Gentlemen:
I am attaching a copy of the
Pay Plan, Personnel Rules and
Regulations which will become
effective January 1, 1958, The
Personnel Rules and Regulations
are a compilation of existing rules
and policies that have been issued
separately but never combined in
one document.
The Pay Plan is a schedule show-
ing monthly pay ranges and titles
of classes of positions which are
to be compensated within each pay
range. Pay for each individual is
Figured so that no one will be be•
low the minimum pay step and
each employee within a pay step
will be moved to the next higher
step, Those above the maximum
pay for their classification will not
be reduced in pay but will receive
no increases as long as his posi•
tion remains in a class having a
maximum rate which is equal to
or below the salary paid.
The pay schedule for each em-
ployee has been figured according
to the above plan and the ap•
propriation ordinance has been
prepared accordingly.

Personnel Rules and Regulations,

Section 2. General Miscellaneous Revenues. General
miscellaneous revenues which are colleoted during the
fiscal year shalt be allocated to the funds and purposes
as provided far herein and shall be used for the payment
of the expenses of such funds and purposes in the sums
herein shown.
Section 3, Surplus, Any surplus not specifically
allocated for a definite purpose in the budget shall be
and the same is hereby appropriated and set apart to
be applied as contingencies arise or may be Used for
such proper purposes as the Council may determine upon.
Any surplus not specifically distributed in the budget
and remaining in funds created by the levy of special
taxes shall be and the same is hereby appropriated for
hereinrcontapedoshallnauthorize thehtransfer of funds
realized from special taxes to a fund or purpose for
which any special tax levy has been made, except only
with the approval of the State Comptroller.
Section 4. Delinquent Tax Collections. Delinquent
Prior years' tax collections shall be allocated to the re-
spective funds most logically including the purpose for
which the tax was levied when and as the same are
received by the City Treasurer,
Section 5. Distribution, That the distribution and
division of the within appropriations shall be made in
accordance with the detailed distribution adopted by the
City Council on January 6, 1958, which detailed distribu-
tion is made a part of this ordinance by reference there-
to and shall be so considered in connection with the
expenditures of said appropriations.
Section 6. This ordinance shall be in force and effect
from and after its final passage, adoption and approval
by the City Councit and publication as provided by law,
and the appropriations herein provided shall be avail-
able when transferred to their respective funds,

Mr. Hal Reynolds, representing
the Healy interests in the re-zoning
of the property at 30th. and Cen-
tral Avenue addressed the Council
stating that the ultimate plan of
rezoning is to do something good
for the City, The rezoning of this
area would be useful and it would.
not reduce the values of the prop-
erty in the immediate neighbor-
hood as some are lead to believe.
Mr. Wm. Oster addressed the Coun-
cil by stating that he also was of
the opinion that the value of the
property would increase rather
than decrease, Mr. Matt Czizek ad-
dressed the Council, objecting to
the rezoning. of the area and in
quoting the original Zoning Ordi•
nonce stressed the fact that moral
values must be considered and that
business is not the only thing that.
makes a cornmunity. Mr. John Ma-
tous, owner of property in the area
under discussion, addressed the
Council stating. his objection to the
rezoning primarily on the basis
that if the property was rezoned to
the desired classification of those
proposing to build on same, it
would create a terrific traffic haz-
ard which would: prove very detri-
mental to the children attending
school in the vicinity, Many mem-
bers of the Planning & Zoning
Commission were present. Mr, Irvin
Oeth, chairman of the commission,
presented the minutes of the meet•
ing showing the action taken by
the Commission at the time the re-
zoning of 30th and Central was
under consideration. The minutes
of the Planning & Zoning Commis-
sion were read by City Clerk From-
melt, During the proceedings the
remark was made that Mr. Healy
could have sold the property prior
to this time. Mr, Healy stated that
he never was made a legitimate of-
fer on the property.
The following communication
was resubmitted and read, final
action on the recommendation of
the Planning and Zoning Commis-
sion being referred to this meeting,
subject to a public hearing, as per
motion of the meeting of December
20, 1957.

The petition of Leonard Healy
requesting rezoning of Lats 305
and 306 Davis. Farm Addition lo-
cated at 30th & Central from Mul-
tiple Family Rosidence District to
Local Business A District has been
carefully considered by this Com-
mission. Two meetings were held
and at these meetings many in-
terested citizens appeared and stat-
ed their views,
Among the various factors con-
sidered besides the petition was
the fact that Central Avenue is
now Business District to 26th
Street. There is a Local Business
area at- 28th Street, 30th Street
fs Local Business B on one corner.
Local Buuiness B then starts again
at 32nd Street to the City Limits.
These areas are not completely de-
veloped as business, many resi-
dences are in these zones. The area
in question is predominately resi-
dential with spotted non conform-
ing uses.
The opinions. of the Commission
members were divided but a ma-
jority opposed rezoning the area
under consideration at this time
and by a 4 to 3 vote voted to rec-
ommend denial of the petition.

ing that the area would be approxi-
mately seventy acres, two-thirds of
which is in the County, He sub-
mitted. grocery ads from a neigh-
boring City which showed some
items as high as ten per cent less
than in Dubuque, due to the fact
that they have a shopping center.
Peter J. Seippel, Marshall Thomas,
George Steffen, Dr, Howell, Wayne
Ohmert and Robert Pier all spoke
against rezoning of the area, Mr.
Steger addressed the Council stat-
ing that he would be in favor of re-
zoning the area for a shopping cen-
ter because he has approximately
130 lots to sell, plus the fact that
it would be an ideal location to
service the people already living
in Steger Heights addition City
Solicitor Nelson cautioned the
Council not to lose sight of the fact
that it is not Council business in
reaching a decision to consider
what the area is to be used for.
The real issue is a question of
rezoning.

