Van Milligen, City Manager FROM: Laura Carstens, Planning Services Manager SUBJECT: Siegert Annexation Request—Approval DATE: January 3, 2017 INTRODUCTION This memorandum transmits a 100% voluntary annexation request for City Council for approval after a public hearing on January 17, 2017. The request is being filed by William and Janet Siegert for approximately five acres of property, concurrent with rezoning. The resolution, maps, and other supporting documentation is enclosed. DISCUSSION The annexation territory is located between Old Highway Road and US Highway 20/Dodge Street. The property is primarily farmland and contains a 50'W x 90' L steel utility building and three steel grain bins. The Siegerts are in the process of replatting the property and are concurrently applying to rezone the property to C-3 General Commercial. The five-acre annexation territory includes 0.48 acres of County right-of-way to the abutting centerline of Old Highway Road, in accordance with Iowa Code. By Iowa Code, the annexation will be subject to final approval of the State of Iowa's City Development Board because the property is considered to be in an urbanized area and lies within two miles of the City of Asbury. RECOMMENDATION I recommend that the City Council approve the City annexation request for these reasons: It is 100% voluntary and in compliance with Iowa Code, • It is in the best interest of the City of Dubuque, and • It is consistent with Dubuque Comprehensive Plan goals and objectives. REQUESTED ACTION The requested action is for the City Council to adopt the resolution approving the voluntary annexation of the five-acre parcel owned by William and Janet Siegert. City staff then will forward the request to the City Development Board for final disposition in accordance with Iowa Code. Purpose/Reason for Annexation: The owner desires to subdivide a lot into two parcels as part of preparing the land for future changes in ownership. As part of working with the City and County of Dubuque to plat the property as desired, it was found to be most conductive to annex and rezone the 5-acre parcel and adjoining county right-of-way into the city of Dubuque. Physical Characteristics: The subject property is approximately 5 acres in size and has frontage on Old Highway Road. The parcel is a portion of land owned by the applicants and the requested annexation facilitates future platting of the property. The area drains toward the southwest. Conformance with Comprehensive Plan: The 2030 Future Land Use Map designates this property for single-family or duplex development. Traffic Patterns/Counts: The 2013 IDOT Traffic Counts indicate 3,920 average daily trips for Old Highway Road and 21,700 average daily trips along U.S. Highway 20. Property access is from Old Highway Road. Public Services: Existing public services can serve the subject property. Environment: No adverse environmental impact is expected, provided that any future development or redevelopment of the property, there is compliance with the City's development, erosion control and storm water management regulations. Adjacent Properties: No significant negative impacts to adjacent properties are expected upon annexation or commercial rezoning. CIP Investments: None proposed. Staff Analysis and Recommendation: The City received a written application from William and Janet Siegert, owner and applicant, for voluntary annexation of territory that abuts the Dubuque corporate limits. The territory is located between Old Highway Road and US Highway 20. The application, a resolution, and other supporting documents are attached. The territory is primarily farmland and contains a 50' W x 90' L steel utility building and three steel grain bins. Adjacent Old Highway Road right-of-way is included. State law also requires the City to annex to the centerline of the abutting County public rights-of- way. The applicant has requested rezoning to C-3 General Commercial District concurrent with annexation. The rezoning will be considered by the City's Zoning Advisory Commission on January 12, 2017. The subject property is part of Area Q of the 2006 Annexation Analysis. This study provides a cost/benefit analysis of 23 potential growth areas around the city of Dubuque. Area Q is ranked #11 in priority of annexation areas. This annexation is consistent with the City's Comprehensive Plan. The City of Dubuque has the capacity to provide substantial municipal services to the annexation territory. By Iowa Code, the annexation will be subject to final approval of the State of Iowa's City Development Board because the property is considered to be in an urbanized area and lies within two miles of the City of Asbury. Planning, zoning, development, and resource management should promote increased diversity of employment and business opportunities, promote access to education and training, expand entrepreneurial opportunities, and promote the establishment of businesses in locations