Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant's representative, Patrick Norton, spoke in favor of the request, reviewing
the location of the property and the reasons for replatting the property.
Staff reviewed the staff report, noting that the submitted plat is before the Commission
as there is not the required 50 feet of lot frontage for either Lot 1 of 1 or Lot 2 of 1 . Staff
indicated that each lot has 25 feet of frontage currently and will have 25 feet of frontage
as shown on the submitted plat. Access to the property will not change.
There were no public comments.
The Zoning Advisory Commission discussed the request, and found it appropriate.
Recommendation
By a vote of 5 to 0, with one abstention, the Zoning Advisory Commission recommends
that the City Council approve the request, subject to waiving lot frontage requirements
for Lot 1 of 1 and Lot 2 of 1 of Stark Place.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey Lot 1-1 and Lot 2-1 of Stark Place
DATE: December 8, 2016
INTRODUCTION
The submitted Plat of Survey of Lot 1-1 and Lot 2-1 of Stark Place subdivides an
existing 9.9 acre parcel of land into two parcels to facilitate the sale of a portion of the
existing lot to a neighboring property owner. The corporate limits run between the two
properties and hence both the County and City of Dubuque are reviewing this Plat of
Survey.
DISCUSSION
The submitted Plat of Survey subdivides a 9.9 acre into two lots, with the smaller of the
two lots being sold to adjacent property owners Scott and Natalie Schramm.
The Zoning Advisory Commission is reviewing this plat as the lot to be sold to the
Schramm's, Lot 2 of 1, does not have frontage on a public or private street and the
remaining balance of the property, Lot 1-1, only has 25 feet of frontage on Mela Drive,
where 50 feet is required by Section 16-11-14 of the City of Dubuque Code of
Ordinances.
Access to the Stark property is by way of an existing driveway that connects with Mela
Drive through the Schramm property. The proposed platting will not negatively impact
the existing access arrangement.
Approval of the submitted Plat of Survey will not result in any additional building lots
being created, but only facilitates the sale of additional property between neighboring
property owners.
RECOMMENDATION
Planning staff recommends that the Plat of Survey of Lot 1-1 and Lot 2-1 of Stark Place
be approved subject to waiving lot frontage requirements for Lot 1-1 and Lot 2-1 of
Stark Place.

RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1-1 & LOT 2-1 OF
STARK PLACE IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Plat of Survey of Lot 1-1 & Lot 2-1 of
Stark Place in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 25 feet of frontage for Lot 1-1 and 0 feet of
frontage for Lot 2-1 on a public or approved private street, where 50 feet of street frontage
is required by Section 11-14 of Title 15 of the City of Dubuque Code of Ordinances, Unified
Development code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that
it conforms to the statues and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11-14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 25 feet of frontage for Lot 1-1 and 0 feet of
frontage for Lot 2-1 on a public street or an approved private street for Lot 1.
Section 2. That the Plat of Survey is hereby approved and the Mayor and City Clerk are
hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon
said Plat of Survey.
