Of course, some of these suggestions may be affected by the changes you have made, and would have to be revisited once we see everything. Jeanne, this would be a great time to really get your code in shape, and one of the things we strongly urge is a reorganization. Our suggested organization creates the following advantages: 1. New materials can be easily added. Our organization was designed so that not only could new chapters be added at any point, but also that articles could be included for chapters and sections are subsectioned to allow future subsections to be added that may address only a small provision in lieu of creating a whole new chapter/article for that provision. 2. Like subjects are grouped together. In your present code, as an example, note chapters 29 and 35 on junk and secondhand dealers and peddlers and solicitors. Also, chapters 11 and 42 on building and subdivisions. Wouldn't it be easier for your building/community development department to work with building, zoning and subdivisions in one area of the code, rather than all over the code? The reorganization we are suggesting with this memo does not go into great detail, as it is mainly meant to show you the basic organization. We would also renumber your zoning ordinance to fit in as an integral part of the code, making access, amendment and search functions easier. General Provisions. This contract provides for the performance and delivery by Sterling Codifiers, Inc., in return for the consideration as stated herein, of the specialized professional services of collection, organization, classification, analysis, editing, proofreading, publication and supplementation of the legislation of the City of Dubuque, having been entered into between the City of Dubuque, Iowa, hereinafter termed "city", and Sterling Codifiers, Inc., whose principal office is located in the city of Coeur d'Alene, Idaho, hereinafter termed "Sterling". Section 2. Specialized Nature of Work. Sterling will codify the legislation of the city through the specialized processes of collection, classification, editing, proofreading, printing and binding. Upon completion of the codification processes, the legislation as codified will be termed the code, and Sterling will maintain the code in the future, all of the preceding to be performed in accordance with Sterling's methods, procedures and style described more fully herein. Section 3. Materials Furnished by City. The city will provide Sterling with the changes it desires to be made to its municipal code in a compatible Word or WordPerfect format. It is understood that the city has redlined a copy of the code with all the changes it desires to be made. Section 4. Procedures and Services. A. Make Changes Authorized By City. Sterling will make all the changes that the city has provided in the draft it presents to Sterling. Sterling will also add in all the ordinances that have been passed during the time that the city's review has been ongoing. B. Reorganizastion. Sterling will then prepare a new organization for the municipal code, grouping like subject matters together. Sterling will submit to the city a Sterling Contract - Page 1 suggested table of contents for this new reorganization, and the city will give its approval of that organization. C. Index. Sterling will prepare a new comprehensive index to be used with the hard copy of the code. D. Format New Code. Sterling will format the code for publication in the page format, type size and style meeting Sterling standards. The code will be proofread and any changes thoroughly scrutinized for complete accuracy. The new code will contain: • A table of contents listing the major divisions of the code including all titles and chapters. • Divider tabs and pages separating the titles and listing the chapters. • Prechapter analyses, listing all sections contained in the chapter. • Descriptive catchlines to each section and, if applicable, subsection, of the code to provide a summary of the context contained therein. s The text of the legislation, accurately and properly worded, capitalized and punctuated. Sterling will make no substantive changes other than those previously agreed to and as directed by the city. • Historical notations indicating the source and date of adoption of each enactment. • Cross-references and statutory footnotes as required to tie related sections together and to address relevant state law. E. Publication of Final Code. 1. Hard copy. Sterling will publish the desired number of hard copies of the new code using state of the art publishing procedures, high quality binders, and custom tab separators. The cosmetic look of the page will be in modern format projecting a professional image for the code. Binders are multi -ring and will be imprinted with the city's name. Mylar reinforced tabs, printed both sides, will be provided for the major divisions in the code. 2. Code Online. Sterling will format the code