Mayor Kintzinger read the call
and stated that this is the. regular
monthly meeting of the City Coun-
cil for the purpose of acting upon
such business as may properly come
before the meeting.
Proof of Publication, certified to
by the publisher, of notice of pub-
lic hearing on the Budget Estimate
of Expuenditures for the year be-
ginning January 1, 1960 and end-
ing December 31, 1960, presented
and read.
No written objections were filed
and no objectors were present in
the Council Chamber at the time
set for the public hearing.

Whereas, the Council of the City
of Dubuque caused to be prepared
and published as provided by law
the Budget Estimate of Expendi-
tures for the fiscal year beginning
January 1,1960 and ending Decem-
ber 31, 1960 and the hearing upon
said Budget Estimate was fixed for
the 3rd day of Auguste, 1959, at
7:30 P.M. at the Council Chamber
of the City Hall; and
Whereas, this being the time, and
place for said hearing said Budget
Estimate was taken up for final
consideration by the Council and
all parties in interest have been
given the opportunity to be heard
for or against said Budget Estimate,
It Is Therefore Resolved by the
City Council for the City of Du-
buque, Iowa:
That the Budget Estimate of Ex-
penditures for the fiscal year be-

ginning January 1, 1960 and end-
ing December 31, 1960, heretofore
prepared and published be and the
same is hereby finally approved
and adopted and the Mayor and
Clerk are directed to certify the
same to the County Auditor of Du•
buque County, Iowa, together with
the verified proof of publication
and the notice of hearing upon
said Budget Estimate.
Be It Further Resolved that the
taxes required to be collected in
the year be and the same are here-
by levied in the various funds in
the amounts in said Budget Esti-
mate.

of the Dubuque Historical Society,

Mrs. Abby McDonald Dancer ad-
dressed the Council by stating that
the Dubuque Historical Society is
behind the project of restoring
the shot tower one hundred per
cent, and that they are apprecia-
tive of what has been done by the
Council by appropriating $5000
for restoration of the shot tower
in the 1960 budget. Mr. H. P. Mil-
ler addressed the Council by urg•
ing the restoration of the shot
tower as a representative of the
vacation land committee of the
Chamber of Commerce. Mrs. Don
Glasell also spoke in favor of the
restoration of the shot tower as a
representative and president of
the Dubuque Women's Club. The
following resolution was presented
by the Dubuque County Historical
Society.
RESOLUTION
BE IT RESOLVED by the Du•
buque County Historical Society
that:
WHEREAS, the Board of Dock
Commissioners of the City of Du-
buque, Iowa, has seen fit to in-
clude in its proposed budget for
the ensuing fiscal year an appro-
priation for the restoration of the
Dubuque Shot Tower; and
WHEREAS, said proposal will
be before the City Council of the
City of Dubuque for action on Au-
gust 3, 1959; and
WHEREAS, the Dubuque Shot
Tower is a monument of general
and local historical importance,
and a prime tourist attraction in
the Dubuque vacationland area;
BE IT RESOLVED that the Du-
buque County Historical Society
hereby publicly commends the
said Board of Dock Commissioners
for its foresight and civic con-
sciousness in recommending an ap-
propriation for the restoration of
the Dubuque Shot Tower; and
BE IT RESOLVED that the Du-
buque Historical Society earnestly
prays and strongly urges the City
Council of the City of Dubuque,
Iowa, to approve said appropria-
tion for the restoration of the Du-

ed; and that the President of this
Society appear before the said
City Council on August 3, 1959,

Gentlemen:
The Ninth Street or Central Fire
Station is the only one of our fire
stations that has not been remodel-

ed or reconditioned during the past
several years. The reason for this
is that it would be a major con•
struction project and it was felt
that an architect should be retained
to advise the City as to the best
methods of making this station
more adaptable to modern opera-
tions.
Because of this, there has been
very little maintenance work on the
Ninth Street station in the last few
years and it is felt that the ap•
paratus room should be made ad-
aptable to modern equipment and
that the quarters on the second
floor should be redecorated and
some minor changes made. Also the
exterior of the building should be
tuck•pointed and there are some
windows and window frames that
should be replaced.
In order that the City may be
able to study the problems and
what should be done about them,
I recommend that the Manager be
authorized to eater into an agree-
ment with the architectural firm of
Durrant & Bergquist to make a
study of this station and make a
report back to the City within the
shortest possible time so that the
Council can make a decision as to
whether to proceed with the re•
modeling of this station and asking
the voters to approve a bond issue
for this work or to budget over
a number of years.

