The proposed subdivision is located west of John F. Kennedy Road and south of the Northwest Arterial. The subject subdivision provides for the platting of 32 new residential lots. DISCUSSION The submitted final plat provides for the construction of two new public streets, One is to be named Peach Tree Lane. The other is a small stub street to be named Charleston Court. Peach Tree Lane will be built to the City's residential street standard of 3'I-foot of paving within a 50-foot right-of-way. Peach Tree Lane will connect with David Drive, which is a collector street that serves Wynstone Subdivision and connects to John F. Kennedy Road. Peach Tree Lane will be built to loop around through the subdivision and will reconnect with David Drive in the future when 35 acres of land owned by the Hacienda Land Corporation is developed. Charleston Court will serve the adjacent property to be developed as Pebble Cove Subdivision #2. The Engineering and Water Departments have reviewed the submitted final plat and improvement plans for compliance with storm water control, sanitary sewer and water main installation requirements and codes. Lot B, located on the south end of the proposed subdivision, will be the location for the storm water detention basin serving the proposed subdivision, The developers are proposing to dedicate Lot A to the City of Dubuque for park purposes. Leisure Services Manager Gil Spence is supportive of the dedication of Lot A as park land, and will budget funds in the future for installation of playground equipment. Subdivision Staff Report -Final Pfat of Pebble Cove Subdivision Page 2 Conformance with Comprehensive Plan: This 2030 Future Land Use Map designates the property as multi-family residential. This proposal implements the Comprehensive Plan Land Use Element: Goal 1.2, 1.5, 4.3, 7.1 and 7.2. Impact of Reques# on: Utilities: City Water and Sanitary sewer service are available to the subjec# parcel. City water is available in David Drive and will be extended through the subdivision and stubbed out to adjacent property owned by the Hacienda Land Corporation. The City sanitary sewer main runs through the middle of the property and will be extended to serve tl~e individual properties within the subdivision. ' Traffic Patterns: The proposed subdivision will be primarily served by a, single street, Peach Tree Lane. Access to the subdivision will be byway of David Drive which is the collector street within Wynstone Subdivision. David Drive connects with John F. Kennedy Road on the east and when the Hacienda Land Corporation property is developed, will be extended westward through that future subdivision. No traffic counts are available. Public Services Existing public services are adequate to serve the site Environment: Staff does not anticipate any adverse impact #o the environment provided adequate erosion control is provided during al[ phases of development of the project. Prior to any grading, both a State of Iowa and City of Dubuque permit wi11 be required to ensure compliance with State and City erosion control requirements. Adjacent Properties: The most likely impact to adjacent properties will be an increase in vehicle trips on David Drive. Recommended Conditions on Plat:- None. Staff Analysis: The submitted final plat of Pebble Cove Subdivision subdivides approximately 17 acres of land into 32 single-family home building lots. The subject property is located near the southwest corner of the Northwest Arterial and John F. Kennedy Road. Access to the new subdivision will be from an existing stub street on the north side of David Drive, an existing collector street within Wynstone Subdivision. The new proposed roadway, Peach Tree Lane, will loop through the 17-acre parcel and stub at property owned by Hacienda Land Corporation. The submitted final plat also shows a small stub street to be named Charleston Court. This stub street will serve the adjacent property proposed to be developed as Pebble Cove #2. Subdivision Staff Report -Final Plat of Pebble Cove Subdivision Page 3 The submitted final plat of Pebble Cove Subdivision is in compliance with the City's Comprehensive Plan as it promotes in-fill development, use of existing infrastructure and the property is designated for multi-family residential on the. 2030 Future Land Use Map of the Comprehensive Plan. The developer's have indicated a willingness to donate Lat A to the City of Dubuque as park land that would principally serve this subdivision. Typically, the land is rough graded by the developer as part of the grading in the subdivision and the City budgets far the final grading and installation of the playground facilities. Both roadways within the proposed subdivision will be built to the City's residential street standards of 50-foot right-of--way and 31-foot of paving from back of curb to back of curb. City water and sewer are available to the subject property and will be extended throughout the subdivision to serve the 32 building lots. The submitted final plat designates Lot B as a detention basin. The developer will dedicate the detention area to the City for public maintenance. The proposed final plat of Pebble Cove Subdivision is in substantial compliance with the City of