for the Internet and host online with a link from Sterling's website to the city's webpage. G. Supplement Service. Upon passage of a new or amending ordinance, said ordinance will be sent to Sterling who will prepare same for inclusion in the code. In the process of supplementation, Sterling will analyze the ordinance to be sure there are no discrepancies or conflicts with other parts of the code not addressed by the new Sterling Contract - Page 2 or amending legislation. Any questions will be directed immediately to the city and clarified before work on the legislation is completed. The amendments will then be inserted, all changes to the table of contents, index and pages with special tables made, and the proper number of supplement sets for hard copy and updated electronic copies will be forwarded to the city. Additionally, in conjunction with ongoing supplement service, ordinances emailed to Sterling will be posted in our "ordinances pending codification" folder on the Internet. Section 5. Responsibility of Sterling. Sterling will be responsible for the correctness and accuracy of its work, based upon the materials and information supplied by the city, as reflected in the published code or supplements delivered to the city. Regardless of the city's acceptance of published materials when delivered, Sterling will correct errors found either by the city or Sterling with succeeding supplementation. Sterling's liability for all services will extend only to the correcting of errors in the code or supplementation, not to any acts or occurrences as a result of such errors, and only so long as this contract is in effect. Section 6. Responsibility of City. The city will be responsible for the correctness and accuracy of the information it supplies Sterling, for providing Sterling with decisions and answers to questions and problems raised by them, for the inclusion of sufficient funds in the budget to pay Sterling for services, and for the prompt payment of invoices as provided herein. In order for Sterling to adhere to production schedules and meet delivery deadlines, it is necessary for the city to communicate with and provide information to Sterling without delay. Section 7. Performance Schedules. The time frames for the initial work done by the city attorney and Sterling under this contract are: City to deliver completed CD to Sterling 60 days Sterling to deliver published code to city 120 days Section 8. Cost and Payment Procedures. A. Codification. Reorganize and make changes $8,355.00 New index $1,100.00 Hard copy, per set $200 Prep for Internet hosting $1,000.00 Annual host fee $500 Sterling Contract - Page 3 B. Supplement Service. Supplement service will be provided on an ongoing basis to the city code at Sterling's prevailing rate. As of the date of this proposal, supplement service is available as follows: Hard copy, per page Update Internet copy $20.00 no charge C. Shipping and Handling. Shipping and handling charges are prepaid by Sterling and invoiced to the city. D. Payment Schedule. 1. Initial Codification Services. The following payment schedule will be adhered to for the initial codification: $4,500.00 on signing of contract Balance on delivery of final code 2. Supplementation and Related Services. Costs will be paid by the city upon receipt of services and an invoice/voucher from Sterling. 3. Terms of Payment. All payments will be made in full upon receipt of an invoice/voucher from Sterling. Section 9. Additional Services. At the request of the city, Sterling will perform any of the following services, at an additional cost: A. Pamphlets. The preparation of pamphlets containing portions of the code as published, such as the zoning title, will be billed at Sterling's prevailing rates. B. Additional Volumes of the Code. The preparation of additional volumes of the code, beyond the quantity contracted herein, may be ordered at any time at Sterling's prevailing rates. C. Binders. Changes involving cover material, seals, metals, colors or multiple colors, or other changes from Sterling's standard binder can be made available at the city's request and at extra expense to the city, with such costs not to exceed the extra expense of Sterling. Section 10. Term of Contract. This contract will be in effect until revoked in writing by either party. The party so desiring to terminate this contract shall give the other party sixty (60) days written notice of such termination. THIS CONTRACT COMPRISES the entire contract between Sterling and the city regarding Sterling's services for the effective period of this contract. (2007 Code § 7-45) 6-5C-2: CONFINEMENT AUTHORIZED: A. Animal Suspected Of Having Rabies; Quarantine Requirement: The owner or keeper of any dog or cat or other animal which has contracted rabies, or which has been subject to rabies, or which has bitten or caused skin abrasion to any person shall produce and surrender up such dog, cat or other