Ordi- nances of the city adopted after said ordinance supersede the provisions of this city code to the extent that they are in conflict or inconsistent therewith. Consult the city office in order to ascertain whether any particular provision of the code has been amended, superseded or repealed. Sterling Codifiers Coeur d'Alene, Idaho September 2015 City of Dubuque 2-2-1 2-2-3 SECTION: 2-2- 1: 2-2- 2: 2-2- 3: 2-2- 4: 2-2- 5: 2-2- 6: 2-2- 7: 2-2- 8: 2-2- 9: 2-2-10: 2-2-11: CHAPTER 2 CIVIL SERVICE COMMISSION Applicability; Compliance With Statutes Commission Created Qualifications Generally Appointment; Term Compensation Chairperson; Clerk Council To Furnish Meeting Room, Equipment, Recorder Record Of Meetings And Personnel Examination Of Applicants Conduct Of Examinations; Certification Of Qualified Persons Procedure For Conduct Of Hearing Appeals 2-2-1: APPLICABILITY; COMPLIANCE WITH STATUTES: The provisions of this chapter shall apply to those persons enumerated in Iowa Code section 400.6 and shall be in accordance with the laws of the state. (2007 Code § 2-178) 2-2-2: COMMISSION CREATED: A civil service commission is hereby created under and in accordance with the provisions of the code of Iowa. (2007 Code § 2-179) 2-2-3: QUALIFICATIONS GENERALLY: Civil service commission- ers must be citizens of Iowa, eligible electors as defined in the code of Iowa, and residents of the city preceding their appointment, and shall not hold or be a candidate for any office of public trust. The human rights director shall, ex officio, be a member, without vote, of the civil service commission. Civil service commissioners shall not buy from, sell to, or in any manner become parties, directly, to any contract to furnish supplies, material, or labor to the city in which they are commissioners. (2007 Code § 2-180) City of Dubuque 2-2-4 2-2-11 2-2-4: APPOINTMENT; TERM: The mayor, with the approval of the council, shall appoint three (3) civil service commissioners for four (4) year terms. (2007 Code § 2-181) 2-2-5: COMPENSATION: The civil service commissioners shall serve without compensation. (2007 Code § 2-182) 2-2-6: CHAIRPERSON; CLERK: The civil service commission shall elect a chairperson from among its members and the city clerk shall be the clerk of the commission. (2007 Code § 2-183) 2-2-7: COUNCIL TO FURNISH MEETING ROOM, EQUIPMENT, RECORDER: The council shall provide suitable rooms in which the civil service commission may hold its meetings and supply the commission with all necessary equipment and a qualified shorthand reporter to enable it properly to perform its duties. (2007 Code § 2-184) 2-2-8: RECORD OF MEETINGS AND PERSONNEL: The civil service commission shall keep a record of all its meetings and also a complete individual service record of each civil service employee which record shall be permanent and kept up to date. (2007 Code § 2-185) 2-2-9: EXAMINATION OF APPLICANTS: Examinations for the positions in the city civil service shall be applicable to and required of all applicants in accordance with the code of Iowa. (2007 Code § 2-186) 2-2-10: CONDUCT OF EXAMINATIONS; CERTIFICATION OF QUALIFIED PERSONS: The civil service commission shall conduct examinations in accordance with the provisions of the laws of the state relative thereto, and for the purpose of determining the qualifications of applicants for positions under civil service and shall duly certify to the council a list of the qualified persons as set forth in the code of Iowa. (2007 Code § 2-187) 2-2-11: PROCEDURE FOR CONDUCT OF HEARING APPEALS: Notwithstanding chapter 1 of this title, the civil service City of Dubuque 2-2-11 2-2-11 commission shall adopt its own rules governing the procedure for the conduct of hearing appeals. (2007 Code § 2-188) City of Dubuque 2-4-1 2-4-2 SECTION: 2-4- 1: 2-4- 2: 2-4- 3: 2-4- 4: 2-4- 5: 2-4- 6: 2-4- 7: 2-4- 8: 2-4- 9: 2-4-10: 2-4-11: 2-4-12: 2-4-13: 2-4-14: 2-4-15: 2-4-16: CHAPTER 4 CIVIC CENTER ADVISORY COMMISSION Commission Created Purposes, Objectives Generally Specific Purposes Duties And Responsibilities Programs, Projects And Services Membership; Appointment Vacancies In Membership Attendance At Meetings Compensation Organization; Election Of Officers Duties Of Officers Meetings Quorum And Voting Minutes Filed With City Clerk Internal Rules And Regulations Administrative And Other Policies; Applicability 2-4-1: COMMISSION CREATED: There is hereby created a civic center advisory commission to have such powers and responsibilities as hereinafter provided. (2007 Code § 13-11) 2-4-2: PURPOSES, OBJECTIVES GENERALLY: A. The commission is charged with development of the optimum utiliza- tion of the civic center facility by the widest possible range of users and uses to respond to community needs and demands at the least possible cost to the city. B. It is intended that the commission shall have that authority and responsibility essential to assure that its general purpose is fulfilled subject to this chapter and subject to the approval of the city council in matters of policy. (2007 Code § 13-12) City of Dubuque 2-4-3 2-4-4 2-4-3: SPECIFIC PURPOSES: The specific purposes of the civic center advisory commission shall be to: A. Provide the city council as necessary with recommendations that further the general and specific purposes of the commission. B. Develop effective leadership for efficient planning, control and administration of policies and programs to realize optimum use of the civic center. C. Foster the development of financial and other resources to support the short and long term needs of the civic center facility and its programs. D. Develop programs to provide a variety of year round intellectual, cultural, enjoyable and attractive leisure time activities which contribute to the physical and mental well being of residents and visitors. E. Develop programs which contribute to the economic base of the community