near existing housing, infrastructure, and transportation. The request is being filed by William and Janet Siegert for approximately five acres of property, concurrent with rezoning. The resolution, maps, and other supporting documentation is enclosed. DISCUSSION The annexation territory is located between Old Highway Road and US Highway 20/Dodge Street. The property is primarily farmland and contains a 50' W x 90' L steel utility building and three steel grain bins. The Siegerts are in the process of replatting the property and are concurrently applying to rezone the property to C-3 General Commercial. The five -acre annexation territory includes 0.48 acres of County right-of-way to the abutting centerline of Old Highway Road, in accordance with Iowa Code. By Iowa Code, the annexation will be subject to final approval of the State of Iowa's City Development Board because the property is considered to be in an urbanized area and lies within two miles of the City of Asbury. STATEMENT OF THE CASE The City of Dubuque (hereinafter the "City") filed its request for City Development Board approval of annexation of territory within the urbanized area of Asbury on January 31, 2017. Notice of City Development Board review of the request and owner's application was given on February 10, 2017, and the Board considered the matter at its March 8, 2017, meeting. The City Development Board, having considered the City's request for approval, the property owner's application and all evidence submitted by the affected parties, hereby makes the following findings of fact, conclusions of law and determination: FINDINGS OF FACT 1. On October 26, 2016, by written application, which included a map, William A. Siegert & Janet L. Siegert requested the City of Dubuque annex the following described property owned by them and located in Dubuque County, Iowa: The proposed annexation territory is described in Appendix A attached hereto and by this reference made a part of. 2. On December 21, 2016, the City of Dubuque published in an official county newspaper notice of the City Council's meeting on January 17, 2017, to consider the application for voluntary annexation. 3. On December 20, 2016, the City of Dubuque provided a copy of the application for voluntary annexation to the City of Asbury, Dubuque County Board of Supervisors, East Central Intergovernmental Association, Iowa Department of Transportation and affected public utilities. By resolution dated January 17, 2017, which contained a legal description, the City Council of Dubuque voted to annex the subject property. 5. The area to be annexed is within two miles of the City of Asbury and is therefore within its urbanized area. 6. The area to be annexed has a common boundary with the City of Dubuque of more than 50 feet. 7. The area to be annexed does not contain railroad right-of-way. 8. On January 31, 2017, the City requested the City Development Board to approve the annexation of the territory described in finding number one. Said request included a copy of the owner's application, map and City Council resolution. 9. On February 10, 2017, the City Development Board notified, by mail, the Cities of Dubuque and Asbury, Dubuque County Board of Supervisors, Dubuque County Attorney, East Central Intergovernmental Association, Iowa State Attorney General, Iowa Department of Transportation and affected public utilities of the proposed annexation and request for approval. Said notice invited oral and written evidence relative to the proposed annexation. 10. The City Development Board received no response from any governmental unit, business or individual. 11. The Board considered the City's request at its March 8, 2017, meeting and found it to be complete and properly filed. 12. Based on the information favoring the annexation found in the City's request and other materials filed by the City of Dubuque and the absence of evidence of any potential adverse consequences, the Board finds the annexation to be in the public interest. CONCLUSIONS OF LAW 1. The territory to be annexed "adjoins" the City of Dubuque as the term is defined in Iowa Code Section 368.1(1) and is within the "urbanized area" of the City of Asbury as the term is defined in Iowa Code Section 368.1(16). 2. The City published notice of the filing of the application and provided copies of the proposed annexation to parties in accordance with the requirements of Iowa Code Section 368.7. 3. The City Development Board possesses jurisdiction to approve or decline the application for annexation in accord with Iowa Code Section 368.7(3). If the application is approved by the Board, the Board is required to file portions of the proceedings in accord with Iowa Code Section 368.7. 4. The resolution by the City Council of Dubuque conforms to Iowa Code Section 368.7. 5. The City of Dubuque's request for Board approval and the annexation is in substantial. compliance with Iowa Administrative Code r. 263-7.2.