Gentlemen:
The petition of Key Gate Cen•
ter requesting permission to eon•
struct sanitary sewers and water
mains to serve Lots 1, 8 and 3 of
Key Gate Center, and connect to
the City Water System was re•
ferred to the City Manager.
Adequate sanitary sewer facili•
ties are available from the Catfish
Creek Sewer and adequate capac-
ity is available at the Sewage
Treatment Plant to take care of
this area. Connections can be
made at several location which
can be determined jointly by the
City sad Key Gate Center owners.
Water facilities are available in
adequate quantities to serve this
area without adversely effecting
the pressure within the City Lim•
its. The water main available
would be either on Southern Ave•
nue or on the Rockdale Road near
the City Limits.
Connection to the City sewer
and water system may be made
only upon approval of the ~ City
Council. Also, no part of the cost
of any extension outside the City
has ever been paid by the City.
This extension of sewer and wa•
ter into the area requested would,
no doubt, be a favorable point
toward annexation, and would
help provide these services much
sooner than by gradual gmwth.
Any decision by the Council on
a policy should be applicable to
any extensions outside the limits
of the City. ff the City Council,
in any manner, agrees to pay part
of the construction costs, consid•
eration should be given to those
areas within the City not now
served with water.

Whereas, the City Council, hav-
ing considered all arguments ad-
vanced regarding said proposal, is
of the opinion that it is in the best
public interest that said property
be sold under said terms and condi-

a Section 1. That all objections to
said proposal be and the same are

Section 2. That the offer of Sears,
Roebuck & Co to purchase

buque, Dubuque County, Iowa,
subject to an easement for
storm sewer as the same ap-
pears upon the plat of said sub-
division,
be and the same is hereby accepted
and said property is hereby sold to
Sears Roebuck & Co. under the fol-
lowingterms and conditions, to-wit:
(a) The purchase price is $284,-
359.00, payable as follows: $28,-
436.00 at the time of purchaser's
offer, receipt of which is hereby
acknowledged by the City of Du-
buque; $255,923.00 at the time
of delivery of the City's deed
conveying good and merchant-
able title to said real estate, to-
gether with an abstract of title
showing good and merchantable
title in the City of Dubuque,
free and clear of all liens or en-
cumbrances;
(b) In the event substantially Sears,
Roebuck & Co. fails to com-
mence construction of a retail
department store and auxiliary
facilities (as described in its
letter to the City Council dated
June 19, 1959) within four years
from the delivery of the City's
deed, then, in that event, the
City shall have the right to re•
purchase the property by repay-
ment of the said purchase
price;
(c) The City's conveyance of title
and the payment of the unpaid
balance of the purchase price
shall be accomplished on or be•
fore January 1,1960;
(d) The City shall have the right to
continue to use. said real estate
until the commencement of con-
struction by Sears, Roebuck &
Co., with the further right to
remove all playground and
other City equipment now in-
stalled in the area;
(e) Sears, Roebuck & Co. shall have
the right of access, and ingress
and egress at the place where
Charter and Camp Streets, as
now platted, intersect with the
east line of South Locust Street;
(f) Sears, Roebuck & Co. shall have
the right to inspect the property

and make test borings for the
purpose of determining the soil
conditions and if, in the sole
and absolute discretion of Sears,
Roebuck & Co., the company
shall, prior to the conveyance of
title, determine that the soil
conditions as shown by said test
borings would render the con-
struction and erection of the
facilities described in the Com-
pany's letter inadvisable or un-
reasonably or excessively costly,
then the company shall have the
right to terminate and cancel its
offer, in its sole discretion;
Section 3. That the Mayor and
City Clerk be and they are hereby
authorized and directed to execute
the deed of the City of Dubuque,
Iowa, conveying said property to
said grantee and to deliver the
same upon receipt of the sum of
$255,923.00;
Section 4. That the City Clerk
be and he is hereby authorized and
directed to record a certified copy
of this Resolution in the office of
the County Recorder of Dubuque
County, Iowa.