by encouraging business use of the civic center facility. (2007 Code § 13-13) 2-4-4: DUTIES AND RESPONSIBILITIES: The duties and responsi- bilities of the commission are as follows: A. Development of an administrative plan and operating policies to assure the maximum effectiveness in the use of all facilities and resources. B. Development of schedules of fees and charges for special building services, equipment, special building features, rental rates, admissions, and concessions. C. Development of informational and promotional programs to secure the full support and participation of the community. D. Development of accurate, timely and understandable financial data and measurements of effectiveness necessary to assure sound policy formulation for operation and management. E. Development of the annual operating budget and an ongoing capital improvements budget. City of Dubuque 2-4-4 2-4-7 F. Development of a maintenance program to provide a safe, secure, sanitary, clean and attractive facility. G. Serve as a personnel advisory committee to the city manager in the selection of civic center personnel. H. Participate with the Dubuque area chamber of commerce, the hotel and restaurant industry and other interest groups to promote and develop the convention and tourism business for the Dubuque area. I Execution of contracts and agreements for the use, operation and maintenance of the civic center facility; contracts and agreements for the use of the facility may be signed by the city manager, except that all contracts for usage of the facility involving a term of longer than five (5) days shall be signed by the mayor with the approval of the city council. (2007 Code § 13-14) 2-4-5: PROGRAMS, PROJECTS AND SERVICES: All programs, projects and services to be developed by the commission must conform to the policies of the city and to applicable local, state and federal laws, rules and regulations. (2007 Code § 13-15) 2-4-6: MEMBERSHIP; APPOINTMENT: A. Membership; Terms: The commission shall be comprised of a membership of five (5) persons, who shall be appointed by the city council for terms of three (3) years. B. Serve Until Successor Appointed: Upon completion of the term of office, a member of the commission shall continue to serve in the member's full capacity until a successor has been duly appointed. (2007 Code § 13-17) 2-4-7: VACANCIES IN MEMBERSHIP: A vacancy caused by death, resignation or otherwise on the commission shall be promptly filled by the city council for the unexpired term of office. (2007 Code § 13-18) City of Dubuque 2-4-8 2-4-11 2-4-8: ATTENDANCE AT MEETINGS: A. Frequency Of Attendance: Members of the commission shall attend at least two-thirds (2/3) of all regularly scheduled and held meetings within any twelve (12) month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the commission to recommend to the city council that said member be replaced. B. Record Of Attendance: The attendance of all commission members shall be entered upon the minutes of all meetings by the secretary. (2007 Code § 13-19) 2-4-9: COMPENSATION: All members of the commission shall serve without compensation except for reimbursement of necessary expenses. (2007 Code § 13-20) 2-4-10: ORGANIZATION; ELECTION OF OFFICERS: A. Officers Designated: The officers of the commission shall be a chairperson, a vice chairperson, and a secretary. All officers shall be members of the commission. B. Election By Commission: At the initial meeting of the commission and at the first meeting of each calendar year thereafter, the commission shall elect the above identified officers to serve one year terms of office. All officers shall be eligible to serve successive terms of office. (2007 Code § 13-21) 2-4-11: DUTIES OF OFFICERS: A. Chairperson: The chairperson shall preside at all meetings of the commission and shall perform all duties incident to the office of chairperson. B. Vice Chairperson: The vice chairperson shall perform the duties of the chairperson in the absence or incapacity of the chairperson. In the event of such absence or incapacity, the vice chairperson shall perform such duties as are imposed upon the chairperson until such time as the commission designates a new chairperson. Temporary Chairperson: In the event of the absence of the chair- person or vice chairperson at any meeting of the commission, the then present members of the commission shall select a temporary chairperson for that meeting. D. Secretary: The secretary shall record votes, keep a record of all proceedings of the commission and perform such other duties incident to the office of secretary. E. Absence Of Secretary: In the event of the absence of the secretary at any meeting of the commission, the chairperson shall appoint one of the then present commission members to serve as secretary pro tem for that meeting. (2007 Code § 13-22) 2-4-12: MEETINGS: A. Meetings: The commission shall meet not less than quarterly. B. Special Meetings: Special meetings may be called by the chair- person or at the request of three (3) members of the commission. (Ord. 41-12, 6-18-2012) 2-4-13: QUORUM AND VOTING: A. Quorum: Three (3) members of the commission shall constitute a quorum. B. Voting: All votes shall be entered upon the minutes by the secretary. (2007 Code § 13-26) 2-4-14: MINUTES FILED WITH CITY CLERK: The commission shall file with the city clerk a copy of the minutes of each regular and special meeting of the commission within ten (10) working days after each such meeting. (2007 Code § 13-27) 2-4-15: INTERNAL RULES AND REGULATIONS: The commission may adopt such further rules and regulations to govern its organization and procedures as it may deem necessary and which are not in conflict with this chapter. Such rules and regulations, upon their adoption, shall immediately be provided the city clerk. (2007 Code § 13-28) August 2012 City of Dubuque 2-4-16 2-4-16 