Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed lot split.
Staff reviewed the submitted plat of survey, noting that the existing parcel being split
has no frontage, and the problem would be eliminated when the lot is consolidated.
The Zoning Advisory Commission discussed the request, and felt it was appropriate.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple-majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted plat of survey of Park View No. 2 subdivides an existing parcel of land
owned by the City of Dubuque into two parcels. The lot split is being requested by an
adjacent property owner, Kevin Wade, who wishes to purchase approximately 2,000
square foot from the City to facilitate construction of a new detached garage.
DISCUSSION
The plat of survey of Park View No. 2 is being reviewed by the Zoning Advisory
Commission as the proposed lot split will not comply with City of Dubuque Subdivision
Regulations. Specifically, neither Lot 1 nor Lot 2 will have 50 feet of frontage on a
public or private street and the proposed Lot 2 will have 1,987 square feet of lot area,
where 5,000 square feet of lot area is required.
The existing parcel of land owned by the City of Dubuque currently does not have
frontage on a public or private street. This property is located below Sunnycrest Manor
and is principally a wooded hillside. The applicant proposes to split off the small parcel
of land and consolidate it with his existing parcel, which has frontage on Shiras Avenue.
RECOMMENDATION
Planning Staff recommends that the plat of survey of Park View No. 2 be approved,
subject to waiving the lot frontage requirement for Lot 1 and Lot 2, and the lot area
requirement for Lot 2.

RESOLUTION N0. 213-08
A RESOLUTION APPROVING THE PLAT OF SURVEY OF PARK VIEW NO. 2 IN THE CITY
OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey of Park View No. 2 in
the City of Dubuque, Iowa; and;
Whereas, said Plat of Survey provides 0 feet of lot frontage for Lot 1 and Lot 2, and 1,987
square feet of lot area, where 50 feet of lot frontage and 5,000 square feet of lot area are
required by Section 42-19(b) of the Subdivision Regulations; and
Whereas, the Plat of Survey has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 1 and Lot 2 to have 0 feet of lot frontage and Lot 2 to have 1,987 square feet of lot area,
where 50 feet of lot frontage and 5,000 square feet of lot area are required.
Section 2. That the Plat of Survey of Park View No. 2 is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa, upon said final plat.
