Historic Preservation Commission Established; Membership; Term Of Office; Vacancies In Office: This section has been affected by a recently passed ordinance, ORDINANCE NO. 28- 07: VACANT DISTRICT SEATS. (see last page) (a) The historic preservation commission is hereby established and shall consist of nine (9) members who shall be residents of the city. (b) Members of the commission shall be appointed by the city council as follows: one resident from each designated historic preservation district, including the districts hereinafter established; and four (4) at large members. Each member shall possess qualifications evidencing expertise or interest in architecture, history, archeology, law, construction or building rehabilitation, city planning or conservation in general. One commission member shall be a licensed architect. (c) Members shall serve three (3) year terms. (d) Vacancies occurring in the commission, other than through expiration of term of office, shall be only for the unexpired portion of the term of the member replaced. Each member shall serve until the appointment of a successor. (e) Members may serve for more than one term. (f) Vacancies shall be filled by the city council in accordance with the requirements set forth above. (g) Members shall serve without compensation. (Ord. 18-01, § 1, 3-19-2001; Ord. 74- 03, § 1, 9-15-2003, eff. 10-17-2003) Sec. 25-4. Election Of Officers; Organization; Rules And Bylaws; Conduct Of Meetings; Record Of Actions; Attendance At Meetings: (a) The commission shall elect from its membership a chairperson and vice chairperson, whose terms of office shall be fixed by bylaws adopted by the commission. The chairperson shall preside over meetings of the commission and shall have the right to vote. The vice chairperson shall, in cases of absence or disability of the chairperson, perform the duties of the chairperson. (b) The city manager shall designate a person to serve as secretary to the commission. The secretary shall keep a record of all resolutions, proceedings and actions of the commission. (c) The commission shall adopt rules or bylaws for the transaction of its business. The bylaws shall provide for, but not be limited to, the time and place of holding regular meetings, the procedure for the calling of special meetings by the chairperson or by at least three (3) members of the commission and quorum requirements. (d) All meetings of the commission shall be subject to Iowa Code chapter 21, the Iowa open meetings act. (e) The commission shall keep a record of its resolutions, proceedings and actions. The records shall be subject to Iowa Code chapter 22, the Iowa public records act. (f) A quorum of the commission shall be required in order to transact business. (g) The affirmative vote of a majority of commission members present at a meeting shall be required for the approval of plans or the adoption of any resolution, motion or other action of the commission. (h) The vote of each member of the commission shall be recorded. (i) A member of the commission shall attend at least two-thirds (2/3) of all scheduled meetings within any consecutive twelve (12) month period. If any member does not attend such prescribed number of meetings it shall constitute grounds for the commission to recommend to the city council that said member be replaced. Attendance of all members shall be entered on the minutes. Q) The commission shall file with the city council a copy of the minutes of each regular and special meeting of the commission within ten (10) working days after each meeting. (Ord. 18-01, § 1, 3-19-2001) Sec. 25-5. Powers And Duties Generally; Procedures For Operations: (a) The general duties and powers of the commission shall be as follows: (1) To promote and conduct educational and interpretive programs on historic properties within its jurisdiction; (2) To develop and adopt specific standards for review and design guidelines, in addition to those set forth in subsection 25-10(a) of this chapter, for the alteration of landmarks, landmark sites or property and structures within historic districts; (3) To adopt its own bylaws; (4) To identify, evaluate, register, manage and protect significant prehistoric and historic archeological sites; (5) To conduct an ongoing survey to identify historically, archaeologically and architecturally significant properties, structures and areas that exemplify the cultural, social, economic, political, archeological or architectural history of the nation, state or city; (6) To research and recommend to the city council the adoption of ordinances designating areas as having historic, architectural, archeological or cultural value or significance as "historic districts"; (7) To research and recommend to the city council the adoption of ordinances designating properties or structures having historic, architectural, archeological or cultural value or significance as "landmarks" or "landmark sites"; (8) To maintain a register of all properties and structures which have been designated as landmarks, landmark sites or historic districts, including all information required for each designation; (9) To assist and encourage the nomination of landmarks, landmark sites and historic districts to the national register of historic places, and review and comment at a public hearing on any national register nomination submitted to the commission upon the request of the mayor, city council or the state bureau of historic preservation; (10) To confer recognition upon the owners of landmarks or of property or structures within historic districts; (11) To review in-progress or completed work to determine compliance with specific certificates of appropriateness or certificates of economic nonviability; and (12) To serve as an advisory design review body to the city council for review