Gentlemen:
At the present time, the alley
running from Jones to West 1st
Street, east of Locust Street, is
carried in Schedule I, Section 1,
subsection (B) as a northbound
alley only,
During the past few years num-
erous vehicles have been observed
traveling southbound in this alley
and arrangements have been made
with trucking concerns whose dock
abuts this alley to proceed south
through this alley.
Future expansion of the area with
regards to increased off-street park-
ing facilities by private individ•
uals will result in increasing traffic
in this alley. Because of present
conditions and in anticipation of
additional demands, it is believed
that this alley should be deleted
from the above schedule so that
two way traffic will be allowed in
this alley.

Gentlemen:
Because of the parking of vehic-
les on Prairie Street between Loras
and West 11th Street, the effective
width of Prairie Street has been
reduced to one lane of travel. This
street is one of the primary streets
leading into and out of the resi•
dential area embracing 11th Street,
Walnut, Race, Arlington, Chestnut
Street and other. It is also a part
of two bus routes. The existence
of such conditions makes travel
extremely hazardous especially dur-
ing the winter months.

be eliminated on the east side of
Prairie Street between Loras and
West 11th.

A request has been made for the
installation of street lights on Mis-
sissippi Heights Subdivision. Upon
investigation it was determined
that street lights should be placed
upon the streets of this subdivision
at the following locations,
1. At the intersection of Missis-
sippi View Drive and Mt. Loretto
Avenue.
2. At the northeast curve of
Mississippi View Drive.
3. At the Intersection of Missis-
sippi View Drive and River Ridge.
4. At the turn around at the end
of River Ridge.
I recommend that street lights be
installed at these above locations.

Gentlemen:
Because of a frequency of acci-
dents at the intersection of Queen
Street and 24th Street, an investi-
gation was made to determine what
corrective measures could be taken
to eliminate the possibility of a
serious accident.
Because of the vision obstruc-
tions located at all corners of this
intersection, it is believed that if
a stop sign were erected which
would give the right of way to
vehicles traveling east on 24th
Street and at the same time re-
quiring astop of those vehicles
traveling north and south on Queen
Street across 24th, frequency of
accidents would be reduced.
It is recommended that stop signs
be erected which will require north
and south bound vehicles on Queen
Street to stop before entering the
intersection of 24th Street,

~~ Gentlemen:
The request of John C. Sanner
1 requesting an investigation as to
the cost of construction of a sani-
tart' sewer in the alley between
Brunswick and Burden Streets was
referred to the Council to view the
grounds.
The decision of the Council upon
viewing the grounds was that the
~ cost per lot, charging the cost of
the improvement against the bene-
fited property within the City,
would amount to about $1500 per
lot which was felt excessive. The
Council directed that the City En-
gineer make a study of the areas
outside of the City that could be
served by this sewer and also an
investigation be made as to the
possibilities of annexing this area
outside of the City.
With the construction of this
sewer and the improvement that
could be made, providing water
' facilities and the construction of
streets, it was felt that the overall
improvement to this area would be
beneficial to the people living out-
side of the City.

Gentlemen:
The petition of Chris Becke ask-
ing that a grade be set on Fulton
Street so that he would have ac•
cess to his property for the con-
struction of a new home was refer-
red to the Council to view the
grounds.
Upon investigation, it was deter-
mined that a preliminary grade
should be set by the City Engineer,
taking into consideration the
grades of the property on each side
of the street and that such grade
be given to Mr. Becke for the pur-
pose of setting the elevation of his
home to determine whether he
could make sewer connection to
his lots.
I recommend that the decision of
the Council be confirmed.

Gentlemen:
The communication of William J.
Walsh complaining about severe

interference from radiation from
the Jerrold Cable was referred to
the City Manager for investigation
and report.
The Electrical Inspector has been
constantly checking any complaints
with regard to radiation from this
cable system and has, since this
communication, contacted the Du-
buque Jerrold Company and they
have jointly investigated any com-
plaints that have been recorded.
It was found that there are very
few reports of intereference from
radiation, but as soon as they have
been reported, an effort is made
to correct them. Our Electrical In-
spector will diligently investigate
any complaints that are received
by the City and see that they are
corrected,

The communication of James
Sigman indicating his interest in
purchasing a parcel of land on the
corner of Hillcrest and Morning-
view Roads, that is now owned by
the City of Dubuque, was referred
to the City Council to view the
grounds.
Upon viewing the ground, it was
the decision of the Council that
this property was no longer needed
by the City of Dubuque and should
be advertised for sale.
I recommend that the decision of
the Council be confirmed and that
the City Clerk be instructed to
publish a notice of the intention
of the City Council to sell this
property and to solicit written
bids.