of constructing the City of Du-
buque 1959 Hot Mix-Hot Laid As-
phaltic Concrete Paving Project
No. 1 as described in said Reso-
lution, in said City, which cost
is payable by the abutting and
adjacent property along said im-
provements and is made by law
a lien on all of said property. It
is payable only out of the Special
Assessment Fund No. 1217 created
by the collection of said special
tax, and said fund can be used
for no other purpose.
It is hereby certified and re-
cited that all the acts, conditions
and things required to be done,
precedent to and in issuing this
series of bonds, have been done,
happened, and performed, in regu-
lar and due form, as required by
law and said Resolution, and for
the assessment, collection and pay-
ment hereon of said special tax,
the full faith and diligence of said
City of Dubuque are hereby irre-
vocably pledged.

Harbor Company Addition was va-
cated in favor of and upon the
petition of Crescent Realty Corpo-

Subsequent to this action Cres-
cent Realty Corporation was billed
$600.00 for the land vacated. This
amount was paid to the City of Du•
buque. It now seems that accord-
ing to the original dedication of
the plat of the Dubuque Harbor

easement rather than title to the

Rebecca Rath, 2015 Chaney Road,
for damages sustained when she
fell entering her car at 739 Main
Street May 1, 1959 and £ind that
the claimed defect was in the
street and outside of the crosswalk
area.
Under Iowa Law the City ap-
pears to have discharged its obli-
gation when it provides safe cross-
. walks and sidewalks far pedes-
trians.

Gentlemen:
At your direction, I have inves-
tigated the claim of Mrs. Frances
Hutchins, 50 Devon Drive, for
damages sustained in a fall at the
corner of Devon and Cambridge
Court January 4, 1959.
Investigation discloses that Mrs.
Hutchins sustained a fractured
ankle when she fell at such time
on an icy crosswalk, and was in
a cast for eight weeks, as the re-
suit of her injury.
I have discussed the claim with
Mrs. Hutchins and she has agreed
to accept the sum of $200.00 in
full settlement.
I recommend that this settle-
ment be approved and the Auditor
instructed to issue a warrant pay-
able to Frances Hutchins in the
sum of $200.00 and deliver the
same to her upon receipt of a
properly executed release.

I have investigated the claim of
Mrs. Mary Bauer, 929 High Bluff
Street, for damages claimed to
have been sustained when she fell
on a defective sidewalk November
18, 1958, and find that Mrs. Bauer
fell as claimed and sustained seri-
ous personal injuries, and that
the defect existed as claimed.
I have discussed the matter with
the attorney for Mrs. Bauer and
he has agreed to accept $750 in
full settlement, of which the abut-
ting property owner and his insur-
ance company has agreed to pay
$500.
I recommend that the settle-
ment be approved and the Auditor
instructed to issue a warrant in the
amount of $250, payable to Mary
Bauer and Alfred C. Hughes, her
attorney, and deliver the same up-
on receipt of a properly executed
release.

Mayor Kintzinger read the call
and stated that service thereof
had been duly made and that this
meeting is called for the further
consideration of the proposal for
purchase of land by the Harnisch-
feger Corporation on the Indus•
trial Island in Riverfront Subdivi•
Sion No. 3 and acting on any other
business as may properly come be-
fore aregular meeting of the City
Council.

