DISCUSSION The attached plat shows the proposed portions of Liebe Street and Washington Street to be vacated. The abutting properties are owned by the corporate entities of Dubuque Stamping Manufacturing, R&S Realty, and C&K Realty. The area to be vacated is divided into two lots numbered Lot C and Lot D of Liebe's Subdivision No. 2. Lot C is a 119-foot section of Washington Street which dead ends at Dubuque Stamp's building. Lot D is a 313-foot section of Liebe Street which dead ends at property owned by the City and is used for a portion of Heritage Trail. A portion of Lot D will be reserved for an easement for an existing sanitary sewer. The existing watermain on Lot D will be abandoned and used as a private service line for Dubuque Stamp's operations. Other utilities have indicated they do not require easements across the areas to be vacated. The intersection of Liebe and Washington Streets will remain public right-of-way. As part of the purchase agreement, the City will resolve drainage issues at this intersection by reconstructing portions of the curb and pavement. The property has been valued at $1.54 per square foot. Dubuque Stamp indicated they did not need Lot C or Washington Street but would purchase at a nominal fee of $300. Lot D or Liebe Street was valued at $24,101, plus conditions outlined in the attached December 18, 2007 letter. RECOMMENDATION The City has no plans for the utilization of Lot C and and Lot D of Liebe's Subdivision No. 2 to be vacated, except for reserving the utility easements as noted. would recommend that the areas indicated by Lot C and Lot D of Liebe's Subdivision No. 2 on the attached plat be vacated, and that a public hearing be set for the disposition of the City's interest in the subject area on May 5, 2008. would further recommend that the purchase price be established at $24,101 for Lot D and $300 for Lot C, plus platting, publication and filing fees. We would like to offer the following as a counter proposal to the city's offer. We would purchase the Liebe Street property at the proposed price of $24,101 and take responsibility for the five issues outlined in the fourth paragraph of your December 18th letter (We assume from the way the easement is requested and drawn you are acknowledging that we can only grant an easement through property we own.). However, we have no compelling reason to acquire the Washington Street property and, accordingly, will not include that property in our request. If the City believes it is in its' best interest to vacate the Washington Street property, we would purchase it for a nominal price. In addition, we would ask the City to address the severe water drainage problem which exists at the Washington and Liebe Street intersection within the proposed hammerhead. During the winter it is either a lake or an ice skating rink depending on the temperature. In the summer, following a rain of any significance it also retains water for several days afterward. An onsite visit anytime in the immediate future would confirm that this problem exists. Please advise us if any utility concerns have been identified. We,are asking the City to vacate that portion of Liebe Street because it currently separates our~two manufacturing complexes. To the northwest is our main manufacturing operation comprising of 120,000 square feet on approximately 4.7 acres and to the southeast is 4.4 acres which we acquired in December, 2005. To date, we have invested over $850,000 iii that property and occupy 35,000 square feet of building space. We have grown significantly over the past decade and fully occupy the functional buildings on these properties (the building at 3000 Elm Street is not suitable for manufacturing). We are currently revising our Strategic Plan and considering opportunities for continuing that growth. Those plans require additional facilities and equipment, which we would like to incorporate into our current location. The best and most efficient construction scenario would include a building connecting the properties across from each other on Liebe Street. Thus the reason for this request. This letter summarizes our conversation and provides further information relative to the vacating process. The area anticipated for vacating includes Liebe Street and Washington Street northerly and easterly of a line 20 feet from the intersection of two streets. This will allow the existing intersection to remain as a hammerhead-type area for maintenance and refuse vehicles to turn around without having to reconfigure the intersection by constructing a cul-de-sac. The area of Liebe Street proposed to be vacated east of the area needed for a hammerhead is 313 by 50 feet or 15,650 square feet. This does not include the extension of Liebe Street 33 feet into Lot 1 of 6 of Mineral Lot 322. The area of Washington Street proposed to be vacated north of the hammerhead is 130 by 50 feet or 6,500 square feet. Based on the City Assessor's average land values abutting these streets of $1.54 per square feet abutting these streets, city real estate would have a value of $34,111 (22,150 square feet x $1.54). Service People Integrity Responsit+ility Innovation Teamwork Mr. Dave Spahn Page 2 December 18, 2007 Other issues concerning the proposed vacating are as follows: - The watermain easterly of the hydrant at Washington Street would be turned over to Dubuque Stamping & Manufacturing as private service line. - The existing watermain which will become private (described above) may need to be abandoned or reconfigured per building codes if in a proposed building area. - The hydrant at the east end of Liebe would need to be relocated and connected to the watermain that runs parallel to the trail at the expense of Dubuque Stamping & Manufacturing. - Dubuque Stamping & Manufacturing would be responsible for the necessary surveying and platting for the vacates. - Dubuque Stamping 8~ Manufacturing would be responsible for platting a 20- foot wide easement for sanitary sewer through properties owned by Dubuque Stamping (R&S Realty, LLC) south of Liebe Street. The City will notify the utilities of the proposed vacating and let you know if there are concerns from them in this regard. I have enclosed a map of the proposed vacate area for your use.
