Sealed bids were received for the Dubuque Industrial Center West -Chavenelle Court
2008 project on May 8, 2008. Five contractors submitted bid proposals, however,
during the public bid opening there was a technical irregularity noted with one of the
bids received. Because of the potential for litigation regarding the qualification of the
bid, both City staff and City Attorney Barry Lindahl are recommending that all bid
proposals received be rejected and the project re-bid.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution rejects all construction contract bid proposals received and
authorizes staff to re-advertise for proposals under the public bidding procedure for the
Dubuque Industrial Center West -Chavenelle Court 2008 Project.
BACKGROUND
Chavenelle Court will be a new street located south of Chavenelle Road serving 48.6
acres of industrial property in the lower level of the Dubuque Industrial Center West.
The new street, Chavenelle Court, is needed to accommodate the Hormel project.
Chavenelle Court will be a 31-foot back-to-back roadway, with the roadway widening to
45 feet in order to accommodate aright- and left-turn lane at its intersection with
Chavenelle Drive. The project will also include street lighting, landscaping, the
installation of a watermain, storm sewer, fiber optic conduit and junction boxes. A
sidewalk will not be paved at this time, although the sidewalk berm will be graded to
accommodate the future placement of a sidewalk on the west side and a future trail on
the east side.
Specifically, the project involves: 1,453 lineal feet of 6-inch through 16-inch DIP
watermain; 1,017 lineal feet of 15-inch through 36-inch RCP storm sewer; 6,491 square
yards of 9-inch PCC; 1,600 lineal feet of 4-inch HDPE conduit; 8 street lights; and 57
trees.
BID RESULTS

that all bid proposals received be rejected and the project re-bid.
The City of Dubuque Standard Specifications includes the provision which allows the
City Council to reject any and all bids or to waive any technicalities or irregularities.

It is the intent of City staff to immediately re-bid the project based on the following
project schedule:

RECOMMENDATION
I recommend that the City Council reject all of the construction contract bid proposals
received, authorize the City Clerk to re-advertise for proposals under the public bidding
procedure, and to establish the date for awarding the construction contract.

NOTICE TO BIDDERS
CITY OF DUBUQUE PUBLIC IMPROVEMENT PROJECT
DUBUQUE INDUSTRIAL CENTER WEST - CHAVENELLE COURT 2008
Time and Place for Filina Sealed Proposals. Sealed bids for the work comprising
each improvement as stated below must be filed before 2:00 p.m. on the 5th day of
June, 2008, in the Office of the City Clerk, City Hall -First Floor, 50 West 13th Street,
Dubuque, Iowa.
Time and Placed Sealed Proposals Will be Opened and Considered. Sealed
proposals will be opened and bids tabulated at 2:00 p.m. on 5th day of June, 2008, at
City Hall -Conference Room B, 50 West 13th Street, Dubuque, Iowa, for consideration
by the City Council (Council) at its meeting on June 16th, 2008. The City of Dubuque,
Iowa, reserves the right to reject any and all bids.
Time for Commencement and Completion of Work. Work on each improvement
shall be commenced within 10 days after the Notice to Proceed has been issued and
shall be fully completed within 60 calendar days.
Bid Security. Each bidder shall accompany its bid with a bid security as security that
the successful bidder will enter into a contract for the work bid upon and will furnish after
the award of contract a corporate surety bond, acceptable to the governmental entity,
for the faithful performance of the contract, in an amount equal to one hundred percent
of the amount of the contract. The bid security shall be in the amount of ten percent
(10%) of the amount of the contract and shall be in the form of a cashier's check or
certified check drawn on astate-chartered or federally chartered bank, or a certified
share draft drawn on astate-chartered or federally chartered credit union, or the
governmental entity may provide for a bidder's bond with corporate surety satisfactory
to the governmental entity. The bid bond shall contain no conditions excepted as
provided in this section.

Preference for Iowa Products and Labor. By virtue of statutory authority, preference
will be given to products and provisions grown and coal produced within the State of
Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa statutes.
Sales Tax. The bidder should not include sales tax in its bid. A sales tax exemption
certificate will be available for all material purchased for incorporation in the project.

RESOLUTION NO. 173-08
REJECTING THE CONTRACT BID PROPOSALS FOR THE DUBUQUE
INDUSTRIAL CENTER WEST - CHAVENELLE COURT 2008 PROJECT AND
ORDERING THAT THE PROJECT BE RE-BID
Whereas, sealed proposals have been submitted by contractors for the
Dubuque Industrial Center West -Chavenelle Court 2008 Project, pursuant to
Resolution No. 128-~8 and notice to bidders published in a newspaper published
in the City of Dubuque, Iowa, on the 25t" day of April, 2008; and
Whereas, the sealed proposals were opened and read on the 8t" day of
May, 2008.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. All of the bid proposals received for the Dubuque Industrial
Center West -Chavenelle Court 2008 Project are hereby rejected.
Section 2. The City Treasurer is authorized and instructed to return the
bid deposits of the unsuccessful bidders.
Section 3. The City Clerk is hereby directed to re-advertise for bids for
the construction of the Dubuque Industrial Center West -Chavenelle Court 2008.
