Kintzinger.
Mayor Kintzinger read the call
and stated that service thereof had
been duly made and that this meet•
ing is called for the purpose of con-
sidering any matters presented to
the. Regular Meeting and such other
business as might properly come be-
fore aregular meeting of the City
Council.

completed and the City Manager

This Bond is one of a series of
127 bands, 126 for $500.00 numr
bend from 9695 to 9820 inclusive,

sued for the purpose of paying the
cost of the City of Dubuque 1954
Concrete Curb & Gutter Project No.
1 as described in said Resolution,
in said City, which cost is payable
by the abutting and adjacent prop-
erty along said improvements and
is made by law a lien on all of
said property. It is payable only out
of the Special Assessment Fund No.
1173 created by the collection of
said special tax, and said fund can
be used for no other purpose.
It is hereby certified and recited
that all the acts, conditions and
things required to be done, prece•
dent to and in issuing this series of
bands, have been done, happened,
and performed, in regular and due
form, as required by law and said
Resolution, and for the assessment,

ance of Street Improvement bonds
far the purpose of providing for
the payment of the assessed cost of
the improvement of Pennsylvania
Avenue.
Whereas the contract heretofore
entered into by the City of Du-
buque, Iowa, for the improvement
hereinafter described has been com-
pleted .and the City Manager has
certified the completion thereof to
the City Council and the City Coun-
cil has ascertained the cost there-
of and has determined that $12,434:
66 Dollars of the cost thereof shall
be assessed against the property
subject to assessment therefor; and
Whereas public notice, as provid-
ed by law, has been published by
the City Clerk stating the intention
of the City Council to issue bonds
for the purpose of providing for
the payment of the assessed cost
of said improvement and a public
hearing has been held, pursuant to
such notice and all objections made
thereto have been considered and
determined;
Now Therefore Be It Resolved
by the City' Council of the City of
Dubuque:
1, That to provide for the pay-
ment of the assessed cost of improv-
ing Pennsylvania Avenue with con-
crete curb and gutter from the old
Corporation Limits to the East
Property Line of Chaney Road
there shall be issued street im-
provement bonds in the amount of

the deferred payment of assess-

I have entered into a settlement
agreement with Henry Mertes in
which he has agreed to accept
$2D22,75 in full settlement of his
claim for damages resulting from a
fractured hip sustained in a fall
near Third and Main Streets Janu-
ary 25, 1954,
St. Joseph Mercy Hospital has
heretofore filed a notice of lien on
any damages payable to Mr, Mertes
and has advised me that it will
accept $900.00 in full satisfaction
of its lien.
Mr, Mertes total hospital bill
was in excess of $1400,00, his medi-
cal expense was approximately
$500,00 and he has a permaennt dis•
ability.
I recommend that the settlement
be approved and that the Auditor
be instructed to issue the fallowing
warrants:
In the sum of $900 payable to St.
Joseph Mercy Hospital and Henry
Mertes,
In the sum of $1122,75, payable to
Henry Mertes and O'Connor, Thom-
as, McDermott and Wright,

In his last communication to you
regarding Radio and TV interfer-
ence Mr, Schiltz indicated that we

were awaiting a report from NIMLO
on the subject. That report has now
been received and can be sum-
marized as follows:
There are two types of radiation
that can interfere with radio and
TV reception, legitimate interfer-
ence and "Spurious" radiation.
Legitimate interference is the inter-
ference caused by a licensed radio
or TV transmitter-it includes co-
channel and harmonic tnterference.
The FCC controls this through the
licensing powers and by spacing
stations geographically and on the
dial.
The "spurious" radiation is
caused by two types of equipment.
In the one there is a legitimate but
"restricted" use of radio waves for
purposes other than communica•
tion; this includes record players,
garage door openers, et cetera. In
the other type the radiation is only
"incidental" such as diathermy ma-
chines, electric motors, lighting sys-
tems and radio and TV sets them-
selves,
Part of this "spurious" interfer-
ence is now under FCC regulation
Industrial, scientific and medical
equipment must now be licensed
under Part 18 of the Commission's
rules.
The Commission is proposing to
issue rules governing the rest of
the restricted and incidental radia-
tion. As proposed, all TV and FM
receivers would require certifica-
tion and the operation of any de-
vice which interferes with author-
ized radio services would be pro-
hibited.
Enforcement. Complaints are in-
vestigated by the thirty-three field
offices and 18 monitoring stations
of the FCC. Obviously they are not
enough to do the job and have
been successfully supplemented in
some 358 communities by television
interference committees composed
of amateur radio operators, TV dis•
tributors, industry representatives
and other interested volunteers.
These committees have often been
successful in amicably settling com-
plaints. While the FCC welcomes
local regulations governing this
field it feels the investigation and
detection of violations should be
accomplished on the Federal level,
The FCC would then submit the
facts to the local officials, who
would take whatever corrective ac-
tion is required.