Dubuque Subdivision Regulations and Planning staff recommends approval of the final plat as submitted. Citv Clerk Address: Citv Hall- 50 W. 13t" St Telephone: 589-4121 RESOLUTION NO. 171-08 A RESOLUTION AUTHORIZING APPROVING FINAL PLAT OF PEBBLE COVE IN THE CITY OF bUBUQUE, IOWA Whereas, there has been filed with the City Clerk a final plat of Pebble Cove in the City of Dubuque, Iowa; and Whereas, upon said final plat appears streets to be known as Peach Tree Lane (Lot C) and Charleston Court (Lot D), together with certain public utility, storm sewer, sanitary sewer and water main easements, storm water detention facility (Lot B) and park land (Lot A), which the owners by said final plat have dedicated to the public forever; and Whereas, said plat provides 0 feet of frontage for Lot B, where 50 feet is required by Section 42-19(b) of the Subdivision Regulations; and Whereas, the preliminary plat has. been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said final plat has been reviewed by the City Planner and had her approval endorsed thereon; subject to the owner's agreeing to the conditions noted in Section 3 below; and Whereas, said final plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating to it, except that no streets or public utilities have yet been constructed or installed. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the dedication of Peach Tree Lane (Lot C) and Charleston Court (Lot D) together with park land (Lot A) and the easements for public utilities, sanitary sewer, storm sewer and water mains, as they appear on said final plat, be and the same are hereby accepted; and Section 2. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot B to have 0 feet of frontage, where 50 feet of frontage is required; and Section 3. That the Final Plat of Pebble Cove is hereby approved by the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon said final plat, provided the owners of said property herein named, execute their written acceptance hereto attached agreeing: (a) To reduce Peach Tree Lane (Lot C) and Charleston Court (Lot D) to grade and to construct concrete curb and gutter and to hard surface with asphaltic concrete, or with concrete paving with integral curb, all in accordance with the City of Dubuque standard specifications, all in a manner acceptable to the City Engineer, in conformance with construction improvement plans approved by the City Engineer, and inspected by the City Engineer. (b) To install sanitary sewer mains and sewer service laterals into each individual lot, water mains and water service laterals into each individual lot, storm sewers and catch basins, boulevard street lighting and erosion control devices all in accordance with the City of Dubuque standard specifications, all in a manner acceptable to the City Engineer, and in accordance with construction improvement plans approved by the City Engineer, and inspected by the City Engineer. (c) To construct a storm water detention facility (Lot B) in a manner acceptable to the City Engineer, in accordance with the City of , Dubuque standard specifications approved by the City Engineer, and inspected by the City Engineer. (d) To construct said improvements, prior to two (2) years from the date of acceptance of this resolution, at the sole expense of the owners, or future owner; (e) To maintain the public improvements, for a period of two (2) years from the. date of the acceptance of those improvements by the City Council of the City of Dubuque, Iowa, at the sole final expense of the owners, or future owner; And, further provided that said Kivlahan Farms, L.C., as owners of said property, shall secure the performance of the foregoing conditions provided in this Section by providing guarantees in such form and with such sureties as may be acceptable to the City Manager of the City of Dubuque, Iowa. 2 Section 4. Sidewalk installation shall be the responsibility of the owner abutting the public rights-of-way, including lots with multiple frontages, as required by City Code 41-100 through 42-24. Section 5. Upon the City's acceptance of the detention facility, the maintenance expenses incurred by the City of Dubuque for the storm water detention facility (Lot B) shall be assessed against the lot owners of all additions in Pebble Cove and Pebble Cove #2 as indicated in the preliminary plats, in equal amounts, and the City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify such costs to the Dubuque County Treasurer, and such costs shall then be collected with and in the same manner as general property taxes in accordance with provisions of law. Section 6. That the final acceptance of all public improvements shall occur upon certification of the City Engineer to the City Council that all public improvements have been completed in accordance with the improvement plans and City standard specifications and accepted by City Council Resolution. Section 7. That in the event Kivlahan Farms, L.C., fails to execute the acceptance and furnish ,the guarantees provided in Sections 2 and 3 hereof within 180 days after the date of this Resolution, the provisions hereof shall be null and void and the acceptance of the dedication and approval the-plat shall not be effective.
