INTRODUCTION
Kivlahan Farms, L.C. has submitted the final plat for Pebble Cove #2 Subdivision. The
proposed subdivision subdivides approximately eight acres of land into 14 two-family
residential lots.
DISCUSSION
The submitted final plat provides for the construction of Charleston Court. The cul-de-
sac will be built to the City's residential street standards of 31-foot of paving within a 50-
foot right-of-way. Charleston Court connects with Peach Tree Lane, which is proposed
as a public street in Pebble Cove Subdivision immediately to the east. Charleston Court
terminates at the right-of-way for the Northwest Arterial. No access is proposed to the
Northwest Arterial.
The Engineering and Water Departments have reviewed the submitted final plat and
improvement plans for compliance with the storm water control, sanitary sewer and
water main installation requirements and codes. The submitted final plat provides for a
detention basin located on Lot A of the subdivision.
The applicants are proposing the dedication of Lot B and Lot C to the City of Dubuque
for parkland. Leisure Services Manager Gil Spence has reviewed the proposal and is in
agreement with the dedication of Lot B, only, but would reserve it as open space as Lot
A is being designated in Pebble Cove Subdivision for a City park with playground
equipment.
In Pebble Cove #2, Charleston Court will provide access to Peach Tree Lane in Pebble
Cove Subdivision. Peach Tree Lane will intersect with David Drive in Wynstone
Subdivision when it is extended. Until that connection is made, 66 dwelling units will be
served by a single access of 2,200 feet. City Engineering Standards are for a maximum
cul-de-sac length of 1,300 feet. Since the developer is providing the necessary street to

comply with the City's Policy for secondary access in the future, staff has no objection to
approving the plat as submitted.
RECOMMENDATION
Staff recommends City Council approve the final plat of Pebble Cove #2 as the
submitted final plat is in substantial compliance with the City of Dubuque Subdivision
Regulations, subject to waiving the lot frontage requirements for Lot A and the City
Engineering Standards for maximum cul-de-sac length.

Impact of Request on:
Utilities: Existing City water and sanitary sewer services are available to the subject
parcel. City water is available currently in David Drive and along the Northwest
Arterial. The water main will need to be extended to the subdivision through the
applicant's existing property previously approved as the first phase of Pebble Cove
Subdivision. The sanitary sewer main runs through the property owned by the
applicant to the east, and is also part of the first phase of Pebble Cove, and can be
extended along Charleston Court to serve the proposed lots in Pebble Cove #2.
Traffic Patterns: The proposed subdivision will be served by a single cul-de-sac to
be called Charleston Court. This roadway will be built to the City's residential street
standard of 31-foot of paving within a 50-foot right-of-way. No traffic counts are
available at this time.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development of
the property. Prior to any grading, both the State of Iowa and City of Dubuque
permit will be required to insure compliance with the State and City erosion control
requirements.
Adjacent Properties: The most likely impact to adjacent properties will be an
increase in vehicle trips on David Drive.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted final plat of Pebble Cove Subdivision #2 subdivides
approximately eight acres of land into 14 building lots zoned R-2 Two-Family
Residential District. The subject property is located along the Northwest Arterial west of
John F. Kennedy Road. The proposed subdivision is also adjacent to Pebble Cove
Subdivision, for which a final plat has also been submitted seeking approval for 32
single-family lots. The proposed final plat of Pebble Cove #2 would use an extension of
Charleston Court to serve the subject property. No access to the Northwest Arterial is
proposed.
The submitted final plat of Pebble Cove Subdivision #2 is in compliance with the City's
Comprehensive Plan as it promotes in-fill development and use of existing
infrastructure. The property is designated for multi-family residential and commercial
on the 2030 Future Land Use Map of the Comprehensive Plan.
The proposed subdivision will be served by an extension of Charleston Court.
Charleston Court is also part of the final plat.for Pebble Cove Subdivision that is directly