2-4-16: ADMINISTRATIVE AND OTHER POLICIES; APPLICABIL- ITY: All administrative, personnel, accounting, budgetary and procurement policies of the city shall govern the commission in all of its operations. (2007 Code § 13-29) August 2012 City of Dubuque 2-5B-1 2-5B-2 CHAPTER 5 HOUSING AGENCY AND COMMUNITY DEVELOPMENT COMMISSIONS ARTICLE B. HOUSING COMMISSION SECTION: 2-5B-1: 2-5B-2: 2-5B-3: 2-5B-4: 2-5B-5: 2-5B-6: 2-5B-7: 2-5B-1: Commission Created Purpose; Approval Of Proposals Membership; Vacancies; Qualifications Meetings Compensation Internal Organization And Rules Procedures For Operations COMMISSION CREATED: There is hereby created a housing commission. (2007 Code § 15-21) 2-5B-2: PURPOSE; APPROVAL OF PROPOSALS: A. Duties And Responsibilities: The housing commission shall monitor and evaluate city housing needs and shall make recommendations to the city council as to how those needs can be met. In furtherance of this mission, the housing commission's duties and responsibilities shall include, but not be limited to, the following: 1. To contribute as appropriate in the planning, coordinating and review of housing development; 2. To conduct public hearings to ensure meaningful citizen input in the planning, implementation and assessment of the city's housing programs; 3. To provide for and encourage the participation of low and moderate income persons in the planning, implementation and assessment of housing programs; City of Dubuque 2-5B-2 2-5B-2 4. To provide input into the community planning process and to assist in accomplishing a coordinated and consistent housing devel- opment program of the city in accordance with present and future housing needs; 5. To request and review ongoing surveys assessing housing needs and identifying future community housing needs, particularly the needs of persons of low and moderate income; 6. To support the efforts of the city council and other city commissions in the assessment of the general housing needs of the community; 7. To undertake from time to time other specific ongoing housing planning which may be referred to it by the city council; 8. To research and recommend to the city council policies and programs facilitating the development of affordable housing; 9. To undertake public information efforts to educate citizens of the availability of federal, state and locally funded housing assistance programs; 10. To assist in the preparation of the housing element of the city comprehensive plan and the annual consolidated plan; 11. To offer comment, as appropriate, on the consistency of proposed housing development with the comprehensive `plan, consolidated plan and existing city housing strategies. B. Project Approval: Any proposed low rent housing project shall be subject to specific approval by the city council and any project requiring a referendum as provided in the code of Iowa shall be submitted to the voters of the city in accordance with the code of Iowa. C. Monitor Housing Program; Conduct Hearings On Grievances: The housing commission shall monitor the city's housing program and conduct hearings on grievances which arise out of the operation of such program except in the area of housing code enforcement. D. Additional Duties: The housing commission shall undertake such additional duties, with regard to the housing trust fund, as are specified in this code. (2007 Code § 15-22) City of Dubuque 2-5B-3 2-5B-4 2-5B-3: MEMBERSHIP; VACANCIES; QUALIFICATIONS: A. Membership: The housing commission shall be comprised of ten (10) members. B. Term Of Office: Appointments shall be for a term of three (3) years. C. Vacancies: Vacancy caused by death, resignation or otherwise on the commission shall be promptly filled by the city council for the unexpired term of office. D. Manner Of Selection: At least three (3) members of the commission shall be selected specifically on the basis of experience in real estate development, banking, finance, accounting, funds manage- ment or other related areas of expertise. E. Member Receiving Rental Assistance: One member of the commis- sion shall be a person who is a recipient of tenant based rental assistance under section 8 of the United States housing act of 1937 (42 USC 1437f) whose name appears on a lease of section 8 property and who is eighteen (18) years of age or older. If such member ceases to be a recipient of rental assistance under section 8, the term of such member shall be deemed terminated and a new member who meets the requirements of this subsection shall be appointed for the remainder of the term. (2007 Code § 15-27) City of Dubuque 2-9-1 2-9-3 CHAPTER 9 SISTER CITY RELATIONSHIPS ADVISORY COMMISSION SECTION: 2-9- 1: 2-9- 2: 2-9- 3: 2-9- 4: 2-9- 5: 2-9- 6: 2-9- 7: 2-9- 8: 2-9- 9: 2-9-10: 2-9-11: 2-9-12: Commission Created Purpose Internal Organization And Rules Procedures For Operation Membership Terms Vacancies Officers; Organization Meetings Compensation Removal Powers 2-9-1: COMMISSION CREATED: There is hereby created the sister city relationships advisory commission to have such powers and responsibilities as hereinafter provided. (Ord. 59-10, 11-1-2010) 2-9-2: PURPOSE: The purposes of the commission shall be to facilitate and maintain economic and cultural exchanges with the city's officially recognized international sister cities; to explore potential relationships with cities where a sister city relationship may be mutually beneficial; and to engage partnerships with the business community and education institutions that will enhance sister city relationships. (Ord. 59-10, 11-1-2010) 2-9-3: INTERNAL ORGANIZATION AND RULES: The commission may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with city or state code. (Ord. 59-10, 11-1-2010) May 2011 City of Dubuque 2-9-4 2-9-9 2-9-4: PROCEDURES FOR OPERATION: All administrative, person- nel, accounting, budgetary, and procurement policies of the city shall govern