Gentlemen:
On December :9th, 1957 you re•
ferred the claim of Max Retten-
berger, Dodge Street and Cherokee
Drive, to this office for investiga-
tion and report. Mr, Rettenberger's
claim arises out of alleged improp-
er blasting done by Schueller and
Company, in connection with the
construction of Catfish Creek Sew-
er, during the last half of October
1957, and resulting damage to his
dwelling.
As you know, Mr, Schueller was
required by his contract, to pro-
vide insurance covering his flabil-
ity and that of the City of Dubuque
from exposure to claims for dam-
ages arising out of his blasting. I
have forwarded the claim to the
insurance company and have re-
ceived advice from them that they
have investigated the claim and
can find no liability, 'and are
therefore denying the claim.
In accordance with our insurance
contract we must cooperate with
the Insurance Company in such
matters, and I therefore recom-
mend that the claim be denied.

BE IT -0RDAINED BY THE CITY
COUNCIL OF THE CITY -0F DU-
BUQUE:
Section 1. That &ledical Associates
Really Company be and it is hereby
granted the right and authority to
construct a marquee over the public
sidewalk on the north side of west
Twelfth Street between Iowa Street
and the alley first west of Iowa
Street, in accordance with the plans
now on file with 4he City Manager;
Section 2. That such ,construction
shall be done under the supervision
and direction :of the Building Com-
missioner and :City Manager of the
City of Dubuque and in accordance
with all applicable State and Federal
Laws and regulations and the Ordin•
ances of the City of Dubuque;
Section 3. That .the right to con-
struct and maintain said marquee
shall be subject to the continuous
control of the City Council, reserving
the right to said City Council to
impose restrictions and conditions on
the enjoyment thereof as said City
Council may deem necessary for the

scind the grant hereby made;

tion of the rights and privileges

Realty Company, its successors and
assigns, assume any and all liability
for damages to person or property
which may result from the construc-
tion or maintenance of said marquee.
Fraid applicant, its successors and
signs, at its own expense, .agrees
to pay on behalf of the City oP Du-
buque all sums which the City oP
Dubuque shall become obligated to
pay by reason of the liability imposed
on the City of Dubuque for damages

Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion there-
of to the City Council and the
City Council has ascertained the
cast thereof and has determined
that $752.58 Dollars of the cost
thereof shall be assessed against
the property subject to assessment
therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City Council to issue
bonds for the purpose of pro-
viding for the payment of the
assessed cast of said improvement
and a public hearing has been held,
pursuant to such notice and all
objections made thereto have
bean considered and determined:
Now Therefore Be It Resolved
by the City Council of the City of

structing the Ramona Street-Ade-
line Street Sanitary Sewer.
Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been
completed and the City Manager
has certified the completion there-
of to the City Council and the City
Council has ascertained the cost
thereof and has determined that
$19,832.91 Dollars of the cost there-
of shall be assessed against the
property subject to assessment
therefor; and
Whereas public notice, as pro-
vided by law, has been published
by the City Clerk stating the in-
tention of the City Council to is-
sue bonds for the purpose of pro-
viding far the payment of the as•
sensed cost of said improvement
and a public hearing has been
held, pursuant to such notice and
all objections made thereto have
been considered and determined;

The City of Dubuque in the State
of Iowa promises to pay as herein-
after mentioned to the bearer here-

the sum of Five Hundred dollars
with interest thereon at the rate
of 5 per cent per annum, payable
semi-annually, on the presenta-

principal and interest of this bond
are payable at the office of the
City Treasurer in the City of Du•
buque, in the State of Iowa. This
bond is issued by the City of Du-
buque under and by virtue of
Chapter 396 of the 1954 Code of
Iowa, as amended, and the Resolu•
tion of said City duly passed on
the 6th day of January, 1956, being
Resolution No. 11-58.
This Bond is one of a series of
40 bonds, 39 for $500.00 numbered
from 1266 to 1304 inclusive, and
one for $332,91 numbered 1305, all
of like tenor and date, and issued
for the purpose of constructing the
Ramona Street-Adeline Street San-
itary Sewer as described in said
Resolution, in said City, which cost
is payable by the abutting and
adjacent property along said im-
provements and is made by law a
lien on all of said property. It is
payable only out of the Special As-
sessment Fund No. 1201 created by
the collection of said special tax,
and said fund can be used for no
other purpose,
It is hereby certified and recit-
ed that all the acts, conditions and
things required to be done, prece-
dent to and in issuing this series
of bonds, have been done, hap-
pened, and performed, in regular
and duo form, as required by law
and said Resolution, and for the
assessment, collection and payment
hereon of said special tax, the full
faith and diligence of said City of
Dubuque are hereby irrevocably
pledged.