east of the subject parcel. Attached are the final plat of Pebble Cove and the final plat
for Pebble Cove #2, which illustrates the future street network system. As shown on
the final plat of Pebble Cove, Peach Tree Lane will intersect with David Drive, which is
a collector street serving the Wynstone Subdivision, and eventually loop back to
property owned by the Hacienda Land Corporation. Once David Drive is extended in
the future to serve a development on the Hacienda Land Corporation property, Peach
Tree Lane will intersect with David Drive again, and complete the loop. However, until
that connection is made in the future, approximately 66 dwelling units will be served by
a single access that will extend approximately 2,200 feet. City Engineering Standards
indicate that a maximum cul-de-sac length of 1,300 feet. Planning staff typically looks
for a second means of access when a cul-de-sac length extends over 1,300 feet or the
number of units exceeds approximately 30-35 units. In the present case, there is a
potential that both phases of Pebble Cove Subdivision could be developed prior to
having a second access to David Drive. Engineering and Planning staff believe that
while initially the proposed development of Pebble Cove Subdivision and Pebble Cove
#2 would exceed the City's policy for secondary access, since the developer is
providing the necessary street to comply with the City's policy on secondary access,
staff has no objection to the proposed street layout.
The proposed extension of Charleston Court will be built to the City's residential street
standard of 50-foot of right-of-way and 31-foot of pavement from back of curb to back of
curb. Storm water control for the subdivision will be provided by a detention basin
located on Lot A at the west end of Charleston Court. This lot does not meet City
standards for frontage; however, because the access is only needed for future
maintenance of the detention basin, staff has not objection to waiving the lot frontage
for Lot A.
The applicant is proposing to dedicate Lots B and C to the City for park land. Staff is
recommending dedication of Lot B only for open space.
The proposed final plat of Pebble Cove #2 is in substantial compliance with the City of
Dubuque Subdivision Regulations subject to waiving the lot frontage requirement for Lot
A, and City Engineering standards for maximum cul-de-sac length.

RESOLUTION NO. 172 - 08
A RESOLUTION AUTHORIZING APPROVING FINAL PLAT OF PEBBLE COVE #2 IN
THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a final plat of Pebble Cove #2
in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears streets to be known as Charleston Court
(Lot C), together with storm water detention facility (Lot A) and park land (Lot B) and
certain public utility, storm sewer, sanitary sewer and water main easements, which the
owners by said final plat have dedicated to the public forever; and
Whereas, said plat provides 14.20 feet of frontage for Lot A, where 50 feet is
required by Section 42-19(b) of the Subdivision Regulations; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon; subject to the owners agreeing to the conditions noted in
Section 3 below; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that no streets or
public utilities have yet been constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Charleston Court (Lot C) together with open
space (Lot B) and the. easements for public utilities, sanitary sewer, storm sewer and
water mains, as they appear on said final plat, be and the same are hereby accepted;
and

Section 2. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot A to have 14.20 feet of frontage, where 50 feet of frontage is required, and the
City Engineering Standards are waived to allow a cul-de-sac of 2,200 feet, where a
maximum 1,300 feet is required; and
Section 3. That the Final Plat of Pebble Cove #2 is hereby approved by the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa, upon said final plat, provided the owners of said property herein
named, execute their written acceptance hereto attached agreeing:
(a) To reduce Charleston Court (Lot C) to grade and to construct
concrete curb and gutter and to hard surface with asphaltic
concrete, or with concrete paving with integral curb, all in
accordance with the City of Dubuque standard specifications, all in
a manner acceptable to the City Engineer, in conformance with
construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(b) To install sanitary sewer mains and sewer service laterals into each
individual lot, water mains and water service laterals into each
individual lot, storm sewers and catch basins, boulevard street
lighting and erosion control devices all in accordance with the City
of Dubuque standard specifications, all in a manner acceptable to
the City Engineer, and in accordance with construction
improvement plans approved by the City Engineer, and inspected
by the City Engineer.
(c) To construct a storm water detention facility (Lot A) in a manner
acceptable to the City Engineer, in accordance with the City of
Dubuque standard specifications approved by the City Engineer,
and inspected by the City Engineer.
(d) To construct said improvements, prior to the two (2) years from the
date of acceptance of this resolution, at the sole expense of the
owners, or future owner.
(e) To maintain the public improvements, for a period of two (2) years
from the date of the acceptance of those improvements by the City
Council of the City of Dubuque, Iowa, at the sole final expense of
the owners, or future owner;
And, further provided that said Kivlahan Farms, L.C., as owners of said property,
shall secure the performance of the foregoing conditions provided in this Section by
providing guarantees in such form and with such sureties as may be acceptable to the
City Manager of the City of Dubuque, Iowa.

Section 4. Sidewalk installation shall be the responsibility of the owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code 41-100 through 42-24.
Section 5. Upon the City's acceptance of the detention facility, the
maintenance expenses incurred by the City of Dubuque for the storm water detention
facility (Lot B) shall be assessed against the lot owners of all additions in Pebble Cove
and Pebble Cove #2 as indicated in the preliminary plats, in equal amounts, and the
City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify
such costs to the Dubuque County Treasurer, and such costs shall then be collected
with and in the same manner as general property taxes in accordance with provisions of
law.
Section 6. That the final acceptance of all public improvements shall occur
upon certification of the City Engineer to the City Council that all public improvements
have been completed in accordance with the improvement plans and City standard
specifications and accepted by City Council Resolution.
Section 7. That in the event Kivlahan Farms, L.C., fails to execute the
acceptance and furnish the guarantees provided in Sections 2 and 3 hereof within 180
days after the date of this Resolution, the provisions hereof shall be null and void and
the acceptance of the dedication and approval the plat shall not be effective.