animal to be held in confinement in a licensed veterinarian's animal hospital under the supervision of a licensed veterinarian and in quarantine for observation for a period of not less than ten (10) days at the expense of the owner or keeper of the animal. (2007 Code § 7-47) B. Quarantine Of Animal Bitten By Rabid Animal: Any animal bitten or attacked by any known rabid animal shall be quarantined under direction of the health officer by being confined and in quarantine as provided above for a minimum of ninety (90) days. (Ord. 17-2007, 3-14-2007) C. Application For Home Quarantine; Conditions: The owner or keeper of any dog or cat or other animal which has bitten a person may apply to the city manager to have the animal released for the purpose of home quarantine. Home quarantine shall not be permitted unless all of the following conditions are met: DU549 SAMPLE (February 2008) 6-5C (3) 1. The animal must have been vaccinated against rabies a minimum of at least two (2) weeks prior to the bite, and such vaccination must be valid for at least one month after the bite. The vaccination certification must bear the description of the animal, the type of vaccine used, the expiration of the vaccination, and the signature of the veterinarian administering the vaccination. (2007 Code § 7-47) 2. The animal must have a current city license, if the animal is three (3) months of age or older. (Ord. 8-08, 2-12-2008) 3. The animal must not have been running at large at the time of the bite. 4. The animal has not previously bitten any person. 5. Prior to approval of home quarantine, the owner or keeper must have the animal examined by a veterinarian, licensed in the state of Iowa, who shall certify that the animal appears to be free of rabies or any other zoonosis. Such examination and certification must be repeated on the tenth day. 6. The owner of keeper must demonstrate to the satisfaction of the city manager that the owner or keeper has the proper facilities and the ability to adequately and properly confine the animal to the owner or keeper's home or property during the quarantine period. 7. The owner of keeper must agree to immediately notify the health officer of any changes in the animal's health or disposition, to allow representatives of the city manager to enter upon the property and to. examine the animal at any time and to immediately take the animal to a licensed veterinarian for examination at any time when directed by the city manager. 8. The owner or keeper must agree to promptly pay all costs of veterinarian examinations during the quarantine period. 9. The owner or keeper must further agree to immediately surrender the animal at any time the city manager determines that the home quarantine should be terminated, or at any time that any provisions or conditions of home quarantine are violated, in which event the animal shall be put in the custody of a licensed veterinarian of the state of Iowa in the city of Dubuque for the remainder of the quarantine period. 10. If the city manager determines at any time that home confinement is not appropriate for the animal, quarantine at a veterinary hospital shall be ordered. 11. The person bitten, or if a minor, the person's parent or guardian, must sign an acknowledgement indicating that the person has been advised of the risks of rabies, that if the animal disappears during home quarantine, the person may have to undergo post -exposure rabies prophylaxis, and that the person does not object to home quarantine. The acknowledgement shall also relieve DU549 SAMPLE (February 2008) 6-5C (4) the city of Dubuque, its agents, officers, and employees from any liability if the animal disappears during home quarantine. (2007 Code § 7-47). 12. The owner or keeper shall also execute an indemnity agreement in favor of the city of Dubuque, which shall provide that the owner or keeper shall save harmless, defend and indemnify the city of Dubuque and its officers, agents and employees from any or all claims of 'any kind arising out of the home quarantine. (Ord. 53-06, 9-27-2006) 13. The owner or keeper shall agree in writing that if the animal disappears during the home quarantine, the owner or keeper shall pay liquidated damages to the person bitten and shall also indemnify the person bitten for any and all medical expenses incurred as a result of the disappearance of the animal. Acceptance of any such payments by the person bitten shall not in any way release the owner or keeper from any other liability the owner may have to the person bitten by reason of the animal bite. It shall be the sole responsibility of the person bitten, and not the responsibility of the city, to enforce such agreement. This subsection shall not apply if the person bitten is the owner or keeper of the animal or any person residing with the owner or keeper. D. Wild Animals: If an undomesticated or wild animal such as a skunk, bat, fox, raccoon or other