Claim by Bruce OhnesorgeTHE CITY OF DUB E Masterpiece on the Mississippi n MEMORANDUM BARRY LIN CITY ATTO N Y To: Ma or Roy D. Buol and Me ers of the City Council DATE: August 18, 2008 RE: Claim Against the City of Dubuque by Bruce Ohnesorge Claimant Date of Claim Date of Loss Nature of Claim Bruce Ohnesorge 07/30/08 04/14/08 Vehicle Damage This is a claim in which the claimant alleges that his vehicle was damaged after striking a pothole in the 1900 block of Asbury. According to the report of John Klostermann, Street & Sewer Maintenance Supervisor, records indicate that the Public Works Department had crews patching holes on Asbury Road on numerous dates prior to this incident including April 11, 2008. Mr. Klostermann states that the records show that the Public Works Department crews made several attempts to respond to these pothole hazards as they developed. It is therefore the recommendation of John Klostermann to deny this claim due to the efforts of the Public Works Department to repair the pothole hazards in a timely manner. The City Attorney's Office concurs with this recommendation. BAL:tIs cc: Michael C.