and that an additional light 'be in-
stalled on Pole No. 207.964T, which
is west of the present light 'on
Southern Avenue. Also that a light
be installed on Sullivan Street be-
tween Levi and English Lane on
Pole No. 207.950F.

Gentlemen:
I have been informed by Fire
Chief, Thomas C. Hickson, of the
outstanding conduct of Pipeman
Raymond Ryan, while off duty the
night of December 28, 1954.
Because of the alertness of Pipe-
man Ryan when passing the home
of Louis Spielman at 601 Rhomberg
Avenue, he observed flames coming
from the home. He immediately in-
structed an unidentified man to pull
the alarm box and then proceeded
into the house. He met Mr. Spiel•
man and his brother on the steps
and told them to get out of the
building, but NIi. Spielman said
his wife was in there. Pipeman
Ryan told him to leave and he
would get his wife. Crawling
through heavy smoke, he located
her and carried her out of the
house to a neighbors. He then
helped other firemen in extinguish-
ing the fire.
Pipeman Raymond Ryan is to be
commended on 'his conduct and cer-
tainly he reflects credit on his de-
partment and other city employees.
In recognition of Raymond Ryans
conduct, I have prepared a resolu-
tion for action of the City Council.

Whereas it has been brought to
the attention of the City Council
that Pipeman Raymond Ryan of
the Dubuque Fire Department con
ducted himself in an outstanding
manner while assisting in rescue
operations and extinguishing a fire
while off duty.
Whereas Pipeman Raymond Ryan
of Engine Company No. 5, who re-
sides at 535 Southern Avenue, and
who was appointed to the Fire De-
partment January 2, 1954, who was
taking his brother and family home
to 900 Rhomberg Avenue at ap-
proximately 12;05 A.M, and while
passing Johnson and Rhomberg
Avenue noticed flames coming out
of the side window of the Spielman
building. He stopped the car and
told an unidentified man to pull
the alarm box on the corner of
Johnson and Rhomberg. Pipeman
Ryan then went to the rear of the
building and proceeded to go up
to the rear stairway to the 2nd
floor apartments when he met
Louie and Henry Spielman coming
out. Mr, Louie Spielman informed
Ryan that his wife was in there yet.
Ryan told Louie Spielman to get
out of the building and that he
would go in and bring her out.
After crawling through the heavy
smoke, he located her and carried
her out of the building to one of the
neighbors house, Pipeman Ryan
then helped the other firemen in
extinguishing the fire.
Be It Resolved by the City Coun•

Raymond Ryan is commended for
his alertness and action in con•
ducting himself in such an exem-
platory manner while oat on duty.

