The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant was not in attendance.
Staff reviewed the location of the parcel, access to Commerce Park Drive and the need
for splitting the parcel into two lots. Staff noted Lot 2-6 does not have the required
street frontage, but it does have a reciprocal access agreement.
There were no public comments.
The Zoning Advisory Commission discussed the request, and felt it was appropriate.
Recommendation
By a vote of 6 to 0 the Zoning Advisory Commission recommends that the City Council
approve the request, subject to waiving lot frontage for Lot 2-6.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey of Lot 1-6 and Lot 2-6 of Block 3 of Westbrook Subdivision
INTRODUCTION
The submitted Plat of Survey of Lot 1-6 and Lot 2-6 of Block 3 of Westbrook Subdivision
subdivides an existing parcel at the end of Commerce Park into two lots. Commerce
Park is a city street that connects with Seippel Road on the City's far west end. The
subject property is the new location for the East Central Intergovernmental Association
(ECIA) and the Regional Transit Authority (RTA).
DISCUSSION
The submitted Plat of Survey subdivides an existing 4.8 acre parcel into two lots and
splits the recently constructed building in two. The reason for the split is because ECIA
and RTA are two separate entities and for budgeting and operational considerations, it
is best to have separately legal descriptions for the two entities. The Zoning Advisory
Commission is being asked to review this lot split because Lot 2 of 6 does not have
frontage on a public or private street. A 60-foot wide access and utility easement is
provided for access to the public street, Commerce Park. Planning staff does not have
any objection to the proposed lot split nor the waiving of lot frontage for Lot 2 of 6. The
subject property has adequate access and the proposed lot split will not have any
adverse impact on the future development of adjacent property.
RECOMMENDATION
Planning staff recommends that the Ptat of Survey of Lot 1 of 6 and Lot 2 of 6 of Block 3
of Westbrook Subdivision be approved subject to waiving the lot frontage requirement
for Lot 2-6.

RESOLUTION NO. 270-08
A RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1-6 AND LOT 2-6 OF
BLOCK 3 OF WESTBROOK SUBDIVISION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey of Lot 1-6 and Lot 2-
6 of Block 3 of Westbrook Subdivision in the City of Dubuque, Iowa; and;
Whereas, said Plat of Survey provides 0 feet of lot frontage for Lot 2-6, where 50 feet
of lot frontage is required by Section 42-19(b) of the Subdivision Regulations; and
Whereas, the Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 2-6 to have 0 feet of lot frontage, where 50 feet of lot frontage is required.
Section 2. That the Plat of Survey of Lot 1-6 and Lot 2-6 of Block 3 of Westbrook
Subdivision is hereby approved and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa, upon said final plat.
Passed, approved and adopted this 18th day of August 2008.