Whereas Westminster Presbyte-
rian Church of Dubuque, Iowa, as
owner of all abutting property, has
petitioned the City Council to va-
cate the portion of Ashton Place
lying south of the extension of the
north line of Lot 290 in Woodlawn
Park in the City of Dubuque, and
also the portion of the alley first
east of Ashton Place, lying south
of [he extension of the north line
of Lot 290 in Woodlawn Park Ad-
dition; and
Whereas said Petitioner has pre-
pared and submitted a plat show-
ing sold vacated area and assign-
ing lot numbers thereto; and
Whereas Petitioner has prepared
and submitted to the City Council
a plat vacating portions of Wood-
lawn Park Addition and the Sub-

You are advised that Section
391.39 of the 1954 Code of Iowa
provides:
"The cost of construction, recon-
struction, or resurfacing of any
street improvement, except as
provided in section 391.38, and
except for that part for which
railways or street railways are
liable, shall be assessed as a
special tax against all lots ac-
cording to area, so as to include
one-half of the privately owned
property between the street im-
proved and the next street,
whether such privately owned
property abut said street or not.
In no case except where the dis-
trict method of assessment is
used, shall property situated
more than three hundred feet
from the street so improved be
so assessed. Such assessment for
improvements upon an alley
shall be confined to privately
owned property within the block
or blocks improved, and if not
platted into blocks, to property
not more than one hundred fifty
feet from the improved alley."
In my opinion the Legislature
would not have provided fora dif-
ferent method for the improvement
of an alley if they considered an
alley as used in this section to be
a street.
Therefore, I am of the opinion
that the assessment was proper.

Whereas, proposed plans and
specifications, plat and schedule
have been duly prepared and ap-
proved by the City Council of the
City of Dubuque and are now on
file in the office of the City Clerk
showing among other things the
following:
a. An estimated total cost of the
work.
b. The amount proposed to be
assessed against each lot for
the improvement for the con•
struction of the 1958 Kane
Street Water Main Project No.
1, consisting of a cast iron
water main in Kane Street
from the West Property Line
of Maryville Drive to the East
Property Line of Lot 2 of Lot
1 of Mineral Lot 351,
Be It Therefore Resolved by the
City Council of the City of Du•
buque, Iowa:
1. That the City Council deems
it advisable and necessary far the
public welfare to make said im•
provement.
2. Said improvement shall be
constructed and done in accordance
with said plans and specifications
and a portion of the total cost of
making said improvement shall be
assessed against all privately owned
property lying within the assess-
ment district shown on such plat
in an amount not to exceed the
amount provided by law and in pro-
portion to the special benefits con•
ferred thereby and the remainder
of the total cost shall be paid out
of the Water Works General Fund.
3. Bonds shall be issued and
sold in anticipation of deferred pay-
ments of assessments when ~a con-
tract has been performed and ac-
cepted and the proceeds thereof
used to pay the contractor.
4. On the 2nd day of June, 1958
at 7:30 p.m, the City Council will
meet in the City Council chambers
in the City Hall, in the City of Du-
buque, Iowa and hear property
owners subject to the assessment
and interested parties for and
against the improvement, its cost,
the assessment thereof, or the
boundaries of the district.
5. The City Clerk is hereby au-
thorized and directed to cause pub-
lic notice of the date, time and
place of hearing to be given by
publication once each week for two
consecutive weeks the first of which
publications shall be not less than
fifteen nor more than twenty-five
days prior to said hearings and by
mailing a copy of said notice by
ordinary mail to the owners of
said property to be assessed, as
shown by the records in the office
of the County Auditor not less than
fifteen days prior to said hearing.

be paid out of the sewer funds.
Bands shall be issued and sold
in anticipation of deferred pay-
ments of assessments when a con-
tract has been performed and ac-
cepted and the proceeds thereof
used to pay the contractor. The
railway portion of any street ar
assessment district shall be as-
sessed to and paid by the railway
company.

stated that this is the regular
monthly meeting of the City Coun•
cil for the purpose of acting upon
such business as may properly
come before the meeting.

To the Honorable Mayor

Gentlemen: Section 16,1.11 of
Ordinance 33.49 should be changed
before practical enforcement is
possible. This section now reads
that parking is prohibited opposite
the entrance to a garage or drive-
way on any roadway less than 20
feet in width. Access to garages or
driveways in alleys are restricted
in those areas where the alleys are
thirty feet in width.
It is believed that this ordinance
should be rewritten so that at least
20 feet of available roadway space
is left for the entrance or exit from
the driveway or garage.
It is recommended that this sea
tion of the Ordinance be repealed
and another section be substituted
stating that it is illegal to park op-
posite the entrance to a garage or
driveway on any street or alley
when less than 20 feet of the avail-
able width of said street or alley
shall remain for ingress and egress
to and from said garage or drive-
way.

Dubuque, Iowa.
Gentlemen: At the present time
there is a hazardous and conges-
tive situation that exists on West
1st Street between Iowa and Main
Street. This condition is caused by
trucks which are backed into the
loading dock at Western Grocery
Company. When these trucks are
backed into the loading dock there
is only a very narrow space left
between the front end of the truck
and parked vehicles on the north
side of the street. Such a condition
effectively restricts the traveled
portion of the street to one lane
of traffic.
It is believed that this situation
can be corrected by removing the
parking from the north side of
West 1st Street between Main and
Iowa Streets.
It is therefore recommended that
parking be prohibited between
Main and Iowa Streets on the
north side of West lst Street and
that "No Parking This Side" be
erected in this area.