Your Honor:
In reference to a discussion of
a group of your City's Industrial
Development Committee, a letter
we received from Mr. Thomas M.
Stampfer, and a telephone conver•
sation the writer had with the City
Manager, Mr. Laverne Schiltz yes•
terday, we are desirous to make
our position clear regarding a pro-
posed Electrical Manufacturing
Plant in Dubuque,
We explained to your Commit-
tee that due to changed economic
conditions we could at this time
only take the first step of the pro-
posed total plan which would mean
that we are at the start in need
of a building of two (2) Bays each
40 ft, wide-641 ft. long, a Boiler
Room of 41'x60' and an Office of
60'x80', as shown on our drawing
of interim construction Dubuque
Plant given to your Committee.
We also gave to the Committee
our drawing Electrical Division-
Dubuque, Iowa which indicates the
total plant need at some future
date. This would mean the office
to be enlarged by 80'x120' and five
(5) more Bays 40'x641'.
We also are desirous to have
this plant built by some appro
priate commission in the City o1
Dubuque and the Harnischfeger
Corporation to lease it from this
commission on a twenty year lease
at a monthly installment figure
which will, over the twenty years
absorb the capital needed for
building the plant and a reason-
able interest rate for the unpaid
balance.
In the first step as indicated
above, we would move the Elec-
trical Control Division and Coil
Winding Department from our
Main Plant to Dubuque which will
employ at our present rate of vol•
ume approximately 100 to 120 peo-
pie. We cannot make at this time
a definite commitment as to when
we would be in a position to move
the balance of the electrical op-
erations, such as; the motor and
generator manufacturing, into Du•
buque but whenever that time may
come we would then employ ap•
proximately 700 people at our pres-
ent volume of business.
In order to insure sufficient out-
side storage, parking, and future
expansion, we must include the
74 acres of land formerly discussed
with you.
As indicated in Mr. Stampfer's
letter of August 4th and in the
telephone conversation with Mr.
Schiltz, the Council indicates dis-
pleasure with our proposal and
the Dock Commission is recom-
mending usage of the land under
discussion to yield at least 20 em•
ployees per acre. This would mean
that you are desirous to acquire
an industry that under the 75 acres
under discussion employs 1500 peo-
ple and at no time during our ne•
gotiations have we indicated that
at the outset we would have more
than 700 to 750 employees. We
further submit that a request on
our part to lease the proposed
plant on a twenty year lease basis
is nothing unusual in this day and
age and has been offered to us by
many communities desiring to at-
tract new industries. It is regret-
table that we were forced to delay
our decision regarding our plans
in Dubuque for almost two years
but the recession in business that
we and many others experienced
in the last two years did not al-
low us to act on this matter any
sooner.
It also would not be prudent for
our Management to accept any

when new plant locations are un•
der consideration. While we are
sympathetic to Dubuque's peculiar
land cost and land availability for
industry, we cannok at this time
make any other commitments then
indicated in this letter, If these
conditions do not meet with the
City Council and Dock Commission
approval, as indicated by Mr,
3chiltx's telephone conversation,
then there remains nothing else to
do but for us to look elsewhere
for a location.
We are appreciative of the in-
terest you have shown in our
search far a new plant location
and regret that apparently circum-
stances prevent us from achieving
a happy solution to our mutual
interests.

Mayan Ktnt2iager proposed that
the proper officials of Hanusch-
feger Corporation be invited to
Dubuque to discuss this matter
with the Coancil.
Councilman Welu admitted com-
plete surprise at the turn of
events. He felt that employment
should be our first consideration.
He looked with disfavor upon the
sa called modified offer of the Har-
nischfeger Corporation. However
the door is wide open for further
negotiations.
Councilman Schueller thought it
would be unwise to tie up that
amount of acres to employ only
one hundred and twenty people.
Councilman Freund stated that
we cannot possibly accept this as a
ffnal offer. We could even go to
Milwaukee ff necessary.
Councilman Takos stated that he
could not go along with the offer
as it stands.
Councilman Freund moved that
despite the fact that we are moat
desirous of the Harnischfeger Cor•
poration locating in Dubuque, we
do not accept the proposal of the
Harnischfeger Corporation as out-
lined in Mr. Menck's letter of Au-
gust. 6, 1959, but ask further dis-
cussion with the officers of Har-
nischfeger either in Dubuque ar
Milwaukee toward the goal of lo-
cating aHarnischfeger plant in
Dubuque, and that the communi-
cation be received and made a
matter of record, Seconded by
CouncfIman Takos. Carried by the
folIawing vote:
