INTRODUCTION
This memorandum responds to the letter dated July 18, 2008 from Donna Smith,
Chairperson of the Dubuque County Board of Supervisors concerning Couler Valley.
The letter was concerning the filling of property generally described as north of Flexsteel
Industries, east of Highway 52, and legally described as Lot 1 and 3 Frommelt Place.
This letter asked for information pertaining to the filling, including permits obtained, and
a report that outlines the future impact of this activity and the potential for increased
flooding in the Couler Valley area.
DISCUSSION
Attached to this memorandum is a copy of the Floodplain Development Permit file for
the subject property, that includes the Floodplain Development Permit for the property,
the Conditional Use Permit obtained from the City of Dubuque Zoning Board of
Adjustment, copies of correspondence with Dave Allen of the Iowa Department of
Natural Resources, correspondence from Michael D. Hayes of the Army Corps of
Engineers, a copy of the Erosion and Sediment Control Permit, and the Grading and
Storm Water Pollution Prevention Plan.
The subject property is located within a Zone A on the City's Flood Insurance Rate Map
(FIRM). Zone A does not have base flood elevations determined and when a proposed
project is to be located in a Zone A, it requires that the local flood plain administrator
contact the Iowa Department of Natural Resources (IDNR) for help in determining a
base flood elevation.
The owners of the property have been intermittently filling the site since approval of their
Conditional Use Permit and Floodplain Development Permit in 2004. The property

owners seek to develop the parcel under its current LI Light Industrial zoning for a
commercial or industrial use. The City of Dubuque is a member community of the
National Flood Insurance Program, and as such, is required to follow the regulations
established by the National Flood Insurance Program. The applicants provided the
required information and went through the established process for securing permission
for filling on a property designated as a Zone A on the City's Flood Insurance Rate Map.
As part of the process, City staff and the applicant's engineering firm, Buesing &
Associates, consulted with IDNR staff.in determining the base flood elevation for the
subject property.
The enclosed documents point out the IDNR did change their determination that 100-
yearflood level of 627 feet after the Floodplain Development Permit and Conditional
Use Permit were approved by the City of Dubuque and the Zoning Board of Adjustment.
Subsequently the IDNR indicated that the revised base flood elevation for the property
as being 630.4 MSL to 630.7 MSL.
On May 22, 2008, Tom Larsen of Buesing & Associates, contacted Associate Planner
Kyle Kritz by email asking whether the permits were still valid for the subject property.
Mr. Kritz informed Mr. Larsen by email that the permits were still valid, but advised him
that a new Floodplain Development Permit and Elevation Certificate will be necessary
before any structure can be constructed on the site. Staff's interpretation was based on
the fact that base flood elevations are used to establish the minimum level of fill
necessary to elevate a structure one-foot above the 100-year flood plain, that a City
Erosion and Sediment Control Permit would be required for the site, and that prior to
any permits being issued for construction on the site, and that a new Floodplain
Development Permit and Elevation Certificate must be submitted to insure compliance
with the revised base flood elevations as determined by the IDNR in their letter of
November 15, 2004.

1. STORM WATER DISCHARGE PERMIT
This project requires the obtaining of o NPDES General Permit No.2 for
storm water discharge osaocioled with industrial activity for

Grading Contractor shall obtain the permit. The prime contractor and
alt subcontractors shall be responsible for compliance ontl fulfilling all
requirements of the NPDES General Permit No.2 inUutlinq The Storm
Water Pollution Prevention Plon.
2. SITE DESCRIPTION
This Pollution Prevention Plqn (PPP) is for the fBling in of this area
using excess material from another site.
This PPP covers approximately 11.8 acres with an estimated 8.5 acres
being disturbed.
The PPP is locatetl in an oreo of commercial activities land use.
The PPP is located in a area of soils classified as Caneek Silt Loam,
Urban land Dorchester complex, Hydrologic SoB Group "B". The
estimated runoff coefficient for the site after construction is 0.15.
Refer to the project plans for locations of typical slopes, tli[ch grades,
and major structural and~non-structural controls. A copy of this pion
will be on file of the owner's office and on site. Runoff from this
work wit Row into on unnomad tributary to the Little Moquoke to River
and ultimately to the Mississippi River.
POTENTIAL SOURCES OF POLLUTION
Site sources of pollution generated os o result of this work relate to
sits and sediment which may be transported os o result of o storm
event. However, this PPP provides conveyance for other (non-project
relatetl) operations. These other operations hove storm water runoff,
the regulation of which is beyond the son trot of this PPP. Potenttolly
this runoff can contain various pollutants related to site-specific land
uses, Examples are:
Rural Agricultural Activities:
Runoff from griculturol land use con potentially contain chemicals
including herbicides, pesticides, fungicides and fertilizers.
3. CONTROLS
Prior to beginning grading, ezcovotion or clearing and grubbing
operation, sill !ante shall be placed along the perimeter of the oreos
to be disturbed of locations where runoff can move off site.
Vegetation in a[eas not needed for construction shall be preserved. As
oreos reach their final grade, additional silt fences, silt basins,
intercepting ditches, sod Rumes, earth dikes, filter berms and inlet
filters ale., shall be Installed as specified in the plans and/or as
required for the project. This will include using silt fence os ditch
checks and to protect intakes. Temporary stabilizing seeding shall be
completed as the disturbed oreos ore constructed. If construction
nativity is not planned to occur in o disturbed oreo tluring the current
construction season, the oreo shall be stabilized by temporary seeding
or mulching. Other stabilizing methods shall be used outsitle the
seeding lime period.
As the work progresses, additional erosion control devices such os silt
fences, .filter berms and inlet filters may be required os determined far
the project after Reld investigation. These erosion control tlevices and
other appropr+ale measures shall be installed by the contractor o
erosion control subconlroclor os directed. The construction will be
completetl with the establishment of permanent vegetation of all
pervious disturbed areas by the contractor or surface realoration
subcontractor.
4. OTHER CONTROLS
Contractor disposal of unused construction motariols and construction
motariol wastes shall comply with applicable state and loco) waste
disposal, sanitary sewer, or septic system regulations. in the event of
o conflict with other governmen Col laws, rules and regulations, the more
restrictive lows, rules or regulations shall apply.
Contractor shall remove any ezcess soil from vehicles prior to leaving
the site to prevent off site frocking of soil onto adjacent streets.
Excess soil hocked onto the streets shall be cleaned up and returned
to the site.
APPROVED STATE OR LOCAL PLANS:
During the course of this construction, it is possible that eituotions will
arise where unknown materials will be encountered. When such
situations ore encountered, they will be handletl according to all federal,
state, and local regulations (n effect al the time.

blocks, Class A stone or erosion stone.

Sorry about the delay in getting back to you but I was in an all day meeting yesterday. Lot 1 & 3 Frommelt Place did
have a Flood Plain Development issued in 2004 so the site can be filled. Originally DNR indicated that the base flood
elevation for the site was 627 MSL. However, subsequent to the Flood Plain Development Permit approval the DNR
revised the base flood elevation for the property as 630.4 MSL to 630.7 MSL. This doesn't impact the filling of the site
now but in the future a new Flood Plain Development Permit and an Elevation Certificate will be necessary before a
building can be constructed on the site.

Tschiggfrie excavating is going to be working on the 32nd St. Detention Basin and they are planning on placing the
excavated material on the property owned by Key City Development Co., LLC, along Hwy 52, as shown on the attached pdf. (It
would appear the Key City Development is Joe Zwack & John George.) (Lot 1 & Lot 3 of Frommelt Place are the legals.)
Tschiggfrie asked us to draw up a SWPPP and submit NPDES to the DNR. In doing some research in our files I found a "Flood
Plain Development Permit Application" and a "Planning Application -Conditional Use Permit". Are these permits still valid? Or is
there anything else.we need to do?

Dear Mr. Koelker:
Our office reviewed your revised wetland delineation dated December 13, 2004, concerning
the proposed Key City Developirient site in Section 11, Townslup 89 North, Range 2 East,
Dubuque County, Iowa.
We determined your project as proposed does not require a Department of the Army (DA)
Section 404 permit. The decision regarding this action is based on information found in the
administrative record which documents the District's decision-making process, the basis for the
decision, and the final decision. No indication of discharge of dredged or fill material was found
to occur in waters of the United States (including wetlands). Therefore, this determination
resulted.
You are advised that this determination for your project is valid for five years from the date
of this letter. If the project is not completed within this five-year period or your project plans
change, you should contact our office for another determination.
Although an individual DA permit and individual IEPA 401 certification will not be required
for the project, this does not eliminate the requirement that you must still acquire other
applicable Federal, state, and local permits.

Using the recently submitted Couler Valley cross section for the referenced project, the 100-year flood
elevation was determined to be 630.5 feet, plan datum. Adjusting that elevation based on stream
slope along the reach of the project, the 100-year flood elevation ranges from 630.7 at the upstream
end to 630.4 at the downstream end. The minimum protection level for high damage potential
development would be one.foot above the mentioned 100-year flood elevation.
The floodway through the project site was calculated at 20 feet as measured from the top of the left
(west) streambank. For the submitted cross. section the top of the left bank was assumed to be
station 620. Therefore, the left edge of the floodway is station 600.

