Dear Chairpersons, Mayor and President:
Enclosed is a copy of a Stipulation of Settlement of a tax assessment appeal. Iowa
Code 441.44 requires that the Stipulation of Settlement be served upon each of you.
The property that is the subject of this appeal is a residence owned by Vicki Glab
located at
680 Southern Avenue, Dubuque, Iowa, Assessor's Parcel 10-36-180-005.
The Dubuque City Assessor's Office revalued all residential property for 2007 and
placed a value of $126,800 on the Glab property located at 680 Southern Avenue. The
breakdown of the value follows:
Land: $23,300
Building: $103,500
Total $126, 800
The 2006 assessed value prior to the revaluation was $112,100. The increase for 2007
was all placed on the dwelling, increasing the dwelling assessment from $88,800 to
$103,500. Upon receiving notice of the 2007 assessment the owner, Vicki Glab filed a
petition to the Dubuque City Board of Review. Ms. Glab's petition was filed because she
felt her property was not assessed fairly compared to a neighboring property when you
compared the assessments. The petition was denied by the Board of Review. Ms. Glab
then appealed to the Property Assessment Appeal Board.
Ms. Glab feels her property should be assessed around 100,000 to 105,000 based on
the comparable property. The property at 680 Southern Avenue has some water
damage in the home. The house is a rental home that is currently sitting vacant. It is
located near the Glab's primary residence and was purchased by the Glab's in 2002 to
protect their investment in their home. The home was built in the early 1800's.
Dubuque City Assessor Rick Engelken talked with Charlie Glab on the phone to set up
an appraisal of the property. The City Assessor's office hired Nick Goodmann to
perform an appraisal on the house in hopes of establishing market value on the
property. Mr. Goodmann visited the home on February 15, 2008 and submitted an
appraisal report on February 25, 2008. Mr. Goodmann felt the property would have a
market value of $89,500. Mr. Engelken then viewed the home with Mr. Glab on March
24, 2008. The property is sitting vacant and is in need of some repair. The two parties
agreed to a settlement of $102,000 for 2007 and for a further reduction to $87,000 for
2008 based on the current condition of the property.
The 2007 settlement will result in a loss of tax dollars of $388 per year.
Pursuant to the Stipulation of Settlement, this appeal will be dismissed and the tax
assessment will be adjusted to $102,000 for January 1, 2007.
The proposed settlement will be presented to the Property Assessment Appeal Board
after fourteen days from the date indicated on the enclosed Notice of Voluntary
Settlement. If there are any objections to the proposed settlement, they should be made
known to the City Assessor prior to that time.