carnivore bites a person, whether or not the animal's owner or keeper is known, the animal shall be humanely destroyed and examined for rabies immediately. (2007 Code § 7-46) 6-50-3: REPORTING RABIES; NOTICE TO CITY MANAGER: A. It shall be the duty of the owner or keeper of any cat, dog or other domesticated animal suspected of being rabid that has attacked, bitten or caused any skin abrasion upon any person to report such incident to the city manager. B. It shall be the duty of any physician or veterinarian immediately to transmit information to the city manager that may come to such physician or veterinarian through such physician's or veterinarian's professional capacity with reference to any person having been attacked, bitten or having skin abrasions by any dog, cat or other domestic animal. Ord. 59-07, 10-6-2007) 6-5C-4: NOTIFICATION TO POLICE OR CITY MANAGER OF DEAD ANIMALS: Any person finding a dead dog or cat shall at once notify the police department or city manager. (2007 Code § 7-48) 6-5C-5: PUNISHMENT FOR HARBORING KNOWN RABID DOG, CAT OR OTHER DOMESTIC ANIMAL:. (2007 Code § 7-49) 6-5C-6: PROHIBITED ACTIONS AFTER MAYOR'S PROCLAMATION OF EMERGENCY: When the mayor, pursuant to resolution of the city, shall declare an emergency due to rabies: A. It shall be unlawful for the owner of any dog, cat or other domestic animal to permit such animal to be at large. Any dog, cat or domesticated animal found to be at large shall be deemed to be so with the permission or at the sufferance of its owner. (2007 Code § 7-47) B. It shall be unlawful for any person except the owner of a dog, cat or other domestic animal, or owner's agent, to open any door or gate of any private premises for the purpose or result of setting such animal at large. KENNEL: Shall refer to a place or establishment where dogs or cats are kept or raised for the purpose of breeding, boarding, racing at a licensed pari-mutuel track, exchanged or offered for sale to the general public and which are kept under constant restraint. NEUTERED: Shall refer to a surgical procedure that has been performed on a dog or a cat that renders it incapable of siring or bearing offspring. NUISANCE: A dog or cat shall be considered a nuisance if it: A. Damages, soils, defiles or defecates on private property other than the owner's or on public walks and recreation areas unless such waste is immediately removed and properly disposed of by the owner. B. Causes unsanitary, dangerous or offensive conditions. C. Causes a disturbance by excessive barking or other noise making or chases vehicles, or molests, attacks or interferes with persons or other domestic animals on public property. OWNER: Any person owning a cat or dog. VICIOUS ANIMAL: A vicious cat or dog is deemed so when it shall have attacked or bitten any person on more than one occasion without provocation or when an attack or bite results in serious bodily injury. Animal Suspected Of Having Rabies; Quarantine Requirement: The owner or keeper of any dog or cat or other animal which has contracted rabies, or which has been subject to rabies, .or which has bitten or caused skin abrasion to any person shall produce and surrender up such dog, cat or other animal to be held in confinement in a licensed veterinarian's animal hospital under the supervision of a licensed veterinarian and in quarantine for observation for a period of not less than ten (10) days at the expense of the owner or keeper of the animal. Quarantine Of Animal Bitten By Rabid Animal: Any animal bitten or attacked by any known rabid animal shall be quarantined under direction of the health officer by being confined and in quarantine as provided above for a minimum of ninety (90) days. Conditions: The owner or keeper of any dog or cat or other animal which has bitten a person may apply to the city manager to have the animal released for the purpose of home quarantine. Home quarantine shall not be permitted unless all of the following conditions are met: DU549 SAMPLE (February 2008) 6-5C (3) 1. The animal must have been vaccinated against rabies a minimum of at least two (2) weeks prior to the bite, and such vaccination must be valid for at least one month after the bite. The vaccination certification must bear the description of the animal, the type of vaccine used, the expiration of the vaccination, and the signature of the veterinarian administering the vaccination. (2007 Code § 7-47) 2. The animal must have a current city license, if the animal is three (3) months of age or older. (Ord. 8-08, 2-12-2008) 3. The animal must not have been running at large at the time of the bite. 4. The animal has not previously bitten any person. 