Van Milligen, City Manager SUBJECT: Acceptance of Bridge Improvements in Timber-Hyrst Estates (Phase I) DATE: April 14, 2008 City Engineer Gus Psihoyos is recommending acceptance of the bridge improvements on Creek Wood Drive over Catfish Creek that the developer, North Cascade Road Developers, LLC (NCR Developers), has recently completed in Timber-Hyrst Estates (Phase I). Maintenance of said improvements shall be the responsibility of the owner, NCR Developers, for a period of two years from the date of final inspection of the bridge on September 26, 2006. SUBJECT: Acceptance of Bridge Improvements in Timber-Hyrst Estates (Phase I) DATE: April 14, 2008 INTRODUCTION The enclosed material provides for City Council acceptance of the bridge improvements on Creek Wood Drive over Catfish Creek which the developer, North Cascade Road Developers, LLC (NCR Developers), has recently completed in Timber-Hyrst Estates. BACKGROUND As a condition of subdivision plat approval through Resolution No. 167-06, the developer of Timber-Hyrst Estates was required to install certain improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street lighting, and a 156'6" by 30' continuous concrete slab bridge on Creek Wood Drive over Catfish Creek and to dedicate these improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. Since the final lift of asphalt has not been placed on the street, only the bridge is being accepted at this time. On August 6, 2006, NCR Developers requested City's acceptance of the improvements in Timber-Hyrst Estates. Upon inspection on September 26, 2006, by IIW Engineers & Surveyors, PC for the City, it has been determined that the 156'6" by 30' continuous concrete slab bridge required by Resolution 167-06 has been completed in accordance with plans approved by the City Council and in conformance with City specifications. Other improvements in Timber-Hyrst Estates will be recommended for acceptance when they have been completed and inspected by City Engineering. RECOMMENDATION I would, therefore, recommend that the City Council accept the bridge improvements. Maintenance of said public improvements shall be the responsibility of the owner, NCR Developers, for a period of two (2) years from the date of the final inspection of the bridge on September 26, 2006. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the bridge improvements on Creek Wood Drive over Catfish Creek in Timber-Hyrst Estates. Prepared by Ronald Turner, PLS RESOLUTION NO. 118-08 ACCEPTING BRIDGE IMPROVEMENTS IN TIMBER-HYRST ESTATES Whereas, pursuant to Resolution 167-06, certain public improvements including a 156'6" x 30' continuous concrete slab bridge over Catfish Creek was installed by the developer of the Timber-Hyrst Estates. Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said bridge improvements in the Timber-Hyrst Estates be and the same is hereby accepted. Section 2. That maintenance of said bridge improvements shall be the responsibility of the owner for a period of two (2) years from September 26, 2006, the date of recommendation for acceptance by IIW Engineers & Surveyors, PC. Tranel, PE On September 13, 2006, IIW conducted a punch list inspection on the above referenced project John F. Wandsnider, PE which was documented in a letter to Marty McNamer of the same date. We returned to the site Julie P. Neebel. PE James P. Kaune, PE on September 20s', and 26~' to observe the final corrections made as recommended in the list Thomas J. Oster. We hereby certify that Taylor Construction of New Vienna, Iowa, has completed construction of the above referenced project in compliance with the drawings and specifications and the project is ready for acceptance. The final project construction cost including final retainage released by the developer was $101,697.85. We also recommend that the City of Dubuque approve and accept the Creek Wood Drive over Catfish Creek Bridge as a public improvement meeting the City's standards.
