(a) Created: There is hereby created a Housing Code Appeals Board to have such powers and
responsibilities to the extent of the authority granted by the City Council.
(b) Purpose: The Housing Code Appeals Board shall conduct hearings upon application by any
person aggrieved by a notice and order of the Housing Officer issued in connection with a
violation of the City of Dubuque residential housing code or of any applicable rule or
regulation issued pursuant to the City of Dubuque residential housing code. The Board
shall also review revised or additional definitions and procedures submitted by the Housing
Officer and shall be empowered to adopt, reject or modify same.
(c) Membership; Terms Of Office; Vacancies:
(1) The Housing Code Appeals Board shall be comprised of a membership of seven (7)
persons who shall be appointed by the City Council for terms of three (3) years. All terms of
office shall expire on January 11 in their respective years.
Reasonable efforts should be made to obtain representation of both tenant and landlord
interests in the appointment process.
(2) Upon completion of their term of office, members shall continue to serve in their full
capacity until a successor has been duly appointed.
(3) Vacancies on the Board caused by death, resignation or other reason shall be promptly
filled by the City Council for the unexpired term of office.
(4) The Board shall elect a chairperson and vice chairperson from its members at the first
regular meeting of each year.
(5) Members of the Board shall be residents of the City and may not be employed by the
City.
(d) Meetings:
(1) The Housing Code Appeals Board shall meet at least quarterly and at such intervals as
necessary in order to fulfill its purpose.
(2) Members of the Board shall attend at least two-thirds (2/3) of all regularly scheduled
and held meetings within a twelve (12) month period. If any member does not attend such a
.prescribed number of meetings, it shall constitute grounds for the Board to recommend to
the City Council that said member be replaced. The attendance of all members shall be
entered upon the minutes of all meetings.
(3) All meetings shall be held in conformance with the provisions of the Iowa Open
Meetings Law.
(4) The Housing Officer shall serve as secretary to the Board and shall render all decisions
and findings in writing to the appellant.

(5) The Housing Officer shall file with the City Council a copy of the minutes of each
meeting of the Board within ten (10) working days after each such meeting.
(e) Infernal Organization And Rules: The Housing Code Appeals Board may adopt rules and
regulations to govern its organizational procedures as it may deem necessary and which
are not in conflict with this Chapter or other regulations of the City.
(f) Procedures For Operations: All administrative, personnel, accounting, budgetary and
procurement policies of the City shall govern the Housing Code Appeals Board in all of its

(a) Board established . In order to determine the suitability of alternative materials and
methods of installation; to provide for reasonable interpretations of the electrical code; to
serve as an appeal body for the decisions of the building official; to advise the city council
on all electrical regulations and procedures; and to provide for examining applicants for
electrical contractor's registration, electrical maintenance and journeyman electrician
certificates of competency and issuing electrical contractor's registration and electrical
maintenance and journeyman certificates of competency, there is hereby created the
electrical code board.
(b) Membership .The electrical code board shall consist of five (5) members appointed by the
city council. Four (4) members shall have a background or experience in electrical
engineering, electrical contracting, electrical installation or electrical maintenance, and one
(1) member shall be appointed from the public at large.
(c) Term of office .The term of office of all board members shall be three (3) years.
(d) Rules and regulations .The board shall make such rules and prescribe such procedures as
may be reasonably necessary for its operation, except that such rules shall include the
following:
(1) Board chairperson. The chairperson of the board shall be a member of the board
elected annually by a majority of the board.
(2) Secretary of the board. The building official, or designee, shall be secretary of the
board. The secretary shall arrange for meetings and prepare and keep such minutes and
records and perform such other clerical work as the board may direct.
(3) Quorum. Three (3) members shall constitute a quorum. The concurring vote of three (3)
members of the board shall be necessary to pass any motion.
(4) Service until appointment of successor. Upon completion of the term office, members of
the electrical code board shall continue to serve in their full capacity until their successor
has been duly appointed.
(5) Meetings. The electrical code board shall meet at least once every three (3) months
upon call of the chairperson, secretary or city manager. Members of the electrical code
board shall attend at least two-thirds (2/3) of all scheduled meetings within a twelve month
period. If any member does not attend such prescribed number of meetings, it shall
constitute grounds for the board to recommend to the city council that said member be
replaced.
(6) Attendance. The attendance of all members shall be entered on the minutes by the
secretary.
(7) Conformity with open meetings law. All meetings shall be held in conformance with
provisions of the Iowa Open Meetings Law.
(8) Minutes. The electrical code board shall file with the city council a copy of the minutes of

each meeting of the board within ten (10) working days after such meeting.
(9) Administrative policies. All administrative, personnel, accounting, budgetary, and
procedural policies of the city shall govern the electrical code board in all of its operations.
(10) Duties when serving as an appeals board. Any person who is aggrieved by a decision
of the building official on any requirements resulting from the enforcement of the electrical
code, may appeal from such decision to the electrical code board and said board shall
serve as an appeal board. In case the aggrieved party is a member of said board, said
member shall be disqualified as a member of the board acting as an appeal board, until the
person aggrieved has been heard and a decision rendered.