of public works projects which have historic preservation implications in historic districts, or for alteration of landmarks, landmark sites or structures, that would result in a material change in appearance or be visible from the public way. (b) The commission shall be governed by the administrative, personnel, accounting, budgetary and procurement policies of the city. AN ORDINANCE AMENDING CHAPTER 25 (HISTORIC PRESERVATION) OF THE CITY OF DUBUQUE CODE OF ORDINANCES BY ADDING A NEW SECTION 25-3(h) TO ALLOW OWNERS OF REAL PROPERTY AND OWNERS OF BUSINESSES IN THE DISTRICT TO BE TEMPORARILY APPOINTED TO VACANT DISTRICT SEATS UNTIL SUCH A TIME A QUALIFIED RESIDENT CAN BE APPOINTED. Whereas, the Historic Preservation Commission has experienced occasional vacancies in membership due to the absence of qualified applicant for vacant seats on the Commission which seats require that the appointee be a resident of the district: and Whereas, the Historic Preservation Commission has found that such vacancies have in some instances reduced the effectiveness of the Commission; and Whereas, the Historic Preservation Commission has recommended an amendment to Chapter 25 (Historic Preservation) of the City of Dubuque Code of Ordinances to allow owners of real property and owners of businesses in the district to be temporarily appointed to vacant district seats until such a time a qualified resident can be appointed; and Whereas, the City Council concurs with the recommendation to allow owners of real property and owners of businesses in the district to be temporarily appointed to vacant district seats until such a time a qualified resident can be appointed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Section 25-3 of the City of Dubuque Code of Ordinances is hereby amended by adding the following new paragraph (h): Sec. 25-3. Historic Preservation Commission Established; Membership; Term of Office; Vacancies in Office: (h) In the event that a vacancy occurs in a seat which requires that the appointee be a resident of the district and for which there is no application from a qualified resident, the City Council may appoint a person who is an owner of real property in the district or an owner of a business in the district to the vacant seat. This appointment shall be temporary and a resident of the district may at any time apply to fill this seat. Upon appointment of a qualified resident to this seat by the City Council, the temporary appointment shall terminate. Section 2. Long-Range Planning Advisory Commission Created; Composition: There is hereby created a city long-range planning advisory commission, which shall consist of seven (7) members including a member of the city council designated by the council and six (6) residents of the city appointed by the city council who shall be qualified by their knowledge, experience and ability to contribute to the city's long-range planning and development efforts. (Ord. 11-90, § 2, 2-5-1990) Sec. 36-6. Term; Filling of Vacancies; Compensation: The term of office for a resident member shall be three (3) years or until a successor is duly appointed. Two (2) of the initial terms shall be for a term of one year; two (2) of the initial terms shall be for two (2) years; and two (2) of the initial terms for three (3) years. A commission member may be removed at any time with or without cause by a vote of two-thirds (2/3) of all members of the city council. A vacancy occurring on the commission caused by resignation or otherwise, shall be filled by appointment by the city council for the remainder of the unexpired term. Powers: The commission shall have the following powers, duties and responsibilities: (1) To provide a leadership role in the planning, coordinating and sponsoring of a periodic community planning process; (2) To coordinate and supervise the preparation and maintenance of the comprehensive plan; (3) To provide input to the city manager in the preparation of the city manager's recommended multi-year capital improvement program (CIP); (4) To make comprehensive studies of the present condition and the future growth of the city to provide input into the community planning process and to guide and accomplish a coordinated, consistent and harmonious development of the city in accordance with the present and future needs thereof to the end that the health, safety, morals, order, convenience, prosperity and general welfare may be promoted; (5) To make or cause to be made such surveys, studies, maps, plans, or charts of the city with due regard to its relation to neighboring territory as may be determined as necessary to carry out the purposes of the commission; (6) To recommend amendments to all or a part of the comprehensive plan in response to the community planning process, upon its own initiative or upon recommendation presented by the zoning advisory commission, but only after a public hearing; (7) To review proposed urban renewal plans and urban renewal plan amendments and urban revitalization plans and urban revitalization plan amendments for consistency with the comprehensive plan for the city; (8) To undertake public information efforts to enhance public understanding of the community planning process generally and the comprehensive plan specifically; and (9) To undertake from time to time other specific long-range planning projects which may be referred to it by the city council. Organization The commission shall choose annually, at its first regular meeting of the fiscal year, one of its members to act as chairperson, and another of its members to act as vice- chairperson, to perform all of the duties of the chairperson during the chairperson's absence or disability. The Commission shall adopt such rules and regulations governing its organization and procedures as it may be deemed