Van Milligen, City Man er FROM: Gus Psihoyos, City Engineer SUBJECT: Acceptance of Subdivision Improvements in Terrace Estates Third Addition DATE: May 6, 2008 INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements on Enstrom Court and Cessna Drive which the developer, Terrace Homes, LLC, has recently completed in Terrace Estates Third Addition. BACKGROUND As a condition of subdivision plat approval through Resolution No. 341-06, the developer of Terrace Estates Third Addition was required to install certain improvements including street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins, and boulevard street lighting and to dedicate these improvements to the City upon completion. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On November 15, 2007, MSA Professional Services, representing Terrace Homes, LLC requested City's acceptance of the improvements in Terrace Estates Third Addition. Upon inspection on May 2, 2008, it has been determined that the public improvements required by Resolution 341-06 have been completed in accordance with plans approved by the City Council and in conformance with City specifications. RECOMMENDATION would, therefore, recommend that the City Council accept the public improvements. Maintenance of said public improvements shall be the responsibility of the owner and contractor for a period of two (2) years from the date of acceptance by City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the public improvements in Terrace Estates Third Addition. Prepared by Ronald Turner, PLS RESOLUTION NO. 164-08 ACCEPTING PUBLIC IMPROVEMENTS IN TERRACE ESTATES THIRD ADDITION Whereas, pursuant to Resolution 341-06, certain public improvements were installed by the developer of Terrace Estates Third Addition. Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said public improvements in Terrace Estates Third Addition be and the same is hereby accepted. Section 2. That maintenance of said public improvements shall be the responsibility of the owner and contractor for a period of two (2) years from the date of this resolution.