5. Prior to approval of home quarantine, the owner or keeper must have the animal examined by a veterinarian, licensed in the state of Iowa, who shall certify that the animal appears to be free of rabies or any other zoonosis. Such examination and certification must be repeated on the tenth day. 6. The owner of keeper must demonstrate to. the satisfaction o the city manager that the owner or keeper has the proper facilities and the ability to adequately and properly confine the animal to the owner or keeper's home or property during the quarantine period. 7. The owner of keeper must agree to immediately notify the health officer of any changes in the animal's health or disposition, to allow representatives of the city manager to enter upon the property and to examine the animal at any time and to immediately take the animal to a licensed veterinarian for examination at any time when directed by the city manager. 8. The owner or keeper must agree to promptly pay all costs of veterinarian examinations during the quarantine period. 9. The owner or keeper must further agree to immediately surrender the animal at any time the city manager determines that the home quarantine should be terminated, or at any time that any provisions or conditions of home quarantine are violated, in which event the animal shall be put in the custody of a licensed veterinarian of the state of Iowa in the city of Dubuque for the remainder of the quarantine period. 10. If the city manager determines at any time that home confinement is. not appropriate for the animal, quarantine at a veterinary hospital shall be ordered. 11. The person bitten, or if a minor, the person's parent or guardian, must sign an acknowledgement indicating that the person has been advised of the risks of rabies, that if the animal disappears during home quarantine, the person may have to undergo post -exposure rabies prophylaxis, and that the person does not object to home quarantine. The acknowledgement shall also relieve DU549 SAMPLE (February 2008) 6-5C (4) the city of Dubuque, its agents, officers, and employees from any liability if the animal disappears during home quarantine. (2007 Code § 7-47). 12: The owner or keeper shall also execute an indemnity agreement in favor of the city of Dubuque, which shall provide that the owner or .keeper shall save harmless, defend and indemnify the city of Dubuque and its officers, agents and employees from any or all claims of any kind arising out of the home quarantine. The owner or keeper shall agree in writing that if the animal disappears during the home quarantine, the owner or keeper shall pay liquidated damages to the person bitten and shall also indemnify the person bitten for any and all medical expenses incurred as a result of the disappearance of the animal. Acceptance. of any such payments by the person bitten shall not in any way release the owner or keeper from any other liability the owner may have to the person bitten by reason of the animal bite.. It shall be the sole responsibility of the person bitten, and not the responsibility of the city, to enforce such agreement. This subsection shall not apply if the person bitten is the owner or keeper of the animal or any person residing with the owner or keeper. D. Wild Animals: If an undomesticated or wild animal such as a skunk, bat, fox, raccoon or other carnivore bites a person, whether or not the animal's owner or keeper is known, the animal shall be humanely destroyed and examined for rabies immediately. (2007 Code §-7-46) 6-5C-3: REPORTING RABIES; NOTICE TO CITY MANAGER: A. It shall be the duty of the owner or keeper of any cat, dog or other domesticated animal suspected of being rabid that has attacked, bitten or caused any skin abrasion upon any person to report such incident to the city manager. It shall be the duty of any physician or veterinarian immediately to transmit information to the city manager that may come to such physician or veterinarian through such physician's or veterinarian's professional capacity with reference to any person having been attacked, bitten or. having skin abrasions by any dog, cat or other domestic animal. AT LARGE: Includes any dog, cat or livestock, fowl or ferret found off the premises of the owner. A dog or cat shall not be deemed at large if the dog or cat is: A. Attached to a leash of sufficient strength and appropriate length to control the animal where such leash is held by its owner or keeper; or B. Restrained within an enclosed motor vehicle or by crate or leash of sufficient strength and appropriate length to keep the dog or cat within the motor vehicle; or C. Housed in a licensed veterinarian's animal hospital; or D. Accompanied by the owner or keeper on the premises of another with such person's consent and restrained by an adequate protective fence or by leash, cord, chain or other similar restraint that does not allow the dog or cat to go beyond such QU549 SAMPLE (February 2008) 6-5B (2) person's property line or to come into contact with anyone outside such person's property line. CAT: Both male and female animals in the family Felis catus whether neutered or not. DOG: Both male and female animals of the canine species