The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
Staff Member Hemenway, representing the applicant, reviewed the proposed text
amendment. He noted that the change is similar to an amendment to the PUD Ordinance
for the Dubuque Industrial Center approved in 2002. The proposed amendment does not
change the regulations related to the size, height or number of signs allowed.
A letter of support was received and filed.
The Zoning Advisory Commission discussed the request, and felt it was appropriate.
Recommendation
By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council
approves the request.
A simple-majority vote is needed for the City Council to approve the request.

SUBJECT: Sign Regulation Amendment for the Dubuque Industrial Center West
Planned Industrial District
INTRODUCTION
The City of Dubuque is requesting an amendment to the sign regulation section of the
Dubuque Industrial Center West Planned Industrial (PI) district ordinance. The
proposed amendment will allow sign content to include non-generic product names.
This regulation change will pertain to the entire Dubuque Industrial Center West PI
district.
DISCUSSION
Currently, the Dubuque Industrial Center West PI District sign regulations permit
primary signs to identify company product or services by generic name only. This
means that signs in the PI District can state "beverage distribution" for example, but
cannot use the brand name of the product(s) they distribute. The intent of the original
ordinance was to enable businesses within the industrial center to identify their
corporate name and location, but not to advertise the products they manufacture or
distribute. The City of Dubuque is asking to amend the PI sign regulations to allow sign
content to include a product's brand name. A similar amendment to the Dubuque
Industrial Center (east) PI District was requested by the Greater Dubuque Development
Corporation and Kirchhoff Distributing and was approved by the City Council on March
18, 2002.
Limiting the allowable content on primary signs within the Dubuque Industrial Center
West makes this district more restrictive than other industrial districts regulated by the
Zoning Ordinance. The Zoning Ordinance currently allows all signs in industrial
districts, other than directional signs, to advertise goods or products that pertain to the
use of the premises. These signs can advertise an establishment, merchandise,
service or product that is sold, manufactured or furnished on the premises. The
proposed change would not affect the number or size of signs permitted, just the

would enable businesses to advertise their products and would create consistent and
uniform signage within the City's two adjacent industrial parks.
RECOMMENDATION
Staff recommends that the Zoning Advisory Commission review the applicant's request
in accordance with Section 3-5.5 Planned Unit Development District PUD Regulations
of the Zoning Ordinance.

The purpose of this correspondence is to ask for your consideration and support of a
proposed change to the PUD for the Dubuque Industrial Center West. Specifically, we
ask that you amend the current regulations to allow primary signs that would identify a
specific brand/product. We believe that there are solid reasons to support the proposed
change.
First and foremost, a positive precedent has been established for this type of
amendment. In 2002, this office made a similar request for Kirchhoff Distributing
Company's new facility in the Dubuque Industrial Center. As you may recall, both the
Zoning Advisory Commission and the Dubuque City Council agreed to that request. As
a result, Kirchhoff Distributing Company now has a beautiful, high-quality facility with
tasteful signage.
Second, and just as important, we believe that your support for the proposed change
sends a strong, positive message to our existing businesses. That is, your consideration
and subsequent approval would prove that the City of Dubuque is flexible, customer-
focused, and certainly "open for business."

ORDINANCE NO. 48-08
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY REPEALING SECTIONS E(3)(a)(2)
AND E(3)(a)(3) OF ORDINANCE 83-04 AND ENACTING NEW SECTIONS E(3)(a)(2)
AND E(3)(a)(3) IN LIEU THEREOF PERTAINING TO ON-PREMISE PRIMARY
SIGNAGE OF THE PI PLANNED INDUSTRIAL DISTRICT FOR DUBUQUE
INDUSTRIAL CENTER WEST.
Whereas, Ordinance 83-04 was adopted on December 20, 2004, by the City
Council amending the PI Planned Industrial District for Dubuque Industrial Center West;
and
Whereas, an amendment has been requested to amend the PUD Ordinance
regulating on-premise signage allowed in the PI Planned Industrial District for Dubuque
Industrial Center West.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by repealing Sections E(3)(a)(2) and E(3)(a)(3)
of Ordinance 83-04 and enacting new Sections E(3)(a)(2) and E(3)(a)(3) in lieu thereof
as follows:
E(3)(a)(2): Company Primary Signs: Limited to identification of uses in
Zones B, C, D and E.