the commission in all its operations. (Ord. 59-10, 11-1-2010) 2-9-5: MEMBERSHIP: The commission shall consist of thirteen (13) members appointed by the city council. A. Two (2) members shall be representatives of the city council. B. Eleven (11) members shall be at large residents of the city, appointed by the city council. (Ord. 1-11, 1-18-2011) 2-9-6: TERMS: The initial terms of commissioners will be as follows: three (3) commissioners for terms ending February 1, 2012, three (3) commissioners for terms ending February 1, 2013, and five (5) commissioners for terms ending February 1, 2014. Thereafter, each member of the commission shall hold office for three (3) years or until such member's successor is appointed and qualified. (Ord. 1-11, 1-18-2011) 2-9-7: VACANCIES: Vacancies caused by death, resignation, or otherwise shall be promptly filled by the city council for the unexpired term of office. (Ord. 59-10, 11-1-2010) 2-9-8: OFFICERS; ORGANIZATION: The commission shall choose annually, from its own membership, two (2) persons to serve as facilitators, each to serve a term of one year. The city manager shall appoint a city staff person to serve as secretary. The commission shall fill vacancies among its officers for the remainder of the unexpired term. (Ord. 59-10, 11-1-2010) 2-9-9: MEETINGS: A. Regular Meetings: The commission shall meet quarterly. B. Special Meetings: Special meetings may be called by the facilitators or at the written request of three (3) members. C. Open Meetings: All meetings shall be called and held in confor- mance with the Iowa open meetings law. May 2011 City of Dubuque 2-9-9 2-9-12 D. Attendance: 1. In the event a member of the commission, created by this chapter, has been absent for three (3) or more consecutive meetings of the commission, without being excused by the facilitator, it shall be grounds for the commission to recommend to the city council that the position be declared vacant and a replacement appointed. 2. Attendance shall be entered upon the minutes of all meetings. E. Minutes: A copy of the minutes of all regular and special meetings of the commission shall be filed with the city council within ten (10) working days after each meeting. F. Quorum: Six (6) members of the commission shall constitute a quorum for the transaction of business. The affirmative vote of a simple majority of the members present shall be necessary for the adoption of any resolution. (Ord. 59-10, 11-1-2010) 2-9-10: COMPENSATION: The members of the commission shall serve without compensation, provided that they may receive reimbursement for necessary travel and other expenses while on official commission business within the limits established in the city administrative policies and the city budget. (Ord. 59-10, 11-1-2010) 2-9-11: REMOVAL: The city council may remove any member of any board or commission which it has established. (Ord. 59-10, 11-1-2010) 2-9-12: POWERS: The commission shall have the following powers, duties, and responsibilities: A. To recommend to the city council the official acknowledgement of or absolving of a sister city relationship. B. To facilitate and maintain the exchange of information by and between the city and its sister cities through, but not limited to, correspondence, delegation visits, and event planning. (Ord. 59-10, 11-1-2010) May 2011 City of Dubuque 14-1A-2 14-1A-2 eighty (180) days; provided, that a fee is paid for each renewal as set by the city manager. All city of Dubuque residential building permits issued prior to July 16, 2007 without an expiration date listed shall expire on October 1, 2010. Sec. 113. Building Code And Advisory Appeals Board. A. Board Created. There is hereby created a building code and advisory appeals board. B. Mission. The mission of the building code and advisory appeals board shall be to determine the suitability of alternative building materials and methods of building construction, to provide for reasonable interpretation of the provisions of the building code, and to advise the city council on all building construction regulations and procedures. C. Internal Organization And Rules. The board may adopt rules and regulations to govern its organizational procedures as may be neces- sary and which are not in conflict with city or state code. D. Procedures For Operation. All administrative, personnel, account- ing, budgetary, and procurement policies of the city shall govern the board in all its operations. E. Membership. 1. The building code advisory and appeals board shall consist of seven (7) residents of the city of Dubuque, appointed by the city council. The mayor must publish notice of the names of persons selected for appointment no less than thirty (30) days prior to a vote by the city council. 2. Residents must be eighteen (18) years of age or older. 3. Special Qualifications. a. One (1) member shall be an architect or engineer registered in the state of Iowa; b. One (1) member shall be a commercial contractor; c. One (1) member shall be a journeyman carpenter; November 2013 City of Dubuque 14-1A-2 14-1A-2 d. One (1) member must be a residential contractor; e. One (1) member shall be from the public at -large; and f. Two (2) representatives must have knowledge of ADA regulations to represent the interests of persons with disabilities. F. Terms. The term of office for members of the building code advisory and appeals board shall be three (3) years. All officers shall be eligible to serve successive terms of office. G. Vacancies. Vacancies caused by death, resignation, or otherwise shall be promptly filled by the city council for the unexpired term of office. H. Officers/Organization. The board shall choose annually, from its own membership, a chairperson and vice chairperson, each to serve a term of one (1) year. The building official, or designee, shall be secretary of the board. The board shall fill vacancies among its officers for the remainder of the unexpired term. I. Meetings. 