Estates #2.

INTRODUCTION
This is in response to a request from Buesing & Associates, Inc., representing
North Cascade Road Developers, LLC, for the vacating and replatting of an
existing sanitary sewer easement across former Block 4 'of Henschel Addition
currently being replatted as Lot CTimber-Hyrst Estates #2 in the City of
Dubuque, Iowa.
DISCUSSION
North Cascade Road Developers, LLC is the current owner of a portion of former
Block 4 of Henschel Addition and is replatting the area into Lot C of Timber-Hyrst
Estates #2. In the process of preparing the final plat for Timber-Hyrst Estates #2,
Buesing & Associates, Inc. discovered the existing sanitary sewer was not
located within the platted easement recorded in 1996. After discussions with the
Engineering Department, it was decided to vacate the location of the easement
established in 1996 and indicate the correct location on the Final Plat of Timber-
Hyrst Estates #2. The property owner, North Cascade Road Developers, LLC,
also agreed to establish the new easement 40 feet wide instead of the previous
20-foot width. The original terms and conditions of the 1996 easement will
remain in effect.
RECOMMENDATION
The proposed location of the sanitary sewer easement has been reviewed and
approved as part of the Final Plat and Improvement Plans for Timber-Hyrst
Estates #2.
North Cascade Road Developers, LLC has agreed to dedicate a new easement
on Lot CTimber-Hyrst Estates #2. I would recommend that the City Council
approve the request and that a public hearing be held.
ACTION TO BE TAKEN
The enclosed resolution releasing the location of the existing sewer easement as
indicated on the Easement Exhibit recorded as Instrument No. 4658-96 should
approved.

RESOLUTION DISPOSING OF INTEREST AND RELEASE IN THE LOCATION
OF EXISTING 20-FOOT WIDE SANITARY SEWER EASEMENT ACROSS
FORMER BLOCK 4 OF HENSCHEL ADDITION IN THE CITY OF DUBUQUE,
IOWA
Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque, Iowa, on 11th day of
April 2008, the City Council of the City of Dubuque, Iowa met on
the 21st day of April , 2008 at 6:30 p.m. in the Historic
Federal Building, Council Chambers (second floor), 350 West 6th Street,
Dubuque, Iowa, to consider the proposal for the vacating and release of real
estate described as:
The location of an existing 20-foot wide sanitary sewer easement
across former Block 4 of Henschel Addition in the City of Dubuque,
Iowa, according to Instrument No. 4658-96 and recorded on April 24,
1996 in the Office of the Dubuque County Recorder and as shown on
the Easement Vacation Plat attached hereto and by reference made
a part hereof; and
Whereas, the City Council of the City of Dubuque, Iowa, overruled any
and all objections, oral or written, to the proposal to dispose of interest of the City
of Dubuque, Iowa, in the hereinabove described real estate to North Cascade
Road Developers, LLC.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the disposal of the interest of the City of Dubuque,
Dubuque County, Iowa, in the location of real property described as an existing
20-foot wide sanitary sewer easement across former Block 4 of Henschel
Addition replatted as Lot C of Timber-Hyrst #2 all in the City of Dubuque, Iowa, to
North Cascade Road Developers, LLC, be and the same is hereby approved.
Section 2. That the proposal to dedicate a new 40-foot wide sanitary
sewer easement on Lot CTimber-Hyrst Estates #2 as set out by North Cascade
Road Developers, LLC, be and the same is hereby approved.
Section 3. That all conditions stated and agreed to on Page 1 of the
Grant of Easement for Sanitary Sewer recorded as Instrument No. 4658-96 on
April 24, 1996 in the Office of the Dubuque County Recorder are still in effect,
except that the location of the easement has been changed as shown on the
Final Plat of Timber-Hyrst Estates #2.
Section 4. That the Mayor and City Clerk be authorized and directed to
execute a Release of Easement and Easement Vacation Plat, and the City Clerk
be and is hereby authorized and directed to deliver said release to the above
named grantees and accept the dedication of a sanitary sewer easement as
platted on Lot C of Timber-Hyrst Estates #2.
Section 5. That the City Clerk be and is hereby authorized and directed
to record a certified copy of this resolution in the office of the City Assessor,
Dubuque County Records, and the Dubuque County Auditor.

AND
DEDICATION OF SANITARY SEWER EASEMENT
North Cascade Road Developers, LLC (herein called "Owners") hereby
state that:
1. They are Owners of the following described property to wit:
Part of former Block 4 of Henschel Addition being replatted as Lot CTimber-
Hyrst Estates #2 in the City of Dubuque, Iowa
2. Presently located across such property is an existing 20-foot wide sanitary
sewer easement, as identified and located on the "Easement Vacation Plat"
attached hereto, and made a part hereof by this reference.
3. The present sanitary sewer easement location on the Easement Vacation Plat
does not represent the existing location of the sewer and that the
establishment of a 40-foot wide sanitary sewer easement as shown and
identified in Lot CTimber-Hyrst Estates #2 on the attached Exhibit "A" and
made a part hereof by this reference, will properly delineate the correct
location of the sewer on the property.
4. Owners wish to vacate the location of the present sanitary sewer easement,
and relocate and dedicate to the public a new 40-foot wide sanitary sewer, as
located and described on Lot CTimber-Hyrst Estates #2.
5. That all conditions stated and agreed to on Page 1 of the Grant of Easement
for Sanitary Sewer recorded as Instrument No. 4658-96 on April 24, 1996 in
the Office of the Dubuque County Recorder are still in effect, except that the
location of the easement has been changed as shown on the Final Plat of

6. The City of Dubuque, Iowa, attaches its consent to this Vacation of Easement

For and in consideration of the sum of one dollar (51.00) and other good and valuable

and convey to the CITY OF DUBUQUE, IOWA, a municipal corporation, its agents and contractors,
in perpetuity, from the date hereof. a right of way and easement through, under and across the
following described real estate situation in Dubuque. Iowa, to•wit:
Block IV of Henschel Addition in the City of Dubuque. Iowa
Said easement shall be as shown on the attached Exhibit A, for the purpose of constructing and
maintaining a sanitary sewer in accordance with the Plans and Specifications on file in the
office of the City Engineer.
Together with the right to enter upon said property during the period of construction until the
project is accepted by City Council.

not to exceed 50 foot in width centered over said sewer.
It is understood and agreed that the grantee herein shall restore the disturbed area due to the
installation of repair of said sanitary sewer. Contractor will stockpile any topsoil present
in separate area and place on top of sewer ditch so as to restore said ground to its present
condition. It is also understood and agreed that any crop damage or loss of profit from not
planting this growing season will be monetarily compensated to said owner according to the manual
titled 'Estimated Costs of Crop Production in Iowa 1996' as published by Iowa State University
Extension, Ames. Iowa. This manual (Form 1712) has a revision date of January 19. 1996.
Grantor shall not erect any structure over or within the Easement Area without obtaining the
prior written approval of the City Engineer.
Grantor shall not change the grade, elevation, contour or perform any construction or excavation
that will diminish the lateral support of said improvement without obtaining the prior written
consent of the City Engineer.
To have and to hold unto the said City of Dubuque. Iowa, in perpetuity. and the undersigned do
hereby expressly covenant that they are the owners in fee of said real estate and have good right
to execute this agreement, and that the grantee. its agents or contractors, shall at all times
have free access to and egress from and over said real estate to maintain, remodel or repair said
sanitary sewer thereon or therein.