Whereas on January 24,1955 the
City Council adopted Resolution
No. 18.55, which erroneously de-
scribed the property involved, and
it is the desire of the City Council
to correct said error;
Now Therefore, Be It Resolved
by the City Council of the City of
Dubuque:
Section 1. That Interstate Power
Company, its successors, or assigns,
be and it is hereby granted per-
mission to construct and maintain
an enclosed overhead bridge span-
ning the alley between Lot 37 and
Lot 164 A in the original townsite
of Dubuque, upon the following
terms and conditions;
(a) That said structure will be
constructed in accordance with the
plans now on file and under the
supervision and inspection of the
Building Commissioner;
(b) That said permission shall be
subject to the continuous control
of the City Council and the City
Council reserves the right to im-
pose restrictions and conditions
upon the enjoyment thereof as it
may deem necessary in the public
interest, including the right to re-
voke and rescind such permission;
(c) Should such permission be
rescinded or revoked Interstate
Power Company shall, within one
year after receipt from the City of
Dubuque of written ,notice so to
do, at its own expense, remove said
structure; and in the event of its
failure so to do, permittee author-
izes the City of Dubuque to remove
said structure at permittee's ex-
pense, assess the cost thereof
against the premises, destroy the
materials, and neither permittee,
nor its successors or assigns shall
have any claim against said City or
any of its agents for any damages
resulting from the removal of said
structure;
Section 2. As a further considera•
tion of the privileges granted here-
in Interstate Power Company, its
successors and assigns, assume any
and all liability far damages to per-
sons and property which may re-
sult from the construction or main-
tenance of said proposed overhead
bridge. The permittee, its succes-
sors or assigns, at its own expense,
agrees to pay on behalf of the
City of Dubuque, all sums which
the City of Dubuque may become
obligated to pay by reason of any
claim arising out of the construc-
tion or maintenance of said over-
head bridge or in settlement of any
such claim. Permittee further
agrees to investigate and defend
any such claim at its own expense,
and on behalf of the City.
Section 3. This Resolution shall
be in full force and effect from
and after its final adoption and
the acceptance of the terms and
conditions hereof by the permittee.
Section 4, That upon the adoption
of this Resolution and the accept-
ance thereof by permittee, the City
Clerk be and he is hereby author-
ized and directed to record a certi•
fied copy hereof with the County
Recorder of Dubuque County, Iowa.
Section 5. That Resolution No.
18-55 and the permission granted
therein be and the same is hereby
repealed and rescinded.

pense of making said improvements
will be assessed upon and against
all privately owned property lying
within the assessable distance pro-
vided by law and in an amount not
to exceed the amount provided by

whether the same abuts on any of
said portions of said street or is ad-
jacent thereto according to area
and in proportion to the special
benefits conferred thereby, and any
deficiency shall be paid out of the
street fund. The railway portion of
any such streets shall be assessed
against the railway company,
Section 4, That the City Council
by this resolution gives notice of
its intention to issue bonds as pro-
vided by Section 396,6 of the Code
of Iowa, 1950, far the purpose of
providing for the payment of the
assessed cost of said improvements:
said bonds to be issued in anticipa•
tion of the deferred payment of the
assessments levied therefor, and
that said bonds will be sold at pub-
lic sale in the manner provided by
law, but shall not be sold for less
than their par value with accrued
interest from date of bonds to the
time of delivery thereof,
Section 5. That unless property
owners at the time of final consid-
eration of this resolution have on
file with the City Clerk objections
to the amount of the proposed as-
sessment, they shall be deemed to
have waived all objections thereto,

Dubuque, Iowa.
Whereas the City of Dubuque, in
Dubuque County, Iowa, did hereto-
fore, in the year 1900, establish a
municipal waterworks in and for
said City which has far many years
been supplying water to said City
and its inhabitants; and
Whereas the management and
control of said municipal water-
works is vested in the City Council
of said City and no board of trus•
tees exists for this purpose; and
Whereas it is necessary and de•
sirable that improvements and ex•
tensions to said municipal water
works be constructed, the cost
whereof is estimated to 'be $1,500,-
000, for which purpose it will be
necessary that said City issue its
revenue bonds payable from arid
secured by tkie net earnings of said
municipal waterworks as authorized
and permitted by Section 397,10 et
seq. of the Code of Iowa, such bonds
to rank on a parity with $200,000

of said City heretofore issued un-
der date of April 1, 1952, as per-

$1,500,000 Water Revenue Bonds,
1955 Series, of said City for the
purpose of paying the cost of con•
strutting improvements and exten•
sions to the municipal waterworks
of said City. These bonds, when is•
sued, will not constitute general ob•
ligations of said City nor will they
be payable in any manner by taxa-'
tion, but will rank on a parity with
presently outstanding Water Reve•
nue Bonds, 1952 Series, of said City,
dated April 1, 1952, and both of
said issues of bonds, together with
such additional bonds as may be
hereafter issued from time to time
an a parity therewith, will be pay
able solely and only from the net
earnings of the municipal water
works plant and system of said CiCy.
At any time before the date of
said meeting five or more taxpayers
may file a petition in the office of
the City Clerk, setting forth their
objections thereto by order of the
City Council of the City of Dubuque,