1. Regular Meetings. The building code advisory and appeals board shall meet upon call of the chairperson, secretary or city manager. 2. Special Meetings. Special meetings may be called by the chair- person or at the written request of three (3) members by giving at least twenty-four (24) hours notice to every other member of the commission. The call for a special meeting shall include an agenda and only matters included in that agenda may be acted on at the meeting. 3. Open Meetings. All meetings shall be called and held in confor- mance with the Iowa open meetings law. 4. Attendance. a. In the event a member of the building code advisory and appeals board, created by this chapter, has been absent for three (3) or more consecutive meetings of the board, without being excused by the chairperson, it shall be grounds for the board to recommend to the city council that the position be declared vacant and a replacement appointed. November 2013 City of Dubuque 14-1A-2 14-1A-2 b. Attendance shall be entered upon the minutes of all meetings. 5. Minutes. A copy of the minutes of all regular and special meetings of the board shall be filed with the city council within ten (10) working days after each meeting. 6. Quorum. Three (3) members of the board shall constitute a quorum for the transaction of business. The affirmative vote of at least three (3) members shall be necessary for the adoption of any resolution. J. Compensation. The members of the building code advisory and appeals board created by this chapter shall serve without compensa- tion, provided that they may receive reimbursement for necessary travel and other expenses while on official board business and such shall be within the limits established in the city budget. K. Removal. The city council may remove any member of any board or commission which it has established. L. Powers. The building code advisory and appeals board shall have the following powers, duties, and responsibilities: 1. Any person who is aggrieved by a decision of the building official on any requirements resulting from the enforcement of the building code may appeal from such decision to the building code board and said board shall serve as an appeal board. In case the aggrieved party is a member of said board, said member shall be disqualified as a member of the board acting as an appeal board, until the person aggrieved has been heard and a decision rendered. The appeal shall be made by the person aggrieved, giving written notice of such appeal to the building official within seven (7) days of receipt of decision from which the appeal is taken. The building code board sitting as an appeal board shall meet within ten (10) working days after receiving such notice and render a decision within five (5) working days thereafter. Any interested party, including the building official, shall have the right to present their case to the appeal board, whose decision shall be final unless appealed to the district court as provided by law. The board of appeals may reverse or modify adecision of the build- ing official only on finding that: November 2013 City of Dubuque 14-1A-2 14-1A-2 a. The building official had incorrectly interpreted the provision of this code; or, b. The decision of the building official creates an unnecessary hard- ship upon the appellant. The board of appeals shall require that sufficient evidence or proof be submitted to substantiate any claims made regarding the use of alternates. All appeal hearings shall be conducted in accordance with the proce- dures specified in this code. On issues before the board involving the Americans with disabilities act (ADA) the board may elect to seek input from ADA advocates in the community. If the board elects to seek input from ADA advocates in the community the board shall consult with a minimum of two (2) individuals. M. Limitations Of Authority. The board of appeals shall have no authority relative to interpretation of the administrative provisions of this code nor shall the board be empowered to waive requirements of this code. In so modifying or reversing such decision of the building official, the board of appeals may authorize any alternate to the decision of the building official and the provisions, provided it finds the proposed material or method of construction is satisfactory for the use intended and complies with the provisions of this code, and that the material, method, or work offered is, for the purpose intended, at least equivalent to that prescribed by this code in suitability, strength, effectiveness, durability, fire resistance, and safety. Sec. 114. Violations. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure or cause or permit the same to be done in violation of this code. The doing of any act, or the omission of any act, declared to be unlawful by this code, or any code or ordinance herein adopted by reference shall be deemed a separate offense for each and every day or portion thereof during which any such unlawful act is committed, continued or permitted and upon conviction shall be November 2013 City of Dubuque 14-1A-2 14-1A-3 punishable as provided in title 1 of the code of ordinances. The penalty herein provided shall be cumulative with and in addition to the revocation, cancellation or forfeiture of any license or permit elsewhere in this code provided for violation thereof. Sec. 116. Unsafe Structures And Equipment. All buildings or structures regulated by this code which are structurally unsafe or not provided with adequate egress, or which constitute a fire hazard, or are otherwise dangerous to human life are, for the purpose of this section, unsafe. Any use of buildings or structures constituting a hazard to safety, health or public welfare by reason of inadequate maintenance, dilapidation, obsolescence, fire hazard, disaster, damage or