
represent quite a liability hazard
to the city.
Petition of Mrs. Walter Kane
et al objecting to vacating and
closing of the public steps connect-
ing Dodge and Burns street for
several reasons, presented and
read.
Mayor Takos moved that the
action on the petition be deferred
and referred to the City Manager
for a comprehensive report. Se-

Mrs. Mildred Knaus, 2403 Staf-
ford Ave., Dubuque, Iowa, filed
a claim against the City of Dubu-
que for injuries suffered as a re-
sult o£ a fall at 1385 Alta Vista in
the City o£ Dubuque, Iowa, which
injury occured on July 15, 1960.
I have made an investigation of
this matter and I have conferred
with Nlrs. Knaus and she has made
an offer of settlement in the a-
mount of $250.00 and it is the re-
commendation of the City Attorney
that said offer be accepted and
that the City Auditor be instructed
to draw a warrant payable to Mil-
dred Knaus and William Knaus.

upon the receipt of a duly executed
release.

Section 1. This Ordinance shall
be deemed an exercise of the police
power of the City under Chapter
148, Acts of the Fifty-Sixth Gen-
eral Assembly of the State of
Iowa, for the preservation of the
public peace, health, safety and
[he promotion oY the general wel-
fare.
Section 2. Definition. For the
purpose of this ordinance, a con-
trolled-access facility shall mean
controlled right of easement of ac-
cess, light, air or view by reason
of the fact that their property
abuts upon such controlled-access
facility or for any other reason.
Section 3. Unlawful use of con-
trolled-access facilities. I[ shall
be unlawful for any person to:
(A) Drive a vehicle over, upon
or across any curb, central divid-
ing section or other separation or
dividing line on such contro]Ied-
accese [acuities.
(B) Make a left turn or a semi-
circular or U-turn except through
an opening provided for that pur-
pose in the dividing curb section,
separation or line.
(C) Drive any vehicle except 1n
the proper lane provided for that
purpose and in the proper direc-
tion, and [o the right of the cen-
tral dividing curb, separation aec-
tlon or line.
(D) Drive any vehtcle into the
controlled-access facility from a
local aervioe road except through
an opening provided for that pur_
pose in the dividing curb or di-
viding section or dividing nne
which separates such service road
from the controlled-access facility
property.
Section 4. Establishment. There

Whereas the contract heretofore
entered into by the City of Dubu-
que, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion thereof
to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$19,642.77 Dollars of the cost
therof shall be assessed against
the property subject to assessment
therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City Council to issue
bonds for the purpose of providing
for the payment of the assessed
cost of said improvement and a
public hearing has been held, pur-
suant to such notice and all ob-
jections made thereto have been
considered and determined;

This bond is one of a series of
40 bonds, 39 for $500.00 numbered
from 3090 to 3128 both inclusive,

all of like tenor and date, and is-
sued for the purpose of construct-
ing the City of Dubuque-1959 Con-
crete Curb & Gutter Project No. 1
and Section 3 as described in said
Resolution, in said City, which
cost is payable by the abutting
and adjacent property along said
improvements and is made by law
a lien on all of said property. It is
payable only out of the Special
Assessment Fund No. 1226 created
by the collection of said special
tax, and said fund can be used for
no other purpose.
It is hereby certified and recited
that all the acts, conditions and
things required to be done, pre•
cedent to and in issuing this series
of bonds, have been done, happen-
ed, and performed, in regular and
due form, as required by law and
said Resolution, and for the as-
sessment, collection and payment
hereon of said special tax, the full
faith and diligence of said City of
Dubuque are hereby invocably
pledged.

This Bond is one of a series of
89 bonds, 88 for $500.00 numbered
from 3155 to 3242 both inclusive,
and one for $97.41 numbered 3243,
all of like tenor and date, and is-
sued for the purpose of construct-
ing the City of Dubuque-1960 Hot
Mix-Hot Laid Asphaltic Concrete
Paving Project No. 1 Section 1 and
Section 2 as described in said
Resolution, in said City, which cost
is payable by the abutting and ad-
jacent property along said im-
provements and is made by law a
lien on all of said property. It is
payable only out of the Special
Assessment Fund No. 1228 created '.
by the collection of said special
tax, and said fund can be used for
no other purpose.
It is hereby certified and recited
that all of the acts, conditions and
things required to be done, prece-
dent to and in issuing this series of
bonds, have been done, happened,
and performed, in regular and due
form, as required by law and said
Resolution, and for the assessment,
collection and payment hereon of
special tax, the full faith and dili-
gence of said City of Dubuque are
hereby irrevocably pledged.

which will be hereafter known as

hereby authorized and directed to
endorse the approval of the City
of Dubuque upon said plat, pro

written acceptance hereto attached

A. To reduce Victoria Street to

You have referred to me a peti-
tion of John Langel and eleven
others requesting the installation
of a street light at 1495 Wood
Street.
This request for additional street
lighting has been investigated by
your staff, and I do not believe
that the conditions in this location
warrant the moving or installing
of additional lighting.
On a neighborhood street, it is
the City's intention to properly
light the intersections and space
the intervening lights approximate-

ly 300 to 400 feet apart. This ar-
rangement provides the necessary
safety. The street light on Wood
Street northerly to Loras only
slightly exceeds this distance.
Therefore, I do not recommend
the installation of a street light as

Associates. This report is phase
one of a study authorized by your
body. Further study will depend
on the evaluation of the recom-
mendations of this report.