Gentlemen:
During the past year studies have
been made to determine what
should be done so that our city
water supply would be adequate
over the next twenty year period.
It was determined that the new
water supply available on City Is-
land be developed and that an iron
removal and hardness reduction
plant be constructed.
The need for these facilities has
been presented to the City Council
and an effort has been made to put
it to the people of the community
through the media of radio and
newspaper publicity.
In order that sufficient funds
are available to perform this con•
struction work, to have sufficient
funds available for operation and
maintenance and do the necessary
main extension work to keep up
with the growth of the city, it is
necessary that a rate increase be
put into effect. The rate increase
ordinance that has been prepared
will provide the necessary funds
for this construction.
I recommend that the City Coun-
cil adopt these rates in order that
we may proceed to provide an ade•
quote water supply for the City of
Dubuque.

Be It Ordained by the City Council
of the City of Dubuque;
RATES FIXED:
Section 1. Commencing with all
tneter readings on or after Sune 1,
1055, the rates to be charged for
water for residential, commercial, in-
dustrial and other uses and pur-
poses by any person, firm or cor-
poration supplying water within the
City of Dubuque, Iowa, shall be and
they are fixed and determined as
follows:

vided in Section 1 hereof plus an ad-
ditional 25% of the rates listed in
Section 1 hereof.
Section 3. Commencing June 1,
1956, the following yearly charge for
fire sprinkler service supplied by the
City Water Department, within and
without the City of Dubuque, Iowa,
shall be paid semi-annually in ad-
vance and they are fixed and deter-
mined as follows:

thirty (30) days in Jail.
Section 5. Ordinance No. 15-50,
adopted June 15, 1950, be and the
same is hereby repealed,
Section 6. This ordinance shall be
1n full force and effect on June 1,
1955, after Its passage, adoption and
publication as required by ]aw.

of Iowa have been limited in their
operations and the services they
can render to our citizens as a re-
sult of existing laws affecting mu-
nicipalities within the State,
Therefore, Be It Resolved by the
City Council of the City of Dubuque
that they request the Legislature of
the State of Iowa to enact such leg-
islation that will
1, Prevent undue or unwarranted
interference with local government,
2. Leave to cities power to set
hours of work and salaries of em-
ployees to conform with the budget
and their duties,
3. Provide cities with sufficient
powers to enable them to satisfy
the mounting demands for service
that they should be entitled to
render.
4, Eliminate the outmoded system
of revenue by personal property
and real estate taxes and use the
modern system of payroll dedue•
tion, dividend and sales taxes that
are made in the Municipality,
5, Enact State Enabling Legisla-
tion so cities and towns can par-
ticipate in Federal Housing benefits
and slum clearance developments,
6. Remove the battle every two
years to have the Legislature enact
laws approving the basic rights be-
longing to cities,
7. Reapportionment of the legis•
lature according to population and
not area so cities and towns are
truly represented.

Bill known as House File No. 47
changing the method of assessment
and taxation of the property of
electric light and power companies;
and
Whereas this proposed legislation
has been reviewed by the City
Council of the City of Dubuque and
found not to be in the interest of
the citizens of the city
Be It Resolved 'by the City Coun-
cil of the City of Dubuque that
House File No, 47 will create a
hardship on the taxpayers of the
,city in providing police, fire, sani•
tation, sewage, and other services
far the electric light facilities, on
which other taxing bodies will re•
eeive the taxes. The distribution
of the basis of mileage will greatly
decrease the city tax revenue de•
rived from our electric utility com•
pony and result in an increase in
property taxes on other real estate,
approximately 8%.
Be It Further Resolved that the
City Council go on record as op•
posing this legislation and that
copies of this Resolution be ad•
mitted to our State Representatives
and Senator;