This letter is in response to your application on behalf of Key City Development, LLC to place fill on
the flood plain of Couler Valley. Earlier I had provided you with a 100-year flood elevation based on
information obtained from the Dubuque County Flood Insurance Study. After reviewing the site plan
submitted with the application, it's obvious that the site topography has been significantly altered
some time in the past and that altered topography was not considered when determining the flood
elevation at this site. In addition, there apparently exists, or is proposed, a stream crossing at the
downstream end of this property. That crossing was not taken into account when developing tha flood
elevation for this site. Consequently, the 100-year ilo~:u elevation that was originally provided is
considered to be unreliable and must not be used.
In order to determine a more accurate 100-year flood elevation as well as the floodway width it will be
necessary to submit a stream valley cross section at the approximate location as shown on the
attached site plan and a streambed profile through the project reach. Also include the following
information concerning the downstream crossing: culvert/ bridge type and size, invert elevation, and
the roadgrade profile extending at least 100 feet from each side of the crossing.

This letter and the attached information is regarding the proposed placement of file in
the Couler Valley within the City of Dubuque corporate limits near Aquin Street. The
City's Flood Plain Ordinance requires that in areas designated as Zone A and base
flood elevations have not been determined, that the Department of Natura{ Resources
is consulted to determine whether the property involved is wholly or partly within the
floodway or floodway fringe.
I am in receipt of a copy of your letter dated August 3, 2004 to Terry Koelker of
Buesing and Associates that did establish a 100-year flood elevation of 627 feet
NGDV. Mr. Koelker indicated that the limit of the fill was established in part based on
a conversation with the DNR to provide a buffer between the creek and the proposed
fill. This information may be redundant, and that you and Mr. Koelker may have
already reviewed this issue. However, I wanted to complete my ftle and make sure all
appropriate agencies have been contacted and responded.

The Zoning Board of Adjustt~nt of the City of Dubuque, Iowa hereby renders and gives
notice of its decision on the above-captioned application in conformance with Section 5 of
the Zoning Ordinance.
APPLICATION: The applicant seeks a conditional use permit to place fill on a designated
flood hazard area.
PUBLIC HEARING: After notice, as required by law, a Public Hearing was held on August
26, 2004. Minutes of the meeting and copies of materials submitted in evidence are on file
in the Office of Planning Services, City Hall, Dubuque, Iowa.
FINDINGS: Based on the specific information presented at the Public Meeting and
contained in the application, and in accordance with the applicable standards in the Zoning
Ordinance, the Board has determined that the application will meet the standards
governing the granting of a conditional use permit as set forth in Section 5-3.4(C) of the
Zoning Ordinance.
DECISION: By a vote of 4 to 0, as indicated in the minutes, the Board approves the
conditional use permit, as submitted.
VALIDITY: This Conditional Use Permit granted by the Board shall be valid for a period of
2 years from the date on which the Board grants the Permit, unless within such iwo-year
period a building permit is obtained and the erection or alteration of a structure is started,
or an occupancy permit is obtained, if required, and the use is commenced. The Board
may grant a maximum of one extension not exceeding six (6) months, upon written
application, without notice of hearing.

Site Characteristics: The subject property encompasses approximately 11.8 acres, is
located on the east side of U.S. Highway 52 across from the Dubuque Shooting
Society. The subject property abuts property owned by Flexs#eel to the east and singie-
family residences #o the south.
If granted, would use impact adjacent properties? The subject property is located in
a designated flood hazard area that does not have base flood elevations established on
the City's Flood Insurance Rate Maps. However, the Iowa Department of Natural
Resources has provided information to the applicant and the City of Dubuque that the
base flood elevation in this area is 627 feet above mean sea level. Adjacent properties
have experienced flooding from time to time in the past. Placement of additional fill on
the subject property most likely will not increase the flooding problem to adjacent
properties, as adjacent properties are already lower than the subject property.
Recommended conditions to alleviate negative impacts: The additional fill placed
on this property, if approved, should be compacted in such a manner as to drain any
runoff to the north away from existing residential and industrial properties.

Staff Analysis: The applicants are requesting a conditional use permit to allow the
placement of fill on property currently designated as a flood hazard area. The
approximately 11-acre parcel is located along U.S. Highway 52 across the highway
from the Dubuque Shooting Society.

The subject parcel is bordered on the south by existing residential homes and abuts
property owned by Flexsteel Industries to the east. The subject property is designated
as "A" on the City's Flood Insurance Rate Maps, but does not have base flood
elevations shown on the map. However, the Department of Natural Resources for the
State of Iowa has provided documentation that the base flood elevation is 627 feet
above mean sea level. The applicants wish to fill the property to a height of 629 feet
above mean sea level, which would be two feet above the base flood elevation.
Planning staff has received one call from a nearby property owner whose main concern
was how the proposed fill will impact storm water in the area. The subject property is
for the most part already above surrounding property from past fill, and the additional fill
should have not a significant impact on flooding conditions in the area provided that the
site is drained away from existing developed areas toward the northeast.
Planning staff recommends that the Zoning Advisory Commission review the standards
for granting a conditional use permit contained in the Zoning Ordinance.