whether neutered or. not, but not including a law enforcement dog. KEEPER: Any person other than the owner keeping, sheltering, having control or custody of or harboring a cat or dog. KENNEL: Shall refer to a place or establishment where dogs or cats are kept or raised for the purpose of breeding, boarding, racing at a licensed pari-mutuel track, exchanged or offered for sale to the general public and which are kept under constant restraint. NEUTERED: Shall refer to a surgical procedure that has been performed on a dog or a cat that renders it incapable of siring or bearing offspring. NUISANCE: A dog or cat shall .be considered a nuisanceif it: A. Damages, soils, defiles or defecates on private property other than the owner's or on public walks and recreation areas unless such waste is • immediately removed and properly disposed of by the owner. B. Causes unsanitary, dangerous or offensive conditions. C. Causes a disturbance by excessive barking or other noise making or chases vehicles, or molests, attacks or interferes with persons or other domestic animals on public property. OWNER: Any person owning a cat or dog. VICIOUS ANIMAL: A vicious cat or dog is deemed so when it shall have attacked or bitten any person on more than one occasion without provocation or when an attack or bite results in serious bodily injury. (2007 Code § 7-16) !DEFEND! 6-5B-2: HARBORING VICIOUS DOG OR CAT: It shall be unlawful for any person or persons to harbor or keep a vicious dog or cat within the city. (2007 Code § 7-17) 6-5B-3: NUISANCE: It shall be unlawful for any owner or keeper to permit a dog or cat to commit a nuisance. (2007 Code § 7-18) DU549 SAMPLE (February 2008) 6-5B (3) 6-5B-4: FEMALE DOGS IN SEASON: It shall be unlawful for any owner or keeper to allow a female dog in season to run at large or to so confine such dog as to attract male dogs to the area and by their presence cause a nuisance. (2007 Code § 7-19) AND SO FORTH 6-5B-14: KEEPING OF CATS OR DOGS ON UNOCCUPIED RESIDENTIAL PROPERTY PROHIBITED: The owner of unoccupied residential property shall not keep or allow to be kept on the property any cats or dogs. For purposes of this provision, "unoccupied" shall mean that the property is not the primary residence of the property owner or any other occupant. .(Ord. 41-06, 6-5-2006) Note that Sterling omitted the section symbol and number in above ordinance citation, since that is the normal manner in which Sterling does historical citations. Would that be acceptable in the new code? ❑ Yes ❑ No 6-5B-15: LICENSING, FEE AND TAG REQUIREMENTS: A. Application For License: The owner shall make application for a license at the office of the city clerk. The forms shall give the name, address, and social security number of the owner, the sex and description of the dog or cat, and if known, its breed and age. In the event of a change of ownership, the license holder shall notify the city clerk of such change. All dogs and cats must be licensed at three (3) months of age. (2007 Code § 7-32) B. Dog Licenses And Fees: 1. License Fee; Proof Of Sterilization: a. The license fee per calendar year, or fraction thereof, for a dog license shall be as established by the city manager. b. The applicant or licensee shall furnish written proof from a licensed veterinarian that surgical procedures have been performed that render either male or female dogs incapable of reproduction. License Expiration; Renewal; Delinquent Fee: All dog licenses issued under this section shall expire on December 31 of the year in which issued and shall become delinquent on March 31 of the year due. A penalty, as established by the city manager, shall be added to the required license fee for each delinquent dog license. (2007 Code § 7-34) C. Cat Licenses And Fees': 1. Tags Not Transferable: A license issued for any dog or cat shall not be transferred to another dog or cat. (2007 Code § 7-38) 2. Tags To Be Attached: The applicant for a dog or cat license, upon procurement of• the license, shall securely attach the license tag to a collar or harness and this collar or harness, with the tag attached, shall at all times be kept on the dog or cat. Any dog or cat found at large without a collar or harness with license tag attached shall be deemed unlicensed and shall be impounded.` (2007 Code § 7-39) E. Fee For Duplicate: The fee for a duplicate license for either a dog or cat shall be as established by the city manager. (2007 Code § 7-40) D. Consent Implied From Application And Receipt: The application for and the receipt of a license as required in this section shall include an implied consent by the owner to permit an inspection of both real and personal property under the owner's control for the purpose of carrying out the provisions of this chapter relating to the harborage of vicious animals or to the control of. rabies outbreak or relating to the provisions of law relative to the prohibition of cruelty to animals.