necessary. (1) The Commission shall meet as necessary to fulfill the purposes of which the Commission was created. (2) Members of the Commission shall attend at least two-thirds (2/3) of all regularly scheduled meetings within any twelve (12) month period. If any member fails to attend such prescribed number of meetings, such failure shall constitute grounds for the Commission to recommend to the City Council that said member be replaced. (2) Establish rules and regulations for all recreational programs provided by the City, including the establishment and collection of fees for participation by the public in such activities. Cooperation With Other Agencies: In the conduct and operation of recreation grounds and recreation programs, the Commission shall cooperate with the Dubuque Community School District, Archdiocese School System and all other groups interested in the promotion and implementation of recreational activities which are in the best interest of the City. Membership, Appointment: (a) The Commission shall be comprised of a membership of seven (7) persons who shall be appointed by the City Council for terms of three (3) years. All action of the Commission shall be by resolution and the affirmative vote of at least four (4) members shall be necessary for the adoption of any resolution. Established; Purposes and Duties: (a) The City Council hereby establishes a commission to be known as the Community Tele-Programming Commission, and which shall continue to exist at the pleasure of the Council. (b) The Commission shall have the following purposes and duties: (1) To develop, in respect to community programming, policies which shall govern: a. The use and protection of equipment and facilities, b. The availability and use of technical assistance, c. All training programs, d. The priorities and scheduling for use of channel time, and e. Fund raising and sponsorship revenues; (2) To develop, in respect to the public community programming channel, policies and procedures which shall: a. Limit its use to residents of Dubuque and their own productions; (3) To encourage interest in and development of decidedly local community programming; (4) To encourage cooperation between community programming users and the local cable manager and the local cable manager's staff; (5) To encourage, and as appropriate, assist and participate in community programming productions and training; (6) To identify and support organization of subcommunities to be responsible for the channels reserved for education, government, human services and religious programming; (7) To advise the City Manager of the duties, qualifications, selection and evaluation of the cable franchise administrator; (8) To advise the cable franchise administrator on all matters relating to community programming, including its annual budget; (9) To advise the cable franchise administrator and the local cable manager on purchase, location, use, repair, and replacement of equipment and facilities for community programming; (10) To promulgate and administer through the cable franchise administrator all policies, rules and procedures relating to community programming; (11) To evaluate its own proceedings and actions and all uses of community programming; (12) To prepare and submit to the City Council an annual report: a. On the progress throughout the year of the uses of the community programming channels, b. On the successes and failures of community programming and Commission activities, and c. Membership; Terms; Officers: (a) The Commission shall consist of seven (7) members appointed by the City Council. In its appointments, the Council shall endeavor to achieve a broad representation of the subcommunities and public interests which can take advantage of dedicated channels to benefit the residents of Dubuque. The Council shall appoint only residents of the City and shall give preference to applicants who are actively interested in promoting community cable programming who possess, or are willing to acquire, video production background, and who will relate to the spectrum of informational and cultural needs of cable viewers of Dubuque. The Cable Franchise Administrator and anyone who is an owner, shareholder, employee or agent of the franchise holder shall be ineligible to serve as a member of the Commission. The membership may include a maximum of two (2) government officers and employees. Members of the Commission who represent subcommunities utilizing dedicated channels shall not be deemed to have a conflict of interest in the use of the equipment and facilities provided for that purpose solely because of their membership on the Commission. (b) The term of each member shall be for three (3) years, with three (3) such terms expiring each June, except those of the initial appointees only, three (3) appointments shall have one year terms and three (3) appointments shall have two (2) year terms. If a vacancy occurs before the expiration of a term, the appointment shall be for the unexpired portion of that term. If the Council fails to make an appointment upon the expiration of a term, the incumbent shall continue to serve until an appointment shall be made. If any member fails to attend at least two-thirds (2/3) of the regularly scheduled Commission meetings within a twelve (12) month period, the Commission may request the Council to declare that member's seat vacant. Attendance of all members shall be entered in the minutes. (c) Annually the members shall elect from among themselves a presiding officer and a secretary whose offices shall expire the next June. Powers: The commission shall have the following powers, duties and responsibilities: (1) To provide a leadership role in the planning, coordinating and sponsoring of a periodic community planning process; (2) To coordinate