Mr. Saul Greenstein addressed
the Council by making inquiry
when the survey was taken. He
was advised that the survey was
taken from August 15th to 20th.
Dfr. Hartig and Mr. Saunders, re-
presentatives of the Chamber were
of the opinion that it was an unfair
week to conduct a parking survey
because it was the same week of
the County Fair. Mr. Keneipp the
representative of Barton-Aschman
Associates was quick to prove that
the week chosen was as good as
any from the overall figures avail-
able. Since 1955 the normal maxi-
mum number of cars parking down-
town has increased by 8.2% or an
average of about 1.6% per pear.
Meanwhile the average increase in
City population has (teen 1.4% and
io city retail sales, 1.3%. Passenger
car registrations have increased
3.3% in Dubuque County. In an
appraisal of the parking system
there are a total of 4,520 parking
spaces in the central business dis-
trict, or 35% more spaces than
existed in 1955. The largest in-
crease, over the past five years,
has occurred in customer lots, 314
spaces, and in private lots 341
spaces. Off street lot spaces have
been enlarged by 349 spaces since
1955.
Attorney F. H. Becker, repre-
senting the merchants on Central
Avenue, presented a petition cal-
ling for more parking along Cen-
tral, north of 12th street, and
stated that the Central Avenue
merchants feel a great need for
off-street parking and that there
has not been enough attention
given to the area. Mr. Ed. Turn-
quist was of the opinion that ad-
ditional off-street parking lots
should be provided for the Cen-
tral Avenue group and the money
to be taken out of parking meter
funds, because the report shows
that over the past five years the
volume of traffic using Main street
has decreased by 14% to 21%
while the volume on Central and
White has increased by over 50%.
In summation of the discussion
Mr. Keneipp was able to prove
that the survey shows that park-
ing supply and demand are gener-
ally balanced now. However busi-
ness activity in Downtown Dubuque
has been growing at a steady pace
and the demand for additional pa-
tron parking can be expected to
increase. The opportunity exists
to create a prestige parking system
that can stimulate further business
activity and help the city to retain
its favorable position as a shop-
ping center for the tri-state re-
gion.
Councilman Schaller moved that
the survey submitted by Bazton-
Aschman Associates and the peti-
lions be referred to the Council
for further consideration and re-

Gentlemen:
You have referred to your staff
a letter from the Dubuque Safety
Council, dated June 10th, which
indicated the following:
1. 200 school children crossing
daily at East 24th and Jackson
Street creating a pedestrian ha-
zard.
2. A request for no parking on
the south side of East 4th
Street between Central Avenue
and the railroad tracks because
of a trucking hazard.
3. The possibility of a dangerous
fence at East 16th Street be-
tween Elm Street and railroad
tracks.
4. The hazard of north-bound traf-
fic entering into south-bound
traffic at 4th Street on Main
Street.
I report on the suggestions of the
Dubuque Safety Council in the
order given above.
First, over the past two or three
years, your staff has received a
number of petitions regarding the
intersection of East 24th and Jack-
son Streets. The previous counts
have shown that the number of
children crossing the intersection
was very low, and further that the
traffic during school periods was
not heavy forcing the children to
wait on the corner for extended
periods before crossing this street.
As a result of this most recent
petition, the school rolls of Sacred
Heart School were checked, and
it was noted that only 34 students
lived in the area west of Jackson
Street within an area bounded by
lines running westerly from about
approximately 2350 Jackson and
2550 Jackson. These might be pre-
sumed to use the 24th Street inter-
section. Further, at the time of in-
vestigating the Safety Council peti-
tion, your staff received verbal
notice from some of the residents
east of Jackson and north of 25th
Street that they intended to peti-
tion for school crossing lights at
25th and Jackson Streets. It has
been noted that Fulton School on
Central Avenue has assigned a
school patrol girl to assist students
crossing at 25th and Jackson Street.
The latest count on the number of
students assisted by this girl is
13 students.
in view of the current investi-
gation, it is not recommended that
school crossing lights be placed at
the intersection of 24th and Jack-
son Street.
S.^cend, in regard to the trucking
hazard on East 4th Street near the
railroad tracks, this is an area of
some confusion, but the accident
ex_nerierce is practically non-exist-
ent. In view of this extreme short-
age of parking spaces available,
and the need for parking space in
this area, it is not believed feasible
that parking be removed from the
south side of East 4th Street be-
tween Central Avenue and t?ie
railroad tracks. Therefore, it is
recommended that the petition be
denied.
~'~ Third, the fence on the soutih
~~ side of East 18th Street between
~ Elm Street and the railroad tracks
has been investigated by both the
Traffic Division and the Building
Inspector. The fence at 16th and