(a) The City Council hereby establishes a Commission to be known as the Cable Regulatory
Commission, and which shall exist throughout the term of the cable franchise.
(b) The Commission shall have the following purposes and duties:
(1) To keep abreast of developments in cable technologies, services and programming;
(2) To become competent in cable regulation, finances and standards of operation;
(3) To act through the Cable Franchise Administrator as the local regulatory agent of the
cable franchise;
(4) To develop policies for the day-to-day regulation and administration of the cable
franchise;
(5) To encourage cordial relations between cable subscribers and the local cable manager
and the local cable manager's staff;
(6) To develop policies for handling and resolving subscriber complaints which could not be
resolved satisfactorily by the cable manager;
(7) To monitor the operation of the cable system;
(8) To counsel the City Council regarding rates and possible revocation procedures;
(9) To advise the City Council on any matter relating to the cable franchise or system;
(10) To consult with the Cable Franchise Administrator and the local cable manager on the

(a) The Commission shall consist of five (5) members appointed by the City Council. In its
appointments the Council shall endeavor to develop a Commission versed and competent
in telecommunication administration, finances and regulation. The Council shall appoint
only residents of the City and shall attempt to give preference to applicants who possess
professional or experiential backgrounds in law, finances, administration, public relations,
or telecommunication technologies. The Cable Franchise Administrator and anyone who is
an owner, shareholder, employee, or agent of the City's cable franchise holder shall be
ineligible to serve as a member of the Commission.
(b) The term for each member shall be three (3) years with terms expiring each June, except
those of the initial appointees only, one appointment shall have a one year term and two (2)
appointments shall have two (2) year terms. If a vacancy occurs before the expiration of a
term, the appointment shall be for the unexpired portion of that term. If the Council fails to
make an appointment upon the expiration of a term, the incumbent shall continue to serve
until an appointment shall be made. If any member fails to attend at least two-thirds (2/3) of
the regularly scheduled Commission meetings in a twelve (12) month period, the
Commission may request the Council to declare that member's seat vacant. Attendance of
all members shall be entered in the minutes.
(c) In odd-numbered years, the members shall elect a presiding officer from among
themselves and an official secretary. The City's Cable Franchise Administrator shall be
adviser to the Commission and City staff shall perform secretarial and administrative duties
for the Commission as requested by the Commission. (1976 Code, § 36-177)

The commission created by this article shall consist of nine (9) members. (1976 Code, §

Sec. 27-18. Appointment; Terms; Filling of Vacancies:
Human rights commission members shall be appointed by the city council for terms of
three (3) years each and shall serve thereafter until a successor has been appointed.
Vacancies shall be filled for the remainder of the unexpired term. Appointments shall
take into consideration the various racial, religious, cultural and social groups of the city.

Sec. 27-27: Powers And Duties:
The commission created by this article shall have the following powers and duties:
(1) To receive, investigate and finally determine the merits of complaints alleging
unfair or discriminatory practices.
(2) To investigate and study the existence, character, causes and extent of
discrimination in public accommodations, employment, apprenticeship programs, on
the job training programs, vocational schools, other educational institutions and
housing in this city and to attempt the elimination of such discrimination by education
and conciliation.
(3) To hold hearings upon any complaint made against a person, an employer, an
employment agency or a labor organization, or the employees or members thereof,
to subpoena witnesses and compel their attendance at such hearings, to administer
oaths and take the testimony of any person under oath and to compel such person,
employer, employment agency or labor organization, or employees or members
thereof, to produce for examination any books and papers relating to any matter
involved in such complaint. The commission shall issue subpoenas for witnesses in
the same manner and for the same purpose on behalf of the respondent upon the
respondent's request. Such hearings may be held by the commission, by any
commissioner or by any hearing examiner appointed by the commission. If a witness
either fails or refuses to obey a subpoena issued by the commission, the
commission may petition the district court having jurisdiction for issuance of a
subpoena and the court shall, in a proper case, issue the subpoena. Refusal to obey
such subpoena shall be subject to punishment for contempt.
(4) To issue such publication and reports of investigations and research as in the
judgment of the commission shall promote civil and respectful behavior which shall
tend to eliminate discrimination.
(5) To prepare and transmit to the mayor and city council, from time to time, but not
less often than once each year, reports describing its proceedings, investigations,
hearings conducted and the outcome thereof, decisions rendered and the other work
performed by the commission.
(6) To make recommendations to the city council legislation concerning
discrimination.
(7) To cooperate, within the limits of any appropriations made for its operation, with
other agencies or organizations, both public and private, whose purposes are
consistent with those of this chapter, in the planning and conducting of programs
designed to eliminate discrimination or cultural and intergroup tensions.
(8) To adopt, publish, amend and rescind regulations consistent with and necessary
for the enforcement of this chapter.
(9) The commission may delegate any of its functions, duties and powers to its staff
including functions, duties and powers with respect to investigating, conciliating,
determining, certifying, reporting or otherwise acting as to any work, business or
matter under this chapter.
(10) To receive, administer, dispense and account for any restricted funds that may
be voluntarily contributed to the commission and any grants that may be awarded
the commission for furthering the purposes of this chapter. No disbursements will be
made of any restricted funds without authority from the city council. (1976 Code, §
