Claim by Carissa YoungTHE CITY OF DUB E Masterpiece on the Mississippi BARRY LIND~ CITY ATTORISE To: DATE: RE: Claimant MEMORANDUM Mayor\ Roy D. Buol and Members of the City Council March 19, 2008 Claim Against the City of Dubuque by Carissa Young Date of Claim Carissa Young 03/05/08 Date of Loss 02/03/07 Nature of Claim Vehicle Damage This is a claim in which the claimant alleges that as she was driving near 1015 Cedar Cross Road, she struck several potholes in the road and damaged her 2001 Honda Civic. According to the report of John Klostermann, Street & Sewer Maintenance Supervisor, Public Works records show that the City of Dubuque Public Works Department first received notice of the defect on Cedar Cross Road on the day of the incident, February 3, 2008. Records also indicate that a crew was dispatched and the pothole was patched that day. It is therefore the recommendation of John Klostermann to deny this claim of $349.00 as filed due to the lack of prior notice, and because the action taken by the Public Works Department to repair the defect was done so in a timely manner. The City Attorney's Office concurs with this recommendation. BAL:tIs cc: Michael C.