abandonment is, for the purpose of this section, an unsafe use. Parapet walls, cornices, spires, towers, tanks, statuary and other appendages or structural members which are supported by, attached to, or a part of a building and which are in deteriorated condition or otherwise unable to sustain the design loads which are specified in this code are hereby designated as unsafe building appendages. All such unsafe buildings, structures or appendages are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition or removal in accordance with the proce- dures set forth in title 14, chapter 3 of the code of ordinances. (Ord. 39-13, 7-15-2013) 14-1A-3: PERMIT ISSUANCE PROHIBITED DURING CONSIDERA- TION OF ZONING RECLASSIFICATION OR ZONING OR SUBDIVISION TEXT AMENDMENTS: The building official of the city is hereby prohibited from issuing a building permit for real property for which action has been initiated for a change in the zoning classification of the property or a text amendment of the zoning or subdivision ordinances. The prohibition shall be from the date of the filing of the application with the planning services department until the date of final action of the city council upon such zoning reclassification or text amendment, including publication as provided by law where the reclassification or amendment is adopted by the city council. PLUMBING CODE International Plumbing Code Adopted International Plumbing Code Amendments Licensure And Certification Backflow Prevention Requirements For New Residential Construction Backflow Prevention Requirements For Existing Water Services Inspection Fees 14-1 H-1: INTERNATIONAL PLUMBING CODE ADOPTED: Except as hereinafter added to, deleted, modified or amended, there is hereby adopted by reference as the plumbing code of the city that certain plumbing code known as the international plumbing code, 2012 edition, published by the International Code Council, and the provisions of such plumbing code shall be controlling for the installation, alteration, repair, relocation, replacement, addition to and use or maintenance of plumbing equipment and systems in all matters covered by such plumbing code within the corporate limits of the city and shall be known as the Dubuque plumbing code. A copy of the international plumbing code, 2012 edition, as adopted, shall be on file in the office of the city clerk for public inspection. (Ord. 39-13, 7-15-2013) 14-1 H-2: INTERNATIONAL PLUMBING CODE AMENDMENTS: The following additions, deletions, modifications, or amendments of the international plumbing code, 2012 edition, adopted in section 14-1H-1 of this article to read as follows: Sec. 103.3. Deputies. Sec. 103.4. Liability. The building official or authorized representative charged with the enforcement of this code, acting in good faith and without malice in the discharge of his or her duties, shall not thereby be rendered liable for any damage that may accrue to persons or property as a result of any act or by reason of any act or omission in the discharge of his or her duties. A suit brought against the building official or authorized representative because of such act or omission performed by him or her in the enforcement of any provision of this code shall be defended by legal counsel provided by this jurisdiction until final termination of such proceedings. Sec. 104.1. Administrative Authority. The administrative authority shall be the building official who is duly appointed to enforce this code. Sec. 104.5. Right Of Entry. Whenever it is necessary to make an inspection to enforce the provi- sions of this code, or whenever the building official or the building official's authorized representative has reasonable cause to believe that there exists in any building or upon any premises any condition or violations of this code which make the building or premises unsafe, insanitary, dangerous, or hazardous, the building official or the building official's authorized representative may enter the building or premises at all reasonable times to inspect or to perform the duties imposed upon the building official by this code, provided that if such building or premises be occupied, the building official shall present his or her credentials to the occupant and request entry. If such building or premises is unoccupied, the building official shall first make a reasonable effort to locate the owner or other person having charge or control of the building or premises and request entry. If entry is refused the building official or the building official's authorized representative, the building official shall have recourse to every remedy provided by law to secure entry. When the building official or the building official's authorized representative shall have first obtained a proper inspection warrant or other remedy provided by law to secure entry, no owner or occu- pant or person having charge, care, or control of any building or November 2013 City of Dubuque 14-1H-2 14-1H-2 abate such violation, or to require the removal or termination of the unlawful occupancy of the structure in violation of the provisions of this code or of the order or direction made pursuant thereto. Sec. 108.4. Violation And Penalties. The doing of any act, or the omission of any act, declared to be unlawful by this code, or any code or ordinance herein adopted by reference shall be deemed a separate offense for each and every day or portion thereof during which any such unlawful act is com- mitted, continued, or permitted and upon conviction shall be punishable as provided in title 1, chapter 4 of the code of ordi- nances. Sec. 108.7.1. Authority To Condemn Equipment. Whenever the building official ascertains that any plumbing, or portion thereof, regulated by this code has become hazardous to life, health, property, or has become insanitary, the building official shall order in writing that such plumbing either be removed or