Dear Mr. Van Milligen:
On behalf of the Dubuque /Jackson Counties Chapter of Habitat for Humanity, I am appealing the decision rendered
by Building Services Manager, Rich Russell, to deny issuance of a building permit for the Habitat project @ 1528
Southern Avenue. A copy of the letter received from Mr. Russell on June 24"' is attached for reference.
Habitat for Humanity is a nonprofit, ecumenical Christian organization dedicated to eliminating poverty housing
worldwide. Our mission is to bring together people with resources & people in need to build simple, decent,
affordable houses. 'The homes are sold to those in need @ no profit, through a no-interest loan.
The property in question was purchased by our affiliate in late summer of last year -well prior to adoption of the
Bluff Overlay District Ordinance. Early this spring, we entered into a partnership agreement w/ St. Raphael's
Cathedral for this build in conjunction w/ their 175 year anniversary. Our lot on Southern Avenue (one of several
presently owned by the Chapter) was selected primarily for it's proximity to the Parish's district. Having recently
completed the construction documents for this build (attached), we were in the process of obtaining a permit from
the Building Services Department when the Ordinance issue came to light.
We believe granting of our appeal by City Council will not confer any special privilege that is denied by this
ordinance to other lands, structures, or buildings in the same district. Moreover, it is our position that approval of
this project will not adversely affect other property in the vicinity, & will be in harmony with the intent & purpose
of this ordinance.
To date, we've faced challenges associated w/ the site (topography) & weather (rain) that have delayed the initial
starting date for this build. As such, we respectfully request an expedited review of our appeal by City Council.

Dear Jim:
The Dubuque Building Services Department has received the plans for a
proposed Habitat house at 1528 Southern Avenue. We cannot issue a building
permit for this project, as it is located within the Bluff Overlay District recently
created by Ordinances 37-08 and 42-08.
You may appeal this decision to the City Council, based on Habitat's vested
rights to build said project.
Please appeal directly to City Clerk Jean Schneider to be placed on the July 7,
2008 City Council agenda.
