Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant's representative, David Schneider, spoke in favor of the request,
reviewing the purpose of the rezoning request and that the property is also in the
process of being subdivided as well as annexed to the city of Dubuque.
Staff reviewed the staff report, noting the location of the property, surrounding zoning
and land use. Staff reviewed that the annexation process is being done concurrent with
the rezoning request, and reviewed that the Plat of Survey for the property has been
approved by the City Planner, and is being reviewed by the County.
There were no public comments.
The Zoning Advisory Commission discussed the request, reviewing areas to remain in
the County and surrounding zoning, and found it appropriate.
Recommendation
By a vote of 5 to 0, with one abstention, the Zoning Advisory Commission recommends
that the City Council approve the request.
A simple majority vote is needed for the City Council to approve the request.

Physical Characteristics: The subject property is approximately 4.3 acres in size and
has frontage on Old Highway Road. The parcel is a portion of land owned by the
applicants and the requested rezoning and annexation facilitates future platting of the
property. The area drains toward the southwest.
Concurrence with Comprehensive Plan: The Comprehensive Plan currently
designates the property for single-family or duplex development.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: Based on 2013 [DOT Counts: Old Highway Road — 3,920
average daily trips and U.S. Highway 20 — 21,700 average daily trips.
Public Services: Existing public services are adequate to serve the property.
Environment: Staff does not anticipate any adverse impact to the environment
provided that any future development of the property is in compliance with
established City standards for storm water management and erosion control.

Adjacent Properties: The proposed rezoning of the subject parcel to C-3 General
Commercial allows a wide range of commercial, retail and service uses. Adjacent
property to the south of this parcel is zoned to C-3 General Commercial. There are
no specific plans for the property at this time.
CIP Investments: None proposed.
Staff Analysis: The applicants request to rezone the subject property from County R-2
Residential to City of Dubuque C-3 General Commercial in conjunction with annexation
of the property to the city of Dubuque.
The applicants, William A. and Janet L. Siegert, initially sought to simply split the
subject parcel into two parcels as part of preparing the land for future changes in
ownership. As part of working with the City and County of Dubuque to plat the property
as desired, it was found to be most conducive to annex and rezone the 4.38 acre parcel
into the city of Dubuque.
The Siegert's desire the property to be annexed to the city of Dubuque and rezoned to
C-3 General Commercial District as it is the same zoning applied to their property along
U.S. Highway 20 that abuts the subject property.
The subject property lies within the U.S. Highway 20 Corridor Preservation Zone that
was established by the Iowa Department of Transportation to facilitate future
improvements to U.S. Highway 20. Planning staff has submitted a copy of the rezoning
request and Final Plat to the Iowa Department of Transportation. Sam Shea,
Transportation Planner for District 6, responded that the ]DOT has no interest in the
property for acquisition.
The subject property is adjacent to C-3 General Commercial zoning to the south,
agricultural zoning to the west, R-2 Residential zoning to the east, and across the
highway road to the north is also R-2 Residential zoning. The property immediately to
the east and west of the subject parcel is owned by members of the Siegert Family.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission review the
information in this packet and make a recommendation on the requested rezoning to
the City Council.

Development Code, is hereby amended by reclassifying the hereinafter described
property, in conjunction with annexation, from County R-2 Single -Family Residential