restored to a safe or sanitary condition, as appropriate. The written notice itself shall fix a time limit for compliance with such order. No person shall use or maintain defective plumbing after receiving such notice. When such plumbing is to be disconnected, written notice as prescribed in section 108.7.2 shall be given. In cases of immediate danger to life or property, such disconnection may be made imme- diately without such notice. Sec. 108.7.2. Authority To Order Disconnection Of Utilities. The building official or the building official's authorized represen- tative shall have the authority to order disconnection of any plumbing supplied to a building, structure, or equipment regulated by this code when the building official determines that the equipment or any portion thereof has become hazardous or insanitary. Written notice of such order to disconnect service and the causes therefor shall be given within twenty-four (24) hours to the owner and occupant of such building, structure, or premises. However, in cases of imme- diate danger to life or property, such disconnection may be made immediately without such notice. The building official shall imme- diately notify the serving utility in writing of such order to disconnect. November 2013 City of Dubuque 14-1H-2 14-1H-2 Sec. 108.7.3. Connection From Order To Disconnect. No person shall make connections from any energy, fuel, power supply, or water distribution system nor supply energy, fuel, or water to any equipment regulated by this code which has been dis- connected or ordered to be disconnected by the building official or the use of which has been ordered to be discontinued by the building official until the building official authorizes the reconnection and use of such equipment. When any plumbing is maintained in violation of this code, and in violation of any notice issued pursuant to the provisions of this section, the building official may consult with the city attorney's office to institute any appropriate action to prevent, restrain, correct, or abate the violation. Sec. 109. Means Of Appeal. 109.1. Board Created. There is hereby created a plumbing code board. 109.2. Mission. The mission of the plumbing code board shall be to determine the suitability of alternative materials and methods of installation; to provide for reasonable interpretations of the plumbing code; to serve as an appeal body for the decisions of the building official; to advise the city council on all plumbing regulations and procedures; and to provide for examining applicants for master plumbers and journeyman plumbers licenses and issuing master plumber and journeyman plumbers licenses. 109.3. Internal Organization And Rules. The board may adopt rules and regulations to govern its organizational procedures as may be necessary and which are not in conflict with city or state code. 109.4. Procedures For Operation. All administrative, personnel, accounting, budgetary, and procurement policies of the city shall govern the board in all its operations. 109.5. Membership. November 2013 1. The board of appeals shall require that sufficient evidence or proof be submitted to substantiate any claims made regarding the use of alternates. Sec. 202. General Definitions. Accepted Engineering Practice. That which conforms to accepted principles, tests or standards of nationally recognized technical or scientific authorities. November 2013 City of Dubuque 14-1H-2 14-1H-2 Access (To). That which enables a fixture, appliance or equipment to be reached by ready access or by a means that first requires the removal or movement of a panel, door or similar obstruction (see "Ready Access"). Access Cover. A removable plate, usually secured by bolts or screws, to permit access to a pipe or pipe fitting for the purposes of inspection, repair or cleaning. Adapter Fitting. An approved connecting device that suitably and properly joins or adjusts pipes and fittings which do not otherwise fit together. Air Admittance Valve. One-way valve designed to allow air to enter the plumbing drainage system when negative pressures develop in the piping system. The device shall close by gravity and seal the vent terminal at zero differential pressure (no flow conditions) and under positive internal pressures. The purpose of an air admittance valve is to provide a method of allowing air to enter the plumbing drainage system without the use of a vent extended to open air and to prevent sewer gases from escaping into a building. Air Break (Drainage System). A piping arrangement in which a drain from a fixture, appliance or device discharges indirectly into another fixture, receptacle or interceptor at a point below the flood level rim and above the trap seal. Air Gap (Drainage System). The unobstructed vertical distance through the free atmosphere between the outlet of the waste pipe and the flood level rim of the receptacle into which the waste pipe is discharging. Air Gap (Water Distribution System). The unobstructed vertical distance through the free atmosphere between the lowest opening from any pipe or faucet supplying water to a tank, plumbing fixture or other device and the flood level rim of the receptacle. Alternative Engineered Design. A plumbing system that performs in accordance with the intent of chapters 3 through 12 and provides an equivalent level of performance for the protection of public health, safety and welfare. The system design is not specifically regulated by chapters 3 through 12. Anchors. See "Supports." (Ord. 39-13, 7-15-2013) Sec. 1003.3A. Grease Interceptors And Automatic Grease Removal Devices Required. A grease interceptor or automatic grease removal device shall be required to receive the drainage from fixtures and equipment with grease laden waste located in food preparation areas, such as in restaurants, hotel kitchens, hospitals, school kitchens, bars, factory cafeterias and clubs. Fixtures