has caused this bond to be signed

Whereas, the City Council of
the City of Dubuque, Iowa, has
by Resolution No. 255.57 given its
preliminary approval on the pro-
posed plans, specifications and
form of contract and placed same
an file in the office of the City
Clerk for public inspection, for the
construction of Boulevard Street
lights and appurtenances on Cam-
bridge Court for its entire extent;
on Devon Drive from a point 74'
south of the north line of Lot 1
of 1 of 1 of 1 of 1 of 1 of Clarence
Polfer's Place to its northerly ter-
minus; and on Princeton Place
from Devon Drive to a line con-
necting the north line of Lot 2 of
Lot 3 of Block 8 of Steger Heights
with the north line Lot 15 of Block
9 of Steger Heights, and,
Whereas, the proposed Resolu-
tion of Necessity as amended for
said improvement has been intro
duced and is now on file in the
City Clerk's office for public in•
spection,
Be It Therefore Resolved that on
the 3rd day of February, 1958, a
public hearing will be held at 7:30
o'clock, P.M, in the Council Cham•
ber in the City of Dubuque at
which time the owners of property
subject to assessment for the pro-
posed improvement may appear
and make objection to the pro•
posed plans and specifications and
proposed form of contract and at
the same time to the boundaries
of the proposed district, to the cost
of the improvement, to the amount
proposed to be assessed against
any lot and to the passage of the
proposed Resolution of Necessity
as amended and the City Clerk be
and he is hereby directed to cause
a notice of the time and place of
such hearing to be published in
some newspaper published in the
City of Dubuque, the last of which
shall be not less than two (2) nor
more than four (4) weeks prior to
the day fixed for its consideration
and unless property owners at the
time of final consideration of said
resolution as amended have on file
with the Clerk objections to the
amount of the proposed assess-
ment, they shall have been deemed
to have waived all objections there-
to, at which hearing the Council
will hear such objections and en-
ter on record its final decision
thereon.
Be It Further Resolved that the
City Clerk be and he is hereby or-
dered and directed to advertise for
proposals for the construction of
the various improvements herein
provided far in the manner pro-
vided by law, the said improve-
ments shall be completed on or
before 3D days after notice to pro-
ceed is issued.

Whereas, the City of Dubuque is
contracting for the construction
of a Sewage Treatment Plant and
it is necessary to install a 36 inch
steel pipe under the Illinois Cen-
tral Railroad Company tracks 50
feet east of Mile Post C185 to be
used to incase various pipes car-
rying bulk chemicals, and it is nec-
essary to obtain permission to in•
stall this pipe;
THEREFORE, BE IT RESOLVED
by the City Council of the City of
Dubuque that the Mayor and Clerk
be authorized to execute the Agree-
ment between the Illinois Central
Railroad Company and the City of
Dubuque granting this permission.

Whereas, on September 16, 1957
the City Council of the City of
Dubuque, Iowa, adopted Resolution
No, 19(i•57, approving a plat in
which Lot 1 of Lot 1 of Lat 1 of Lot
1 of Lot 1 of Lot 1 of Lot 1 of Lot
A in Hillcrest Park in the City of
Dubuque, Dubuque County, Iowa,
was platted by Hillcrest Builders,
Inc,; and
Whereas' in' said Resolution the
title of the new Subdivision was
variously designated as,
Block 10, Block 11, Block 12 and
Block 13 in Hillcrest Park Addi-
tion; and Block 10, Block 11, Block
12 and Block 13 in Hillcrest Addi-
tion; and
Whereas the proper title of said
new Subdivision is Block 10, Block
11, Block 12 and Block 13 in Hill-
crest Heights in the City of Du-
buque, Iowa; and
Whereas said improper designa-
tions of said new Subdivision as
set forth in said Resolution arose
through clerical error;
NOW THEREFORE, BE IT RE-

Section 1. That the designation

The final assessment for the
North 15' of Lot 2 of Lot 2 of Wil-
son's Dubuque of the Montana
Street-Merfeld Lane Sanitary Sew•
er was erroneously listed as $95.77.
The correct assessment of the
above mentioned lot is $79.81.
I recommend that the difference
of $15.96 be paid from the Sanita-
tion Fund and that the City Audi-
tor beinstructed to draw a warrant
in this amuont payable to the City
Treasurer.

been conducted to determine where
it would be practical to install
street lights on the Grandview-
Kerrigan Road intersection, includ-
ing the four approach entrances,
and also lights on the Kerrigan
Road between Railroad Avenue and
Grandview Avenue.
I recommend that street lights
be installed at the following loca•
tions:
1. Kerrigan Road and Mt. Car•
mel-light on pale to be lo-
cated at northeast corner by
stop sign.
