RE: REQUEST TO VACATE CITY PROPERTY ON KERPER BLVD.
Dear Mr. Mayor and Member of the Council:
We are counsel for Mr. Thomas A. Luksetich and Mr. and Mrs. Timothy J. Axtell, three of
the members of JMTG Properties, LC, an Iowa limited liability company which owns the real estate
legally described as:
Lot 2 of Lot 2 of Lot 2 of Lot 2 of Lot 1 of Block 5, and Lot 2 of Lot A of Lot 2 of
Lot 2 of Lot 1 of Block 5, in River Front Subdivision No. 3 in the City of Dubuque,
Iowa,
which is locally known as 2530 Kerper Blvd., Dubuque, Iowa, 52001. Our client is interested in the
possibility of purchasing a portion of City real estate abutting this property (see the attached drawing)
so that this "green space" which is owned by the City can be a part of the property which is owned
by our client (which is a commercial/light industrial leasing property).
Our client has contacted the City Engineering Department and our client has been advised
by that Department that conditions are favorable for such a vacation (or sale), but there may be a
need for easements reserved for utilities etc. Our client understand that the vacated area would be
surveyed and platted at our clients expense and that a fee would be paid for the parcel, plus
publication and filing fees would be the responsibility of our client.