and equipment shall include pot sinks, prerinse sinks; soup kettles or similar devices; wok stations; floor drains or sinks into which kettles are drained and automatic hood wash units. Grease interceptors and automatic grease removal devices shall receive waste only from fixtures and equipment that allow fats, oils or grease to be discharged. Where lack of space or other constraints prevent the installation or replacement of a grease interceptor, one or more grease interceptors shall be permitted to be installed on or above the floor and upstream of an existing grease interceptor. Sec. 1003.3.4. Grease Interceptors And Automatic Grease Removal Devices. Grease interceptors and automatic grease removal devices shall be sized in accordance with PDI G101, ASME A112.14.3 appendix A, or ASME A112.14.4. Grease interceptors and automatic grease removal devices shall be designed and tested in accordance with PDI G101, ASME A112.14.3 or ASME A112.14.4. Grease interceptors and auto- matic grease removal devices shall be installed in accordance with the manufacturer's instructions and maintained in accordance with the manufacturer's instructions and the city of Dubuque FOG program. Except as provided in Iowa Code section 105.11, a person shall not operate as a contractor or install or repair plumbing, HVAC, refrigeration, or hydronic systems without obtaining a license issued by the state, or install or repair medical gas piping systems without obtaining a valid certification approved by the state. Except as provided in Iowa Code section 105.11, a person shall not engage in the business of designing, installing, or repairing plumbing, HVAC, refrigeration, or hydropic systems unless at all times a licensed master, who shall be responsible for the proper designing, installing, and repairing of the plumbing, HVAC, refrigeration, or hydronic system, is employed by the person and is actively in charge of the plumbing, HVAC, refrigeration, or hydronic work of the person. An individual who performs such work pursuant to a business operated as a sole proprietorship shall be a licensed master in the applicable discipline. (Ord. 39-13, 7-15-2013) 14-1 H-4: BACKFLOW PREVENTION REQUIREMENTS FOR NEW RESIDENTIAL CONSTRUCTION: There are hereby estab- lished minimum backflow prevention standards for new residential construc- tion. The city manager shall determine the type of backflow prevention assembly required for containment based on the degree of hazard as out- lined in title 13, chapter 1, article D of this code. (Ord. 52-09, 10-19-2009) 16-8-3: GENERAL POWERS: The board shall have the following powers: A. Appeals From Administrative Official: To hear and decide appeals where it is alleged there is error in any order, requirement, decision, or determination made by an administrative official in the enforce- ment of any ordinance adopted pursuant to Iowa Code chapter 414, as such may be amended from time to time. B. Conditional Uses: To hear and decide applications for conditional use permits upon which such board is required to pass under the provisions of this title. C. Variances: To authorize upon appeal in specific cases such variance from the bulk regulation provisions of this title, parking and sign requirements of this title as will not be contrary to the public interest, where owing to special conditions a literal enforcement of these provisions will result in unnecessary hardship, and so that the spirit of these provisions shall be observed and substantial justice done. D. Special Exceptions: To hear and decide applications for special exceptions to the terms of this title, in accordance with the general regulations of the zone in which the property is located and specific standards contained herein. (Ord. 52-09, 10-19-2009) 16-8-4: APPEAL FROM ADMINISTRATIVE OFFICIAL: 16-8-4-1: AUTHORIZATION: Appeals may be made by any person aggrieved or any municipal officer, department, board or bureau affected by any order, requirement, decision, or determination made by an administrative official in the enforcement of this title. (Ord. 52-09, 10-19-2009) 16-8-4-2: APPEAL PROCEDURE: Appeals may only be filed within thirty (30) days immediately following the date of the administrative action which is the subject to the appeal. An appeal is filed by delivering to the administrative office involved and to the board a City of Dubuque 16-8-4-2 16-8-5-2 completed notice of appeal, together with the required fee. Official notice of appeal forms shall be available without cost from the city planner. The notice of appeal must, in addition to all other information required by the form, specify the particular grounds for the appeal. The officer from whom the appeal is taken shall forthwith transmit to the board all documents constituting the record upon which action appealed from was taken. (Ord. 52-09, 10-19-2009) 16-8-4-4: BOARD DECISION ON APPEAL: In exercising its powers of appeal, the board may, in conformity with the provisions of this title, reverse or affirm, wholly or partly, or may modify the order, requirement, decision, or determination appealed from and may make such order, requirement, decision, or determination as ought to be made, and to that end shall have all the powers of the officer from whom the appeal is taken. (Ord. 52-09, 10-19-2009) 16-8-5: CONDITIONAL USE PERMIT PROCEDURE: 16-8-5-1: GENERALLY: The zoning board of adjustment may allow as conditional uses only those uses classified as conditional uses in this title. No conditional use shall be allowed in a particular district unless such use is specifically permitted as a conditional use in the regulations for that district, except as provided in chapter 4 of this title, and the board shall not act upon any conditional use permit application unless and until the requirements for each conditional use within the specific district in which it is located have been met.