and supervise the preparation and maintenance of the comprehensive plan; (3) To provide input to the city manager in the preparation of the city manager's recommended multi-year capital improvement program (CIP); (4) To make comprehensive studies of the present condition and the future growth of the city to provide input into the community planning process and to guide and accomplish a coordinated, consistent and harmonious development of the city in accordance with the present and future needs thereof to the end that the health, safety, morals, order, convenience, prosperity and general welfare may be promoted; (5) To make or cause to be made such surveys, studies, maps, plans, or charts of the city with due regard to its relation to neighboring territory as may be determined as necessary to carry out the purposes of the commission; (6) To recommend amendments to all or a part of the comprehensive plan in response to the community planning process, upon its own initiative or upon recommendation presented by the zoning advisory commission, but only after a public hearing; (7) To review proposed urban renewal plans and urban renewal plan amendments and urban revitalization plans and urban revitalization plan amendments for consistency with the comprehensive plan for the city; (8) To undertake public information efforts to enhance public understanding of the community planning process generally and the comprehensive plan specifically; and (9) To undertake from time to time other specific long-range planning projects which may be referred to it by the city council. Zoning Advisory Commission Created; Composition; Appointment: There is hereby created a City Zoning Advisory Commission, which shall consist of seven (7) residents of the City, appointed by the City Council, who shall be qualified by knowledge, experience and ability to act in matters pertaining to short-range planning and zoning, none of whom shall hold an elective position in the City. Appointment To Airport Zoning Commission: Two (2) members of the Commission shall be appointed by the City Council to serve on the Airport Zoning Commission. A member shall serve out the term on the Airport Zoning Commission even if the member's term on the Zoning Commission has expired. (Ord. 86-95, 12-18-1995) Sec. 36-11. Application And Appointment Process: The appointment process to the Commission by the City Council shall include at least the following: (1) An application form requesting basic information on the education, training, experience, expectations and other qualifications of the applicant; (2) Notice to and an opportunity for the general public to comment in writing on the qualifications of each applicant; and (3) A formal interview by the City Council to determine the applicant's qualifications and ability to effectively serve on the Commission. (Ord. 11-90, § 2, 2-5-1990) Sec. 36-12. Terms; Filling Of Vacancies; Compensation: The term of office for members of the Zoning Advisory Commission shall be three (3) years or until a successor is duly appointed. Two (2) of the initial terms shall be for a term of one year; two (2) of the initial terms for two (2) years; and three (3) of the initial terms for three (3) years. A Commission member may be removed at any time with or without cause by a vote of two-thirds (2/3) of all members of the City Council. A vacancy occurring on the Commission caused by resignation or otherwise, shall be filled by appointment by the City Council for the remainder of the unexpired term. All members of the Commission shall serve without compensation except for actual expenses, which shall be subject to approval by the Council. Powers: The Zoning Advisory Commission shall concern itself with short-range physical planning and shall have and possess the following powers, duties and responsibilities: (1) To prepare and recommend a Zoning Ordinance by exercising the powers conferred by Iowa Code chapter 414, "Municipal Zoning". Such Zoning Ordinance shall include the boundaries of the various zoning districts; the height, number of stories and size of buildings and other structures in each district; the percentage of ground that may be occupied; setback requirements; the size of yards, courts and other open space; the density of population; the location and use of buildings, structures, and land for trade, industry, commercial, residential or other purposes; and such regulations and restrictions necessary to enforce such zoning provisions. To this end the Zoning Advisory Commission shall prepare a preliminary Zoning Ordinance and hold public hearings thereon and after such hearings have been held, shall submit a final Zoning Ordinance and its recommendations to the City Council; (2) To recommend to the City Council, from time to time, as conditions require, amendments, supplements, changes or modifications to the Zoning Ordinance but only after a public hearing; (3) To make such surveys, studies, maps, plans or plats of the whole or any portion of the City and of any land outside thereof, which in the opinion of the Zoning Advisory Commission are consistent with the Comprehensive Plan and are necessary to carry out the purposes of the Commission; (4) To make recommendations to the City Council upon plans, plats or replats of subdivisions or resubdivisions within the City which show streets, alleys or other portions of the same intended to be dedicated for public use; (5) To make recommendations to the Long-Range Planning Advisory Commission on the preparation and maintenance of the Comprehensive Plan; (6) To fulfill those duties and responsibilities assigned to a City Planning Commission in Iowa Code chapter 409, "Plats"; and (7) To undertake from time to time other specific short-range planning projects which may be referred to it by the City Council.
